Hey Abby,
I received the cert for the CVS today. I also stopped by to take a look during my outings and all the 0&M items were
looking very good. As I went to write up the inspection, I realized that this permit falls into the timeframe the legislature
allowed an extension for renewing. So, the question is:
Would the Permittee request the 3 year extension until January 27, 2013? Or prefer to renew the permit now? The new
expiration date will be the same —January 27, 2020. If you are able to find out the preference, it would be appreciated.
Otherwise, I can just grant the extension and the renewal paperwork/processing fee will be required 180 days prior to
January 27, 2013.
Thanks again for your work on this project. It seemed to get off to a slow start but has 'ended' right on time.

On August 5, 2009 the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of
the General Statutes, which is current and valid at any point between January 1, 2008, and
December 31, 2010. The law extends the effective period of any stormwater permit that is set to
expire during this time frame to 3 years from its current expiration date.
Accordingly, Stormwater Permit # SW8 990946, which expired on January 27, 2010, is now in
effect until January 27, 2013. Please submit a renewal application and fee at least 180 days
prior to January 27, 2013, which would be July 27, 2012. A copy of the Renewal Application can
be obtained from the following website:

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8990946 to
CVS Phannacy 4622-02 for a High Density Project on January 27, 2000. This permit expires on January
27, 2010. Section .1003(h) of 15 A NCAC 2H .1000 (the stormwaterrules) requires that applications for
permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied
by a processing fee, which is currently set at $505.00. If this is still an active project please complete and
submit the enclosed renewal application before the expiration date. If this project has not been
constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If
you have sold the project, or are no longer the permittee, please provide the name, mailing address and
phone number of the person or entity that is now responsible for this permit. Enclosed is a form for
change of ownership, which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer for
the system installed. This is to certify that the permitted facility has been installed in accordance with the
permit, the approved plans, specifications and supporting documentation. Please include a copy of the
certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a stormwater
treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and may result in
appropriate enforcement action including the assessment of civil penalties of up to $10,000 per day.

Thank you for the update on the CVS project. Just to clarify, the request for completion of all the items of the Notice of
Violation would be May 28, 2010, correct?
While DWQ certainly appreciates cooperation and compliance with the terms of the state stormwater permit, it will be
imperative that this deadline is met. The steps to gaining compliance have gone to the doorstep of enforcement prior to
RPS communications with DWQ. So, I am looking forward to getting this project fixed and compliant.

December 17, 2009 has been mailed to the address listed on the check submitted for
Stormwater Permit Number SW8 990946 (POB 2628, Wilmington, NC). I have
enclosed a copy of the latest Notice of Continuing Violation letter for the subject
project's stormwater controls. As stated in the letter dated December 17, 2009,'to

On October 20, 2009, Wilmington Regional Office personnel performed a Compliance
Inspection of the subject project, located at 3625 College Road in Wilmington, New Hanover
County, North Carolina. A follow-up Compliance Inspection was conducted on December 8,
2009. The inspection was performed to determine the status of compliance with Stormwater
Permit Number SW8 990946, issued to you on January 27, 2000.
The project has been found in continuing violation of Stormwater Permit Number SW8 990946 ,
issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are:
Failure to Maintain the Stormwater System. At all times, the permittee shall
provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. It was observed that
maintenance including vegetation maintenance within the forebay was not being
conducted. As stated in the permit, the approved Operation and Maintenance
Plan must be followed in its entirety and maintenance must occur at the
scheduled intervals, including, but not limited to:
• Inspections.
• Sediment Removal.
• Mowing and re -vegetation of side slopes.
• Immediate repair of eroded areas
• Maintenance of side slopes in accordance with the approved plans and
specifications.
• Debris removal and unclogging of the outlet structure, orifice device and
catch basins and piping.
2. Failure to certify the stormwater system. A file review revealed that this office
has not received a Designer's Certificate.
Permit condition states that upon completion of construction, prior to issuance of a Certificate of
Occupancy, and prior to operation of this permitted facility, a certification must be received from
an appropriate designer for the system installed certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other
supporting documentation. Any deviations from the approved plans and specifications must be
noted on the Certification.

Dear Scott:
The following additional information is in response to your letter dated
November 29, 1999. Attached are two copies of the revised pond detail sheet
C4.1 with the 6:1 vegetated shelf relocated to the main pond side of the forebay
weir. I also have attached the results of the requested chlorides test along with a
copy of a USGS quad map showing the sample location approximately'/2 mile
from the subject site. Finally, 1 have verified that the eleven (1 1) "pervious"
parking spaces were included in the overall on -site parking impervious area
calculation.
Please continue the review and approval process for the stormwater permit for
the proposed CVS Pharmacy 4622-02 being developed by Zimmer Development

The Wilmington Regional Office received a Stormwater Management Permit Application for CVS
Pharmacy 4622-02 on September 30, 1999. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater review:
Please relocate the 6:1 vegetated shelf around the fore bay to the main pond side of the fore bay
weir. Please resubmit sheet C4.1 with the change shown on the detention pond detail.
2. Detention ponds are not allowed as engineered systems in projects that drain to SA classified
waters. Please submit the proper chlorides test analysis along with the site area and sample area
shown on a scaled USGS quad. map. Note that this chlorides test may not be an option in the
near future so please hurry with the submittal of this test.
Please verify whether the 11 parking spaces noted as pervious parking is, or is not included in
the overall on -site parking impervious area listed on page 2 of 4 of the application. If these 11
spaces are not included they will need to be since we cannot give credit to pervious structures
that will be used for parking.

Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to December 29, 1999, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the
application fee. The Division is allowed 90 days from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan,•is a violation of NCGS 143-215.1 and is subject to enforcement action
pursuant to NCGS 143-215.6A.

Attached are two sets of construction plans and stormwater permitting
application packages for the referenced project. Each package contains the
NCDENR-DWQ Stormwater Management Permit Application (one original),
Wet Detention Basin Supplement, Stormwater narrative, and stormwater
calculations. Also included in the package is a check for the stormwater permit
fee in the amount of $420.00.
Please begin the review and approval process for the stormwater permit for the
proposed CVS Pharmacy 4622-02 being developed by Zimmer Development
