In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

construction, operation and maintenance of an underground infiltration trench in compliance with
the provisions of I5A NCAC 2H .1000 (hereafter referred to as the "stormwater rules'} and the
approved stormwater management plans and specifications and other supporting data as attached
and on file with and approved by the Division of Water Quality and considered a part of this
permit.
This pen -nit shall be effective from the date of issuance until March 27, 2013, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
This stormwater system has been approved for the management of stormwater runoff as
described on page 3 of this permit, the Project Data Sheet. The stormwater control has
been designed to handle the runoff from 17,509 square feet of impervious area. The
system must be operated with a 50' vegetated filter.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of this
permit, and per approved plans.
4. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded casements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this project must
be directed into the permitted stormwater control system.

11. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in it's entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to assure
the permitted stormwater system functions at optimum efficiency. The approved
Operation and Maintenance Plan must be followed in its entirety and maintenance must
occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
C. Maintenance of all slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of stone trench, bypass structures, flow spreaders,
catch basins and piping.
g. Access to the bypass structures must be available at all times.
4. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DWQ. The records will indicate the date, activity, name of
person performing the work and what actions were taken.
S. The facilities shall be constructed as shown on the approved plans. This permit shall
become voidable unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data.
6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other
supporting documentation. Any deviations from the approved plans and specifications
must be noted on the Certification. A modification may be required for those deviations.
7. Use of infiltration systems as an Erosion Control device is not recommended, however, if
it is, it must be restored to design condition prior to operation as a stormwater treatment
device, and prior to occupancy of the facility.
8. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the drainage
area.
e. Further subdivision, acquisition, or sale of the project area. The project area is
defined as all property owned by the permittee, for which Sedimentation and
Erosion Control Plan approval or a CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved
plan.

9. The penmittee shall submit final site layout and grading plans for any permitted future
areas shown on the approved plans, prior to construction. If the proposed BUA exceeds
the amount permitted under this permit, a modification to the permit must be submitted
and approved prior to construction.
10. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
I t . Prior to the sale or lease of any portion of the property, the permittee shall notify DWQ
and provide the name, mailing address and phone number of the purchaser or leasee. An
access/maintenance easement to the stormwater'facilities shall be granted in favor of the
pennittee if access to the stormwater facilities will be restricted by the sale or lease of any
portion of the property.
12. The permittee must maintain compliance with the proposed built -upon area and ensure
that the runoff from all the built -upon is directed into the permitted system.
13. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the permit. Within the time frame specified in the notice,
the permittee shall submit a written time schedule to the Director for modifying the site to
meet minimum requirements. The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have been made.
III. GENERAL CONDITIONS
This permit is not transferable to any person except after notice to and approval by the
Director. In the event there is a desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be submitted to the Division
of Water Quality accompanied by an application fee, documentation from the parties
involved, and other supporting materials as may be appropriate. The permittee is
responsible for compliance with all permit conditions until such time as the Director
approves the transfer. The approval of this request will be considered on its merits and
may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to enforcement action by the Division of Water Quality, in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
as may be required by this Division, such as the construction of additional or replacement
stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal business
hours for the purpose of inspecting all components of the permitted stormwater
management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of
a request for a permit modification, revocation and reissuance or termination does not
stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater control
must follow the guidelines established in the North Carolina Erosion and Sediment
Control Planning and Design Manual.

9. The permittee shall notify the Division any name, ownership or mailing address changes
within 30 days.

We are in receipt of FAX comments dated January 8, 2003 with regard to the referenced
project. The following is a listing of the specific revisions made to the plan/application
package as requested:
l . in our October 30, 2002 submission, we inadvertently sent you a previous version
of the calculations. The correct calculations (based on 2.8' x 9' trench) are
enclosed.
2. The length of trench is 188'. The application has been revised accordingly. Pipe
lengths have been labeled on the plan per your request.
3. Roof drains from the rear of the building are above ground. All roof drains
discharge to the parking lot surface. Roof drain details have been revised
accordingly.

After an unanticipated delay, we have been directed by the owner to follow-up and
acquire necessary permitting for the referenced project. My last correspondence from
you dated July 8, 2002 (copy attached) indicates the only outstanding item is submission
of the revised Sheets 1 and 3 of the Trench Supplement.
My records indicate that we have previously submitted a revised design in response to
your March 12, 2002 letter. To expedite your review, however, I am submitted another
copy of the plan with the most recent revisions. The following is a listing of the specific
revisions made to the plan as requested in a letter from you dated 3/12/02:
I . Marsh area (AEC) is delineated and will remain undisturbed. Only those areas
upland from retaining wall will be disturbed.
2. Soils report is attached. Per your 4/8/02 letter, we have premised the design on
SHWT at elevation 2.3.
3. Roof drains added to drawing.
4. System redesigned to function as an "offline" bypass system.
5. Detail for vegetative filter and spreader provided. Calculations include hydraulic
computation for flow over filter (V10 = 1.2 fps).
6. Detail provided which shows grades, lengths and grades.
7. System designed to accommodate 15'.
8. Sidewalk width (4') shown.
9. Offsite area does not drain to system. I have removed this from application.
10. Drainage areas are delineated on drawing.
11. Application has been corrected.

How will the roof drains get into the infiltration system? The detail indicates that the line
is underground, but I don't see where it ever daylights or connects into the infiltration
system.

This letter is to notify you that the Wilmington Regional Office of the Division of Water Quality is
considering sending a recommendation for enforcement action to the Director of the Division of Water Quality.
The recommendation concerns the violation of North Carolina General Statute NCGS 143-215.6A(2); Failing to
apply for or secure, and/or act in accordance with the terms, conditions, or requirements of a permit required by
NCGS 143-215.1. You have failed to secure the required stormwater management permit prior to the construction
of impervious surfaces. A site inspection was conducted on March 13, 2002, and staff observed the concrete slab
building pad in place and the steel framework underway.
If you have an explanation for this violation that you wish to present, please respond in writing to me within
ten (10) days following receipt of this Notice. Your explanation will be reviewed and if an enforcement action is
still deemed appropriate, your explanation will be forwarded to the Director with the enforcement package for his
consideration.
By copy of this letter to the Building Inspections Department, this Office is requesting that the Building
Inspector consider withholding building permits and Certificates of Occupancy for this project until this matter is
satisfactorily resolved.

Dear Mr. Newsom:
Thank you for your letter of March 22, 2002. In response, I offer the following comments. What you don't
realize is that due to a mixup here at the Office, the original project, The Causeway, went statutory, and a site visit
was not done. That is to say, the file was placed in the wrong file cabinet and I was not able to review the
information prior to the lapse of the 90 day review time. A permit was issued, even though there were some
deficiencies with the application. A new owner with a new project at the same site makes this a new ball game. A
redesign of the system to meet current criteria is warranted because had The Causeway application been reviewed
in atimely manner, it would not have been permitted as proposed. Given that you are proposing an identical system,
I think you can understand why I cannot approve it as proposed.
Additionally, there is a note on the original trench supplement form that a soils investigation was not done
for this specific site in 1999. The note indicates that the soils information from the site across the street was used -
the Treasure Coast Yacht Club. I do not make the calls regarding soils, so I directed your questions to the Regional
Soil Scientist. His answer is that yes, mottling of sandy soils is hard to detect because sand apparently does not
discolor as readily from the mineral leachate. Additionally, it is not considered appropriate to use soils information
from one sit; on another site across the street. However, since the site had already been filled on the day of the site

We do intend to respond to each of your comments, however, desire some clarification on
the following points prior to performing any design changes:
> You will recall that the project was originally permitted as "The Causeway —
Miles McCormick" and the infiltration system designed by Parker & Associates
(Stormwater Plan dated 3/25/99). The design we submitted is identical (almost)
to the original design by Parker, although we have added supplementals
(groundwater elevations, vegetated swales, etc) that were not required on the
project as originally permitted. We are simply trying to modify the existing
permit SW8 990927 to allow an additional 1,350 sf (less than an 8% increase) of
impervious area and to modify the name of the permittee. Your comment 2
(water table) and comment 4 (smart weir) will require a total redesign of the
system. is a total redesign of the system warranted in this case?
> There is no doubt that groundwater elevations at the site are under tidal influence.
We do have a geotechnical report by S&ME (we will provide you a copy with our
response) that indicates groundwater at, or below, elevation 0. Subsequent
observations indicated a level of Elev, 2.3 on which we based the design. My
soils/geotechnical expert indicates that "soil mottling" is usually not present or,
when it is, is not a good indicator of SHWT in clean sandy fill materials under
tidal influence. Rather, he usually relies on a series of observations to estimate

SHWT. That is what we have attempted to do here. Please bear in mind that that
the original design prepared by Parker had trench bottoms at Elev. 1.9 (ours are at
Elev 4.4). Furthermore, a project less than .25 mi. from this site and also under
tidal influence was recently permitted with SHWT at Elev. 0.9. In the opinion of
my soils expert, it would be extremely unlikely that this site would have a SHWT
of 3.0. He is of the opinion that the value of 2.3, on which the designs was based,
is a very conservative value.
Please consider the above points and advise us bow best to proceed. Upon receiving your
response, we will formally respond to your comment letter. Should you have any

The Wilmington Regional Office received a Stormwater Management Permit Application for Bargain
Beachwear on January 29, 2002. A preliminary review of that information has determined that the application is
not complete. The following information is needed to continue the stormwater review:
1. Please either delineate all wetlands on site, disturbed or undisturbed, or note on the plans that none
exist.
2. Please submit a soils report based on an actual field visit. The report must provide an elevation for
the' seasonal high water table, the expected infiltration rate, and the type of soil. Please'remember
that the seasonal high water table is not the same as the observed groundwater elevation.
3. Please show the roof drain locations on the plans and how they will be directed into the proposed
trench system.
4. The system as proposed is not an "offline" bypass, as required by the rules. The proposed project will
force runoff to come up through the top of the catch basin (elevation 9.3) and flow over the parking
lot to a low comer into the vegetated filter. In order to meet the bypass requirement of the rules, the
runoff must overflow from the catch basin at the top of the trench (elevation 8.4). A smart weir must
be set in the catch basin such that only the first 1.5" would be directed into the trench. Once the
trench is full, the runoff would then flow over the smart weir, top set at the same elevation as the top
of the trench, 8.4, and into the filter. Is it possible to relocate the catch basins so that each is adjacent
the filter? That way, one side of the catch basin can be lowered to serve as the smart weir, and the
filter won't be so deep. The invert of the filter would be slightly lower than 8.4. If you cannot achieve
the required offline bypass, the Division must use it's best judgement as to the design storm, which
is based on the proximity to SA waters, the infiltration rate, and the depth of the water table. In this
case, please design the trenches to store and infiltrate a minimum of 4.5" of runoff, which is 3 times
the design storm.
Please provide very detailed cross sections and plan details of the two proposed vegetated filters.
Please show the proximity of the property line, pavement, and the building, the flow spreader,
elevations, inverts, slopes, grass type, the depressed area in the concrete bulkhead, etc.

6. Please show proposed grades in the vegetated filters, and indicate their length as a minimum of 50'
long.
7. If you choose to design the system for 4.5" of runoff, please raise the elevation of the driveway at
the property line to at least a couple of tenths above the overflow elevation of 9.5 to ensure that
runoff will not leave the site before passing through the vegetated filter. If you choose to provide an
offline bypass, this need not be done.
Please label the sidewalk width.
9. Please delineate the offsite drainage area and label the 1,330 sq. ft. of offsite impervious area. Mite
drainage must be accounted for at the full build -out potential.
10. Please delineate the 2.25 acre drainage area. Unless the marsh area behind the building will drain
into the trench system, the drainage area should be much smaller than the tract area. If the drainage
area is actually 2.25 acres, the required volume is deficient by over 500 cubic feet. If the drainage
area is smaller, please revise the calculations. Both the Rational method and Schueler's method
calculate runoff volume over the entire drainage area, not just the impervious area.
11. The BUA total on the application is shown as 18,501 ft'. I have corrected this to 18,561 W, as the
numbers listed actually total.
12. PIease label the perforated pipe size and lengths on the plans.
Please note that this request for additional information is in response to a preliminary review. The requested
information should be received by this Office prior to April 12, 2002, or the application will be returned as
incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee.
If you need additional tinke to submit the information, please mail or fax your request for a time extension
to the Division at the address and fax number at the bottom of this letter. The request must indicate the date by
which you expect to submit the required information.
The Division is allowed 90 days from the receipt of a completed application to issue the permit. The
construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation
Erosion Control Plan, prior to receipt of the Stormwater Management Permit, is a violation ofNCGS 143-215.1 and
is subject to enforcement action pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any original documents that need
to be revised have been sent to the engineer or agent along with a copy of this letter. All original documents must
be returned or new originals must be provided. Copies are not acceptable. If you have any questions concerning this

considering sending a recommendation for enforcement action to the Director of the Division of Water Quality.
The recommendation concerns the violation of North Carolina General Statute NCGS 143-215.6A(2); Failing to
apply for or secure, and/or act in accordance with the terms, conditions, or requirements of a permit required by
NCGS 143 '215.1. You have failed to secure the required stormwater management permit prior to the construction
of impervious surfaces. A site inspection was conducted on March 13, 2002, and staff observed the concrete slab
building pad in place and the steel framework underway.
If you have an explanation for this violation that you wish to present, please respond in writing to me within
ten (10) days following receipt of this Notice. Your explanation will be reviewed and if an enforcement action is
still deemed appropriate, your explanation will be forwarded to the Director with the enforcement package for his
consideration.
By copy of this letter to the Building Inspections Department, this Office is requesting that the Building
Inspector consider withholding building permits and Certificates of Occupancy for this project until this matter is
satisfactorily resolved.

AND DESIST such violation(s) and comply with the terms and conditions of the above permit.
On February 24, 2000, State Permit No. 25-00 was issued to you for the construction of a bulkhead at
The Causeway, at 511 Roland Avenue, in the Town of Surf City, in Pender County, North Carolina. This permit
was issued for CAMA Major Development in an Area of Environmental Concern, North Carolina General Statutes
(hereinafter abbreviated NCGS 1 13A-1 18), and for excavation andlor filling, NCGS 1 13-229(a). This permit
included the following terms and conditions(s): -
That the permit is subject to compliance with the application (where consistent with the permit), and that
development is authorized, as requested in the application dated 9/8/99 including the attached workplan
drawings (2), 1 dated 3/25/99 and 1 dated 12/7/99.
1) That the authorized alignment of the proposed bulkhead must be staked by a representative of the Division
of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.
3) The bulkhead shall must be constructed prior to any backfilling activities.
8) No excavated or fill material will be placed at any time in any vegetated wetlands or surrounding waters
outside of the alignment of the fill area indicated on the workplan drawings.
10) Sedimentation and erosion control measures must be implemented to ensure that eroded materials do not
enter adjacent wetlands or waters.

For the .following reasons, it is my opinion that you are in violation of the above terms and conditions(s) of
your permit:
7 . An inspection of the project on November 28, 2001 revealed that the bulkhead construction method
and scope was inconsistent with the approved workplan drawings and that fill material had been
placed in coastal wetlands in an area approximately 12' wide by approximately 30' long, outside the
alignment of the fill area indicated on the approved workplan drawings.
2. Fill material was being placed waterward of the existing bulkhead prior the new bulkhead being
constructed.
3. Work -was initiated prior to an alignment being staked by DCM.
4. Adequate sedimentation and erosion control measures were not implemented prior to construction.
It the terms and condition(s) of a permit are not complied with, the permit is null and void from the date of
its issuance. To comply with the terms and conditions of the permit issued to you, you must:
Construct the proposed bulkhead as indicated on the approved workplan drawings.
Remove all fill material from coastal wetlands and contain the material on the highground portion of
the property.
Proper sedimentation and erosion controls must be installed to prevent further erosion of excavated
material and disturbed areas in the adjacent wetlands.
Please be advised that this project was required to obtain a .Stormwater Permit from the North Carolina
Division of Water Quality and that modifications to the highground portion of the development, authorized under
CAMA Minor Permit No. 99-030 by the Town of Surf City on May 13, 1999, may require that the Storrowater
permit be modified as well. You should contact Linda Lewis with the Division of Water Quality at (910) 395-3900
for information concerning stormwater permitting requirements.
A civil penalty of up to Twenty -Five Hundred Dollars ($2500.00) may be assessed, or an injunction or
criminal penalty may be sought against any person who violates a CAMA Major Development permit. It is the
policy of the Coastal Resources Commission to assess a minimum civil penalty of One Hundred Fifty Dollars
($250.00) against all violations. This is done to recoup some of the costs of investigating violations and/or to
compensate the public for any damage to its natural resources. Whether a higher amount will be assessed will
depend on several factors, including the nature and area of the resources which were affected and the extent of the
damage to them. If restoration of the affected resources is requested but is not undertaken or completed
satisfactorily, a substantially higher civil penalty will be assessed and a court injunction will be ordering
restoration. In addition, a criminal penalty, damages, or an injunction maybe sought against any person who
violates a Dredge and Fill Permit, NCGS 113-229(k) and (1). , ,

Thank you for your letter of November 1 regarding the subject state stormwater management permit for The
Causeway. As I understand the project status to date, you have been required to submit a state stormwater
management permit application in response to filing a CAMA Major permit application to alter the existing bulkhead
on the project site.
Our state stormwater management program requires that any coastal development project which needs
either a CAMA Major permit or an erosion and sediment control plan approval must also comply with our rules [ 15A
NCAC 2H .10001. Our rules also require that we take into account the master plan of the entire project when issuing
permits [2H .1003(h)(3)]. For this project, the master plan of development means that we must consider the entire
development even though the CAMA Major permit, which triggered the state stormwater application, is for a very
localized portion of the project.
The intent of our state stormwater management program is to provide protection to sensitive waters that is
equivalent to low density development. The requirements under this state program are in addition to any local
stormwater requirements, However, local requirements may be evaluated to determine if they meet all or a portion
of the state stormwater management requirements for total suspended solids removal and control of the runoff from
the project.

requirements because the project is located on fill material. The Wilmington Regional Office, who will issue the
permit for this project, has requested a supplement for an underground infiltration trench. Per 2H .1008(d)(7),
infiltration systems sited on fill can be approved on a case -by -case base. Your engineer should contact Linda Lewis
in the Wilmington Regional Office to discuss the engineering constraints of this project.

Allow me to introduce myself. I am Miles McCormick and I have recently applied for
a major LAMA permit for my project The Causeway located in Surf City, North
Carolina. I have in hand a minor CAMA permit as well as permission from Surf City town
council to proceed with construction of this project, however, this past summer 1
inquired of Ms, Bob Stroud as to whether it would be possible to make a minor alteration
in the existing bulkhead, He indicated that the granting of permission to alter the bulkhead
was very likely, but would necessitate applying for a major CAMA permit, which I did
on September 8, 1999. On September 17, 19991 received a letter from NCDENR by
Linda .Lewis. indicating that I needed to apply for a Stormwater Management Permit ,
through the Division of Water Quality. Most recently, on October 25, 1999,1 was told
by NCDENR., through Noelle Lutheran, that my application for a General Storm Water
Permit was insufficient and that they now require a State Stormwater Management Permit.
When 1 referred this request to my engineer, Gordon McAdams, I was informed that this
property could not possibly meet the State Stormwater Rules as it was primarily fill some
seventy-five years ago.
After meeting personally with both Bob Stroud and Tim Gregson about this latest
request it was suggested by them that I contact you to please intervene and review this
application, After all, I can already proceed with this project but am merely asking to
align the existing bulkhead to make the property snore uniform and attractive. The impact
on this property or the adjacent properties is minimal, if at all. The town of Surf City
requires that all stormwater be retained on the property and the plans that I submitted will,
according to my engineer, contain that.

1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit

Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood

3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control

The Wilmington Regional Office received a Stormwater Management Permit Application for The
Causeway on October 8, 1999. A preliminary review of that information has determined that the application
is not complete. The following information is needed to continue the stormwater review:
Re -alignment of an existing bulkhead on the project site required a CAMA Major Permit.
When a CAMA Major Permit is required, a State Stormwater Management Permit is also
required. An application for a General Stormwater Permit was received, but because this is a
high density project with a designed stormwater treatment system, an Underground Infiltration
Trench Supplement must be submitted. Please make sure that the plans and design of the
infiltration system meet the State Stormwater Rules.
2. Please be sure to delineate all wetlands on site, or note on the plans that none exist.

Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action

This project is being built on a one half acre parcel across from Hardees on Hwy 210/50
in Surf City. Stormwater from the projects impervious surfaces will be collected and directed to
an underground infiltration system designed and approved in accordance with the Town of Surf
City's drainage requirements.
The Major CAMA Permit which has been applied for by Mr. McCormick simply
involves a minor re -alignment of an existing bulkhead on the property.

existing bulkhead,instead of being straight across the rear
of the property, was slightly angled. Accordingly, this
permit application addresses the squaring of the property
corner by the modification of the existing bulkhead
necessitating construction of 70 feet of bulkhead.
Development activity is anticipated,to be limited to the use
of a backhoe to fill the area with sand/clay once the
construction of the bulkhead is complete. Standard
construction methods are to be employed in the modification
of the bulkhead with daily activity on the property limited
to that only necessary to accomplish the construction in

The Wilmington District, during the months of December 1986, and January
and Feburary, 1987,issued 27 Department of the Army permits pursuant to both
Section 10 of the River and Harbor Act of 1899 (33 U.S.C. 403) and Section
404(b) of -the Clean Water Act (33 U.S.C. 1344), 17 Department of the Army
permits exclusively,:pursuant to 33 U.S.C. 403, and 41 Department of the Army
permits exclusively pursuant to 33 U.S.C. 13.44 for a total of 85. One new
general permit.was issued and two general permits were renewed, ten letter
modification were issued, and 39 applications which were advertised by public

Before these actions were taken, the probably impact of the existing and
proposed activities on public interest was evaluated. All factors relevant to
the activities were considered, including but not limited to conservation,
economics, and esthetics, general environmental concerns, historic values,
fish and wildlife values, flood damage prevention, land use classification,
navigation, recreation, water supply, water quality, energy needs, safety,

This permit authorizes construction of three retail buildings.
1. All proposed development and associated construction must be done in accordance
with the permitted workplat drawing(s) as originally submitted on 03-31-99.
2. All construction must conform to the NC Building Code requirements and all other
Local, State, and Federal regulations.
3. Any change or changes in the plans for development, construction, or land use
activities will require a re-evaluation and modification of this permit.
4. The amount of impervious surface areas shall not exceed 30% of the lot area within
the 75` Area of Environmental Concern. Must install as per site plan 03-31-99.
5. In order to prevent sedimentation, a vegetated buffer zone must be maintained
between all disturbed areas and the adjacent waterbody or marsh.
6. Prior to irutiating any land -disturbing activities, a barrier Iine of filter cloth', or burlap
must be installed between the land -disturbing activity and the adjacent marsh or water
areas, until such time as the area has been properly stabilized with a vegetated cover.
7. Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned,
transferred, sold or otherwise disposed of to a third -party.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mit must cease until the appeal is resolved.
`This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All work must cease when this permit expires on December
31. 2002

'A. Ennis Chestang, owner of property across from the new water tank site on S. Topsail Drive addressed
Council. He indicated that he originally got signatures from owners of 17 properties in his area who are
opposed to the water tower being placed in their neighborhood. He stated that the list of persons opposed
has now grown by a considerable number, he has received responses from 30 of the 45 houses he visited.
He said he could not locate an individual who had knowledge of the water tower going in on S. Topsail Dr.
Mr. Chestang presented two pictures, one of the existing water tower and one of the proposed site of the new
tower. He asked what could be done to change the town's plans to place the new tank on S. Topsail Drive.
He said that he realized the area was not very developed (there were only two houses on the east side) when
the town purchased the property. He asked that the new tank not be placed in his or any other residential
neighborhood.
'Barry Mills, owner of property at 714 S. Topsail Drive and adjacent to the water tower property asked that the
Board reconsider placing the tower on the proposed site. He expressed concern over property values being
adversely affected by placement of the tank in the proposed area. Mr. Mills volunteered to work with the town
in seeking an alternative site and other options.
'Otis Sizemore, a Surf City property owner and North Topsail Beach Alderman, addressed Council concerning
beach renoubshment. A beach renourishment project for North Topsail Beach is estimated to cost
$26,000,000. Federal and state shares of the project, 65% or $16.9 million and $4.5 million, respectively,
would still leave North Topsail Beach responsible for $4.5 million. Over a ten year period, North Topsail
Beach's share for the project would be $450,000 annually. Mr. Sizemore doubted that three (3) beach
renourishment projects (one for each town on the island) would be approved; therefore, one project island
wide would be best. North Topsail Beach town manager, Tony Hammond, arranged for Roland Gunn, a
lobbyist, to address the North Topsail Beach elected officials. Mr. Gunn suggested possibilities such as
placing spoil from the Intracoastal waterway on the beach rather than on spoil islands and using the beach
renourishment as a demonstration project for endangered species, ie. sea turtles. North Topsail Beach is
considering hiring Mr. Gunn at a cost of S60,000/year to assist with the project through lobbying efforts. Mr.
Sizemore said that his town was inviting Surf City, Topsail Beach, Onslow, and Pender Counties to share the
cost and project The US Army Corps of Engineers is pumping sand from New River Inlet onto the beach
now, and has raised the beach four feet and made it 100 feet wide. Mr. Sizemore said there may be enough
sand to renourish the whole island if the Corps will pump it onto the beach. The project will be an eight to ten
year process. North Topsail Beach will also be looking for grants to assist with project costs. Mr.Gunn is
willing to meet with Surf City.
"Phil Mills, 713 S. Shore Drive property owner, was upset because he had not been notified that a water tank
was being proposed in his neighborhood, and he objected to site the town selected. He asked the Board to
reconsider the site for a new tank.
Planning Board Recommendations
Surf City Pier Site Plan
After brief discussion concerning leased parking for the pier, motion by Council Member Thomas, seconded
by Council Member Medlin, and unanimously carried to approve the site plan for Surf City Pier.
The Causeway Site Plan
Miles McCormick presented the site plan for The Causeway and showed pictures of how his project will look
when finished. The Causeway site plan was approved by motion by Council Member Smith, seconded by
Council Member Thomas, and unanimously carried.
Street Closing Order
Manager Hedrick presented a brief history of the town's intent and actions to close the last 20 feet of North
Shore Drive and, with the town's adjacent six ocean front lots, construct a neighborhood beach access
complete with rest rooms, walk -over, and parking. The town went through the required process to obtain a
CAMA permit and close the street (20 feet). Mr. Williamson, an adjacent property owner, filed suit against
