This office had noted as of April 21, 2010 that you were working on the compliance issues and
transfer of ownership request for the Barkley Estates Subdivision, Stormwater Permit No. SW8
990827. Please notify this office of the status of the compliance issues, particularly the status of
the engineers' certification of the stormwater system, and the status of the transfer of ownership
of the state stormwater permit.
Please submit a plan of action of the specific actions that'will be undertaken and the time frame
that will be required to perform and submit this Certification. Please note the certification may
be submitted by a certified engineer or a certified landscape architect. Please inform this office
in writing before December 21, 2010 of the plan of action.

Compliance Timeframes:
If the sludge level' is equal to or higher than the stop pump level of the lagoon or if the sludge level
results in an elevated waste'analysis, a sludge management plan that meets the requirements of SB
Interagency Group Guidance Document 1.26 must be prepared by a technical specialist and submitted to
DWQ within 180 days. Work to reduce the sludge level must begin within another 180 days.
Compliance with NRCS Standard 359 must be achieved by the expiration date of the current permit.
If the sludge, level is noncompliant, but below the stop pump level of the lagoon, compliance with NRCS
Standard 359 must be achieved by the expiration date of the current permit. If future sludge surveys do
not show improverhent in sludge levels, DWQ may require the owner to develop a sludge management
plan that meets the requirements of SB Interagency Group Guidance Document 1.26.

On September 22, 2009, Wilmington Regional Office personnel performed a file review
of the subject project, located at the intersection of US Hwy 76 and Allens Lane in
Wilmington, New Hanover, North Carolina. The file review was performed to determine
the status of compliance with Stormwater Permit Number SW8 990827, issued to you
on October 11, 1999.
The project has been found in violation of Stormwater Permit Number SW8 990827,
issued pursuant to the requirements of 15A NCAC 2H.1000 effective September 1,
1995. The violations found are:
1. Failure to certify the stormwa ter system. A file review revealed that this office
has not received a Designers Certificate.
Permit condition states that upon completion of construction, prior to issuance
of a Certificate of Occupancy, and prior to operation of this permitted facility, a
certification must be received from an appropriate designer for the system
installed certifying that the permitted facility has been installed in accordance
with this permit, the approved plans and specifications, and other supporting
documentation. Any deviations from the approved plans and specifications
must be noted on the Certification.
2. Failure to submit a copy of recorded deed restrictions. A file review revealed
that this office has not received a copy of recorded deed restrictions.
Permit condition states that a copy of the recorded deed restrictions must be
submitted to the Division within 30 days of the date of recording the plat, and
prior to selling lots. The recorded copy must bear the signature of the
Permittee, the deed book number and page, and stamp/signature of the
Register of Deeds.
To correct these violations you must:
1. Provide a written "Plan of Action" which outlines the actions you will take to
correct the violation(s) and a time frame for completion of those actions, on or
before October 21, 2009.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8990827
to Barkley Estates Subdivision for a High Density Project on October 11, 1999. This permit expires on
October 11, 2009. Section .1003(h) of 15 A NCAC 2H .1000 (the stormwater rules) requires that
applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must
be accompanied by a processing fee, which is currently set at $505.00. If this is still an active project
please complete and submit the enclosed renewal application in a timely manner. If this project has not
been constructed and a permit is no longer needed, please submit a'request to have the permit
rescinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing
address and phone number of the person or entity that is now responsible for this permit. Enclosed is a
form for change of ownership, which should be completed and submitted if the property has changed
hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer for
the system installed. This is to certify that the permitted facility has been installed in accordance with the
permit, the approved plans, specifications and supporting documentation. Please include a copy of the
certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to $10,000
per day.

In response to your correspondence dated September 30, 1999 we offer the
following:
1. We have now shown swales and infiltration areas within proposed drainage
easements.
2. We have shortened the proposed swale along the western property line. A very
small amount of lot No. 14 will drain away from the street and swale, but it is
beyond the limits of any proposed impervious. We have revised the swale along the
eastern property line to drain to the middle between lot Nos. 7 and 9. No part of the
swales will be deeper than 2.5' and should fit within the 15' drainage easement.
3. We have increased the slope along the northeast swale to 0.40%.
4. A notation of "no wetlands are located on this property" has been added to the
drawings.
5. The developer is pursuing the HOA paperwork.
6. As you noted, there was a lot going on at the front of this tract. In pursuit of a less
"cluttered" design, we have relocated the proposed infiltration trench away from
Barkley Avenue and Aliens Lane. We also added two additional curb inlets to better
control runoff from our site. 'This should prevent potential interference with other
utilities. We have included an inset for each drop inlet with pipe sizing and invert
information.

7. As stated above, we have eliminated the trench parallel to Aliens Lane in favor of
the proposed trench along the rear of lot Nos. 1, 2, b, & 8.

Management Permit Application for Barkely Estates Subdivision on October 5, 1999. A preliminary review
of that information has determined that the application is not complete. The following information is needed
to continue the stormwater review:
1. Now that the trench has been relocated, it does not appear that the same trench lengths and pipe
lengths are being used as originally submitted. Please provide a new supplement showing both
the 12" pipe and 8" pipe lengths, and new volume required and volume provided.
2. Please provide a little more detail as to how you arrived at the provided volume in the
calculations. Simply stating that l 3,200 cubic feet is provided isn't sufficient. You need to go
through the actual calculations to arrive at that conclusion.
3. Please show which side the open grate is supposed to go on and which side is supposed to have
the solid top on the drop inlet detail.

Dear Mr. Brisson:
The Wilmington Regional Office received a Stormwater Management Permit Application for Barkley
Estates Subdivision on August 17, 1999. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater review:
Please locate the swales in recorded drainage easements along the backs of the lots, which are
wide enough to accomodate the swale's width. It appears that a minimum of 25` will be needed,
based on existing and proposed grades.
2. A portion of each swale appears to be located in fill, le., the proposed grades are above the
existing grade. Please show proposed grading contours for the lots and for each swale.
3. I am concerned about the very slight fall proposed for the northeast swale. There is only 1 foot
of fall in almost 400', or a 0.25% grade. is this sufficient to collect the required 1 " runoff from
the lots and get it into the proposed infiltration system?
4. Delineate all wetlands on site, or note on the plans that none exist.
5. Please think about establishing an HOA now, prior to selling lots, in order to assure that
maintenance will be performed in the future. As the developer, you will be out of the picture
after the subdivision is built -out. Unless you want to be held responsible for the continued
maintenance of the system, after completion of the project, please think about an HOA now.
6. The bypass pipe inverts are NOT shown on the plans as the detail suggests. Please add. There

7. For the trench system adjacent Allen's Lane, please show another detail which shows the piping
located to one side of the trench; with the laterals coming off it. Please label the size, length and
spacing of the laterals.
8. The top of page 3 of the supplement has not been initialled.
9. There is conflicting cul-de-sac information between the plan and the detail. If the pavement
width is 22' from the face of the tree curbing to the centerline of the valley curb, then the total
measurement from the radius point to the outside of the valley curb is 43.5', not 421
.
10. Please label the split road dimension as to where the I is measured from and to.
11. Please recalculate the road area. I a1n getting about 5,000 square feet more area.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to October 30, 1999, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the
application fee. The Division is allowed 90 days from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action
pursuant to NCGS 143-215.6A. -
