Deed Restriction Language The following statements must be recorded for all low density projects and for all projects that involve the subdivision and selling of lots or outparcels: 1. No more than square feet of any lot, including that portion of the right-of-way between the edge of pm+ement and the front lot line, shall be covered by impervious structures including asphalt, gravel, concrete, brick, stone, slate or similar material but not including wood decking or the surface ofswimming pools. This covenant is intended to insure continued compliance with the stormwater permit issued by the State of North Carolina. The covenant may not be changed or deleted without the consent of the ,State. 2. No one may fill in, pipe, or alter anv roadside swale except as necessary to provide a minimum driveway crossing. NOTE: If lot sizes vary significantly, the owner, developer must provide an attachment listing each lot number, size and the allowable built -upon area for each lot. For commercial projects that have outparcels or future development the following statements must also be recorded: 3. The connection from the outparcel or future area into the stormwater system must he made into the forebay such that short-circuiting of the .rystem does not occur. 4. All built -upon area from the outparcel or future development must be directed into the permitted stormwater control system. 5. Built -upon area in excess of the permitted amount will require a permit modification prior to construction. For curb outlet systems, the following statements in addition to items 1 and 2 above must be recorded: 6. No one may pipe, fill in or alter any designated 100 foot long grassed Swale used to meet the requirements ofNCAC 2H.1008(g). 2. II phi even 9;1.4/343.-,9653 • Fax 910/343-9604 We are responding to your letter of March 25, 199 which we received on March 29, 1999 as follows: 1. Dimensions have been added for the parking lot and paved area. 2. We have enclosed a separate red -lined drainage plan that delineates the drainage areas. 3. We have added some additional dimensions which we hope will prove to be helpful to you. 4. We have added spot elevations to clarify the division of drainage areas. 5. The site has been added to the vicinity map. The Lot 1 R property is the old Exide plant site. It has been labeled. 6. Additional spot elevations have been added as requested. 7. As stated in the narrative, Pond 2 is for future development. It may be constructed now, however the Owner is aware that plans must be submitted to show the future development and drainage patterns when the configuration of that development has been created. B. We have calculated that the forebay for Pond 1 is approximately 21 % of the total volume. We would hope that this is close enough to 20% to function properly.
