This law impacts any development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that is set to expire during this time frame to 3 years from its current expiration date. Accordingly, Stormwater Permit # SW8 980710, which was set to expire on November 7, 2010, is now in effect until November 7, 2013. Please resubmit the renewal application and fee at least 180 days prior to November 7, 2013, which would be May 7, 2013. Initial Site Plan was submitted to the Jacksonville Development and Planning Board on 5/3/98. The board reviewed this plan and requested a resubmission with land watershed conditions. Resubmitted plan on 5/15/98 had contour details and ponds for development of the property. On finther review of the one building and parking area against the total site of 11.11 Acreas, a suggestion was trade that it looked as if less than 300/6 of the total land was to be used, and that we needed to have a Professional draw up the details of this layout. Oceanside Engineering was contracted to draw up the site plans to meet NCDENR requirements for the above conditions. A submission on 6/22/98 was made to NCDENR for approval. No problems were anticipated since it looked as if all conditions for the Ma rule were meet by the site plan. Subsequent correspondece with NCDENR required drawing enhancements and resubmission were made 7/16/98 & 8/I9198. At this point it was felt that approval for the site plan water shed was OK. In August of'98 the Planning and inspection Depts gave us approval to start the project, which we did. Site plan development was initiated as per the layout submitted on 8/19/98, not anticipating any problems. In early Nov. 498 we were notified that the site plan needed more detail and was now being considered as a high density area When this information was presented to Rev. Perry, a question arose in his mind, that if more acreage was required to be disturbed to meet this new condition it night be more advisable to develop the full 11.11 acreas by showing his future expansion of a new Sanctuary. Assumption was trade that the next building phase was going to be accomplished just after we had completed the Ist phase. Oceanside Engineering was asked to submirt this revised plan 12/4/98 with a subsequent revision again on 3/4/99. During all these site plan revision phases the project was being completed assuming that we had meet water shed site conditions on what we were building,. Nearing the completion and occupancy of the premisses Rev. Perry ( 5/99 ) notified us that the Sanctuary Project would have to be placed on hold until adequate financing could be obtained. So much time had passed and we had obtain Occupancy Permits, and with no. continuation of this project we had our attention focused on other endevours. It was not untill Rev. Perry notified us of your correspondence dated 3/13/2000 that we were made aware of this confusion about the site plan. Since the Sanctuary is not presently being considered for construction, I have asked Oceanside Engineering to mail you the drawings and calculation corresponding to the present site water shed conditions (8/19/98 submission). Beth'el Word Ministries, Inc. is a corporation organized and existing under the laws of the State of North Carolina. B. Beth'el Word Ministries, Inc. has developed a site located off NCSR 1410 (Halltown Road), near the intersection with NCSR 1406 (Piney Green Road) in Jacksonville, Onslow County, North Carolina, as a church known as Beth'el Word Ministries. C. On July 24, 1998, DWQ sent a letter to Reverend Earnest Perry, registered agent for Beth'el Word Ministries, Inc., via certified mail, advising Reverend Perry of the requirement to apply for and obtain a Stormwater Management Permit for development of the Beth'el Word Ministries site. The letter stated that any construction on the site, performed prior to receipt of the permit would constitute a violation of 15A NCAC 2H .1000. D. On July 31, 1998, DWQ received a Stormwater Management Permit application for the Beth'el Word Ministries site. Review of the application found it to'be incomplete and noted that the plans indicated a cluster of high density development on the property. On October 22, 1998, DWQ notified Beth'el Word Ministries, Inc. of the requirement to design and install an engineered system to serve the site. E. On April 6, 1999, Beth'el Word Ministries, Inc. submitted a revised application showing a wet detention pond. Additional information relative to the project was requested by DWQ on June 11, 1999. No response to the request was received. 3�6 F. On March 13, 2000, DWQ sent a Notice of Recommendation of Enforcement letter to Beth'el Word Ministries, Inc. via certified mail, regarding its failure to secure a stormwater permit. G. On April 26, 2000, DWQ staff inspected the Beth'el Word Ministries site, observing the construction of buildings and parking areas. Such development represents an increase in the amount of impervious surface or and/or a decrease in the capacity for infiltration of precipitation into the soil at the site. At the time of the inspection, the first phase of construction was complete and the facility was in operation. H. As of the date of this action, a Stormwater Management Permit has not been issued by DWQ for development of the Beth'el Word Ministries site. I. . The costs to the State of enforcement procedures in this matter totaled $220.46. Based upon the above Findings of Fact, I make the following: 11. CONCLUSIONS OF LAW A. Beth'el Word Ministries, Inc. is a "person" within the meaning of G.S. 143- 215.6A, pursuant to G.S. 143-212(4). B. North Carolina Administrative Code Section 15A NCAC '2H .1003 requires development activities within the State's coastal counties that require a CAMA major development permit or a Sedimentation/Erosion Control Plan to obtain a stormwater management permit. C. Onslow County is a coastal county pursuant to 15A NCAC 2H .1002. D. Beth'el Word Ministries, Inc. was required to obtain a stormwater management permit for its development at the Beth'el Word Ministries site prior to the construction of impervious surfaces pursuant to 15A NCAC 2H .1003. E. Beth'el Word Ministries, Inc. violated 15A NCAC 2H .1003 by failing to obtain a stormwater management permit prior to its development of the Beth'el Word Ministries site. F. 15A NCAC 2H .1003 is a rule of the Environmental Management Commission implementing Chapter 143, Article 21, Part 1 of the North Carolina General Statutes. 3 7 G. Beth'el Word Ministries, Inc. may be assessed civil penalties in this matter pursuant to G.S. 143-215.6A(a)(6), which provides that a civil penalty of not more than ten thousand dollars per violation may be assessed against a person who violates a rule of the Commission implementing Chapter 143, Article 21, Part 1 of the North Carolina General Statutes. Case No. WQ 00-010 Dear Ms Sullins: In response to the Notice of a civil penalty assessed against Bethel Word Ministries I submit a request for its remission on the ground that the violation was inadvertent or a result of an accident and hereby enclose the waiver and stipulation form 1. On or about April 6, 1998, Bethel Wore! Ministries Inc. entered into a contract with a Contractor, Edwin H. Holt General Contractors Inc. for the construction of its Church. This was the first time ever that the Church had been involved in a construction project and the Pastor, Superintendent E. A. Perry, had no knowledge or experience in Church construction. 2 Accordingly the Church relied on the Contractor to apply for all the permits necessary to enable it to perform the work for which it had been engaged. In addition the Church advanced to it monies to pay for the storm water permit. 3. The Contractor retained the services of Mr. Joseph F. Dunnehoo to prepare the storm water plan before the violation was issued. Mr. Dunnehoo apparently had problems- with the Contractor and was not able to complete the application for the storm water permit without the knowledge of Superintendent Perry. (See Exhibit1). 4. The Notice from NCDEHR dated June 25, 1998 to the effect that no permit had yet been issued was not sent to the Church but to Mr. Edwin Holt. (See Exhibit 2) Consequently, the Church was unaware that there had been a violation of 15A NCAC 21-1.1003 5. On July 26, 1998, the Church received a notice dated July 24, 1998 to apply for storm water permit for the Church Site. The Church Superintendent passed this on to Mr. Holt. Holt advised him thathe would take care of k At Holt's request the `// Church paid Holt to apply for and obtain the storm water permit. In fact the storm water management permit application was received by NCDENR on July 31, 1998 6. During the construction process, Holt informed the Superintendent that the plans had been submitted and that everything was in order. The Church never received notice of any discrepancies as all the notices from NCDEHR went direct to Holt Construction 7. The Church first became aware that Hoft had not acquired the necessary permit when they received DWQ's Notice of Recommendation of Enforcement dated March 13, 2000. 8. Immediately after the receipt of this Notice the Superintendent promptly took steps to abate the violation by contacting Joseph F. Dunnehoo of Oceanside Engineering and Surveying to do another plan and submit it to NCDENR, which he did. They paid to him $2000 more for this work which should have been done by Holt. It was then that the Church determined that there had been a problem between the Contractor and the Engineer. 9. Mr. Dunnehoo obtained approval of the plan and a permit No. SW8 980710 was issued on November 7, 2000 (Exhibit 2). The Church is currently scheduling the work to be done in accordance with the approved plan. 10. The Church has limited finances and had to obtain a loan from First Citizens Bank to enable it to carry out the Church construction. It has never been assessed civil penalties for any violations and the payment of this amount will seriously affect its ability to carry out the rest of the construction work. Stevens, Director of the Division of Water Quality (DWQ), make the following: 1. FINDINGS OF FACT A. Beth'el Word Ministries, Inc. is a corporation organized and existing under the laws of the State of North Carolina. B. Beth'el Word Ministries, Inc. has developed a site located off NCSR 1410 (Halltown Road), near the intersection with NCSR 1406 (Piney Green Road) in Jacksonville, Onslow County, North Carolina, as a church known as Beth'el Word Ministries. C. On July 24, 1998, DWQ sent a letter to Reverend Earnest Perry, registered agent for Beth'el Word Ministries, Inc., via certified mail, advising Reverend Perry of the requirement to apply for and obtain a Stormwater Management Permit for development of the Beth'el Word Ministries site. The letter stated that any construction on the site, performed prior to receipt of the permit would constitute a violation of 15A NCAC 2H .1000. D. On July 31, 1998, DWQ received a Stormwater Management Permit application for the Beth'el Word Ministries site. Review of the application found it to be incomplete and noted that the plans indicated a cluster of high density development on the property. On October 22, 1998, DWQ notified Beth'el Word Ministries, Inc. of the requirement to design and install an engineered system to serve the site. E. On April 6, 1999, Beth'el Word Ministries, Inc. submitted a revised application showing a wet detention pond. Additional information relative to the project was requested by DWQ on June 11, 1999. No response to the request was received. F. On March 13, 2000, DWQ sent a Notice of Recommendation of Enforcement letter to Beth'el Word Ministries, Inc. via certified mail, regarding its failure to secure a stormwater permit. G. On April 26, 2000, DWQ staff inspected the Beth'el Word Ministries site, observing the construction of buildings and parking areas. Such development represents an increase in the amount of impervious surface or and/or a decrease in the capacity for infiltration of precipitation into the soil at the site. At the time of the inspection, the first phase of construction was complete and the facility was in operation. H. As of the date of this action, a Stormwater Management Permit has not been issued by DWQ for development of the Beth'el Word Ministries site. I. The costs to the State of enforcement procedures in this matter totaled $220.46. Based upon the above Findings of Fact, I make the following: II. CONCLUSIONS OF LAW A. Beth'el Word Ministries, Inc. is a "person" within the meaning of G.S. 143- 215.6A, pursuant to G.S. 143-212(4). B. North Carolina Administrative Code Section 15A NCAC 2H .1003 requires development activities within the State's coastal counties that require a CAMA major development permit or a Sedimentation/Erosion Control Plan to obtain a stormwater management permit. C. ' Onslow County is a coastal county pursuant to 15A NCAC 2H .1002. D. Beth'el Word Ministries, Inc. was required to obtain a stormwater management permit for its development at the Bethel Word Ministries site prior to the construction of impervious surfaces pursuant to 15A NCAC 2H .1003. E. Beth'el Word Ministries, Inc. violated 15A NCAC 2H .1003 by failing to obtain a stormwater management permit prior to its development of the Beth'el Word Ministries site. F. 15A NCAC 2H. 1003 is a rule of the Environmental Management Commission implementing Chapter 143, Article 21, Part 1 of the North Carolina General Statutes. G. Beth'el Word Ministries, Inc. may be assessed civil penalties in this matter pursuant to G.S. 143-215.6A(a)(6), which provides that a civil penalty of not more than ten thousand dollars per violation may be assessed against a person who violates a rule of the Commission implementing Chapter 143, Article 21, Part 1 of the North Carolina General Statutes. H. The State's enforcement costs in this matter may be assessed against Beth'el Word Ministries, Inc. pursuant to G.S. 143-215.3(a)(9) and G.S. 143B- 282.1(b)(8). E. On April 6, 1999, a submittal was made showing a wet detention pond. Additional information was requested on June 11, 1999. No response was received. F. On March 13, 2000, the Division sent a Notice of' Recommendation to Enforce via certified mail. G. On April 26, 2000, DWQ staff inspected the site and observed the construction of building and parking. 1-1. The Bethel Word Ministries contains building; and parking which will result in an increase in the amount of impervious surface at this site or otherwise decrease the infiltration of precipitation into the soil. Please remember that the vegetated filter is not a continously wet connector ditch from the pond to the receiving waters. It is a normally dry, flat, gently sloped grassed area that is at least 30' long. Initial Site Plan was submitted to the Jacksonville Development and Planning Board on 5/3/98. The board reviewed this plan and requested a resubmission with land water shed conditions. Resubmitted plan on 5/15/98 had contour details and ponds for development of the property. On further review of the one building and parking area against the total site of 11.11 Acreas, a suggestion was made that it looked as if less than 30% of the total land was to be used, and that we needed to have a Professional draw up the details of this layout. Oceanside Engineering was contracted to draw up the site plans to meet NCDENR requirements for the above conditions. A submission on 6/22/98 was made to NCDENR for approval. No problems were anticipated since it looked as if all conditions for the 304/6 rule were meet by the site plan. Subsequent correspondece with NCDENR required drawing enhancements and resubmissions were made 7/16/98 & 8/19/98. At this point it was felt that approval for the site plan water shed was OK. In August of'98 the Planning and Inspection Depts gave us approval to start the project, which we did. Site plan development was initiated as per the layout submitted on 8/19/98, not anticipating any problems. In early Nov. `98 we were notified that the site plan needed more detail and was now being considered as a high density area. When this information was presented to Rev. Perry, a question arose in his mind, that if more acreage was required to be disturbed to meet this new condition it might be more advisable to develop the full 11.11 acreas by showing his future expansion of a new Sanctuary. Assumption was made that the next building phase was going to be accomplished just after we had completed the I st phase. Oceanside Engineering was asked to submitt this revised plan 1214/98 with a subsequent revision again on 3/4/99. During all these site plan revision phases the project was being completed assuming that we had meet water shed site conditions on what we were building,. Nearing the completion and occupancy of the premisses Rev. Perry ( 5/99 ) notified us that the Sanctuary Project would have to be placed on hold until adequate financing could be obtained. So much time had passed and we had obtain Occupancy Permits, and with no continuation of this project we had our attention focused on other endevours. It was not until] Rev. Perry notified us of your correspondence dated 3/13/2000 that we were made aware of this confusion about the site plan. Since the Sanctuary is not presently being considered for construction, I have asked Oceanside Engineering to mail you the drawings and calculation corresponding to the present site water shed conditions (8/19/98 submission). Initial Site Plan was submitted to the Jacksonville Development and Planning Board on 5/3/98, The board reviewed this plan and requested a resubmission with land water shed conditions. Resubmitted plan on 5/ 15198 had contour details and ponds for development of the property. On fiuther review of the one building and parking area against the total site of 11.11 Acreas, a suggestion was made that it looked as if less than 301/6 of the total land was to be used, and that we needed to have a Professional draw up the details of this layout. Oceanside Engineering was contracted to draw up the site plans to meet NCDENR requirements for the above conditions. A submission on 6/22/99 was made to NCDENR for approval. No problems were anticipated since it looked as if all conditions for the 301/6 rule were meet by the site plan, Subsequent correspondece with NCDENR required drawing enhancements and resubmissions were made 7/16/98 & 8/19/98, At this point it was felt that approval for the site plan water shed was OK. In August of'98 the Planning and Inspection Depts gave us approval to start the project, which we did. Site plan development was initiated as per the layout submitted on 8/19/98, not anticipating any problems. In early Nov. '98 we were notified that the site plan needed more detail and was now being considered as a high density area. When this information was presented to Rev. Perry, a question arose in his mind, that if more acreage was required to be disturbed to meet this new condition it might be more advisable to develop the full 11.11 acreas by showing his future expansion of a new Sanctuary. Assumption was made that the next building phase was going to be accomplished just after we had completed the I st phase. Oceanside Engineering was asked to submitt this revised plan 1214/98 with a subsequent revision again on 3/4/99. During all these site plan revision phases the project was being completed assuming that we had meet water shed site conditions on what we were building,. Nesting the completion and occupancy of the premisses Rev. Perry ( 5I99 ) notified us that the Sanctuary Project would have to be placed on hold until adequate financing could be obtained. So much time had passed and we had obtain Occupancy Permits, and with no continuation of this project we had our attention focused on other endevours. It was not untill Rev. Perry notified us of your correspondence dated 3/13/2000 that we were made aware of this confusion about the site plan. Since the Sanctuary is not presently being considered for construction, 1 have asked Oceanside Engineering to mail you the drawings and calculation corresponding to the present site water shed conditions (8/19198 submission), I hope the above information gives you a better picture as to the events leading to the present day. The North Carolina Administrative Code requires any project that must receive either a Sedimentation and Erosion Control Plan permit and/or a CAMA major permit to apply for and receive a Stormwater Management Permit by the Division of Water Quality. Any construction on the subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement action by this Office. Either a Stormwater Permit Application Package including 2 sets of plans, completed application form, fee, and supporting documentation, or a written response regarding the status of this project and the expected submittal date must be received in this Office no later than August 14, 1998. Failure to respond to this request may result in the initiation of enforcement action, and construction may experience a subsequent delay.
