On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of
Chapter 143 of the General Statutes, which is current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that is set to expire during this time frame to 3 years from its current
expiration date.
Accordingly, Stormwater Permit # SW8 980710, which was set to expire on
November 7, 2010, is now in effect until November 7, 2013. Please resubmit the
renewal application and fee at least 180 days prior to November 7, 2013, which would
be May 7, 2013. A copy of the Renewal Application can be obtained from the following
website: htto://h2o.enr.state.nc.us/su/bmr) forms.htm.

This letter is to notify you that the Wilmington Regional Office of the Division of Water Quality is
considering sending a recommendation for enforcement action to the Director of the Division of Water Quality.
The recommendation concerns the violation of North Carolina General Statute NCGS 143-215.6A(2); Failing
to apply for or secure, and/or act in accordance with the terms, conditions, or requirements of a permit required
by NCGS 143-215.1. You have failed to respond to a request for additional information needed in order to
process the Stormwater Management Permit Application, and you have constructed the project without a permit
and without a stormwater treatment system.
If you have an explanation for this violation that you wish to present, please respond in writing to me
within ten (10) days following receipt of this Notice. Your explanation will be reviewed and if an enforcement
action is still deemed appropriate, your explanation will be forwarded to the Director with the enforcement
package for his consideration.

Pursuant to our telephone conversation on April 11, 2002, attached please find a
proposed payment schedule that should allow us to resolve the matter of the subject civil penalty
assessment. I hope you will find that the terms contained in the schedule are as we previously
discussed. Twenty-three of the scheduled payments are in the same amount; the final payment
will be ten cents higher than the others. If it becomes possible, it would be beneficial to both
parties if this penalty could be paid and the underlying matters resolved before the end of the

BETHEL WORD MINISTRIES, INC.
On November 21, 2000, Kerr T. Stevens, Director of the Division of Water Quality
assessed Bethel Word Ministries, Inc. a civil penalty of $4,220.26 in the matter of case WQ 00-
010, for violation of the 15A NCAC 2H .1003 (State Stormwater Rules). On March 14, 2001,
Mr. Fred D. Webb, Jr. requested remission of the penalty on behalf of Bethel Word Ministries,
Inc. The information submitted by Bethel Word Ministries, Inc. has been considered by both the
Director of the Division of Water Quality and the Environmental Management Commission's

THIS MATTER came before the Committee on Civil Penalty Remissions of the
Environmental Management Commission, pursuant to N.C.G.S. § 143-215.6A and § 14313-282.1,
on March 14, 2002 upon recommendation of the Director of the Division of Water Quality for
entry of a final decision on the assessment of civil penalties and investigation costs against
Bethel Word Ministries, Inc. in the amount of $4,220.46 ($4,000.00 plus $220.46 investigative
costs). Bethel Word Ministries, Inc.'s request for remission was presented to the Committee on
Civil Penalty Remissions for consideration. The Division of Water Quality was represented by
Mr. Rick Shiver, Regional Supervisor in the Wilmington Regional Office, and Bethel Word
Ministries, [tic. was represented by Mr. Fred D. Webb, Jr., Esq. of Sanford, N.C.
Having considered the record, argutnents of the parties, and the factors set forth in
N.C.G.S. §14313-282.1(b) and (c), the Committee on Civil Penalty Remissions finds the facts
contained in the Director's Findings and Decision and Assessment of Civil Penalties as stipulated
by Bethel Word Ministries, Inc., that the Findings of Fact support the Conclusions of Law, and
that the Director properly applied the criteria set forth in N.C.G.S. 514313-282.1 in determining
the amount of the civil penalties. The Committee further finds that there are no grounds shown
Pursuant to N.C.G.S. § 14313-282.1 for remission or reduction of' the penalties assessed by the

Director for violation of Commission regulation 15A N.C.A.C. 21-I.1003 by failing to obtain a
required stormwater management permit prior to developing and increasing the impervious
surface at its church site off'State Road 1410 in Onslow County, N.C.
Upon duly made motion and vote, the Committee finds that no grounds for remission
have been shown and the assessment of civil penalties and costs in the amount of $4.220.46
($4,000.00 civil penalty plus $220.46 investigation costs) should be upheld.
THEREFORE, IT IS ORDERED:
1. That the assessment of civil penalties and costs in the amount of $4,220.46 against
Bethel Word Ministries, Inc. is AFFIRMED.
2. That this Final Decision and Order be served upon Bethel Word Ministries, Inc.
and upon receipt hereof, the amount of $4,220.46 be paid to the Department of Environment and
Natural Resources within thirty days.

by NCGS 143-215.1. You have failed to respond to a request for additional information needed in order to
process the Stormwater Management Permit Application, and you have constructed the project without a permit

As per our phone conversation I am setting the chronology of events, as best as I can recall, of how this project evolved
and the circumstances that led to the water shed site implementation as it stands today.
Initial Site Plan was submitted to the Jacksonville Development and Planning Board on 5/3/98. The board reviewed this plan
and requested a resubmission with land watershed conditions. Resubmitted plan on 5/15/98 had contour details and ponds for
development of the property. On finther review of the one building and parking area against the total site of 11.11 Acreas, a
suggestion was trade that it looked as if less than 300/6 of the total land was to be used, and that we needed to have a Professional
draw up the details of this layout. Oceanside Engineering was contracted to draw up the site plans to meet NCDENR requirements
for the above conditions. A submission on 6/22/98 was made to NCDENR for approval. No problems were anticipated since it
looked as if all conditions for the Ma rule were meet by the site plan. Subsequent correspondece with NCDENR required
drawing enhancements and resubmission were made 7/16/98 & 8/I9198. At this point it was felt that approval for the site plan
water shed was OK. In August of'98 the Planning and inspection Depts gave us approval to start the project, which we did.
Site plan development was initiated as per the layout submitted on 8/19/98, not anticipating any problems. In early Nov. 498 we
were notified that the site plan needed more detail and was now being considered as a high density area When this information
was presented to Rev. Perry, a question arose in his mind, that if more acreage was required to be disturbed to meet this new
condition it night be more advisable to develop the full 11.11 acreas by showing his future expansion of a new Sanctuary.
Assumption was trade that the next building phase was going to be accomplished just after we had completed the Ist phase.
Oceanside Engineering was asked to submirt this revised plan 12/4/98 with a subsequent revision again on 3/4/99.
During all these site plan revision phases the project was being completed assuming that we had meet water shed site conditions on
what we were building,. Nearing the completion and occupancy of the premisses Rev. Perry ( 5/99 ) notified us that the Sanctuary
Project would have to be placed on hold until adequate financing could be obtained. So much time had passed and we had obtain
Occupancy Permits, and with no. continuation of this project we had our attention focused on other endevours. It was not untill
Rev. Perry notified us of your correspondence dated 3/13/2000 that we were made aware of this confusion about the site plan. Since
the Sanctuary is not presently being considered for construction, I have asked Oceanside Engineering to mail you the drawings and
calculation corresponding to the present site water shed conditions (8/19/98 submission). I hope the above information gives you a
better picture as to the events leading to the present day.

justification for such request.
A request for remission or mitigation is limited to consideration of the
reasonableness of the amount of the penalty and is not the proper procedure for
contesting the accuracy of any of the statements contained in the assessment letter.
Because a remission request forecloses the option of an administrative hearing,
such a request must be accompanied by a waiver of your right to an administrative
hearing and a stipulation that there are no factual or legal issues in dispute. You

FINDINGS AND DECISIONS
AND ASSESSMENT OF
CIVIL PENALTIES
Acting pursuant to delegation provided by the Secretary of the Department of
Environment and Natural Resources, I, Kerr T. Stevens, Director of the Division of Water
Quality (DWQ), make the following:
I. FINDINGS OF FACT
A. Beth'el Word Ministries, Inc. is a corporation organized and existing under the
laws of the State of North Carolina.
B. Beth'el Word Ministries, Inc. has developed a site located off NCSR 1410
(Halltown Road), near the intersection with NCSR 1406 (Piney Green Road) in
Jacksonville, Onslow County, North Carolina, as a church known as Beth'el
Word Ministries.
C. On July 24, 1998, DWQ sent a letter to Reverend Earnest Perry, registered agent
for Beth'el Word Ministries, Inc., via certified mail, advising Reverend Perry of
the requirement to apply for and obtain a Stormwater Management Permit for
development of the Beth'el Word Ministries site. The letter stated that any
construction on the site, performed prior to receipt of the permit would constitute
a violation of 15A NCAC 2H .1000.
D. On July 31, 1998, DWQ received a Stormwater Management Permit application
for the Beth'el Word Ministries site. Review of the application found it to'be
incomplete and noted that the plans indicated a cluster of high density
development on the property. On October 22, 1998, DWQ notified Beth'el Word
Ministries, Inc. of the requirement to design and install an engineered system to
serve the site.
E. On April 6, 1999, Beth'el Word Ministries, Inc. submitted a revised application
showing a wet detention pond. Additional information relative to the project was
requested by DWQ on June 11, 1999. No response to the request was received.

F. On March 13, 2000, DWQ sent a Notice of Recommendation of Enforcement
letter to Beth'el Word Ministries, Inc. via certified mail, regarding its failure to
secure a stormwater permit.
G. On April 26, 2000, DWQ staff inspected the Beth'el Word Ministries site,
observing the construction of buildings and parking areas. Such development
represents an increase in the amount of impervious surface or and/or a decrease in
the capacity for infiltration of precipitation into the soil at the site. At the time of
the inspection, the first phase of construction was complete and the facility was in
operation.
H. As of the date of this action, a Stormwater Management Permit has not been
issued by DWQ for development of the Beth'el Word Ministries site.
I. . The costs to the State of enforcement procedures in this matter totaled $220.46.
Based upon the above Findings of Fact, I make the following:
11. CONCLUSIONS OF LAW
A. Beth'el Word Ministries, Inc. is a "person" within the meaning of G.S. 143-
215.6A, pursuant to G.S. 143-212(4).
B. North Carolina Administrative Code Section 15A NCAC '2H .1003 requires
development activities within the State's coastal counties that require a CAMA
major development permit or a Sedimentation/Erosion Control Plan to obtain a
stormwater management permit.
C. Onslow County is a coastal county pursuant to 15A NCAC 2H .1002.
D. Beth'el Word Ministries, Inc. was required to obtain a stormwater management
permit for its development at the Beth'el Word Ministries site prior to the
construction of impervious surfaces pursuant to 15A NCAC 2H .1003.
E. Beth'el Word Ministries, Inc. violated 15A NCAC 2H .1003 by failing to obtain a
stormwater management permit prior to its development of the Beth'el Word
Ministries site.
F. 15A NCAC 2H .1003 is a rule of the Environmental Management Commission
implementing Chapter 143, Article 21, Part 1 of the North Carolina General
Statutes.

G. Beth'el Word Ministries, Inc. may be assessed civil penalties in this matter
pursuant to G.S. 143-215.6A(a)(6), which provides that a civil penalty of not
more than ten thousand dollars per violation may be assessed against a person
who violates a rule of the Commission implementing Chapter 143, Article 21,
Part 1 of the North Carolina General Statutes.
H. The State's enforcement costs in this matter may be assessed against Beth'el
Word Ministries, Inc. pursuant to G.S. 143-215.3(a)(9) and G.S. 143B-
282. 1 (b)(8).
I The Director of the Division of Water Quality, pursuant to delegation provided by
the Secretary of the Department of Environment and Natural Resources, has the
authority to assess civil penalties in this matter.
Based upon the above Findings of Fact and Conclusions of Law, I make the following:

Accordingly, Beth'el Word Ministries, Inc. is hereby assessed a civil penalty of:

Pursuant to G.S. 143-215.EA(c), in determining the amount of the penalty I have taken
into account the Findings of Fact and Conclusions of Law and the factors set forth at
G.S. 143B-282.1(b), which are:
(1) The degree and extent of harm to the natural resources of the State, to the public health,
or to private property resulting from the violation;
(2) The duration and gravity of the violation;
(3) The effect on ground or surface water quantity or quality or on air quality;
(4) The cost of rectifying the damage;
(5) The amount of money saved by noncompliance;
(6) Whether the violation was committed willfully or intentionally;
(7) The prior record of the violator in cbmplying or failing to comply with programs over
which the Environmental Management Commission has regulatory authority; and
(8) The cost to the State of the enforcement procedures.

does hereby waive the right to an administrative hearing in the above -stated matter and
does stipulate that the facts are as alleged in the assessment document. The undersigned
further understands that all evidence presented in support of remission of this civil
penalty must be submitted to the Director of the Division of Water Quality within 30
days of receipt of the notice of assessment. No new evidence in support of a
remission request will be allowed after 30 days from the receipt of the notice of
assessment.

Dear Ms Sullins:
In response to the Notice of a civil penalty assessed against Bethel Word Ministries I
submit a request for its remission on the ground that the violation was inadvertent or
a result of an accident and hereby enclose the waiver and stipulation form
1. On or about April 6, 1998, Bethel Wore! Ministries Inc. entered into a contract
with a Contractor, Edwin H. Holt General Contractors Inc. for the construction of its
Church. This was the first time ever that the Church had been involved in a
construction project and the Pastor, Superintendent E. A. Perry, had no knowledge
or experience in Church construction.
2 Accordingly the Church relied on the Contractor to apply for all the permits
necessary to enable it to perform the work for which it had been engaged. In addition
the Church advanced to it monies to pay for the storm water permit.
3. The Contractor retained the services of Mr. Joseph F. Dunnehoo to prepare
the storm water plan before the violation was issued. Mr. Dunnehoo apparently had
problems- with the Contractor and was not able to complete the application for the
storm water permit without the knowledge of Superintendent Perry. (See Exhibit1).
4. The Notice from NCDEHR dated June 25, 1998 to the effect that no permit had
yet been issued was not sent to the Church but to Mr. Edwin Holt. (See Exhibit 2)
Consequently, the Church was unaware that there had been a violation of 15A
NCAC 21-1.1003
5. On July 26, 1998, the Church received a notice dated July 24, 1998 to apply for
storm water permit for the Church Site. The Church Superintendent passed this on
to Mr. Holt. Holt advised him thathe would take care of k At Holt's request the

Church paid Holt to apply for and obtain the storm water permit. In fact the storm
water management permit application was received by NCDENR on July 31, 1998
6. During the construction process, Holt informed the Superintendent that the
plans had been submitted and that everything was in order. The Church never
received notice of any discrepancies as all the notices from NCDEHR went direct to
Holt Construction
7. The Church first became aware that Hoft had not acquired the necessary
permit when they received DWQ's Notice of Recommendation of Enforcement dated
March 13, 2000.
8. Immediately after the receipt of this Notice the Superintendent promptly took
steps to abate the violation by contacting Joseph F. Dunnehoo of Oceanside
Engineering and Surveying to do another plan and submit it to NCDENR, which he
did. They paid to him $2000 more for this work which should have been done by
Holt. It was then that the Church determined that there had been a problem between
the Contractor and the Engineer.
9. Mr. Dunnehoo obtained approval of the plan and a permit No. SW8 980710
was issued on November 7, 2000 (Exhibit 2). The Church is currently scheduling the
work to be done in accordance with the approved plan.
10. The Church has limited finances and had to obtain a loan from First Citizens
Bank to enable it to carry out the Church construction. It has never been assessed
civil penalties for any violations and the payment of this amount will seriously affect
its ability to carry out the rest of the construction work.
In view of all of the above, we would respectfully ask that the Penalty assessed
against the Church be remitted.

In re nse to our letter dated Feb 15, 2001 and enclosure, I here

I . That this Church is the�first we have ever constructed and we had no knowledge' a

experience in Church or building construction.
2. Accordingly, we hired Mr. Edwin Holt, a licensed General contractor of Holt. Construction, to
constructthe'Church building and relied on him to apply for all the permits necessary to
enable him to perform the work for which he had been engaged In addition we advanced
him monies to pay for the storm water permit.
3. I never received a copy of the notice dated June 25, 1998 from NCDEHR to Mr.- Edwin Holt
that no permit had yet been issued. Consequently, 1 was unaware that there had been a
violation of 15A NCAC 2H.1003
4. On July 26, 1998,.we received a notice to apply for storm water permit for the Church Site.
(Exhibit 1). This was passed on to Mr. Holt and he advised = that he would take care of it.
At his request we paid Holt - S ; . to apply for and obtain the storm water permit.

I attempted to get your pla m approved by NCDENR, but was held back by the contractor.
Each time I told him what had to be done, he told me he could not do that for various reasons.
After a while I told him I was through with the project and that he could do it himself or get
someone else to complete the job. After the State wrote a letter of violation, I received a call
from you stating that you wanted me to finish the project. Approximately two and one-half
months laur I had final approved plans., I then send you a letter stating what you should do
because of all the problems you had in the past (Sec attached letter).,
I hope that this will help you in exploiting to the State what happened. If I can be of

Request for Remission of Civil Penalty by
the Town of Princeton (LV 01-228)
Johnston County
On July 3, 2001, in accordance with
authority provided by the Secretary of the
Department of Environment and Natural
Resources and the Director of the Division
of Water Quality, the Raleigh Region
Water Quality Supervisor assessed a civil
penalty of $4,366.00, including $41.00 for
investigative costs, against the Town of
Princeton for violations of NPDES Permit
NCO026662 and G.S. 143-2 15.1 (a)(6).
On August 28, 2001, the Town of
Princeton requested remission and waived
its right to an administrative hearing and
stipulated that the facts were as alleged in
the assessment document.
The Division of Water Quality opposes
any remission or mitigation of the penalty.
The recommendation is made for the
following reason:
1. On December 4, 2001, the Director
considered information submitted in
support of the Town of Princeton's
request for remission of civil penalty in
accordance with G.S. 143-215.6A(f) and
delegation provided by the Secretary of the
Department of Environment and Natural
Resources and modified the initial civil
penalty assessment of $4,366.00 to the
amount of $4,291.00. The Town of
Princeton Was informed that if the case
were brought before the Environmental
Management Commission, the Division
staff would argue against any reduction of
the assessment.

FINDINGS AND DECISIONS
AND ASSESSMENT OF
CIVIL PENALTIES
Acting pursuant to delegation provided by the Secretary of the Department of
Environment and Natural Resources, I, Kerr T. Stevens, Director of the Division of Water
Quality (DWQ), make the following:
1. FINDINGS OF FACT
A. Beth'el Word Ministries, Inc. is a corporation organized and existing under the
laws of the State of North Carolina.
B. Beth'el Word Ministries, Inc. has developed a site located off NCSR 1410
(Halltown Road), near the intersection with NCSR 1406 (Piney Green Road) in
Jacksonville, Onslow County, North Carolina, as a church known as Beth'el
Word Ministries.
C. On July 24, 1998, DWQ sent a letter to Reverend Earnest Perry, registered agent
for Beth'el Word Ministries, Inc., via certified mail, advising Reverend Perry of
the requirement to apply for and obtain a Stormwater Management Permit for
development of the Beth'el Word Ministries site. The letter stated that any
construction on the site, performed prior to receipt of the permit would constitute
a violation of 15A NCAC 2H .1000.
D. On July 31, 1998, DWQ received a Stormwater Management Permit application
for the Beth'el Word Ministries site. Review of the application found it to be
incomplete and noted that the plans indicated a cluster of high density
development on the property. On October 22, 1998, DWQ notified Beth'el Word
Ministries, Inc. of the requirement to design and install an engineered system to
serve the site.
E. On April 6, 1999, Beth'el Word Ministries, Inc. submitted a revised application
showing a wet detention pond. Additional information relative to the project was
requested by DWQ on June 11, 1999. No response to the request was received.

F. On March 13, 2000, DWQ sent a Notice of Recommendation of Enforcement
letter to Beth'el Word Ministries, Inc. via certified mail, regarding its failure to
secure a stormwater permit.
G. On April 26, 2000, DWQ staff inspected the Beth'el Word Ministries site,
observing the construction of buildings and parking areas. Such development
represents an increase in the amount of impervious surface or and/or a decrease in
the capacity for infiltration of precipitation into the soil at the site. At the time of
the inspection, the first phase of construction was complete and the facility was in
operation.
H. As of the date of this action, a Stormwater Management Permit has not been
issued by DWQ for development of the Beth'el Word Ministries site.
I. The costs to the State of enforcement procedures in this matter totaled $220.46.
Based upon the above Findings of Fact, I make the following:
II. CONCLUSIONS OF LAW
A. Beth'el Word Ministries, Inc. is a "person" within the meaning of G.S. 143-
215.6A, pursuant to G.S. 143-212(4).
B. North Carolina Administrative Code Section 15A NCAC 2H .1003 requires
development activities within the State's coastal counties that require a CAMA
major development permit or a Sedimentation/Erosion Control Plan to obtain a
stormwater management permit.
C. ' Onslow County is a coastal county pursuant to 15A NCAC 2H .1002.
D. Beth'el Word Ministries, Inc. was required to obtain a stormwater management
permit for its development at the Bethel Word Ministries site prior to the
construction of impervious surfaces pursuant to 15A NCAC 2H .1003.
E. Beth'el Word Ministries, Inc. violated 15A NCAC 2H .1003 by failing to obtain a
stormwater management permit prior to its development of the Beth'el Word
Ministries site.
F. 15A NCAC 2H. 1003 is a rule of the Environmental Management Commission
implementing Chapter 143, Article 21, Part 1 of the North Carolina General
Statutes.

G. Beth'el Word Ministries, Inc. may be assessed civil penalties in this matter
pursuant to G.S. 143-215.6A(a)(6), which provides that a civil penalty of not
more than ten thousand dollars per violation may be assessed against a person

FINDINGS OF FACT:
A. BE1'I- EL WORD MINISTRIES, INC., is an active non-profit Corporation organized and existing
under the laws of the State of North Carolina.
B. REVEREND EARNEST PERRY, REGISTERED AGENT is developing a site located offNCSR
1410 (Halltown Road) near the intersection with NCSR 1406 (Piney Green Road) in .lacksonville,
ONSLOW County, North Carolina., as a new church site known as Bethel Word Ministries.
C. On July24,1998,theDWQ requested that REVERENDEARNESTPERRY,REGISTERI DAGENT
submit a Stormwater Management Permit application for Bethel Word Ministries via certified mail.
D. On .luly 31, 1998, the Division received an incomplete application for Bethel Word Ministries. It was
determined that there was a pocket of high density being created due to the clustering; of built -upon
area. On October 22, 1998, the Division required that an engineered system be designed.
E. On April 6, 1999, a submittal was made showing a wet detention pond. Additional information was
requested on June 11, 1999. No response was received.
F. On March 13, 2000, the Division sent a Notice of' Recommendation to Enforce via certified mail.
G. On April 26, 2000, DWQ staff inspected the site and observed the construction of building and
parking.
1-1. The Bethel Word Ministries contains building; and parking which will result in an increase in the
amount of impervious surface at this site or otherwise decrease the infiltration of precipitation into
the soil.

'11e Wilmington Regional Office received a revised Stormwater Mana{cement Permit Application
for Bethel Word Ministries on April 26, 2000. A preliminary review of that information has determined
that the application is not complete. The following information is needed to continue the stormwater
review:
1. The revised application form submitted is unreadable and is outdated. Please submit a clear,
readable, current permit application and appropriate supplement.
2. Please provide 2 sets of complete plans. The plans submitted are incomplete sets, and are
ambiguous. One set shows a detention pond, and the other does not.'
3. As stated in my letter of October 22, 1998, this site is clustering impervious area, i.e.,
creating a pocket of hid-h density, and does not utilize the remaining site area for treatment of
the runoff. It will not be possible to meet the low density requirements in this case, even
though the built -upon area is below 30%. The low density option involves more than just
meeting a magic number. Please submit a complete application for an engineered system to
treat the runoff. The system can be designed to accommodate any amount of future
impervious area that you wish.
4. Please be advised that even though.you may have received permission from the Planning
Department to proceed with construction and gotten building permits and CO's, it remains
your responsibility to obtain all the required permits prior to construction. Even though your
site is built, revisions are needed to bring this site into compliance. The Building Permit
should not have been issued, and 1 will take that matter up with the appropriate personnel.

Permit Application for Bethel Word Ministries on April 6, 1999. A preliminary review of that information has
determined that the application is not complete. The following information is needed to continue the stormwater
review:
Please provide a completed and signed wet pond supplement form, revision 3.99, enclosed,
2. Please delineate the 10.82 acre drainage area.
3. Please label the outlet structure location within the pond area on the plans.
4. For clarity, please relabel the sediment basin detail as the "Detention Pond" detail.
5. For clarity, please relabel the pipe area detail as the "Outlet Structure" detail.
6. The pond detail indicates that a 118" orifice is to be drilled in a 3" cap. The enlarged view of the outlet
structure indicates a 1-11/32" orifice. Please correct.
7. Please provide the elevations of the permanent pool, temporary pool, and orifice inverts on the outlet
structure detail. Currently, the detail shows the orifice invert into the structure below permanent pool.
Please revise to show that the orifice invert into the structure is at the permanent pool.
8. FYI- The side slopes of the pond above the permanent pool can be 3:1. Only the vegetated shelf needs
to be 6:1. This may save space -see next two comments.
9. The SA/DA ratio for a 5' deep pond at 50% impervious, using the 85 % TSS chart is 2.7 %, not 1.5 %
as shown in the calculations. If the pond were 7' deep, the 1.5% could be used. Please revise. As a
result, the surface area provided is deficient.
10. Please label the elevation of the top of the forebay wall and the weir elevation on the detail. Please
keep the top of the weir anywhere between 12" below PP up to the storage elevation. Without a top
elevation to reference, the 1' drop to the weir elevation doesn't mean anything.

1 1. Since the 85 % TSS chart has been used, a vegetated filter must be provided, however, one is not
shown on the plans. Please add the location, pertinent elevations, grading, and details to [lie plans.
Please provide calcuations demonstrating that the width is sufficient to provide a non -erosive velocity
for the 10 year storm. Please remember that the vegetated filter is not a continously wet connector
ditch from the pond to the receiving waters. It is a normally dry, flat, gently sloped grassed area that
is at least 30' long. If all adequate filter cannot be designed, please use the 90% TSS chart, and by
regrading the pond slopes to 3:1, (except in the area of the shelf) to gain the needed surface area, the
vegetated filter can be elininnated.
12. The forebay volume is based on 20 % of the total storage volume from the bottom of the pond to the
permanent pool, called the "Permanent Pool Volume" on the supplement. Please revise the calculation
to achieve as close to the required 20% as possible, without going over or under it excessively,
Currently, the forebay volume is about 32% of the storage volume.
13. The orifice size is based on the required I" volume only. This is different than in the past. Please
revise.
14. Please add sidewalk widths and the overall parking lot dimensions.
15. Please provide proposed grading in the parking lot. The elevations shown are noted as existing.
16. Please specify a 3:1 or flatter slope on the collection ditch detail.
17. The invert of the l 8" arched pipe is higher than the inverts of both incoming ditches. Please lower the
pipe invert or raise the ditch centerline elevations.
18. FYI- The vegetated shelf is required to be located under the permanent pool. In this case, since all
the slopes are 6:1, this shelf is OK, but if the design is revised to use a 3A slope, please remember
to locate the 6:1 shelf under the permanent pool.
Please note that this request for additional information is in response to a preliminary review. The requested
information should be received by this Office prior to July 11, 1999, or the application will be returned as incomplete.
The return of a project will necessitate resubmittal of all required items, including the application fee. The Division
is allowed 90 days fronn (lie receipt of a completed application to issue the permit.
The construction of any impervious surfaces associated with this project prior to receipt of the stormwater
permit is considered a violation of NCGS 143-215.1, and is subject to enforcement action.

Narrative description of stormwater management for Bethel Word Ministries Inc. project:
Grading limits will be adhered to, no &,lading will be done outside flagged area.
Total area to be disturbed is 3.3 acres. Sedimentation basin will be installed prior to any grading
being performed. Once sedimentation basin is constructed, silt fencing will be placed around area
to be graded. Graded area will be cross sloped, as indicated by circled elevations.
Graded top soil will be placed on site as designated on plan. Silt fence will be placed on low
side of spoil area. A sweal will be installed from weir of sediment basin to roadside ditch.
The sweal will be soded and be a min. of 50 feet long. As sweal enters existing roadside ditch
a RIP RAP apron will be placed at end of sweal and up the opposite ditch bank as per plan.

The Wilmington Regional Office received a Stormwater Management Permit Application for Beth'el
Word Ministries on July 31, 1998. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater review:
1. The project is clustering the impervious areas and does not utilize the remainder of site to
filter the runoff. This constitutes a pocket of high density. Please design an engineered system
to treat the runoff from all impervious areas on the project. Please submit 2 sets of revised
plans with details, updated application with correct supplement, sealed design calculations,
and an additional $160.00 application fee.
2. Because there is no distinction made, the lines for the pavement and building are merging with
the dimension lines. It is very difficult to tell what is impervious and what isn't. Please use
different line weights, highlight, shade, or somehow make the proposed impervious areas
stand out.
3. Locate the proposed engineered system in a recorded access/drainage easement to the nearest
right-of-way.
4. The proposed grading information is very sketchy. Please add spot elevations in the corners
of the parking area, and on the sidewalk around the building,

As per our phone conversation I am setting the chronology of events, as best as I can retail, of how this project evolved
and the circumstances that led to the water shed site implementation as it stands today.
Initial Site Plan was submitted to the Jacksonville Development and Planning Board on 5/3/98. The board reviewed this plan
and requested a resubmission with land water shed conditions. Resubmitted plan on 5/15/98 had contour details and ponds for
development of the property. On further review of the one building and parking area against the total site of 11.11 Acreas, a
suggestion was made that it looked as if less than 30% of the total land was to be used, and that we needed to have a Professional
draw up the details of this layout. Oceanside Engineering was contracted to draw up the site plans to meet NCDENR requirements
for the above conditions. A submission on 6/22/98 was made to NCDENR for approval. No problems were anticipated since it
looked as if all conditions for the 304/6 rule were meet by the site plan. Subsequent correspondece with NCDENR required
drawing enhancements and resubmissions were made 7/16/98 & 8/19/98. At this point it was felt that approval for the site plan
water shed was OK. In August of'98 the Planning and Inspection Depts gave us approval to start the project, which we did.
Site plan development was initiated as per the layout submitted on 8/19/98, not anticipating any problems. In early Nov. `98 we
were notified that the site plan needed more detail and was now being considered as a high density area. When this information
was presented to Rev. Perry, a question arose in his mind, that if more acreage was required to be disturbed to meet this new
condition it might be more advisable to develop the full 11.11 acreas by showing his future expansion of a new Sanctuary.
Assumption was made that the next building phase was going to be accomplished just after we had completed the I st phase.
Oceanside Engineering was asked to submitt this revised plan 1214/98 with a subsequent revision again on 3/4/99.
During all these site plan revision phases the project was being completed assuming that we had meet water shed site conditions on
what we were building,. Nearing the completion and occupancy of the premisses Rev. Perry ( 5/99 ) notified us that the Sanctuary
Project would have to be placed on hold until adequate financing could be obtained. So much time had passed and we had obtain
Occupancy Permits, and with no continuation of this project we had our attention focused on other endevours. It was not until]
Rev. Perry notified us of your correspondence dated 3/13/2000 that we were made aware of this confusion about the site plan. Since
the Sanctuary is not presently being considered for construction, I have asked Oceanside Engineering to mail you the drawings and
calculation corresponding to the present site water shed conditions (8/19/98 submission). I hope the above information gives you a
better picture as to the events leading to the present day.

On July 13, 1998, the Wilmington Regional Office received a copy of the Notice of Receipt of a Sedimentation
Erosion Control Plan for Beth'el Word Ministries. The North Carolina Administrative Code requires any project that
must receive either a Sedimentation and Erosion Control Plan permit and/or a CAMA major permit to apply for and
receive a Stormwater Management Permit by the Division of Water Quality. Any construction on the subject site, prior
to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate
enforcement action by this Office.
Either a Stormwater Permit Application Package including 2 sets of plans, completed application form, fee,
and supporting documentation, or a written response regarding the status of this project and the expected submittal
date must be received in this Office no later than August 24, 1998. Failure to respond to this request may result in the
initiation of enforcement action, and construction may experience a subsequent delay. Please reference the Project

As per our phone conversation,[ am setting the chronology of events, as best as I can recall, of how this project evolved
and the circumstances that led to the water shed site implementation as it stands today.
Initial Site Plan was submitted to the Jacksonville Development and Planning Board on 5/3/98, The board reviewed this plan
and requested a resubmission with land water shed conditions. Resubmitted plan on 5/ 15198 had contour details and ponds for
development of the property. On fiuther review of the one building and parking area against the total site of 11.11 Acreas, a
suggestion was made that it looked as if less than 301/6 of the total land was to be used, and that we needed to have a Professional
draw up the details of this layout. Oceanside Engineering was contracted to draw up the site plans to meet NCDENR requirements
for the above conditions. A submission on 6/22/99 was made to NCDENR for approval. No problems were anticipated since it
looked as if all conditions for the 301/6 rule were meet by the site plan, Subsequent correspondece with NCDENR required
drawing enhancements and resubmissions were made 7/16/98 & 8/19/98, At this point it was felt that approval for the site plan
water shed was OK. In August of'98 the Planning and Inspection Depts gave us approval to start the project, which we did.
Site plan development was initiated as per the layout submitted on 8/19/98, not anticipating any problems. In early Nov. '98 we
were notified that the site plan needed more detail and was now being considered as a high density area. When this information
was presented to Rev. Perry, a question arose in his mind, that if more acreage was required to be disturbed to meet this new
condition it might be more advisable to develop the full 11.11 acreas by showing his future expansion of a new Sanctuary.
Assumption was made that the next building phase was going to be accomplished just after we had completed the I st phase.
Oceanside Engineering was asked to submitt this revised plan 1214/98 with a subsequent revision again on 3/4/99.
During all these site plan revision phases the project was being completed assuming that we had meet water shed site conditions on
what we were building,. Nesting the completion and occupancy of the premisses Rev. Perry ( 5I99 ) notified us that the Sanctuary
Project would have to be placed on hold until adequate financing could be obtained. So much time had passed and we had obtain
Occupancy Permits, and with no continuation of this project we had our attention focused on other endevours. It was not untill
Rev. Perry notified us of your correspondence dated 3/13/2000 that we were made aware of this confusion about the site plan. Since
the Sanctuary is not presently being considered for construction, 1 have asked Oceanside Engineering to mail you the drawings and

III. SCHFDUL E OF COMPLIANCE
The stormwater management system shall be constructed in it's entirety, vcgctaWd and operational for its
intended use prior to the construction of any bulls -upon surface.
1 DuHng construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum el'liciency. Ile approved Operation and Maintenance flan must
be lirllowcd in its entirely and maintenance must occur at Be scheduled intervals includinl—. but not limited
to: ,
a. Semiannual scheduled inspections (every 6 months).
b- Sediment removal.

the facilities are constructed in accordance with the conditions of this permi, the approved plans and

7. Upon completion ofconstruction, prior to issuance of a Certi Ikale of Occupancy, and prior to operation of
this permitted facility, a certification must be received from an appropriate designer f of the system installed
certifying that the permitted facility has been installed in accordance with this permit, the approved plans
and specifications, and other supporting documentation. Any deviations from Be approval plans and
specilications must be noted on the Certification.

to operation as a stormwater trealmms device, and prior to occupancy of the vilify.
9. A modi I ication must be permitted prior to any construction. The Billowing items will rcquirc a 1110di f ication

Fail= to abide by the conditions and limitations contained in this permit may subject the Permitter to
enAvement action by the Division of Water Quality, in accordance with North Carolina General Statute
14301 K6A to 143015AC.
The issuance ofthis permit does not preclude the Pemilitee Rom complying with any and rill slatutrs, rules,
regerlations, or ordinances which may be imposed by other government regencies (local, state, and federal)
which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
the Permittee shall tale immediate corrcctivc action, including WC as May be required by this Division,
such as the construction of additional or replacement stormwater managcmen! systems.

Narrative description of stormwater management for Bethel Word Ministries Inc. project:
Grading limits will be adhered to, no grading will be done outside flagged area.
Total area to be disturbed is 3.3 acres. Sedimentation basin will be installed prior to any grading
being performed. Once sedimentation basin is constructed, silt fencing will be placed around area
to be graded. Graded area will be cross sloped, as indicated by circled elevations.
Graded top soil will be placed on site as designated on plan. Silt fence will be placed on low
side of spoil area. A sweal will be installed from weir of sediment basin to roadside ditch.
The sweal will be soded and be a min. of 50 feet long. As sweat enters existing roadside ditch
a RIP RAP apron will be placed at end of sweal and up the opposite ditch bank as per plan.

Dear Mr. Perry:
On July 13, 1998, the Wilmington Regional Office received a copy of the Notice of Receipt of Erosion
& Sedimentation Control Plan for Beth'el Word Ministries, Inc.. The North Carolina Administrative Code
requires any project that must receive either a Sedimentation and Erosion Control Plan permit and/or a CAMA
major permit to apply for and receive a Stormwater Management Permit by the Division of Water Quality.
Any construction on the subject site, prior to receipt of the required permit, will constitute a violation of 15A
NCAC 2H.1000 and may result in appropriate enforcement action by this Office.
Either a Stormwater Permit Application Package including 2 sets of plans, completed application
form, fee, and supporting documentation, or a written response regarding the status of this project and the
expected submittal date must be received in this Office no later than August 14, 1998. Failure to respond to
this request may result in the initiation of enforcement action, and construction may experience a subsequent
delay. Please reference the Project Number above on all cormspondeme. If you have any questions, please
