On September 23, 2011, David Cox of the Wilmington Regional Office of the Division of
Water Quality (DWQ) inspected Alleigh's Restaurant in New Hanover County to
determine compliance with Stormwater Management Permit Number SW8 980124
issued on May 6, 1998. DWQ file review and site inspection revealed that the site is not
in compliance with the terms and conditions of this permit. Please find a copy of the
completed form entitled "Compliance Inspection Report" attached to this letter, which
summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be
resolved:
1. Repair the forebay berm.
2. Install a trash rack and unclog the orifice of the outlet structure
3. Remove the trash from the pond and trim up the vegetation on the side slopes of
the pond.
Please inform this Office in writing before March 2, 2012, of the specific actions that will
be undertaken and the time frame that will be required to correct the deficiencies.
Failure to provide the requested information, or to respond to this letter by the due date,
may initiate enforcement action including the assessment of civil penalties of up to
$25,000 per day. If a written plan of action is not submitted to this office by March 2,
2012 then DWQ staff will re-inspect.the site and issue a Notice of Violation if the listed
deficiencies have not been addressed.

Please find attached a copy of the completed form entitled "Stormwater Compliance Inspection
Report". The report summarizes the findings of a recent inspection of the project's stormwater
controls conducted on August 6, 2008 to determine compliance with Stormwater Permit
Number SW8 980124 issued on May 6,1998.
Photos taken during the inspection are located in Section 4 of this report and a summary of the
required actions is noted under Section 5 of the report. Please inform this Office in writing
before October 3, 2008, of the specific actions that will be undertaken and the time frame
required to correct the deficiencies. Failure to provide the requested information, when
required, may initiate enforcement action. If you have any questions please contact me at the

There appears to be excess sediment
present in the forebay.
Remove muskrat from property to
prevent further damage to the pond side
slopes.
Three fountains are located within the
main pond area. Owner informed
inspectors that the fountains are likely '/z
HP each. At the time of the inspection,
only the 2 fountains closest to the
forebay were working.
Retaining wall was not installed along
the inlet side of the forebay

Several small wax myrtle trees were
observed growing on the pond side
slopes and vegetated shelf.
Additional decking installed in excess of
permit.
The trash rack for the pond outlet was
missing at the time of inspection.

PVC pipes appear to have been
installed to drain the patio area directly
into the main pond. Additionally, it
appears that the main roof drain from
the building drains directly into the main
pond. These inlets allow stormwater
runoff to bypass the forebay and short
circuit the pond.
The orifice was clogged/plugged with
debris at the time of the inspection.
Owner unclogged orifice during the
inspection.
5. Required Actions- (Explain each deficiency and what needs to be done to bring
the system back into compliance)
a. Remove trash and debris from the pond and outlet structure.
b. Remove invasive shrubs and trees from pond side slopes and vegetated
shelf.
c. Several holes and areas of slight erosion were noted on the pond side slopes
due to muskrat activities. Repair these areas as required in your permit.
d. There appeared to be an accumulation of sediment in the forebay. The
forebay and pond bottom levels should be checked and sediment should be
removed, if required, according to your permit.
e. The forebay berm appears to have been partially blown out and should be
repaired and returned to design specifications.

Section 11.4 of the stormwater permit issued May 6, 2008 prohibits the use of
decorative spray fountains in the pond. If the fountains are desired to remain
in the pond, the permit must be modified and the fountains located in
permitted stormwater pond must meet the provided fountain guidance.
Ponds with a permanent pool volume of less than 30,000 cubic feet are not
permitted to have fountains. Please submit documentation that the pond
fountains have been sized per the attached guidance.
g. Replace the missing outlet structure trash rack.
h. The retaining wall on the west side of the forebay was not constructed as
approved. Please submit a revision to the approved plans.
Additional inlets that were identified during the inspection were not included
with the approved plan. Please submit a revision or build per the approved
plans.
Please continue to perform the required maintenance as instructed in the
Operations and Maintenance Agreement.
k. The business name has changed since the issuance of the permit. Please
submit'a name/ownership change form to update the facility name listed on
the permit.
I. The stormwater permit expired on May 6, 2008 and no request for renewal
has been received to date.
