In response to the-letter.we received from you dated 10/13/03 and from.
our phone .
conversation on 10/23/03,1 have itemized below the status of.each required action that is'.
. required to correct our.deficiencies. -
a. Replace weeping love grass with approved seeding mixture: I have requested
from Mr. Jon Vincent's office a copy of the seeding mixture that was
submitted and approved by your office. Upon receipt'of this" information, we
will begin -the steps to replace the pond with.the correct permanent vegetation.
I will be in touch with you as soon as -we have begun re -seeding and can give
you.an exact time'for completion. At this point,,LI.would say it will take
approximately'until the end of this•year to complete this process.
b. Development plans for Lot 4 will be submitted under -separate cover. They
will be 'sent to you by 11-26-03.
c. I will.be in touch with Mr: Peter Dugan to make sure he has -applied for his
offsite permit'on Lot 1. 1 will follow up with you -as to the status of,
this by
a 11-26-03.
d. Currently.Lot 3 is still owned by Mr. Palmer and no plans.are presently
underway to either develop or sell'. If either transaction is to take place, I will
inform. you' and submit any appropriate development plans. .

NOTICE OF INSPECTION AND NON-COMPLIANCE

Dear Mr. Vincent:
Please find attached a copy of the completed form entitled "Stormwater Compliance
Inspection Report". The report summarizes the findings bf a recent inspection of the
project's stormwater controls conducted on October 10, 2003 to determine compliance
with Stormwater Permit Number SW8 971218 issued on May 7, 1998, A request to
transfer the permit from Gulfstream Shopping Center Properties, LLC to the Myrtle
Grove Business Park POA was received on September 29, 2003.
A summary of the findings and comments are noted under Section 4 of the report.
Please inform this Office in writing before November 13, 2003, of the specific actions
that will be undertaken and the time frame required to correct the deficiencies. Failure to
provide the requested information, when required, may initiate enforcement action. If
you have any questions please contact me at the Wilmington Regional Office, telephone

Directions to site, address: On the west side of US 421 in Monkey Junction, just
south of the stoplight at the service road near the fire station and Kohl's Custard.
The access road is adjacent the Goodwill store
Inspection Date:. October 10, 2003
Weather Conditions: Cool & rainy. Recent flooding.
Compliance Issues:

❑ ® All the built -upon area associated with the project is graded such that the
runoff drains to the system.
®❑ The inlets and outlet structure are located per the approved plans and do
not cause short-circuiting.
®❑ A trash rack is provided over the outlet weir and orifice.
❑ ® All slopes are grassed with permanent vegetation and are not eroding.
®❑ Vegetated slopes are no steeper than 3:1.
®❑ The approximate amount of permitted surface area has been provided.
(Must be verified via as -built survey or designer's certification.)
®❑ All required parts of the system are provided, such as a vegetated shelf,
and a forebay.
®❑ The designer's certification has been submitted.
®❑ The required deed restrictions are correctly recorded and submitted.
®❑ The number of lots or outparcels is per the permitted amount.
®❑ The built -upon area on the lots or outparcels does not appear to exceed
the maximum amount (must be verified via as -built survey if in question)
®❑ The road, cul-de-sac, parking lot and sidewalk widths are per the
approved plan.

Required Actions: (Each deficiency is explained below, and the required actions
necessary to bring the system back into compliance)
a. Weeping Love grass is not a suitable permanent grass cover in North
Carolina. Additionally, the seeding mixture approved for this pond was
Bahiagrass, Lespedeza, Bermudagrass, German millet and Tall Fescue.
Please remove the Love grass and replace with the approved seeding
mixture.

b. Development plans for Lot 4, owned by Curtis Palmer, were not submitted
for approval as a plan revision prior to construction. Please submit a copy
of the development plans for the permit file.
C. The development on Lot 1 was approved under the 971218 wet detention
permit. Since Lot 1 is now owned by Peter and Cynthia Dugan, they will
need an offsite permit. This is a similar situation as occurred at Landfall
Executive Park. I will forward the necessary paperwork to Mr. and Mrs.
Dugan along with.a copy of this report.
d. If Lot 3 is sold, the owner must submit an offsite permit application prior to
construction. If Mr. Palmer retains ownership, then only two sets of
development plans must be submitted as a revision to the approved plans.

Monthly, or after every runoff producing rainfall event, whichever comes first:
A Inspect trash rack; remove accumulated debris, repair/replace if it is not functioninv.
B. Inspect and clear the orifice of any obstructions. If a pump is used as the drawdown
mechanism, pimp operation will be checked. A log of test runs of the pump will be kept
on site and made available to DENI personnel upon request.
C. Inspect the pond side slopes and grassed inlet swales; remove trash, and repair eroded
areas before the next rainfall event.
D. If the pond is operated with a vegetated filter_ the filter will be checked for sediment
accumulation, trash accumulation, erosion and proper operation of the flow spreader
mechanism. Repairs/cleaning will be done as necessary.
11. Quarterly:
A. Inspect the collection system (i.e. catch basins; piping, grassed swales) for proper
functioning. Accumulated trash will be cleared from basin grates, basin bottoms, and
piping will be checked for obstructions and cleared as required.
B. Pond inlet pipes will be checked for undercutting, riprap or other energy dissipation
structures will be replaced; and broken pipes will be repaired.
III. Semi-annually:
A. Accumulated sediment from the bottom of the outler structure will be removed.
C

1V. General:
A. Mowing. of the side slopes will be accomplished according. to the season. Maximum grass
height will be 6".
B. Cattails are encouraged along -the pond -perimeter, however. they will be removed. when
they cover more than '/a the surface area of the pond.
C. The orifice/pump is designed to draw down the pond in 2-5 days- if drawdown is not
accomplished in that time, the system will be checked for clogging. The source of the
clogging will. be found and eliminated:
D. All components of the detention pond system will be kept in good working order. Repair
or replacement components will meet the original -design- specifications as -per the approved
stormwater plan.
V. Special. Requirement:
