Effective August I, 2013 the State Stormwater program was transferred from the Division of Water
Quality (D%VQ) to the Division of Energy, Mineral and Land Resources (DENII,R). All previous
references to DWQ will remain in older stormwater pennits issued prior to August 1, 2013 until they are
modified, transferred, or renewed. Please note that this letter references DE.NI LIZ as the Division
responsible for issuance of the permit.
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development
approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The
law extended the effective period of any stormwater permit that was set to expire during this time frame
to tliree. (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law
2010-177 which granted an extra year for a total of four (4) years extension.
Accordingly, the four Stormwater Permits listed below which were issued io Ocean Ridge Farms, Inc., all
received the 4-year extension, but they have been allowed to expire and must now be renewed. Please
note that the corporation was notified of all of these permit extensions and of the need to renew the
permits; however, the corporation was not active at that time, and has only recently been reactivated with
the NCSOS.

Stormwater Management Permit under Title 15A North Carolina administrative Code 21-1 .1003 and
North Carolina Genera] Statute 143-214.7 until .you submit the required Permit Transfer Application
Fortrt to the Division and receive approval from the Division to transfer- these permits. This includes
providing the necessary operation and maintenance of the permitted stormwater runoff collection system
that coneys runoff to the permitted Storttnvater Control Nleasure (SCNI) and the permitted SCM itself.
The Permit "Transfer Application Form is available on the saute Nyebsite listed above for the renewal
application.
It is imperative that the permits be renewed inintediately, otherxise, you will be operating a stormwater
treatment system ti,ithout a valid and active permit which is a violation ofNCGS 143 Article 21 and may
result in appropriate enforcement action, including the assessment of civil fines and penalties. An
inspection of these projects for compliance with the pe.rmil will be conducted soon. Any items that are
found to be out of compliance will be identified in the inspection report and you will be expected to
resolve those comphance. issues prior to transferring those permits to a new developer or to the HOA.

days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this is

not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you have sold

On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of
Chapter.143 of the General Statutes, which is current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that is set to expire during this time frame to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law 2010-
177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit # SW8 971121 which has already expired on July 12,
2008, is now in effect until July 12, 2012. Please resubmit the renewal application and
fee at least 180 days prior to July 12, 2012, which would be January 12, 2012. A copy
of the Renewal Application can be obtained from the following website:

This letter is to notify you that you are in violation of Title 15A North Carolina
Administrative Code (NCAC) 2H .1003 in accordance with North Carolina General
Statute (G.S.) 143-214.7 for failure to apply for and secure a renewal of Stormwater
Management Permit SW8 971121, which expired on July 12, 2008.
On July 27, 2009, David Cox of the Wilmington Regional Office performed a file
review to determine the status of compliance with Stormwater Management
Permit SW8 971121. Permit Number SW8 971121 was issued to you on June 12,
1998 for the Ocean Ridge Phase II, Section 1, located at U.S. 17 & Hwy 904 in
Brunswick County, North Carolina.
As a result of the site DWQ file review, the following violations are noted:
1. Failure to Renew State Stormwater Permit
Title 15A NCAC 2H .1003 (h) (2) requires that applications for permit renewals to be
submitted 180 days prior to the expiration of the permit. On June 12, 2008, an
application for a permit renewal was required to be submitted to DWQ. As of the date
of this letter, DWQ has not received an application to renew Stormwater Permit SW8

Title 15A NCAC 2H .1003, in accordance with G.S. - 143-214.7, requires a State
Stormwater Management Permit for development activities within the 20 coastal
counties that require a Coastal Area Management Act (CAMA) Major Permit or an
Erosion and Sedimentation Control Plan. The inspection and DWQ file review confirms
that a valid, active State Stormwater Management Permit was not obtained prior to the
expiration of Stormwater Permit SW8 971121
lll. Failure to Certify the Stormwater System A file review revealed that this office has
not received an Engineer's Certificate.
Permit condition states that upon completion of construction, prior to issuance of a
Certificate of Occupancy, and prior to operation of this permitted facility, a certification
must be received from an appropriate designer certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification.
Required Response
This Office requires that you respond to this letter in writing within 30 calendar dwys of
receipt of this Notice. Your response should be sent to this office at the letterhead
address. Your response should address the following items:
1. Submit the enclosed renewal application with new signed O&M agreement
and Designer's Certification along with the processing fee, currently set at
2. Provide a written "Plan of Action" which outlines the actions you will take to
correct the violation(s) noted under the `Comments' in the attached inspection
report and a time frame for completion of those actions.
Thank you for your immediate attention to this matter. This Office is considering an
enforcement action including the assessment of civil penalties regarding these
violations and any continuing violations that may be encountered. Your above -
mentioned response to this correspondence will be considered in this process.
Please be advised, these violations and any continuing or future violations are subject
to a civil penalty assessment of up to $25,000.00 per day for each violation pursuant to
North Carolina General Statute 143-215.6A.

The Wilmington Regional Office received previously requested information for the Stormwater
Management Permit Application for Ocean Ridge Plantation, Panther's Run Phase H, Section I on March
6, 1998. A preliminary review of that information has determined that the application is not complete. The
following information is needed to continue the stormwater review:
1. The total built -upon area for the proposed tracts appears to exceed the amount permitted under
the Master Plan for these tracts. The road Iayout is also changed. You must now either revise
the Master Plan to reflect the new BUA or revise Section I to meet the previously permitted
allowable built -upon area. Did you include any of the 22 acres of existing roads in Section I
that were previously permitted under the Master Plan?
2. Section I, at 36.5 %, is not considered of such high density within the overall low density
project, that stormwater runoff is a threat, however, the collection system is kicking this into
an engineered system. Therefore, you are correct in that collection from the lots is not
required. I had totally forgotten that we had permitted an overall Master Plan.
3. Per my Email messages, please remember to reference the project number on all
correspondance, and reference the original tract designation(s) in the cover letter when you
first submit the project to help keep track of the projects.
4. The orifice calculation for Pond 3 has not been provided. The outlet detail table shows a 2.5",
but the summary box on Sheet 6 of 12 indicates a 2". Which is correct?

The Wilmington Regional Office received a Stormwater Management Permit Application for Ocean
Ridge -Panther's Run, Phase 11, Section I on November 13, 1997. A preliminary review of that information
has determined that the application is not complete. The following information is needed to continue the
stormwater review:
1. Add a trash rack for the orifices in Pond 2 or find some other way to arrange the orifices.
Why not have one orifice instead of 3?
2. Provide eye -brow and cul-de-sac road details.
3. The drainage areas you have delineated only include 112 of the lot. A project that exceeds low
density must collect the runoff from all impervious areas of the lots and roads and direct it
into the pond. You must either show sufficient grading to indicate how runoff from the lots
will be directed to the pond, or the deed restrictions for the subdivisions must include
statements that roof gutters are required on all homes and they must drain into the street, or
that a minimum of 2/3rds of the lot must be graded toward the street or a collection ditch and
sent to the pond.
4. Delineate all wetlands on site, or note on the plans that none exist.
5. Locate the pond in a recorded access/drainage easement.
b. The TSS removal efficiency is listed in the calculations as 80%. A minimum of 85% is
required. Please correct and list the proper SAIDA table.

7. Locate the vegetated filters for each pond. Detail each one with pertinent elevations, specify
grass cover and detail/label the flow spreader mechanism. The vegetated filters are NQT
ditches. Runoff from the outlet piping must first daylight to natural ground, then the spreader
and filter are constructed.
8. Please list each pond's statistics separately on the enclosed supplement to the permit.
9. Due to the recalculations of the drainage areas and lot BUA to the pond, pond design will be
verified after resubmission of the plans and calculations.

between the normal pool and the storage pool is only 0.3 feet and the
use of one orifice instead of three would place the top of the orifice
above the storage pool.
2. Details and profiles of the cul-de-sacs and eye -brow roads are shown on
Sheets 7 and 8.
3. The proposed subject project is located within Phase 2 of Ocean Ridge
Plantation. An overall stormwater plan for Phase 2 was permitted
September 11, 1996, Permit No. SW8 960822. Enclosed are two copies
of the revised overall stormwater plan. The Phase 2, Ocean Ridge
Plantation is permitted under the low density option. The rear half of
the lots drains to swales/ditches located on the golf course. This is
accomplished using existing land topography.
4. Wetlands are delineated on the plans and a note has been added to the
plans crediting the provider of information.
5. Notes have been added to Sheets 5 and 6 on the pond details requiring
the ponds to be located in recorded access/drainage easements.
6. The TSS removal has been revised in the calculations for Pond 1.
7. No vegetated filters are required for the ponds. All ponds have a 90%
TSS removal.
8. A list of each pond's statistics is attached to the permit application.

DEFINITIONS
1.1. The Declarant adopts the definitions of terms as set out in the Master
Declaration, except as specifically modified or changed by this Second Amendment.
ARTICLE H
2.1. For the purposes of this Second Amendment, Section 12.6 of the Master
Declaration is hereby amended to provide as follows:
"12.6 Stormwater Runoff Rules. The following covenants in this Section 12.6
are intended to ensure ongoing compliance with North Carolina Stormwater Management Permit
Number SWS 960822 Modification dated August 29, 2001, (herein called "Permit"), as issued by
the North Carolina Division of Water Quality or any successor agency (herein called " Division
of Water Quality"), under NCAC 2H.1000, evidencing the approval of the stormwater drainage
plan for the Property (herein called "Approved Plan").

(a) The State of North Carolina is made a beneficiary of the covenants
contained in this Section 12.6, to the extent necessary to maintain compliance with the Permit.
(b) The covenants pertaining to stormwater in this Section 12.6 may
not be altered or rescinded without the express written consent of the Division of Water Quality:
(c) Alteration of the drainage as shown on the Approved Plan may not
take place without the concurrence of the Division of Water Quality.
(d) Filling in, piping or altering any designated 5:1 curb outlet swale
associated with the Property is prohibited by any persons.
(e) The Approved Plan for this Property proposes a curb outlet system.
Each designated curb outlet swale shown on the Approved Plan must be maintained at a
minimum of 100' long with 5:1 (H:V) side slopes or flatter, have a longitudinal slope no steeper
than 5%, carry the flow from a 10 year storm in a non -erosive manner, and maintain a dense
vegetated cover.
{f) The maximum allowable built -upon area per lot is 8,000 square
fedt. This allotted amount includes any built -upon area constructed within the lot property
boundaries, and that portion of the right-of-way between the front lot line and the edge of the
pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel,
brick, stone, slate, coquina and parking area, but does not include raised, open wood decking, or
the water surface of swimming pools.
(g) All stormwater runoff from the built -upon areas on each Unit
within the Property must drain into the permitted system. This may be accomplished through
providing roof drain gutters which drain to the street, grading the lot to drain toward the street, or
grading perimeter swales to collect lot runoff and directing them into the stormwater system or
into the street. Lots that will naturally drain into the system are not required to provide these
additional measures."
2.2 Except as specifically set out in this Second Amendment, the remaining
provisions of the Master Declaration, the Supplemental Declaration, and the Amendment remain as
set out therein.

recreational facilities and common areas that certain covenants, conditions, easements, assessments,
liens and restrictions governing the use and occupancy of the Property be established and declared
to be covenants running with the land.
AND WHEREAS, Declarant has previously executed and recorded the Master
Declaration of Covenants, Conditions and Restrictions for Ocean Ridge Plantation in Book 1021,
Page 811, Brunswick County Registry (herein "Master Declaration"), which contains covenants,
conditions and restrictions applicable to all property within the subdivision known as Ocean Ridge
Plantation.
AND WHEREAS, the Property described herein is Future Development Property as
defined in the Master Declaration.
AND WHEREAS, pursuant to the provisions of Article a of the Master
Declaration, Declarant desires to add the Property described herein to the subdivision known as
Ocean Ridge Plantation, and to subject the Property described herein to the Master Declaration
and to this Supplemental Declaration which contains covenants, conditions and restrictions
applicable to the Property known as and described herein as Dartmoor Forest.
NOW, THEREFORE, in consideration of the premises, the Declarant declares
that all of the Property is and shall be held, transferred, sold, conveyed, occupied, and used
subject to the restrictions and matters set forth in the Master Declaration and in this
Supplemental Declaration, said Master Declaration and Supplemental Declaration to be
construed as covenants running with the described Property which shall be binding on all parties
having or acquiring any right, title or interest in the described Property, or any part thereof; and
which shall inure to the benefit of each owner thereof, for and during the time herein specified.

Every party hereafter acquiring any Unit, or portion thereof, in the above -described Property, by
acceptance of a deed conveying title thereto or by execution of a contract for the purchase
thereof, whether from. the Declarant or a subsequent owner of such Unit, shall accept such deed
or contract subject to each and all of the covenants, restrictions and agreements contained in the
Master Declaration and these Supplemental Declarations, as well as any additions or
amendments thereto, and also subject to the jurisdiction, rights and powers of the Declarant, the
Association, and their successors and assigns as set out herein. Each grantee of any Unit subject
to this Supplemental Declaration, by accepting the deed or contract thereto, shall for himself, his
heirs, personal representatives, successors and assigns, covenant, consent and agree to and with
the Declarant, the Association, and with grantees and subsequent owners of each of the Units

DEFINITIONS
The Declarant adopts the definitions of terms as set out in the Master Declaration,

Declaration.
The following definitions shall apply for purposes of this Supplemental
1. "Property" as used in this Supplemental Declaration shall refer'to the real
property herein described.
2. "Limited Cornmon Areas" shall be those areas which shall be limited in
use to those owners of properties located in Dartmoor Forest, or their guests, invitees, licensees or
immediate family members, and designated as Limited Common Areas on any duly recorded plat
of the Property, including any plats recorded in the future.

3. "Owner" shall mean one or more persons or entities which hold the record
title to any Unit within Dartmoor Forest.
ARTICLE I
Master Declaration of Covenants, Conditions and Restrictions
1.1 The Declarant hereby adopts by. reference, as if fully set out herein, all
provisions of the Master Declaration of Covenants, Conditions and Restrictions for Ocean Ridge
Plantation (herein called "Master Declaration"), executed by the Declarant and recorded on the
23`d day of February, 1995, in Book 1021, Page 811, in the Brunswick County Registry, and any
supplements or amendments thereto.
ARTICLE II
Additional Provisions
2.1 The covenants and restrictions of this Supplemental Declaration may be
amended as provided in the Master Declaration.
2.2 There is reserved to and for the benefit of the Declarant, the Association,
and their successors and assigns, an easement in, on, over, across and through that portion of the
Property, including any Unit within Dartmoor Forest, within ten feet (10') of the mean high
water line of.any pond, lake, stream, creek, wetland area, or other body of water (herein
