All previous references to DWQ will remain in older stormwater pennits issued prior to August 1, 2013 until they are modified, transferred, or renewed. Please note that this letter references DE.NI LIZ as the Division responsible for issuance of the permit. On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The law extended the effective period of any stormwater permit that was set to expire during this time frame to tliree. (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177 which granted an extra year for a total of four (4) years extension. Accordingly, the four Stormwater Permits listed below which were issued io Ocean Ridge Farms, Inc., all received the 4-year extension, but they have been allowed to expire and must now be renewed. Please note that the corporation was notified of all of these permit extensions and of the need to renew the permits; however, the corporation was not active at that time, and has only recently been reactivated with the NCSOS. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. The total built -upon area for the proposed tracts appears to exceed the amount permitted under the Master Plan for these tracts. The road Iayout is also changed. You must now either revise the Master Plan to reflect the new BUA or revise Section I to meet the previously permitted allowable built -upon area. Did you include any of the 22 acres of existing roads in Section I that were previously permitted under the Master Plan? 2. Section I, at 36.5 %, is not considered of such high density within the overall low density project, that stormwater runoff is a threat, however, the collection system is kicking this into an engineered system. Therefore, you are correct in that collection from the lots is not required. I had totally forgotten that we had permitted an overall Master Plan. 3. Per my Email messages, please remember to reference the project number on all correspondance, and reference the original tract designation(s) in the cover letter when you first submit the project to help keep track of the projects. 4. The orifice calculation for Pond 3 has not been provided. The outlet detail table shows a 2.5", but the summary box on Sheet 6 of 12 indicates a 2". A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. Add a trash rack for the orifices in Pond 2 or find some other way to arrange the orifices. Why not have one orifice instead of 3? 2. Provide eye -brow and cul-de-sac road details. 3. The drainage areas you have delineated only include 112 of the lot. A project that exceeds low density must collect the runoff from all impervious areas of the lots and roads and direct it into the pond. You must either show sufficient grading to indicate how runoff from the lots will be directed to the pond, or the deed restrictions for the subdivisions must include statements that roof gutters are required on all homes and they must drain into the street, or that a minimum of 2/3rds of the lot must be graded toward the street or a collection ditch and sent to the pond. 4. Delineate all wetlands on site, or note on the plans that none exist. 5. Locate the pond in a recorded access/drainage easement. b. The TSS removal efficiency is listed in the calculations as 80%. A minimum of 85% is required.
