Hello Christine:
Thank you again for all of your help.
I think we found a hole in the process and design here for water control.
In my conversations with the local government engineer Bridget Flora -Brunswick Co, the local government
has no control or say in the storm water run-off. That is why I was forward to the NC government to address
this issue. So if I am hearing correctly the State of NC and the local County has no control of the amount of
water that is flowing for a item like this.
The county is assuming that the state has control of this, and the state is assuming that the county has control
of items like this. Really no one has control for items like this.
have added Bridget and William from Brunswick Co to this email thread so they can see where this issue is
going.
There should be something in place that manages the amount of water that is flowing in the stormwater
troughs and into the holding ponds that are in installed and used in areas like this.

Mr. Liskey,
Being a low density development, the ponds on this site are not permitted stormwater control measures and the
Division has no jurisdiction over them. They are likely amenity ponds or water hazards for the golf course.
The purpose of the state stormwater program is protect water quality. For this project, that is accomplished by limiting
the amount of built -upon area and reducing the piping to achieve the goal of allowing water to infiltrate or have contact
time with vegetation either via sheet flow or in vegetated conveyances to remove sediment. The State has no
jurisdiction over the quantity of water (flooding). This is delegated to the local governments.

Thank you for the follow up on this matter.
I can understand and appreciate the response and matter to this issue.
The question is, what can be done if the golf course's property is not draining correctly and it is causing
flooding?
The culvert behind my home is still clogged up and will not allow the water to flow freely. The retention pond
that is down stream that the troughs empty into behind my home has a drain pipe is still smashed and closed
up over SO%. This does not allow the water to drain out correctly which backs up the water behind my home
and onto my property. I am not the only one in this development that is having this issue. There are a number
of home owners that are suffering from the mismanagement of the Stormwater drainage that was not
planned correctly or not
I will take a few pictures and send them to you by tomorrow.
If I am reading your note below correctly, all the golf course has to do is submit a revised stormwater plan and
it just gets approved. That does not make the corrections that are needed for any stormwater that runs
behind my home from the Golf courses property to run freely and drain off quickly and empty the stormwater
troughs.
If the State of NC cannot force the Golf course to make the corrections that are needed, then who can force
this issue?

I have finished reviewing the file and the site inspection notes from the inspector and have drafted a notice of inspection
for the permittee, which will be sent out later this week. To answer your question directed to Cameron on April 27,
2020, the State cannot require the permittee to make any changes to address flooding. The State and this Division
have no jurisdiction over flooding or standing water as flood control and drainage is left to the local jurisdictions per G.S
77-14 (attached).
Low density permits for sites such as this one are issued by the Division to limit the amount of built -upon area and limit
the amount of piping. The inspector did find during his initial visit on April 9, 2020 that the swales were in the process of
being maintained. During a follow-up visit on April 28, 2020, he confirmed that there were some changes to the
stormwater system from the approved plans. The inspection report that will go out later this week will ask the
permittee to submit the revised plans to the Division for review and approval.
If you would like a copy of the inspection notice and inspection report, 1 can pass those along after they have been sent
to the permittee.

In addition, what can the State do to push Meadowland in to making the correction to the stormwater runoff
in the Meadowlands Golf course? This issue is causing flooding into our development. The troughs and catch
basins/ponds are not being maintained.

Mr. Liskey — I have reviewed the correspondence regarding the stormwater issue behind your home, I can address the
County requirements with the following:
1. There is no County Stormwater Permit for this area as it was developed prior to the Brunswick County
5tormwater Ordinance going into effect.
2. The Brunswick County Stormwater Ordinance does have a section that addresses stormwater drainage:
"The Stormwater Ordinance (brunswickcountync.goy] requires individual property owners to maintain all streams.
creeks, ditches, sxvales, pipes, culverts. etc. that are on the private property. The county does not provide
maintenance of drainage ways. (Article V1. Division 111. Section 3)A)"
3. Based on the Ordinance requirement, I will send a letter to Meadowlands Golf Club to remind them of this
requirement. We typically ask them to provide us a plan including timeline for completing the necessary
maintenance. I would expect 30 to 60 days at the earliest.
4. Please be aware that upon review of the area, your lot along with the Meadowlands Golf Club is located in the
AE Flood Zone with a Base Flood Elevation of 27. If you have any questions or concerns regarding Floodplain
Requirements, feel free to contact our Floodplain Administrator, Mr. John Shirk at 910-253-2406,

Please see the attached document of a copy of the Meadownland Golf Course Stormwater permit that was
sent to the golf course on April 16, 2003. The permit was issued by the North Carolina State Department of
Natural Resources Division of Water Quality.

Mr. Weaver, in our conversation on 04/06/2020 you had expressed that if you could be provided the Storm
Water permit that your department could look into this and address the issue of the storm water from the
Meadowlands golf course into our community.
Mr. Vansteen was out and look into the issue on 04/08/2020 and has documented that this is an issue and the
coverts, retention pond and troughs have not been maintained.
How soon can something be done to address and mandate the Meadowlands Golf course take the corrective
action and fix these items?

Hello William and Dalton:
Yes, that is correct and what was discussed earlier. We already know those facts on this issue.
The question is what can be done to have this addressed and corrected by Meadowlands?
I have a hard time believing that there is a NC state storm water permit for the troughs and run off from
Meadowlands Golf course and no one is willing to enforce the regulations on a issue like this.
I have added Cameron Weaver to this e-mail thread. Maybe he can provide some guidance on how the state
can look into this and enforce the regulations for storm water run off in the Meadowsland golf course and
how this flooding is effecting the building development.
need someone to step in here and provide the leverage to get this fixed before we have more flooding in our
area.
This issue is not limited to the area behind my home. The full trough and retention pond needs evaluated and
corrected.
Please provide your guidance on how this should be handled.

Yes, I called to let you know that I made a site visit yesterday Tuesday, April 7, 2020. 1 inspected the run-off complaint
that you contacted us about, it looks that the culvert pipe under the cart path does have water flowing through it but
the ditch has not been sufficiently maintained so that the run-off falls toward the pond located to the left of your house.
The maintenance of the culvert pipe and ditch behind your house, as you discussed with Mr. Pinnix, is the responsibility
of the Meadowland's Golf Course,

Hello Brigit:
I wanted to follow up to our earlier conversation about the storm water run-off issue behind my home in
Calabash, NC. Over a month ago we had spoken and review the issue with the water that is in a storm water
trough behind my home that is owned by the Meadowlands Golf course.
The water is not running off and pooling up in the storm water trough and backing up and making a hazard to
my home and other homes in the area of the Meadowlands. The dirt on the sides of the storm water trough
are falling in, and the golf course paths culverts that cross over the storm water trough are full of roots, limbs
and leaves that the water will not run off properly.
The storm water trough is owed by the Meadowlands Golf course and they need to make the corrections that
are needed to mitigate the flooding into our community and also address the mosquito and bug infestation
from this standing water.
I have reached out the Meadowlands Golf course and received only one response over a month ago from Mr.
McLamb stating that they will have the golfing superintendent look into this issue back at the beginning of
March. Since the beginning of March, I have reached out contacted the Golf course and McLamb four
additional times, but have not heard anything back from either the Meadowlands Golf course or Mr. Mctamb.
i have coordinated with your director and Mr. Weaver from the NC state government to see what can be done
to address this and have the Meadownlands Gold course fully fix this storm water trough issue.
What can be done to get get the storm water trough fixed by Meadowlands Golf course?

Yes, that is correct and what was discussed earlier. We already know those facts on
this issue.
The question is what can be done to have this addressed and corrected by
Meadowlands?
I have a hard time believing that there is a NC state storm water permit for the
troughs and run off from Meadowlands Golf course and no one is willing to enforce
the regulations on a issue like this.
I have added Cameron Weaver to this e-mail thread. Maybe he can provide some
guidance on how the state can look into this and enforce the regulations for storm
water run off in the Meadowsland golf course and how this flooding is effecting the
building development.
I need someone to step in here and provide the leverage to get this fixed before we
have more flooding in our area.
This issue is not limited to the area behind my home. The full trough and retention
pond needs evaluated and corrected.
Please provide your guidance on how this should be handled.

Yes, I called to let you know that I made a site visit yesterday Tuesday, April 7, 2020. 1
inspected the run-off complaint that you contacted us about, it looks that the culvert pipe
under the cart path does have water flowing through it but the ditch has not been
sufficiently maintained so that the run-off falls toward the pond located to the left of your
house. The maintenance of the culvert pipe and ditch behind your house, as you discussed
with Mr. Pinnix, is the responsibility of the Meadowland's Golf Course.

Hello Brigit:
I wanted to follow up to our earlier conversation about the storm water run-off issue
behind my home in Calabash, NC. Over a month ago we had spoken and review the
issue with the water that is in a storm water trough behind my home that is owned
by the Meadowlands Golf course.
The water is not running off and pooling up in the storm water trough and backing up
and making a hazard to my home and other homes in the area of the Meadowlands.
The dirt on the sides of the storm water trough are falling in, and the golf course
paths culverts that cross over the storm water trough are full of roots, limbs and
leaves that the water will not run off properly.
The storm water trough is owed by the Meadowlands Golf course and they need to
make the corrections that are needed to mitigate the flooding into our community
and also address the mosquito and bug infestation from this standing water.
I have reached out the Meadowlands Golf course and received only one response
over a month ago from Mr. McLamb stating that they will have the golfing
superintendent look into this issue back at the beginning of March. Since the
beginning of March, I have reached out contacted the Golf course and McLamb four
additional times, but have not heard anything back from either the Meadowlands
Golf course or Mr. McLamb.
I have coordinated with your director and Mr. Weaver from the NC state government
to see what can be done to address this and have the Meadownlands Gold course
fully fix this storm water trough issue.
What can be done to get get the storm water trough fixed by Meadowlands Golf
course?

The Meadowlands Golf Club (MGQ is the current owner of the stormwater permit #SW8 970631. The
Meadowlands Property Owners Association, Inc. (POA) has expressed concerns to MGC about maintenance
responsibilities pertaining to this permit. We currently have several issues we have brought to MGC's
attention. At a recent meeting with MGC, they told us they would assume all maintenance responsibilities
covered by this permit, including the current issues we brought to their attention.
We are concerned; however, as MGC stated that they believed they had transferred the permit to our
Association. Our Association believes that the permit should never be transferred due to the fact that the golf
course contributes the vast majority of the stormwater runoff in the part of our development covered by this
permit.
In accordance with section III. 5. of the permit, the POA respectively requests that your department not
entertain the transfer of this permit without advanced notification to our association so we may discuss the
merits and conditions of any potential transfer.
Although we do not anticipate any attempt at transferring the permit from the MGC to the POA in the
immediate future, we want to make sure our concerns are addressed just in case.

Calabash, NC. Several months ago, I had the opportunity to speak with you concerning a storm water permit
issued to our Association and the state of North Carolinas rejection of a modification request. At the sarne
time, I inquired about storm water permit SW8 970631. which was issued to the Meadowlands Golf Club Inc.
As our Association is currently dealing with Meadowlands Golf Club Inc., (MGC) concerning drainage and
roadway issues that may or may not be related to SW8 970631 I have several questions I hope you can answer.
1. 1MGC has implied that the storm water permit (SW8 970631) is no longer held by them, but has been
turned over to the property owners association. Could you clarify this issue? We have no records of the permit
being transferred to the POA.
Sure. The following two stormwater permits have been issued for the Meadowlands and are still active:

So you are correct, that SW8 970631 is still issued to MGC and has not been transferred to the POA.
2. If in fact, MGC still is the permit holder of record, what responsibility, if any, do they have for maintaining
swales and culverts which are part of the system?
As the permittee, MGC is responsible for the operation and maintenance of the facility, which would include the
associated storm water features. That being said, there are developments out there that have legal documents (such as
sections in the restrictive covenants or recorded maintenance assignments) that place the responsibility with another
entity. The enforcement of that legal document is solely between those two entities.
3. Does the permit in question (SW8 970631) pertain only to the property which is developed for housing, or
does it also include land that is owned and maintained by MGC as a golf course?
You would have to review the approved plans to determine the extent of the project area.
4. if MGC is required to maintain the storm water system under the existing permit, is there any action which
the state of North Carolina can or would take to ensure that the storm water system is being maintained
according to existing standards.
This depends on the extent of the problems. For instance, a few bare spots in a swele would not be something the
Division would act upon. On the other side of the spectrum, if the swales have been piped, then that is something we
would act upon. We would need to know all of the concerns to provide a better answer.

Being a low density development, the ponds on this site are not permitted stormwater control measures and the
Division has no jurisdiction over them. They are likely amenity ponds or water hazards for the golf course.
The purpose of the state stormwater program is protect water quality. For this project, that is accomplished by limiting
the amount of built -upon area and reducing the piping to achieve the goal of allowing water to infiltrate or have contact
time with vegetation either via sheet flow or in vegetated conveyances to remove sediment. The State has no
jurisdiction over the quantity of water (flooding). This is delegated to the local governments.

i can understand and appreciate the response and matter to this issue.
The question is, what can be done if the golf course's property is not draining correctly and it is causing
flooding?
The culvert behind my home is still clogged up and will not allow the water to flow freely. The retention pond
that is down stream that the troughs empty into behind my home has a drain pipe is still smashed and closed
up over 50%. This does not allow the water to drain out correctly which backs up the water behind my home
and onto my property. I am not the only one in this development that is having this issue. There are a number
of home owners that are suffering from the mismanagement of the Stormwater drainage that was not
planned correctly or not
will take a few pictures and send them to you by tomorrow.
If I am reading your note below correctly, all the golf course has to do is submit a revised stormwater plan and
it just gets approved. That does not make the corrections that are needed for any stormwater that runs
behind my home from the Golf courses property to run freely and drain off quickly and empty the stormwater
troughs.

I have finished reviewing the file and the site inspection notes from the inspector and have drafted a notice of inspection
for the permittee, which will be sent out later this week. To answer your question directed to Cameron on April 27,
2020, the State cannot require the permittee to make any changes to address flooding. The State and this Division
have no jurisdiction over flooding or standing water as flood control and drainage is left to the local jurisdictions per G.S
77-14 (attached).
Low density permits for sites such as this one are issued by the Division to limit the amount of built -upon area and limit
the amount of piping. The inspector did find during his initial visit on April 9, 2020 that the swales were in the process of
being maintained. During a follow-up visit on April 28, 2020, he confirmed that there were some changes to the
stormwater system from the approved plans. The inspection report that will go out later this week will ask the
permittee to submit the revised plans to the Division for review and approval.
If you would like a copy of the inspection notice and inspection report, I can pass those along after they have been sent
to the permittee.

Mr. Liskey — I have reviewed the correspondence regarding the stormwater issue behind your home. I can address the
County requirements with the following:
1. There is no County Stormwater Permit for this area as it was developed prior to the Brunswick County
Stormwater Ordinance going into effect.
2. The Brunswick County Stormwater Ordinance does have a section that addresses stormwater drainage:
"The Stormwater_ Ordinance [brunswickcountync.gov] requires individual property owners to maintain all streams,
creeks. ditches, swales, pi])es, culverts, etc. that are on the private property. The county does not provide
maintenance ofdrainage ways. (Article VI. Division Ill, Section 3.4)"
3. Based on the Ordinance requirement, I will send a letter to Meadowlands Golf Club to remind them of this
requirement. We typically ask them to provide us a plan including timeline for completing the necessary
maintenance. I would expect 30 to 60 days at the earliest.
4. Please be aware that upon review of the area, your lot along with the Meadowlands Golf Club is located in the
AE Flood Zone with a Base Flood Elevation of 27. If you have any questions or concerns regarding Floodplain
Requirements, feel free to contact our Floodplain Administrator, Mr. John Shirk at 910-253-2406.

Yes, that is correct and what was discussed earlier. We already know those facts on this issue.
The question is what can be done to have this addressed and corrected by Meadowlands?
I have a hard time believing that there is a NC state storm water permit for the troughs and run off from
Meadowlands Golf course and no one is willing to enforce the regulations on a issue like this.
I have added Cameron Weaver to this e-mail thread. Maybe he can provide some guidance on how the state
can look into this and enforce the regulations for storm water run off in the Meadowsland golf course and
how this flooding is effecting the building development.
I need someone to step in here and provide the leverage to get this fixed before we have more flooding in our
area.
This issue is not limited to the area behind my home. The full trough and retention pond needs evaluated and
corrected.
Please provide your guidance on how this should be handled.

Yes, I called to let you know that I made a site visit yesterday Tuesday, April 7, 2020. 1 inspected the run-off complaint
that you contacted us about, it looks that the culvert pipe under the cart path does have water flowing through it but
the ditch has not been sufficiently maintained so that the run-off falls toward the pond located to the left of your house.
The maintenance of the culvert pipe and ditch behind your house, as you discussed with Mr. Pinnix, is the responsibility
of the Meadowland's Golf Course.

wanted to follow up to our earlier conversation about the storm water run-off issue behind my home in
Calabash, NC. Over a month ago we had spoken and review the issue with the water that is in a storm water
trough behind my home that is owned by the Meadowlands Golf course.
The water is not running off and pooling up in the storm water trough and backing up and making a hazard to
my home and other homes in the area of the Meadowlands. The dirt on the sides of the storm water trough
are falling in, and the golf course paths culverts that cross over the storm water trough are full of roots, limbs
and leaves that the water will not run off properly.
The storm water trough is owed by the Meadowlands Golf course and they need to make the corrections that
are needed to mitigate the flooding into our community and also address the mosquito and bug infestation
from this standing water.
I have reached out the Meadowlands Golf course and received only one response over a month ago from Mr.
McLamb stating that they will have the golfing superintendent look into this issue back at the beginning of
March. Since the beginning of March, I have reached out contacted the Golf course and McLamb four
additional times, but have not heard anything back from either the Meadowlands Golf course or Mr. McLamb.
I have coordinated with your director and Mr. Weaver from the NC state government to see what can be done
to address this and have the Meadownlands Gold course fully fix this storm water trough issue.
What can be done to get get the storm water trough fixed by Meadowlands Golf course?

My client is in receipt of the aforementioned Notice of Inspection. The following is in response to the
listed deficiencies. For ease, your questions are repeated in normal font and our responses follow in
bold.
I . The site inspection found that the pipe shown on the approved plans near lot 75 is missing and
that additional swales were constructed on the east side of Wild Oak Lane. Per Section 11.4 of
the permit. any changes to the approved plans must be approved by the Division prior to
construction. Please submit revised plans documenting these changes and any other changes
from the approved plans to the Division for approval.
The developer represents that the pipe is installed. If you would like a re -inspection
please contact the developer WJ McLamb at 910-520-2727, we think the inspector may
have been in a different location than what was represented in the plans and we would
like to walk the site with them during a re -inspection.
2. Per Section U.12 of the permit, a copy of the recorded deed restrictions was to be submitted within 30
days of recording. The permit modification approved on April 16, 2003 revised the built -upon area
allocations to the lots; however, the revised or amended deed restrictions and protective covenants have
not been submitted. Please submit a copy of the final deed restrictions and protective covenants that are
consistent with the April 16, 2003 permit version.
Recorded deed restrictions are attached.
3. Per Section 11.7 of the permit, the permittee must certify that the project has been built in accordance
with the approved plans. This certification could not be found in the file. Once these compliance items
are resolved, please submit the certification confirming that the site is consistent with the to -be -revised
plans.

report.

Dear Mr. McLamb:
Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that this letter references DEMLR as the Division responsible for compliance with
the permit.
On April 28, 2020, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected the subject project to determine the status of compliance with the State
Stormwater Management Permit Number SW8 970631 last issued on April 16, 2003. DEMLR file
review and site inspection revealed that the site is not in compliance with the terms and conditions of this
permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to
this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The site inspection found that the pipe shown on the approved plans near lot 75 is missing and
that additional swales were constructed on the east side of Wild Oak Lane. Per Section I1.4 of the
permit, any changes to the approved plans must be approved by the Division prior to
construction. Please submit revised plans documenting these changes and any other changes
from the approved plans to the Division for approval.

Please be advised that, as the permittee, you are required to comply with the terms, conditions and
limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative Code
2H .1003 and North Carolina General Statute 143-214.7, including the operation and maintenance of the
permitted stormwater system.
Failure to provide the requested information, or to respond to this letter with a plan of action, including a
timeline to resolve the identified deficiencies, by June 15, 2020, are considered violations of the permit.
If the requested information is not submitted to this office by the due date, then DEMLR staff will re-
inspect the site and may issue a Notice of Violation. Please also note that any individual or entity found
to be in noncompliance with the provisions of a stormwater management permit or the stormwater rules is
subject to enforcement action as set forth in NCGS 143 Article 21, including the assessment of civil
penalties of up to $25,000 per day.
