The Division of Water Quality issued a high density S.tormwater Management Permit # SW8
950611 to Jo Ann Simmons for the Freedom Homes project on September 12, 1995. This
permit expired on September 12, 2005. A letter was sent to you on July 11, 2007 requesting
that an application for renewing the permit be submitted and, at this time, a response has not
yet been received. Per 15A NCAC 21-11.1003(h) (the stormwater rules), it is your responsibility to
submit an application to renew the permit 180 days prior to the expiration of a permit.
If this is still an active project please complete and submit the enclosed renewal application
along with the processing fee, which is currently set at $505.00 prior to July 15, 2013. If this
project has not been constructed and a permit is no longer needed, please submit a request to
have the permit rescinded. If you have sold the project please provide the name, mailing
address and phone number of the person or entity that is now responsible for this permit.
Enclosed is a form for change of ownership, which should be completed and submitted if the
property has changed ownership.
Your permit requires that upon completion of construction and prior to operation of the permitted
stormwater treatment system, a certification of completion be submitted to the Division from an
appropriate designer for the type of system installed. This is to certify that the permitted facility
has been installed in accordance with the permit, the approved plans, specifications and
supporting documentation. If you have not already provided a Designer's Certification to our
office, please include a copy with your permit renewal request and processing fee. A copy of the
certification form is enclosed for your convenience.
You should be aware that failure to provide the Designer's Certification and the operation of E
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-
215.1 and may result in appropriate enforcement action including the assessment of civil
penalties of up to $25,000 per day.
If a renewal application is not submitted prior to July 15, 2013, enforcement actions may be
initiated, which may include the assessment of civil penalties. If you have any questions, please

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8950611
to Ms. Jo Ann Simmons for a High Density pond to serve Freedom Homes on 9112/1995. This permit
expired on 9/12/2005. Section .1003(h) of 15 A NCAC 2H .1000 (the stormwater rules) requires that
applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must
be accompanied by a processing fee, which is currently set at $420.00. If this is still an active project
please complete and submit the enclosed renewal application in a timely manner. If this project has not
been constructed and a permit is no longer needed, please submit a request to have the permit
rescinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing
address and phone number of the person or entity that is now responsible for this permit. Enclosed is a
form for change of ownership, which should be completed and submitted if the property has changed
hands.

treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with

certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.

The following is in response to your request for additional information
dated July 19, 1995 and additional items are enclosed for your review:
1. Revised calculations incorporating runoff volume from rooftops. Please
note that the revised calculations are not as conservative as the
old ones due to the averaging effect of the coefficients for rooftops
and grass verses the business coefficient. However, the volume in
the pond is sufficient for both approaches.
2. Revised woodland C factor to .2 in the calculations.
3. A copy of our stormwater routing program showing the equations
used for the stage -volume table.
4. Revised plans show rip -rap stabilization for pond.

The Willnington Regional Office received previously requested information for Freedom Homes
on July 10, 1995. A preliminary review of that information has determined that the submittal for the
subject project is not complete. The following information is needed to continue the stormwater review:
1. There is still a volume discrepancy. There will obviously be a varying number of mobile
homes on site at any given time. These rooftops will run off 100% of the rain that falls,
and not allow the gravel under the home to absorb the runoff. Please estimate the
maximum number of homes that can be located on site, and revise the volume calculation
to account for the rooftops at 100 %.
2. Wooded areas usually are assigned a C factor of .2. The woods noted on the plan are not
heavy, with deep ground litter. Flat, sandy lawns can use .1 as shown in your calculations.
Generally, the State prefers to err on the conservative side.
3. Please list the equations you used for the stage -volume table in your calculations.
4. Side slopes steeper than 3:1 must be permanently stabilized with rip rap or other material,
not including grass. While 3:1 is not a regulatory requirement common sense dictates that
in order to keep grassed slopes mowed and in good repair they should not be steeper than
3:1.

The following is in response to your request for additional information

4. Ms. Simmons has signed submittal form and Operation and
Maintenance Plan.
5. Map clarifying drainage area for west side and east side ditches,
enclosed. Off -site impervious and grassed areas were used for pond
storage volume only.
6. Revised plan showing new location of 12" CMP cross pipe further
from the pond outlet structure, enclosed.
7. Surface area calculations and storage volume shown on revised
calculations.
8. Built -upon area stated on the submittal form is for the Freedom
Homes site only. The total built -upon area, used in pond storage
calculations, for the two site drainage areas (west side and east
side ditches) includes off -site impervious areas.
9. Attached map represents drainage delineation of the west side and
east side ditches.

10. The runoff coefficient for the parking lot has been revised to .95
and runoff volumes recalculated.
11. Existing regulations do not require 3:1 side slopes of the pond.
Although 3:1 side slopes would be preferable, due to the
constraints of the existing businesses, a steeper side slope is
necessary for the pond.
12. Clarification has been made on the 4" pipe inlet and support on
revised plan. We used a pipe routing calculation rather than an
orifice routing calculation to size the outlet structure. (See
attached calculations, Sheets 5 to 7 of 7)
13. Spillway detail was added to revised plan.
14. Calculations have been revised using Chart 4 for SA/DA
percentage required. Therefore, no vegetative filter is required.
15. Revised calculations show that the storage required is 12,859 CF
and the available storage is 13,292 CF.

it warrants approval for the stormwater portion of this project.

The Wilmington Regional Office received a Stormwater Submittal for the Freedom Homes on June
9, 1995. A preliminary review of that information has determined that the submittal for the subject
project is not complete. The following information is needed to continue the stormwater review:
✓ 1'. Pond design calculations must be sealed.
,% 2. Signed and notarized Operation and Maintenance Plan for the stormwater controls.
✓3. Please complete the back of the submittal form with the name and address of the
engineering firm authorized to submit stormwater plans on the owner's behalf. Since Ms.
Simmons is the owner of the property, she must sign the form.
U,"`-4. If Ms. Simmons is the owner of the land, and lots are being leased to Freedom Homes,
then she must sign the submittal form and the Operation and Maintenance Plan. Her rental
contract with Freedom homes should include statements to the effect that Freedom Homes
is responsible for maintenance of the pond in accordance with the approved plans, as long
as they rent the property.
5. The drainage areas of 1.96 acres (west side) and 4.62 acres (east side) must be clearly
delineated on the plan. Off -site impervious and grassed areas that flow to this pond must
be accounted for in the volume only.

'1/6. The proposed 12'' CMP cross pipe must enter the pond further away from the outlet or the
flow path from the pipe to the outlet structure must be lengthened by the use of baffles to
prevent short-circuiting of the pond.
7. Please revise the calculations to include calculations of the provided surface areas at 97.2
and 98.3, as well as the volume provided between.
/ 8. The built -upon areas in the calculations differ from the built -upon submitted on the form.
Please explain why the calculations report 1.176 acres of built -upon area west of the ditch,
and 2.3 acres east of the ditch, whale the submittal form shows 2.05 acres total. How can
the impervious area reported on the submittal form for the proposed development (2.05
acres) be more than the drainage area (1.96 acres)? Is off -site drainage accounted for in
the 4.62 acres of drainage area on the east side of the ditch?

What does the map attached with the calculations represent? It is not referenced in the
calculations. 6A 5
The runoff coefficient assigned to pavement (asphalt, gravel or pinestraw) is .95, not .75.
While in reality, .75 is probably valid for a new gravel parking lot, over time and traffic,
the void spaces in the gravel will clog with fines, creating a surface as impervious as
asphalt. Please recalculate the runoff volumes using a revised C factor.
Please add a note concerning the 3:1 minimum pond side slope above permanent pool to
the pond section details.
12. Please add a note to the 4" pipe inlet and support detail indicating which side the pond is
located on, so that no confusion arises as to where to locate the "tee" section of the outlet.
My calculations indicate that a 4" orifice is too large. Please revise the calculations.
/13. Please add a spillway detail.
✓14. If using Chart 3, 85 % TSS, a 30' vegetated filter must be provided. Please add a detail
of the filter to the plans, provide calculations of non -erosive flow velocity for the 10 year
storm, and indicate velocity reduction/flow spreader mechanism. See attached.
15. Including off -site impervious and green areas, the volume provided in the pond, based on
my planimetering, is deficient by approximately 3,600 ft3. Please revise.
