Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2007-1967. We are forwarding Permit No. SW8 081010 dated November 14, 2008, for the construction of the subject project. This permit shall be effective from the date of issuance until November 14, 2018, and shall be subject to the conditions and limitations as specified therein.- Please pay special attention to the Operation and Maintenance requirements in this permit and those in NPDES No. NC 0007064. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If at any time stormwater runoff from this project cannot be treated in the pond and system permitted under NPDES Permit No. NC0007064, then notification to the Division is required and alternative treatment measures must be provided and approved. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Wills, Jr. and Carolina Power & Light Company Progress Energy Brunswick Plant —Independent Spent Fuel Storage Installation (1SFSI) 8470 River Road SE, Southport, Brunswick County FOR THE Construction, operation and maintenance of impervious surfaces with collection and treatment of the stormwater runoff in the treatment system permitted under Permit No. NC 0007064. The NPDES system will serve as the permitted stormwater, control system for this project in compliance with the provisions of 15A NCAC 2H .1000 and Session Law 2007-1967 (hereafter referred to as the "stormwater rules') and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of this permit. This permit shall be effective from the date of issuance until November 14, 2018, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.8 on page 3 of this permit. The stormwater control has been designed to handle the runoff from 133,726 square feet of impervious area and its associated drainage areas from this project in addition to other flows in permit for NPDES NC0007064. 3. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. There is no future built -upon area allotted in this permit. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. Projects covered by this permit will maintain a minimum 50-feet wide vegetative buffer between all impervious areas and surface waters. 7. If at any time stormwater runoff from this project cannot be treated in the permitted system for the NPDES No. NC0007064, then notification to the Division is required and alternative treatment measures must be provided and approved. 8. The following design criteria have been provided in the stormwater control system and must be maintained at design condition: a. Drainage Area, acres: 17.53 Onsite, ft : 763,488 Offsite, ft2: none b. Total Impervious Surfaces, ft2: 133,726 C. Design Storm, inches: 1.5 d. Receiving Stream/River Basin: Atlantic Ocean/Cape Fear River e. Stream Index Number: 99-(3) f. Classification of Water Body: "SB" g. Permitted Stormwater Control System: NPDES Permit No. NC 0007064 II. SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all time provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and re -vegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Decorative spray fountains will not be allowed in the stormwater treatment system, unless specified in Permit No. NC0007064. Page 3 of 7 State Stormwater Management Systems Permit No. SW8 081010 6. The facilities shall be constructed as shown on the approved plans. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 10. The permittee shall submit to the. Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.. 11. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, Page 4 of 7 State Stormwater Management Systems Permit No. SW8 081010 accompanied by a completed name/ownership change form, documentation . from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation -and re -issuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. The permittee shall notify the Division any name, ownership or mailing address changes within 30 days. Permit issued this the fourteenth day of November 2008. Progress Energy Brunswick Plant —Independent Spent Fuel Storage Installation (1SFSI) 8470 River Road SE, Southport, Brunswick County FOR THE Construction, operation and maintenance of impervious surfaces with collection and treatment of the stormwater runoff in the treatment system permitted under Permit No. NC 0007064. The NPDES system will serve as the permitted stormwater control system for this project in compliance with the provisions of 15A NCAC 2H .1000 and Session Law 2007-1967 (hereafter referred to as the "stormwater rules') and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of this permit. This permit shall be effective from the date of issuance until November 14, 2018, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.8 on page 3 of this permit. The stormwater control has been designed to handle the runoff from 133,726 square feet of impervious area and its associated drainage areas from this project in addition to other flows in permit for NPDES NC0007064. 3. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. There is no future built -upon area allotted in this permit. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all time provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and re -vegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Decorative spray fountains will not be allowed in the stormwater treatment system, unless specified in Permit No. NC0007064. Page 3of7 State Stormwater Management Systems Permit No. SW8 081010 6. The facilities shall be constructed as shown on the approved plans. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. Access to the stormwater.facilities shall be maintained via appropriate easements at all times. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. Ill. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, Page 4of7 State Stormwater Management Systems Permit No. SW8 081010 accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 4. in the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 7. An approximately 2.0 acre reinforced concrete pad will be constructed at BSEP. The concrete pad will house the spent fuel storage canisters from the Unit I and Unit 2 nuclear reactors. The storm water runoff from the site will be from the flat concrete pad. Storm water from the pad and apron will be directed to the onsite 39 acre storm drain stabilization pond. The pond is permitted under the BSEP National Pollutant Discharge Elimination System (NPDES) permit number NCO007064 and is currently permitted to accept storm water runoff from most of the impervious surface areas of the plant. A copy of the storm water management permit application and design narrative for the ISFSI is enclosed. An Independent Spent Fuel Storage Installation (ISFSI) is proposed just outside the northeast corner of the existing Protected Area (PA) between the cooling "rater Intake Canal to the east and Industrial Landfill area to the west. The ISFSI consists of two (2) independent reinforced concrete storage pads in conjunction with adjoining aprons, which provide access to the pads. The two (2) reinforced concrete pads will provide storage capacity for (1.08) 61BTH Spent Fuel Dry Shielded Canisters (DSC) contained inside NUHOMS® concrete Horizontal Storage Modules (HSM) — Model H. Each pad consists of two (2) rows of 27 DSC-HSM units. STORMWATER INFORMATION The ISFSI area is currently a gently sloping gravel area that conveys stormwater runoff, through sheet flow, into. a series of swales. After construction of the project, runoff will be collected in a tank and then will be pumped to the existing Stabilization Pond. The water ultimately discharges through Outfall 005, as noted in NPDES Permit NC0007064, to the Intake Canal. The final discharge of the treated stormwater is conveyed through the plant, into the discharge canal, to the Caswell Beach Pumping Station via the discharge canal, and eventually into the Atlantic Ocean (Class SB water). The discharge point within the Atlantic Ocean is an existing point discharge and terminates approximately 2000-ft from the shore. Outfall 005 is an existing permitted outfall and this proposed work would not require permitting by the NCDENR Division of Coastal Management (DCM). The collection system for the ISFSI Pad is comprised of catch basins, piping, drainage trenches and a central detention vault. Two (2) 600-gpm pumps are to be provided to convey the detained runoff to the existing Stabilization Pond for controlled release to the Intake Canal through Outfall 005. The detention vault was sized to provide storage of the 1-year, 24-hour storm event with a total precipitation depth of 3.7-inches. The required storage for this event was calculated to be 11,700-cf. The total storage volume provided within the detention vault is 11,782-cf. The proposed drainage area for the 1SFS1 Pad, drainage area 1., is 1.73,686-sf (3.99-ac) and is 51.47% built -upon -area (BUA). Sizing computations. for the first 1.5-in of runoff show that a treatment volume of 11.,143-cf is required (11,782-cf provided). Based on the sizing of the storage vault, the flow rate of the pumps and the large volume in the Stabilization Pond, the first 1.5-in of runoff will be treated within the existing Stabilization Pond. Four other drainage areas fall within the ISFSI project boundary. The drainage area for each wet pond is clearly delineated and numbered to match up to the calculations and supplement. Drainage area delineation is best done as a separate plan sheet. 27. All roof drainage must be directed to the pond. Show the roof drain collection lines on the plan. The items may be combined into one plan or a few. Typically stormwater plans for one pond treatment includes a site plan; a second for layout with drainage areas, grading, and bua details; and a third for appropriate details. The design storm and narrative are addressed in the calculations package that is sealed by the PE. You do not need to submit a pond supplement and details of the pond since it is permitted in NPDES permit, but most of the rest is typical of other high density permits for state stormwater. in addition to this for normal state stormwater projects, in lieu of the pond supplement and calculations for a typical bmp, the information from the NPDES permit will be submitted with the application, to include at a minimum: NPDES permit cover page and applicable pages demonstrating flows are permitted from this project drainage area and BUA... or otherwise. If there is an ATC for changes to the NPDES permit, please submit the cover sheet from that ATC submittal and approval where applicable. Please mention the NPDES 0007064, outfall 005. It would help if you can describe the outfall 005 going to large canal and then outlet 5 miles out to the Atlantic and then [i thought they said] the discharge is 2000 ft into the water body. The intent is to describe that the design storm is collected and routed to the NPDES 0007064 pretreatment tank and pond, then outlets through 005, to the canal, etc... to the discharge point. It would help to state that the discharge point is not new to address any potential LAMA questions. Mention the spoil area used is permitted by DCM, etc.. 2. site plan locating this project area and other relevant stormwater permitted.drainage areas and facilities on the property. [major landmark - not anything confidential] 3. drainage area plan showing the project area with contours and elevations, paving, collection, built -upon areas, wetlands, waters, etc... that demonstrates the state stormwater is being collected on the new BUA and routed to the treatment system. 4. documentation demonstrating the design storm is collected, stored and treated. This project falls under the Oct 1 rule revision for Brunswick county. Typical design storm requirements. The treatment system typically has some form of sediment removal for pretreatment and/or storage basin that meets the intent of state stormwater treatment and often other items, etc... 5. State on the plans that no wetlands exist in the drainage/project area. 6. copy of the existing NPDES permit cover page and applicable pages demonstrating flows are permitted from this project BUA. In this case the permit has a blank for flows and the indicates the appropriate information. Submit the existing one now and if a mod or amendment is done, then send me the cover page from that version. 7. If an ATC is done, then a copy of the ATC cover page and applicable pages for this project when it is submitted. 8. Please note that if not approved by NPDES 0007064 and/or the design or other applicable documents or rates change, then this stormwater permit will need to be modified. 9. Include the application for a new high density state stormwater permit. The project area can just be this particular project. On the application in section 111 (1) you can just state the bua from the ISFS1 pad will be collected and routed to treatment permitted under the NPDES 0007064. 10. The application will be written to the main officer at site, but can be signed by others for him/her if you submit a copy of the letter of signature authority. 11. The application fee is $4000 for the high density permit. 12. At some point, it would really be helpful if Progress Energy could submit a site plan with the drainage and project areas for all the state stormwater permits on site, with permit numbers listed on the site plan. In general, there should not be a lot of extra work to do for stormwater application except for the drainage plan, design storm calcs, and the application. An Independent Spent Fuel Storage Installation (ISFSI) is proposed just outside the northeast corner of the existing Protected Area (PA) between the cooling water Intake Canal to the east and Industrial Landfill area to the west. The ISFSI consists of two (2) independent reinforced concrete storage pads in conjunction with adjoining aprons, which provide _access to the pads. The two (2) reinforced concrete pads will provide storage capacity for (108) 61BTH Spent Fuel Dry Shielded Canisters (DSC) contained inside NL HOMS® concrete Horizontal Storage Modules (HSM) — Model H. Each pad consists of two (2) rows of 27 DSC-HSM units. STORMWATER INFORMATION The ISFSI area is currently a gently sloping gravel area that conveys stormwater runoff, through sheet flow, into. a series of swaies. After construction of the project, runoff will be collected in a tank and then will be pumped to the existing Stabilization Pond. The wrater ultimately discharges through Outfall 005, as noted in NPDES Permit NC0007064, to the Intake Canal. The final discharge of the treated stormwater is conveyed through the plant, into the discharge canal, to the Caswell Beach Pumping Station via the discharge canal, and eventually into the Atlantic Ocean (Class SB water). The discharge point within the Atlantic Ocean is an existing point discharge and terminates approximately 2000-ft from the shore. Outfall 005 is an existing permitted outfall and this proposed work would not require permitting by the NCDENR Division of Coastal Management (DCM). The collection system for the 1SFS1 Pad is comprised of catch basins, piping, drainage trenches and a central detention vault. Two (2) 600-gpm pumps are to be provided to convey the detained runoff to the existing Stabilization Pond for controlled release to the Intake Canal through Outfall 005. The detention vault was sized to provide storage of the 1-year, 24-hour storm event with a total precipitation depth of 3.7-inches. The required storage for this event was calculated to be 11,700-cf. The total storage volume provided within the detention vault is 1.1,782-cf. The proposed drainage area for the ISFSI Pad, drainage area 1, is 173,686-sf (3.99-ac) and is 51.47% built -upon -area (BUA). Sizing computations. for the first 1.5-in of runoff show that a treatment volume of 1.1,1.43-cf is required (11,782-cf provided). Based on the sizing of the storage vault, the flow rate of the pumps and the large volume in the Stabilization Pond, the first 1.5-in of runoff will be treated within the existing Stabilization Pond. Four other drainage areas fail within the ISFSI project boundary. DENR Customer Service Center. 1800 623-7748 SUPPLEMENT TO PERMIT COVER SHEET Carolina Power & Light Company d/b/al Progress Energy Carolinas, Inc. is hereby authorized: 1. to continue operating a 1,900 MGD cooling water system consisting of an intake structure, 9.6 mules of intake and effluent canals connected via internal Outfalls 001 and 002, circulation pumps, siphons under the infra -coastal waterway, a discharge pump station at Oak Island, and final discharge conduits terminating 2,000 feet offshore; all necessary appurtenances to withdraw cooling water from the Cape Fear River near Snow Marsh, and thereby to discharge cooling water into the Atlantic Ocean; and 2. to continue operating and discharging via internal Outfall 004 (see attached map), a 0.055 MGD - domestic wastewater treatment plant (WWTP) consisting of influent pumps, bar screen, effluent flow v-notch weir measuring device, aeration tank, secondary clarifier and chlorination- chamber; and 3. to continue discharging via internal Outfall 010 (see attached map), and continue operating the existing 6.036 MGD Support Services domestic WWTP (previously permitted under NC0083895) consisting of an influent duplex pump station, manually cleaned bar screen, flow EQ basin, flow splitter box, two (2) aeration basins, two (2) clarifiers, two (2) tertiary filters, aerobic sludge digestor with airlift sludge pump, baffled chlorine contact chamber with one (1) tablet chlorinator, and an effluent flow v-notch ff weir measuring device; and `J 4. to continue to discharge treated metal cleaning wastes (Outfall 006), treated low -volume wastes and stormwater (Outfall 005) to the Intake Canal; and 5. to continue operating a diversion fence located at the mouth of the intake canal; and '6; to continue operating fine -mesh screens; as described under Part I, A.(L) Outfalls 001 and 002 at intake pump bays; and 7, to continue to operate an intake pump system to minimize intake flow rate; and 8. to discharge stormwater from Outfalls 007, 008, and 009 (see attached map) into Nancy's Creek, classified as Class SC-Sw-HQW waters within the Cape Fear River Basin; and 9. to discharge stormwater, wastewater, and cooling water via internal outfalls from said treatment works, Intake Canal, and Discharge Canal (see Attachment 1) into the Atlantic Ocean, Class SB waters; located at the Brunswick Steam Electric Plant on NC Highway 87, Southport, Brunswick County.
