Staff review of the plans and specifications has determined that the project; as proposed, ),will comply with the Storrnxvater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding modified Permit No. SW8 060509 dated June 22, 2017, for the construction; operation, and maintenance of the permitted built -upon areas and BMP's associated With the subject project. This modification converts tite pond surface areas that vxre considered as impervious in the previous Version of this permit to future B A for the four permitted wet detention ponds, while maintaining overall low density. The constructed -wetlands are unchanged. This permit shall be effective from the date of issuance until July 10. 2020, and shall be subject to the conditions and limitations as specified therein. Please pay special attention"to the conditions listed in this permit regarding the Operation and Maintenance of the 13MP(s), recordation of deed restrictions, limitation of built -upon area, certification of the B.M11's, and the procedures for changing ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record (iced restrictions, to limit built -upon area; to certify the BMP's, to transfer the pennit; or to renew the permit, will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAFI). DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 on page 3 of this permit. The subdivision is permitted for 1,029 single family lots, each allowed a maximum amount of built - upon area as listed in Section 11.16(f) of this permit. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 4. The overall density level of the project must remain at 30% or less. The overall maximum allowed built -upon area is 6,227,747 square feet. The currently proposed amount of built -upon area is 5,567,798 square feet, which leaves 659,948 square feet of total BUA available for future development. 5. Additional stormwater control measures may be required for any future development areas of higher density that are not treated in one of the ponds or in the constructed wetland. Additional stormwater control measures for these areas must be submitted as a permit modification and approved by the Division prior to construction of any future BUA. SCHEDULE OF COMPLIANCE The facilities shall be constructed, operated and maintained in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data as attached to this permit and on file with the Division. 2. The permittee shall review all new and modified lot plans for compliance with the BUA and piping limits. The plans reviewed must include all proposed built -upon area. The permittee shall not approve any lot plans where the requirements of the stormwater permit have not been met. 3. The permittee is responsible for monitoring the project on a routine basis to ensure that lot owners maintain compliance with the built -upon area limits. The permittee shall notify any lot owners that are not in compliance with the permit requirements in writing and shall require timely resolution. 4. The stormwater runoff collection system, the conveyance system and the control measures must be contained within either public right-of-way, dedicated common area or recorded easement. The final plats for the project will be recorded showing all such required rights -of -way, common areas and drainage easements, in accordance with the approved plans. 5. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 6. The permittee shall submit to the Director and shall have received approval for .revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Redesign of, or addition to the approved amount of built -upon area, including increases and decreases to the recorded maximum BUA limit. C. Further subdivision, acquisition, or sale of the project area, in whole or in part, as reported on the application documents. d. Filling in, altering, piping, removing, rerouting, resizing or regrading any component of the runoff conveyance, the collection system or the permitted stormwater control measures shown on the approved plan. e. The construction of any future BUA reported on the application documents. f. The construction of any areas of #57 stone or permeable pavement or a public trail for BUA credit. g. Other revisions as determined by the Director. 7. The stormwater management system shall be entirely constructed, vegetated and operational for its permitted use prior to the construction of any built -upon surface. 8. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. Page 3 of 8 Siate Stormwater Management Systems Pennit No. SW8 060509 9. The permittee shall provide the operation and maintenance necessary to assure that all components of the permitted stormwater system function at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. c. Mowing and re -vegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of structures, orifice, catch basins and piping. g. Access to all components of the system. 10. Records of maintenance activities must be kept and made available upon request to authorized personnel of DEQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 11. The permittee shall assure that the current recorded deed restrictions are amended as follows, prior to the sale of any additional lots: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 060509 Modification, as issued by the Division of Energy, Mineral and Land Resources under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division. f. The maximum built -upon area per lot is as follows: DA-1 (323 lots) #1-37, 300-547, 551-567, and 600-620 @4500 sf; DA-2 (55 lots) #888-926 and 937-952 @4500 sf; DA-3 (112 lots) #832-887, 927-936 and 953-998 @4500 sf; DA-4 (74 lots) #38-76, 548-550 and 568-599 @4500 sf; DA-5 (1 lot) #1018 @3200 sf; Lots 77-92, 278-299, 999-1017, and 1019-1029 @4500 sf; Lots 93-277 and 621-831 @3800 sf. The allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. g. Lots within CAMA's Area of Environmental Concern may be subject to a reduction in their allowable built -upon area due to CAMA regulations. h. Within the drainage area of a BMP, all runoff on the lot must be directed into the permitted system. This may be achieved by piping or grading. Lots that will naturally drain into the system are not required to provide these extra measures. Page 4 of 8 State Storinwater N-tanagement Systems 1'ennit No. S'W8 060509 12. A copy of the amended recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat. The recorded amendment must contain all of the statements in Section 11.11 above, the signature of the Permittee, the deed book number and page, and bear the stamp/signature of the Register of Deeds. 13. The proposed amendment to the built -upon area limits shall be voted on by the Summerhouse on Everett Bay HOA membership. Additional lot sales may not be finalized until the amendment is approved and recorded. 14. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 15. Permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 16. Prior to transfer of the permit, the stormwater facilities will be inspected by DEQ personnel. The facility must be in compliance with all permit conditions. Any items not in compliance must be repaired or replaced to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 17. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2 foot below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The failing water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for the fountain's pump is based on the permanent pool volume as specified in Section I (6)(m). Ill. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Permit Transfer Application Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events. a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256, c. Bankruptcy; d. Foreclosure, subject to the requirements of Session Law 2013-121; e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2- 01(e) and NCGS. 57D-6-07; Page 5 of 8 State Stormwater Managenient Systems Permit No, SW8 060509 2. The permittee shall submit a competed Permit Update Form to the Division within 60 days of any one or more of the following events: a. A name change of the current permittee; b. A name change of the project; c. A mailing address change of the current permittee; 3. The permittee is responsible for compliance with all of the terms and conditions of this permit until such time as the Director approves the transfer request. 4. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. 5. The issuance of this permit does not preclude the Permittee from complying with all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal), which have jurisdiction. 6. If the facilities fail to perform satisfactorily the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater control measures. A permit modification in required prior to the construction of any additional or replacement stormwater control measures. 7. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. The Permittee grants permission to staff of the DEQ to access the property for the purposes of inspecting the stormwater facilities during normal business hours. 9. A copy of the approved plans and specifications shall be maintained on file by the Permittee. 10. The permittee shall submit a renewal application, fee and required documentation to the Division at least 180 days prior to the expiration date of this permit. That will require signed and sealed calculations for the wetland to show that either: 1) the wetland as currently sized can accommodate the increased volume; or 2) how you are going to enlarge the wetland to accommodate the increases. If you submitted this previously, I am unable to locate these calculations in the file. I confirmed that there are 1029 lots, however, the BUA for Lot 37 appears to be double - counted in both the Spicer Lake Pond (Lots 1-37) and the Painted Lady Pond (Lots 37-51). Now that the BUA has been reallocated to the ponds and the wetland to maintain overall low density, the proposed BUA no longer matches the previously approved supplement forms. It looks like new supplement forms will now be needed for all of the ponds and the wetlands reflecting the revised permitted BUA limits for each BMP. I can accept those via email. In 2013, however, a new registered agent (Richard Sweyer) and a new mailing address (1612 Military Cutoff Road Suite 108, Wilmington) were filed with the NCSOS. The application we received on Mach 2, 2017, indicates that the mailing address is 291 Spicer Lake Drive. This appears to be the home address for the current president, Griff Garner. Since Mr. Garner will not always be 2 the president, we really need to stick with the HOA's corporate mailing address for the permit. We are happy to send a copy of the permit to Mr. Garner at his home address and to any future HOA president. Each time the registered agent changes, and each time the president of the Association changes, please have the HOA complete and submit the Permit Update form with the new registered agent information, and/or the name and home address of the new president. Please update page 2 of 6 with the correct corporate mailing address for the HOA and email that revised page to me. If there are any subsequent NCSOS filings after 2013 regarding the registered agent and/or the mailing address, please submit a copy of that filing to match up with the HOA mailing address you put on the application. We will not be able to write a permit as overall low density that allows the applicant to have large amounts of future BUA and treatment capacity in the ponds. The overall density must be limited to no more than 30% and the amount of future BUA in each pond must be limited such that, when you add up all the future allocations, the total does not exceed 659,948 sf. As the development progresses, and the permittee finds that perhaps capacity needs to be reallocated from one pond to another, that would be a simple plan revision. Having the permittee/HOA understand the currently proposed concept and keep track of it all is asking too much. The project would have to be modified to overall high density in order for us to permit the project as proposed. Keep in mind that changing to overall high density would require that all of the runoff from all of the lots be collected and treated. I'm not sure I can explain it well, either. The total maximum future BUA that the overall site can have and stay under 30%, is 659,948 sf. BUT, he doesn't want to split up that 659,948 sf and allocate a specific amount for each of the 4 ponds. The ponds are over -designed and each can treat a much larger amount of future BUA, but if we put what the ponds can actually treat in the permit, it would far exceed the 659,948 total that keeps it all low density. He wants to specify how much Future BUA each pond could "possibly" handle, but leave it up to the permittee to keep track of how much of the "possible" future BUA each pond actually uses up, and make sure the overall total Future doesn't exceed 659,948 sf. The current proposal is for the permit to say that Pond 1 could handle 659,948 Future sf, Pond 2 can handle 51604 Future sf, Pond 3 can handle 97400 Future sf and Pond 4 can handle 206538 future sf. But, if all of that 659948 future allocation was put into Pond 1, then none of the other 3 ponds could have any future BUA because that would exceed the 30% overall limit, even though the permit would still say that they have a "Possible" future allocation. This seems open-ended and contradictory to me and the permit should not be open-ended or contradictory. I'm not sure we can trust the permittee to understand this concept, or keep tabs on how much future BUA is being allocated within each ponds DA, or to make sure it is capped at 659948 sf. It may require quarterly reporting or frequent updates to the permit to adjust the future balances in each pond. I would prefer it if the permit just had a portion of the 659,948 future amount allocated to each pond. I saw a few "double" counted lots and like you I figured they were being conservative just in case, especially where the lots straddle the two drainage areas. I'm not certain how I will accomplish revising the drainage areas for each drainage basin. I can "estimate" the areas, but I was not the original engineer, and I don't have any CAD files, I've got what you have which is a paper copy of an old set of poorly labeled plans. I will go back and look on the plans,but I suspect the "areas" are probably correct, and they simply messed up listing the lots. The reason i think this is because they prepared a drainage area map for You (DEQ), and that is how I checked the lots, and saw several of their mistakes. I know that is what I had the hardest time doing, was following all of the lots, their numbering scheme doesn't make much sense to me. I suggest that you take any unused pond area allocation (based on the currently permitted maximum BUA allowed per pond) and call it future BUA on the new application. The DA for Pond #1 will most likely be reduced because Lot 550 was added to DA #4, Lots 621-623 were added to DA #5, and lots 977-998 were added to DA #3. DA #3 added lots 832-836 and lost lots 937 and 888. Some of the "overlap" where lots were listed in 2 different DA's, may have stemmed from a desire to be conservative, especially, if those lots straddled 2 drainage areas, or could go either way. The permit for this project currently states that "The overall density of the project must remain at 30% or less. The new overall maximum allowed built -upon area is 5,227,747 square feet. The current proposed amount of built -upon area is 4,789,131 square feet, which includes 51,833 square feet of future development". This permit revision does not change the overall maximum allowed built upon area described above but will revise the current proposed amount above from 4,789,131 to 5,619,831 square feet. This revised amount is still well below the low density threshold set out in this permit. The new impervious percentage is now at 27.07%. Enclosed with this submittal you will find revised BUA calculations for each pond drainage area and the total drainage basin. I removed the BUA from the pond calculations as we discussed on our December 7, 2015 meeting with the president of the HOA. As you can see after we remove this area we have more than enough allowable BUA for the lots. It should also be noted that we discovered several small accounting errors in the lot listing. The rules state that areas of higher density (>30%) should be constructed as far away from surface waters as possible. Are there any areas like this? If so, those areas should be treated by a pond. Please check the low density areas that are not draining to a pond to be sure they remain less than 30% density. Also, they will have to change the deed restrictions to include a higher BUA per lot. They can just sign a new document stating that they will get this done. You may need an Attachment if the BUA varies per lot. As a reminder, the permit modification of Aug. 7, 2012 did not change the individual BMP drainage areas and BUAs. However, it did change the overall BUA and drainage area slightly. The overall BUA went down in this modification (to 4,789,131 sf) due to them adding BUA for lots, streets, tennis courts, and future BUA allocation, but subtracting the pond surface area as impervious. Please reference the Attachment on page 3 of the previous permit application, I'm not sure if this modification was ever implemented in the field. Do you know about that? My notes I jotted down from the meeting stated the following, that we can Add BUA within each Drainage area (basin) so as long as we don't go over what is allowed for each basin. As we discussed the only "area" we gain is from the pond surface area as this is listed as BUA in the original engineer's calculations. So In short, I have studied each drainage basin area (S total) removed the Pond from the BUA calculations and redistributed the pond BUA to the lots within that basin. I was able to do this, achieve the BUA the client desires and stay under the BUA limits as defined in the permit. I believe we will call that a Christmas miracle, lol. What I plan to do is to revise the Basin Information charts to reflect these changes and submit it as a plan revision. No changes to the plans, the BUA limits are all below the pond calculated limits and we stay well below the 30% BUA threshold for the the overall project.
