Dear Mr. Connor and Mr. Baker:
The Wilmington Regional Office received a request to transfer ownership for the Stormwater
Management Permit for Tarawa Terrace II on April 15, 2009. Permits are issued to both Atlantic Marine
Corps as lessee and Camp Lejeune as landowner. Permit compliance lies with the landowner and if the
owner requests others to manage permit compliance then the Division will issue to both. The permit
modification issued on October 17, 2008 was issued to both Atlantic Marine Corps Communities and The
Commander Camp Lejeune. This permit is in effect. Please find attached the current permit. Requests
for Name/Ownership Changes were also received for SW8 051001, SW8 060323 and SW8 051018 on
April 15, 2009 and these permits have been changed to Atlantic Marine Corps Communities LLC and
Camp Lejeune. The permits have been mailed to each permittee.
Please be aware that if the lease agreement between USMC Camp Lejeune, the property owner,
and Atlantic Marine Corps Communities, LLC, the lessee, is cancelled or defaults, USMC Camp Lejeune
will be operating a stormwater treatment facility without a valid permit. This is a violation of NC General
Statue 143-215.1 and may result in appropriate enforcement action including the assessment of civil
penalties of up to $10,000 per day, being taken against the property owner, USMC Camp Lejeune.
Therefore, if the current lease agreement between USMC Camp Lejeune, the property owner, and Atlantic
Marine Corps Communities, LLC, .the lessee, is cancelled or defaults, USMC Camp Lejeune shall notify
DWQ immediately and shall submit a completed Name/Ownership Change Form within 30 days.

Atlantic Marine Corps Communities,- LLC (AMCC) is the private partner within the Public Private Venture (PPV) and we
have a fifty year ground lease with the Department of the Navy for all of the current housing at Camp Lejeune, North
Carolina. Part of our agreement is to build, own, manage, and maintain all systems related to the housing inventory within
our ground lease. That being the case, we are required to maintain all of the storm water systems within that area.
Enclosed are the permit ownership forms that were filled out in error by the Installation as the rightful owner of the storm
water management should have been. Please have the permits updated as soon as possible.

On May 29, 2009, David Cox of the Wilmington Regional Office of the Division of Water Quality (DWQ)
inspected Tarawa Terrace Il in Onslow County to determine compliance with Stormwater Management
Permit Number SW8 051018 issued on October 17, 2008, DWQ fife review and site inspection revealed
that the site is compliant with the terms and conditions of this permit. Please find a copy of the completed
form entitled "Compliance Inspection Report" attached to this letter.
Please be advised that you are required to comply with the terms, conditions and limitations of your
Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North
Carolina General Statute 143-214.7, including operation and maintenance of your permitted stormwater
system.
If the project has changed name, ownership or mailing address, a formal change of nam&ownership form
must be submitted to DWQ within 30 calendar days detailing the change. Please provide the name,
mailing address and phone number of the person or entity that is now responsible for this permit.

After leaving your office last week, we drove the site. We were surprised to see that this house was already built.
suspect that somebody thought that it would have been less disruptive to the resident next to it to build the home
as part of phase 2 instead of 5. Of course, nobody thought about the stormwater permit. I am going to inform .
Actus that they screwed up, but that we can fix it. As Brady said in his e-mail, we will simply collect the
downspouts and run them to the curb inlet, as discussed in your office last week.
It has been difficult to convince these contractors that changes to the approved plans have to go back through you
guys. We'll keep trying to educate the contractors. Sorry for the confusion.

It sounds like you have a problem. in the set of approved plan for the 2nd phase portion of the
development, CS-4.01 and CG-4.01 clearly shows an unidentified "typical" house around the corner
from lot 238 that has been shaded out and not part of Phase 2. So you now have BUA constructed that
has not yet been approved (at least in the Phase 2 portion of the plans). Figure out how to collect the
runoffof and treat it. If there is absolutely noway to collect it, then provide detailed justification and
identify where the runoff is going and if it has at least some kind of vegetated filter.

After our meeting Thursday Tom Davis and I drove through the Tarawa Terrace Neighborhood and
observed that the building at the southwest corner of phase 5 had already been built in phase 2
construction. We had talked about tying a roof drain from the building into a storm inlet along the road
for the solution to capture this BUA. From a new construction standpoint this was a viable option but
now that the building is already in place we wanted your opinion on what direction you would like us to
take on this matter. See the attached plan sheets from our phase 2 construction plans for reference
(CG-4.01 shows the majority of the building). The building in Question is located on lot 237. Other than
that we have all comments addressed and are ready to send out the submittal package to you tomorrow.

After our meeting Thursday "hom Davis and I drove through the Tarawa Terrace Neighborhood and
observed that the building at the southwest corner of phase 5 had already been built in phase 2
construction. We had talked about tying a roof drain from the building into a storm inlet along the road
for the solution to capture this BUA. From a new construction standpoint this was a viable option but
now that the building is already in place we wanted your opinion on what direction you would like us to
take on this matter. See the attached plan sheets from our phase 2 construction plans for reference
(CG-4.01 shows the majority of the building). The building in question is located on lot 237. Other than
that we have all comments addressed and are ready to send out the submittal package to you tomorrow.

(the "Authorization") has provided alternative authorities for acquisition and improvement of

WHEREAS, pursuant to the Authorization, the Department of the Navy issued
Invitations for Offerors N62470-04-RI'-00163, N-62470-06-RP-00013 and N-62470-07-RP-
00002, for creation of a public -private venture for the development and operation of housing
in support of Marine Corps operations at (1) Marine Corps Base Camp Lejeune, Jacksonville,
North Carolina, (ii) Marine Corps Air Station New River, Jacksonville, North Carolina,
(iii) Marine Corps Air Station Cherry Point, Havelock, North Carolina, (iv) Stewart Terrace,
New York and to market and sell certain land and housing at Stewart Terrace; New York,
and (v) Westover Air .Force Reserve Base, Massachusetts (as amended, the "IFO");
WHEREAS, Actus Lend Lease LLC responded to the 1FO, and submitted its offer to
design, develop, finance, construct, renovate, demolish, sell, own, lease, replace, manage,
acquire, operate and maintain existing and certain new residential units and associated

Dear Mr. Connor. -
The Division received a stormwater management application for the modification of Tarawa
Terrace to include Phases 5 and 6 on August 7, 2008. The submitted package was found to
be incomplete, thus not acceptable for the Express Stormwater Permitting Program. The
application and check (number 030306) are being returned because the package lacked the
necessary elements to accept it for review. The following information is needed to accept the
application for review:
Provide a soils report from a soil scientist estimating the elevation of the Seasonal High
Water Table (SHWT) at the proposed location for each BMP. During the
submittallscoping meeting on July 22, 2008, it was understood that a soils report was to
be provided with the package. A geotechnical report is not an appropriate means for
determining the SHWT. Once the SHWT has been determined, include it on the
supplement sheets and on the pond details in the plans.
If the permanent pool is found to be below the seasonal high water table, please
demonstrate that sufficient storage volume has been provided given the possibility that
the permanent pool elevation may be somewhat higher than designed due to the SHWT
elevation and the volume of groundwater entering the pond. The underground
watershed area and the permeability of the soil will need to be taken into account in
order to demonstrate that sufficient storage volume has been provided.
2. Portions of the proposed project are not included in the drainage areas for the ponds.
Since this is a high -density project, stormwater runoff from all built -upon areas (BUA)
must be treated in the pond. If these areas cannot be captured and treated in the pond,
please demonstrate.
3. The drainage area information for each pond on the project, both existing and proposed
needs to be included in Section 111.9 or on a separate sheet of the application. The
information provided in Section 111.9 of the application, combines the Boy Scout Road
pond and the Tarawa Blvd ponds into one drainage area. In addition, please provide an
overall project area detailing the total BUA proposed.
4. Provide Inspection and Maintenance Agreements for each wet detention pond.
5. Verify all numbers are correct to ensure consistency in the application documents.
Please keep in mind that changing one number may change other numbers and reClu�e

In the regular stormwater program the fee is $505.00 for any type of
project. The review period is uncertain. Every once in awhile, they get
a permit issued within 30 days. More often the time period is 60+ days.
The deadline by statute is 90 days from the time a "complete"
application is received. Regular stormwater application packages should
be sent to the attention of Jo Casmer, 127 Cardinal Drive Extension,
Wilmington, NC 28405. Jo's telephone number is 910 796-7245.
In the Express Stormwater Program the fee is $4,000 for a high density
modification. The submittal of the application package must be E C E
scheduled._ There is a meeting in person to go over the application
package. Once the package is accepted, the review period is 10 days at
which time a permit is issued or an additional information request is JUL 0
sent (could be additional charge associated with add --info). Once the
additional information comes back in, the engineer must review it within
2-5 days of receipt. The entire review process should be 30 days or D}A
less. If you would like to get an Express meeting scheduled, that is PROD #
done by me and I am attaching an Express Request. This completed form is
submitted with a stormwater narrative, a vicinity map and a pdf site

June 30, 2008
Phase 5 high density development of the Tarawa Terrace II neighborhood covers 34+
acres of land. The residential project includes demolition of 160 outdated, existing
housing and construction of 64 new duplex buildings which will house 128 Marines and
their families. Plans also call for construction of some new roads, utilities, and other

Jacksonville, North Carolina on Marine Corps Base Camp Lejeune. Stormwater runoff
will be discharged in an Unnamed Tributary to Northeast creek which is classified as
SC;FIQW;NSW. Tarawa Terrace is within the White Oak River Basin. There are no
buffer requirements, no new road construction to access the site, and no off site drainage
for phase 5 of Tarawa "Terrace.
Storm water runoff from the site drains to either the North Guam Drive or South Guam
Drive detention ponds proposed within this phase. The two ponds stated above are part of
the modification to Storm Water Permit No. SW8 051018. The permit includes the Boy
Scout Camp Road pond and the Tarawa Boulevard Pond at the southwest corner of the
site, a small portion of storm water runoff from Tulagi Place has been permitted to
discharge under post -development conditions at the same location it currently discharges
under pre -developed conditions. The Tarawa Boulevard Pond is scheduled for
construction as part of Phase l of the redevelopment of the Tarawa Terrace 11
neighborhood, while the Boy Scout Camp Road pond should be constructed as part of
Phase 2. Storm water runoff will be routed to these ponds through subsurface drainage.
Sediment and Erosion Control Measures for the 34f disturbed acres and 37% impervious
surface of phase 5 construction include silt fence along the perimeter of the site and three
temporary sediment traps to remove sediment from the expected sheet flow. Rock check
dams are also to be installed where flow has been channelized to assist in the removal of
sediment. Drainage areas for the silt fence, temporary sediment traps, and check dams
have been designed according to North Carolina Department of Environment and Natural
Resources regulations.

Phase 6 high density development of the "Tarawa Terrace II neighborhood covers 43+
acres of land. The project includes demolition of outdated, existing housing and
construction of 83 new duplex buildings which will house 166 Marines and their families.
Plans also call for construction of some new roads, utilities, and other infrastructure.

In the regular stormwater program the fee is $505.00 for any type of
project. The review period is uncertain. Every once in awhile, they get
a permit issued within 30 days. More often the time period is 60+ days.
The deadline by statute is 90 days from the time a "complete"
application is received. Regular stormwater application packages should
be sent to the attention of Jo Casmer, 127 Cardinal Drive Extension,
Wilmington, NC 28405. Jo's telephone number is 910 796-7245.
In the Express Stormwater Program the fee is $4,000 for a high density
modification. _The submittal of the application package must be
scheduled._ There is a meeting in person to go over the application
package. Once the package is accepted, the review period is 10 days at
which time a permit is issued or an additional information request is
sent (could be additional charge associated with add -info). Once the
additional information comes back in, the engineer must review it within
2-5 days of receipt. The entire review process should be 30 days or
less. If you would like to get an Express meeting scheduled, ,that is
done by me and I am attaching an Express Request. This completed form is
submitted with a stormwater narrative, a vicinity map and a pdf site
plan (when available). We are currently scheduling appointments within 2
weeks or less.

The Erosion Control plans for Tarawa Terrace Phase 5 were submitted separately and
were received in DENR office on Monday 7th July. (Signed for by C.Pittman) This
Erosion Control permit application was addressed to Dan Sams.
Phase 5 will have two new storm water ponds and Phase 6 will have one new storm water
pond. We have been using the new July regulations for the design of these three
ponds. (along with the interactive spreadsheets)

Gentlemen:
We are in receipt of the Express Request for Tarawa Terrace Phase 5 &
6. The Erosion Control plans cannot be reviewed through Express
because of the 20 -acre limit (land disturbance) imposed by the
Division of Land Resources. I have verified with Carol Miller in Land
Resources.
In the existing file for stormwater Permit SW8 051018, we do not find
the engineering certifications for the two ponds associated with this
project (i.e. Tarawa Boulevard Pond and the Boy Scout Road Pond).
Please provide those when you come in with this submittal if possible.
Please verify that *2 new stormwater ponds* are proposed to treat the
runoff from Phase 5 & 6. This is not indicated on the express
Request-. If 2 more ponds are proposed, are they designed to be meet the
federal Phase II stormwater rules that came into effect last July?
Please let me know so that we can proceed with scheduling.
