Pender County
Dear Mr. Bonomolo:
John E. Skvada, III
Secretary
Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that the attached updated permit now references DEMLR as the Division
responsible for issuance of the permit.
On November 24, 2014, the Wilmington Regional Office received a request to change the owner's
name associated with the state stormwater management permit from the dissolved corporate entity,
Center 118, LLC, to the current tax record owner of the property, Nicole Renee Investments, Inc. Staff
of DEMLR have inspected the project, determined that the documentation is in order, and that the
project is in compliance with the terms and conditions of the state stormwater permit. By signing the
Name/Ownership Transfer form, you have accepted the responsibility for complying with the terms and
conditions outlined in this permit.
The Division is hereby notifying you that ownership of this permit has been changed on December 10,
2014 and to remind you that this permit shall be effective until October 19, 2020, which includes all the
available extensions. The project shall be subject to the conditions and limitations as specified in the
attached updated permit. Please pay special attention to the conditions listed in this permit regarding
the Operation and Maintenance of the BMP(s), recordation of deed restrictions, certification of the
BMP's, procedures for modifying the permit, changing ownership, transferring the permit, and renewing
the permit. Failure to establish an adequate system for operation and maintenance of the stormwater
management system, to record deed restrictions, to certify the BMP's, to transfer the permit., or to
renew the permit, will result in future compliance problems.
For your records, please find enclosed a copy of the updated permit, a copy of the inspection report,
and a copy of the Name/Ownership Change form submitted on November 24, 2014. Please keep this
cover letter and the updated permit on file at all times.
Please be aware that the project's built -upon area and stormwater controls must be built and
maintained in compliance with the permit documents and the approved plans. Maintenance of the
approved system shall be performed in accordance with the signed Operation and Maintenance
agreement. Any modifications to this project must be submitted to DEMLR and approved prior to
construction. The issuance of this approval does not preclude you from complying with all other
applicable statutes, rules, regulations or ordinances, which may have jurisdiction over the proposed
activity, and obtaining a permit or approval prior to construction.

Stormwater Permit No. SW8 041133
Pender County
Dear Mr. Bonomolo:
John E. Skvarla, III
Secretary
Effective August 1, 2013 the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified.
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any. development
approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010.
The law extended the effective period of any stormwater permit that was set to expire during this time
frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed
Session Law 2010-177 which granted an extra year for a total of up to four (4) years extension.
Accordingly, the current State Stormwater Management Permit # SW8 041133, which was set to expire
on October 19, 2016, is now in effect until October 19, 2020. Please submit the permit renewal
application and fee at least 180 days prior to the new expiration date, which would be around April 20,
2020. A copy of the Renewal Application can be obtained from the following website:
http:/pprtal.ncdenr.or,q/web/lr/state-stormwater-forms does.
Please note that per Schedule of Compliance Condition 11.9 of the October 19, 2006, permit, the
permittee is required to submit to and receive approval from the Division for any modifications, including
a transfer of ownership. In addition, General Condition I ll.1 indicates that the permit is not transferrable
except after notice to and approval by the Division. And lastly, per General Condition 111.9, the permittee
is required to notify the Division of any name, ownership or mailing address changes within 30 days.
The original corporate owner, Center 118, LLC, was administratively dissolved by the NC Secretary of
State on August 25, 2010 and has not been reinstated. The dissolution of the permitted corporate
owner is considered an ownership change. Pender County tax records reflect ownership of this parcel
is now under Nicole Renee Investments, Inc. The Division has no record of receiving any notification
from you regarding this ownership change. Please complete and sign the attached Name/Ownership
Change form to document this ownership change.
A compliance inspection will be conducted in the near future. Please note that per Schedule of
Compliance Condition 11.3, the permittee is required to provide the operation and maintenance
necessary to ensure that the permitted system functions at optimum efficiency. Please ensure that the
required maintenance is being performed on a routine basis, as outlined in the permit and in the
Operation and Maintenance Agreement.

Furniture permit number SW8 041133.
Appreciation to you and your client, DWQ Permittee, Mr. Salvatore Bonomolo for submitting the certification. With
receipt of the certification, this project meets the conditions of the permit.
I would encourage Mr. Bonomolo to keep records of all maintenance activities as the permit requires, in the event an

Mr. Carmine,
I hope.this finds you well. Thank you for your recent call about the Sal Bonomolo Tract project (SW8 041133). As I recall,
you had mentioned the survey work was being completed and a certification of the stormwater system would be
completed soon.
As I look through the file, I don't see any written communication from the Permittee, Mr. Bonomolo, in response to the
inspection notices dated Feb. 7, 2011 and March 21, 2011 (attached). A written plan of action is required to avoid
further actions including a Notice of Violation. If you would please consult with your client and have a plan of action
(time schedule for meeting the permit's minimum requirements) submitted to this office, it would make this process
more efficient.
Thank you for your efforts in bringing this permit into compliance. If you or Mr. Bonomolo have any questions, please
don't hesitate to contact me.
Sincerely,
