It appears the parking area was shifted south to be able to access the overhead door, causing a bit more gavement to be created. However, the landscape island at the corner was expanded, so it probably came out close to an even swap SW Measures Are the SW measures constructed as per the approved plans? DWQ file review and site inspection revealed that the site is not compliant with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1.. An engineers' certification of the stormwater system was not found in the file. Please inform this Office in writing before March 8, 2011, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, when required, may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not submitted to this office by March 8, 2011 then DWQ staff will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed. Please be reminded that if any ownership or name change has occurred it is the permittee's responsibility to notify this office in writing. SW8 041 133,and the difficulties the Bonomolos have experienced with their construction project. As I indicated to you, the Bonomolos are in litigation with their builder over thi; project. In short, the builder has been paid a great sum to complete this project and has failed to finish the project and has failed to pay a number of the sub contractors for their work. Included in these unpaid items is the bill for work performed by Crystal Coast Engineering, the designer of the stormwater system. Crystal Coast Engineering has refused to provide the required certification until their bill is paid. The Bonomolos have, unfortunately, run out of funds to pay all of the subs that the builder abandoned. Per Section 11.6 of the permit, and Stormwater Regulation 15A NCAC 2H.10080), which stipulates the following-. "Upon completion of construction, the designer for the type of Stormwater system installed must certify that the system was inspected during construction, was constructed in substantial conformity with plans and specifications approved by the Division and complies with the requirements of this Section prior to issuance of the certificate of occupancy." As of this date, our records indicate the required designer's certification has not been received. Operation of the stormwater system prior to submission of the required certification is a violation of NCAC 2H.10086) in accordance with NCGS 143-215.6. Construction is considered complete at the time the project is occupied by an owner or tenant for its intended use. Our database system indicates that the stormwater system has NOT been certified. We'll take it from here. I could not help but notice the subject facility (at least the building & parking lot) appears to be up and running (open). However, to date, my office has not issued the Engineer's Certification (because we have not been paid for the design, much less an inspection and certification). Just curious as to whether they had another engineer certify the facility (which'is fine with me) or if they are operating in violation of their permit?
