Inspection Summary:
This inspection was conducted as part of the transfer of ownership for this permit, from a dissolved LLC to another LLC
owned by the same individual.
Overall, the project was in good shape. There is a slight layout difference in the asphalt area on the southwest side of the
building near -the infiltration basin. It's not enough.of-a change -to -warrant any. type -of.modification_or-plan- revision. at.this
time. Future modifications and plan revisions should take this small change into account.
Please take a look at the flow diffuser at the entrance to the vegetated filter and replace the missing end caps
Please continue to inspect and maintain the permitted infiltration basin.

Comment: 1, There is a slight discreDancv between the approved plan and the as -built condition on the southwest
side of the building The original overhead doors were proposed to be about 20 feet from the end of the
building, but were constructed within just a few feet of the rear corner. It appears the parking area was
shifted south to be able to access the overhead door, causing a bit more gavement to be created.
However, the landscape island at the corner was expanded, so it probably came out close to an even
swap

Comment: 2. The perforated pipe flow diffuser setup rom the bvDass structure to the veaetated filter appeared to be
_missing it's solid end caps. These should be checked and recapped because the flow velocity may, be
erosive to the filter if it is allowed to channelize.
3. The basin appears to be free of trash, the side slopes are in good condition and stabilized with grass
and it agnears to be Infiltrating well.

On February 1, 2011, Angela Hammers of the Wilmington Regional Office of the Division of
Water Quality (DWQ) inspected the Sal Bonomolo Tract located behind Hampstead Furniture in
Hampstead, Pender County to determine compliance with Stormwater Management Permit
Number SW8 041133 issued on October 19, 2006. DWQ file review and site inspection
revealed that the site is not compliant with the terms and conditions of this permit. Please find a
copy of the completed form entitled "Compliance Inspection Report" attached to this letter,
which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1.. An engineers' certification of the stormwater system was not found in the file.
Please inform this Office in writing before March 8, 2011, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, when required, may initiate enforcement action including the
assessment of civil penalties of up to $25,000 per day. If a written plan of action is not
submitted to this office by March 8, 2011 then DWQ staff will re -inspect the site and issue a
Notice of Violation if the listed deficiencies have not been addressed.
Please be reminded that if any ownership or name change has occurred it is the permittee's
responsibility to notify this office in writing. If you have any questions please contact me at the

Dear Ms. Lewis:
I appreciate the opportunity to speak to you today about the certification for stormwater prof yet no.
SW8 041 133,and the difficulties the Bonomolos have experienced with their construction project.
As I indicated to you, the Bonomolos are in litigation with their builder over thi; project. In short,
the builder has been paid a great sum to complete this project and has failed to finish the project and
has failed to pay a number of the sub contractors for their work. Included in these unpaid items is
the bill for work performed by Crystal Coast Engineering, the designer of the stormwater system.
Crystal Coast Engineering has refused to provide the required certification until their bill is paid. The
Bonomolos have, unfortunately, run out of funds to pay all of the subs that the builder abandoned.
They are now attempting to make arrangements to take care of'this situation

Dear Mr. Bonomolo:
On October 19, 2006, the Division of Water Quality issued a Stormwater Management Permit
to you for the subject project. Per Section 11.6 of the permit, and Stormwater Regulation 15A
NCAC 2H.10080), which stipulates the following-.
"Upon completion of construction, the designer for the type of Stormwater system
installed must certify that the system was inspected during construction, was
constructed in substantial conformity with plans and specifications approved by
the Division and complies with the requirements of this Section prior to issuance
of the certificate of occupancy."
As of this date, our records indicate the required designer's certification has not been received.
Operation of the stormwater system prior to submission of the required certification is a
violation of NCAC 2H.10086) in accordance with NCGS 143-215.6. Construction is considered
complete at the time the project is occupied by an owner or tenant for its intended use. Please
submit the required certification by March 6, 2008, Failure to submit the certification is
considered a violation of the permit, and is subject to enforcement action, per NCGS 143-
215.6A.

I could not help but notice the subject facility (at least the
building & parking lot) appears to be up and running (open).
However, to date, my office has not issued the Engineer's
Certification (because we have not been paid for the design, much
less an inspection and certification). Just curious as to whether
they had another engineer certify the facility (which'is fine with
me) or if they are operating in violation of their permit?
If you have time to check into this (status of Engineer's
Certification), I would appreciate it. If you do not have time, I
certainly understand.
