The Wilmington Regional Office received a complete modified Stormwater Management
Permit Application for the Courthouse Bay Regional Pond on December 15, 2010. Staff
review of the plans and specifications has determined that the project, as proposed, will
comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are
forwarding Permit No. SW8 030720 dated December 20, 2010, for the construction of
the subject project. This modification covers the addition to the Mess Hall, P-1256, and
the addition of impervious area for future projects within the current drainage area.
This permit shall be effective from the date of issuance until January 26, 2015, and shall
be subject to the conditions and limitations as specified therein. Please pay special
attention to the Operation and Maintenance requirements in this permit. Failure to
establish an adequate system for operation and maintenance of the stormwater
management system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing upon written request within thirty (30)
days following receipt of this permit. This request must be in the form of a written
petition, conforming to Chapter 150E of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-
7447. Unless such demands are made this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of one (1)-wet detention pond in compliance
with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater
rules') and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until January 26, 2015, and shall
be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.7 on page 3 of this permit. The final built -out
condition of this stormwater system has been designed to handle the runoff from
1,621,289 square feet of impervious area. The current condition of this
stormwater system has been designed to handle the runoff from 960,509 square
feet of impervious area.
3. This wet detention pond must be operated with a 30 foot vegetated filter strip.
4. The tract will be limited to the amount of impervious area indicated in Section 1.7
on page 3 of this permit, and per approved plans. The impervious area for the
future development within the current drainage area and condition of this
stormwater system is limited to 192,590 square feet. Future impervious area
within the final built -out drainage area and condition of this stormwater system is
limited to an additional660,780 square feet or a total of 853,370 square feet.

5. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
6. The runoff from all impervious area within the permitted drainage area(s) of this
project must be directed into the permitted
stormwater control system.

II. SCHEDULE OF COMPLIANCE
1. The first phase of the stormwater system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
impervious surface associated with this project.
2. The final built -out condition of the stormwater system shall be constructed in its
entirety, vegetated and operational for its intended use prior to the construction of
any impervious area in excess of the 192,590 square feet of future impervious
area permitted under the current condition of the system.
3. Prior to the construction of any permitted future areas shown on the approved
plans, the permittee shall submit final site layout and grading plans to the
Division for approval.

4. The permittee must maintain compliance with the limits of the permitted
impervious area and ensure that the runoff from all the built -upon area is directed
into the permitted system.
5. The permittee must maintain the current permitted drainage area. No runoff from
outside of the permitted drainage. area boundary may enter the permitted
stormwater facilities without first applying for and receiving a permit modification.
6 During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
7. The permittee shall at all time provide the operation and maintenance necessary
to assure the permitted stormwater system functions at optimum efficiency. The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and re -vegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.
8. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
9. Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
b. Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the
deepest part of the pond.
c. The falling water from the fountain must be centered in the pond, away
from the shoreline.
d. The maximum horsepower for a fountain in the current condition of the
pond is 314 horsepower. The maximum horsepower for a fountain in the
final built -out condition of the pond is 2 horsepower.
10. The facilities shall be constructed as shown on the approved plans. This permit
shall become void unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data.
11. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and: other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
12. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.

13. Access to the stormwater facilities for inspection and maintenance shall be
maintained via appropriate recorded easements at all times.
14. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, impervious area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of impervious area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was -sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
15. A copy of the approved plans and specifications shall be maintained on file by
the Permittee at all times. At the time the permit is transferred to a new owner,
the permittee shall forward the approved plans to the new owner.
16. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a completed Name/Ownership Change Form signed by both parties, to
the Division of Water Quality, accompanied by the supporting documentation as
listed on page 2 of the form. The approval of this request will be considered on its
merits and may or may not be approved.
2. The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request.
3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.

6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit remains in force and effect until modified, revoked, terminated or
renewed. The permit may be modified, revoked and reissued or terminated for
cause. The filing of a request for a permit modification, revocation and re -
issuance or termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
10. The permittee shall notify the Division of any name, ownership or mailing address
changes at least 30 days prior to making such changes.
11. The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate
documentation and the processing fee.

3. All the impervious area associated with the project is graded such that the
runoff drains to the system.
4. All roof drains are located such that the runoff is directed into the system.
5. The outlet structure elevations are per the approved plan.
6. The outlet structure is located per the approved plans.
7. Trash rack is provided on the outlet structure.
8. All slopes are grassed with permanent vegetation.
9. Vegetated slopes are no steeper than 3:1.
10. The inlets are located per the approved plans and do not cause short-
circuiting of the system.
11. The permitted amounts of surface area and/or volume have been
provided.
12. Required drawdown devices are correctly sized and located per the
approved plans.
13. All required design depths are provided.
14. All required parts of the system are provided, such as a vegetated shelf,
and a forebay.
15. The required system dimensions are provided per the approved plans.
16. All components of the stormwater BMP are located in either recorded
common areas, or recorded easements.

The Wilmington Regional Office received an Express Stormwater Management Permit
Application for the Courthouse Bay Regional Stormwater Pond on December 6, 2010.
A preliminary review of that information has determined that the application is not
complete. The following information is needed to continue the stormwater review:
Please correct the Project Name on page 1 of the application to
"Courthouse Bay Regional Pond" or something similar. The project name
should be listed as the name assigned for the entire stormwater project,
not the currently proposed additions.
2. The table in Section IV.10 of the application appears to be missing
information and has inconsistent information. For instance, the off -site
drainage area for the current pond condition is the same number as the
existing BUA. The previous permit did not identify any off -site drainage
area for the current pond condition. Additionally, the total drainage area
for the total build out condition of the pond has not been split into on -site
and off -site portions as previously permitted.
3. Please submit a new operation and maintenance (O&M) agreement for
the pond. Since a new supplement was necessary to document the
proposed changes, a new O&M agreement is also needed.
4. Please either delineate all wetlands on site, disturbed or undisturbed, on
the plans or add a note on the plans that none exist.
5. Due to the minor nature of these comments, the express Addlnfo fee has
been waived for this request for additional information
6. Please keep in mind that changing one number may change other
numbers and require the calculations, supplements, and other supporting
documentation to be updated. Verify all numbers are correct to ensure
consistency in the application documents.

I will refer your attention to G. S. 89C-25 which provides limitations on the
application of the Statute. Paragraph 6 specifically exempts "Practice by
members of the armed forces or employees of the government of the
United States while engaged in the practice of engineering or land
surveying solely for said government on government -owned works and
projects."
This exemption should not be construed as to allow engineering services to
be provided to the Department of the Navy by non -registered contract
employees. For any such circumstance, a North Carolina registrant would
need be in responsible charge of any engineering services to be provided for
a North Carolina project.

SUBJECT: P1256, Mess Hall Addition, SWP Application
On behalf of the United States Marine Corps (USMC) Base,
Camp Lejeune, NAVFAC is respectfully submitting application
materials as required for a Major Modification, Express
Stormwater Permit. The project is minor in nature and simply
includes the construction of 10 parking spaces and a 2,060sf
building addition.
The existing area currently discharges Stormwater to a regional
Stormwater management facility. Because we are increasing the
previously approved BUA, we understand it is necessary to apply
for a Major Modification, High Density SWP. This project's
construction will increase,the previously permitted BUA by 0.26%
(from 34.6% to 34.86%)- However, because there is extra capacity
in today's current regional pond, we are proposing to permit the
existing ponds full capacity of 43.6% BUA. Subject to NCDENR's
review and approval of this major modification, using the
existing ponds full storage capacity of 43.6% BUA will allow for
192,590sf of future additional impervious construction and
development.
The requested SWM application is submitted as a Major
Modification of a previously approved permit, SW8 030720MOD
issued in 2007, corrected July 27, 2010. We have attached the
following materials to complete our submission:

The enclosed project is a 2,060sf building addition and minor parking lot expansion of 10 parking spaces
to the existing Courthouse Bay Mess Hall located off of Jackson Street and Horn Road at Camp Lcjeune.
The original Mess Hall was constructed in 2007. The area that the Mess Hall is located and its
stormwater is handled by a Regional Stormwater Management Facility that is located nearby the project.
See below for project specifics.
• The original Stormwater Permit for the Regional Stormwater Management Area is Permit
Number SW8 030720 approved on December 12, 2003.
• The Regional Stormwater Management Area was modified in 2005. Permit ' No. SW8
030720MOD was approved by NCDENR on January 26, 2005.
• The original Dining Hall Building Project was built in 2007/2008 and was a modification of the
Stormwater Permit Number SW8 030720MOD permit that included modification to the Regional
Stormwater Management Area. The permit modification was approved on August 28, 2007 and
corrected on July 27, 2010.
• The existing Permit allows for 34.6% BUA. The existing pond as constructed has excess capacity
for stormwater that "although it has been built -has not been permitted" by NCDENR. Therefore,
this permit MOD will be maximizing the build out of the existing constructed pond.
• The project area as designated for the original permit for the Regional Stormwater Management
area will not change from the permit modification approved in 2007 and totals 50.574-acres.
• The analysis for the existing current pond shows the MAX BUA threshold equals 43.6%,
960,509sf.
• The existing permit (2007) allows for BUA 34.6%, 762, 276sf impervious development. The
revised permit application attached is requesting to Maximize the ponds BUA to 43.6%,
960,509sf of impervious.
• This permit application is proposing "no" physical changes to the pond, just a new hydraulic
analysis maximizing the pond's current condition and some minor physical improvements to the
Mess Hall,
• This Mess [fall Addition project will include a minor building addition (2,060so, parking lot
addition of 10 spaces (3,044sf), and some sidewalk improvements (net 539so adjacent to the
building's front area totaling 5,643sf of impervious area.
• The total impervious area all ready permitted equals 762,276sf and if you add the addition of
5,643sf (mess hall addition) will total 767,919sf —still well under the 960,509sf (43.6%) Max
threshold. Therefore, an additional 192,590sf of FUTURE impervious will be permitted in the
future meeting the ponds full capacity.
• The disturbed area for the Mess Hall Addition project will be approximately 30,000sf or 0.69
acres, and a revised Erosion Control Permit for the project has already been issued in September
2010.

Mess Flail Addition Courthouse Bay

The enclosed project is a 2,060sf building addition and minor parking lot expansion of 10
parking spaces to the existing Courthouse Bay Mess Flail located off of Jackson Street and Florn
Road at Camp Lejeune. The original Mess Hall was constructed in 2007. The area that the Mess
Flail is located and its stormwater is handled by a Regional Stormwater Management Facility that
is located nearby the project. See below for project specifics.
• 'fhe original Stormwater Permit for the Regional Stormwater Management Area is Permit
Number SW8 030720 approved on December 12, 2003.
• The Regional Stormwater Management Area was modified in 2005. Permit No. SW8
030720MOD was approved by NCDENR on January 26, 2005.
• The original Mess Flail Building Project was built in 2007/2008 and was a modification
of the Stormwater Permint Number SW8 030720MOD permit that included minor
modification to the Regional Stormwater Management Area. The permit modification
was approved on August 28, 2007 and corrected on July 27, 2010.
• 'Phis project will include a minor building addition (2,060st), parking lot addition of 10
spaces (3,044st), and some sidewalk improvements (net 539st) adjacent to the building's
front area.
The total impervious area created by the building addition, sidewalk and parking lot
improvements total 5,643sf.
• The project area as designated for the original permit for the Regional Stormwater
Management area will not change from the permit modification approved in 2007 and
totals 50.57-acres.
• The disturbed area for the Mess Flail Addition project will be approximately 30,000sf or
0,69 acres, and as such a Sedimentation and Erosion Control Permit will not be required
by NCDENR.
The Volume of the Temporary Pool in the current condition is 102,380 eft. The
proposed Temporary Volume required that includes the building addition and additional
parking totals 66,771cft. Therefore, the current pond has excess capacity/volume and is
adequate to handle the 5,643sf of additional paved surface. See attached Volume
Calculations.

The Wilmington Regional Office received a complete modified Stormwater Management Permit
Application for Courthouse Bay Regional Pond on August 28, 2007. Staff review of the plans
and specifications has determined that the project, as proposed, will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No.
SW8 030720 Modification dated August 28, 2007, for the construction of the subject project.
This modification will cover the addition of P-1030, Enlisted Dining Facility to the project area.
This letter corrects Section 1.2 and 1.6 of the permit, which had incorrectly identified the
drainage area and impervious area currently associated with this project. Please replace
page 2 and 3 of your permit with the new pages that are enclosed with this letter.
This permit shall be effective from the date of issuance until January 26, 2015, and shall be
subject to the conditions and limitations as specified therein. Please pay special attention to the
Operation and Maintenance requirements in this permit. Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following
receipt of this permit. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding.

construction, operation and maintenance of one (1) wet detention pond in compliance
with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater
rules') and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until January 26, 2015, and
shall be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The built -out condition
of this stormwater control has been designed to handle the runoff from a
maximum of 1,621,289 square feet of impervious area, and must be operated
with a 30' vegetated filter. The current permitted BUA is 762,276 ft .
3. The tract will be limited to the amount of built -upon area indicated in Sections 1.2
and L6 of this permit, and per approved plans. The built -upon area remaining
that can drain to this pond for the future development is limited to a maximum of
859,013 square feet.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE
1. This phase of the stormwater management system shall be constructed in its
entirety, vegetated and operational for its intended use prior to the construction
of any built -upon surface associated with the project .
2.. The entire stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
additional built -upon surface not currently permitted.
3. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
4. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data.
5. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.

General Information
This document is to serve as the narrative for a request of a scope meeting for the
proposed infrastructure improvements of the Courthouse Bay Area. The previously
permitted project was MCB Camp Lejeune — Courthouse Bay Regional Stormwater
Pond project. "Phase I" of this project corresponded to permit SW8 041104 and the
existing permit SW8 030720 correlated to "Phase II". The proposed project is located on
Camp*Lejeune Marine Corps Base in Onslow County, North Carolina. The proposed
project will encompass new development and re -development located off of Horn Road
in the Courthouse Bay Area. At this time the proposed project is still in the pre -design
phase. The scope meeting is being requested to obtain information and answer the
following questions:
1. What are the limits of the existing permit SW8 030720, and whether or not we
could potentially treat the proposed infrastructure Improvements at Courthouse
Bay with the existing wet detention pond? If not do we need a new permit or
Modification?
2. Need to understand what options are available for obtaining a "regional
stormwater permit" for the Courthouse Bay area near Horn Road.

This project is located in the White Oak River Basin. The NCDWQ Stream
Classification of Courthouse Bay is SA, HQW and its NCDWQ Index Number is 19-36.
The Stream Classification of the New River is SA, HQW and its Index Number is 19-27.

Guidelines for Access: The staff of the Regional Office is dedicated to making public records in our
custody readily available to the public for review and copying. We also have the responsibility to the public
to safeguard these records and to carry out our day-to-day program obligations. Please read carefully the
following before signing the form.
1. Due to the large public demand for file access, we request that you call at least a day in
advance to schedule an appointment for file review so you can be accommodated.
Appointments are scheduled between 9:00 a.m. and 3:00 p.m. Viewing time ends at 4:45
p.m. Anyone arriving without an appointment may view the files to the extent that time and
staff supervision are available.
2. You must specify files you want to review by facility name or incident number, as
appropriate. The number of files that you may review at one appointment will be limited to
five.
3. You may make copies of a file when the copier is not in use by the staff and if time permits.
There is no charge for 25 or less copies.; cost per copy after the initial 25 is 2.5 per copy.
Payment is to be made by check, money order, or cash in the administrative offices.
4. Files must be kept in the order you received them. Files may not be taken from the office.
No briefcases, large totes, etc. are permitted in the file review area. To remove, alter,
deface, mutilate, or destroy material in public files is a misdemeanor for which you can be
fined up to $500.00.
5. In accordance with GS 25-3-512, a $25.00 processing fee will be charged and collected for
checks on which payment has been refused.
6. The customer must present a photo ID, sign -in, and receive a visitor sticker prior to
reviewing files.

Certification Requirements:
1. The drainage area to the system contains approximately the permitted
acreage.
✓ 2. The drainage area to the system contains no more than the permitted
amount of built -upon area.
3. All the built -upon area associated with the project is graded such that the
runoff drains to the system.
4. All roof drains are located such that the runoff is directed into the system.
5. The outlet/bypass structure elevations are per the approved plan.
✓ 6. The outlet structure is located per the approved plans.
-� 7. Trash rack is provided on the outlet/bypass structure.
✓ 8. All slopes are grassed with permanent vegetation.
9. Vegetated slopes are no steeper than 3:1.

circuiting of the system.
11. The permitted amounts of surface area and/or volume have been
provided.
12. Required drawdown devices are correctly sized per the approved plans.
13. All required design depths are provided.

and a forebay.
