The Wilmington Regional Office received a complete, modified Stormwater Management
Permit Application for Courthouse Bay Regional Pond on August 28, 2007. Staff review of the
plans and specifications has determined that the project, as proposed, will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No.
SW8 030720 Modification dated August 28, 2007, for the construction of the subject project.
This modification will cover the addition of P-1030, Enlisted Dining Facility to the project area.
This permit shall be effective from the date of issuance until January 26, 2015, and shall be
subject to the conditions and limitations as specified therein. Please pay special attention to
the Operation and Maintenance requirements in this permit. Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have
the right to request an adjudicatory hearing upon written request within sixty (60) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of a wet detention pond in compliance with
the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules')
and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until January 26, 2015, and
shall be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The built -out condition
of this stormwater control has been designed to handle the runoff from a
maximum of 1,621,289 square feet of impervious area, and must tie operated
with a 30' vegetated filter. The current permitted BUA is 652,697 ft .
3. The tract will be limited to the amount of built -upon area indicated in Sections 1.2
and 1.6 of this permit, and per approved plans. The built -upon area remaining
that can drain to this pond for the future development is limited to a maximum of
859,013 square feet.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

1. This phase of the stormwater management system shall be constructed in its
entirety, vegetated and operational for its intended use prior to the construction
of any built -upon surface associated with the project .
2. The entire stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
additional built -upon surface not currently permitted.
3. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
4. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data.
5. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.

6. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.
7. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
8. Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
b. Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the
deepest part of the pond.
c. The falling water from the fountain must be centered in the pond, away
from the shoreline.
d. The maximum horsepower for a fountain in this pond is 112 horsepower.
9. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
10. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
11. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.

12. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
13. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
14. The permittee must maintain compliance with the proposed built -upon area and
ensure that the runoff from all the built -upon area is directed into the permitted
system.
15. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
16. The permittee must maintain the current permitted drainage area. No runoff
from outside of the permitted drainage area boundary may enter the permitted
stormwater facilities without first applying for and receiving a permit modification.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not
be approved. The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.

8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division in writing any name, ownership or mailing
address changes within 30 days.

The revised forebay calculation is incorrect. The forebay volume is based on 20% of
the permanent pool volume, which is the volume provided in the pond from the bottom
to the permanent pool elevation. The latest sealed calculations appear to conclude
that the permanent pool volume is 368,006. This is not correct. Based on
interpolating the numbers provided in the revised calculations, the permanent pool
volume at elevation 7.38 is only 193,648, as reported on the supplement, meaning
that the maximum range of forebay volumes is 34,857 to 42,603 (.18 and .22 times
193,648).
The supplement and calculations report 71,303 as the provided volume, however, this
number appears to be what is provided at elevation 9.92, well above the permanent
pool elevation. Please revise the forebay calculations such that the permanent pool
volume is correctly reported as 193,648 and the calculation of the required forebay
volume (from the bottom of the forebay to elevation 7.38) is based on that number
and the provided forebay volume is within the range stated above.
Please submit revised forebay sizing calculations (sealed, signed & dated).

This is my fault- Rhonda had asked me about how to handle the project, and I made
my comments back to her, but then she wanted me to do the review. I either didn't
realize it was an Express project, or I forgot it was Express. I've already got a
meeting scheduled for this afternoon, but if I get the chance, I'll get the full
review done after my meeting.
Preliminarily, there appears to be some confusion about whether this project is a
modification, plan revision or offsite. Based on my review of the existing
Courthouse Bay file, the dining facility appears to be located within the permitted
drainage area, but because the street names are not consistent, I can't be sure. If
it is within the DA, then it will be an Offsite project, not a modification. The
Dining Facility will receive its own permit. If it comes out that the Dining
Facility is not within the existing approved DA for Courthouse Bay Regional pond,
then in addition to the offsite permit for the Dining Facility, a modification to
the Courthouse Bay pond permit is also needed.

EXECUTIVE SUMMARY
This Stormwater Impact Analysis has been prepared specifically to address
the requirements of Section 15A NCAC 02H .1005 of the North Carolina
Administrative Code as it pertains to the stormwater requirements for coastal
counties. The project site does not drain to Outstanding Resource Waters nor is it
within one-half mile of SA waters or unnamed tributaries of SA water. Therefore,
stormwater management must be in accordance with Rule .1005 (3).
Site Information
The Camp Lejeune Enlisted Dining Facility is located at the southwest corner
of Jackson Street and Horn Road in Camp Lejeune, North Carolina. The site lies
within the White Oak River Basin and is outside of any stream buffers, floodpiains,
wetlands, and Water Supply Watersheds. The project site sits in a relatively flat
area and entirely drains to the existing stormwater management pond, which will
be utilized to meet water quality and quantity regulations.
One permitted water quality device currently exists within the drainage area
for stormwater treatment, which is a wet detention pond (NCDENR, DWQ Permit
#SW8 030720). In order to drain this project's built -upon -area to the existing
pond, existing permit SW8 030720 will be modified to include treatment required
for the proposed Dining Facility.
Proposed Improvements
The project proposes to add one new building; the Dining Facility building.
This project also proposes to construct a large parking area having 160 spaces, a
service entry/loading dock area, and multiple sidewalks. In order to construct the
new Dining Facility, an existing concrete storage area and concrete drainage swale
will be demolished. The site has a total area of 4.76 ac of which 2.52 ac is
proposed built -upon -area. The total Courthouse Bay Regional Pond drainage area
will increase from 45.81 ac to 50.57 ac due to piped stormwater conveyed to the
pond. The project proposes a net increase of 2.52 ac of impervious bring the
proposed total impervious area, within the regional pond drainage area, to 17.50 ac
(34.6%).
The improvements proposed for the existing Courthouse Bay Regional Pond
stormwater facility include the expansion of the wet detention pond and forebay.
The proposed expansion of the existing regional facility will be used to meet water
quality regulations set forth by the State.
Design Requirements
Per Section 15A NCAC 02H .1005 (3) of the North Carolina Administrative
Code for sites that are not with 575 ft of Outstanding Resource Water or within 0.5
miles of SA waters the State Stormwater Regulations mandate that the runoff from
the first one (1) inch of rainfall be captured and released over a period of 2 to 5
days. The treatment device proposed is the expansion of the existing Courthouse
Bay Regional Facility. The existing wet pond provides a bypass as well as a
vegetated buffer, requiring the treatment and release over a period of 2 to 5 days
of the first inch of rainfall.
Design Procedure
Per State Stormwater Management Systems Permit Number SW8 030720,
the existing Courthouse Bay Regional Pond was planned to provide water quality
treatment for future phased development within the drainage area. The proposed
expansion of the existing wet pond falls well under the entire pond design criteria.
Four exhibit maps accompany this report to provide additional information.
Exhibit EX-1 shows the existing conditions of the site along with the impervious
surface that will be removed. Exhibit EX-2 shows the proposed conditions of the
site. Exhibit EX-3 shows typical dimensions of existing and proposed impervious
area within the drainage basin. Exhibit EX-4 shows the existing site with the
proposed basin expansion overlaid.
The pond expansion has been sized to capture the runoff from the first one
(1) inch of rainfall for its entire drainage area. The existing pond provides a bypass
and grassed Swale for overflow; therefore it has only been sized for the first one (1)
inch.
Overall Results / Summary
Table 1 below shows the statistics for the proposed regional pond expansion. The
proposed pond expansion achieves the required storage volume, therefore
treatment credit is assumed for the entire drainage area.

Conclusions
Based on the results of this Stormwater Impact Analysis, the requirements of
Section 15A NCAC 02H .1005 of the North Carolina Administrative Code as it
pertains to the stormwater requirements for coastal counties have been met for the
proposed project. Runoff from all new impervious area has been captured and
treated in the existing regional pond.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built -upon area for each lot must be provided as an attachment.
The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shall he covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone. slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not he filled in, piped, or altered except as necessary to provide driveway crossings.
Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control,systenl shall be performed in a manner that maintains the integrity
and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and protective covenants for this project
shall include all the applicable items required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted

When using the Division SAIDA tables, the correct SA/DA ratio for permanent pool sizing should be computed based upon the
actual impervious % and permanent pool depth. Linear interpolation should be employed to determine the correct value for non-
standard table entries.

II. REQUIRED ITEMS CHECKLIST
The following checklist outlines design requirements per the Stormwater Best Management Practices Manual
(N.C. Department of Environment, Health and Natural Resources, February 1999) and Administrative Code
Section: 15 A NCAC 2H .1008.

III. WET DETENTION BASIN•OPERATION AND MAINTENANCE AGREEMENT
The wet detention basin system is defined as the wet detention basin, pretreatment including f6rebays and the
vegetated filter if one is provided.

Maintenance activities shall be performed as follows:
1. After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e.
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads 3 feet in the main pond, the sediment shall be removed.
When the permanent pool depth reads 3 feet in the forebay, the sediment shall be removed.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.

Thanks for letting me know. I do remember discussing that now and it's making more
sense to me. I think when we were talking about it earlier, the proposed dining
facility project was presented to me as NOT being within the approved drainage area of
the pond, thus my comments that a modification was needed. I think that the way the
original pond was intended to be permitted and modified was with an established maximum
drainage area of 77.85 acres that was flexible in its location, depending on what the
Base needed. Each separate.new proposed project, either already within the DA, or
wanting to be in the DA, would require a permit modification to establish the new DA
boundary and tally up the total BUA to date.
So, in light of that, please address the following inconsistencies in the application:
1. Provide a new map delineating the 50.574 acre drainage area.
2. The calculations use a permanent pool surface area of 62,870 (interpolated) but
64,930 has been reported on the supplement. The numbers must match up.
3. The temporary pool volume reported on the application is only 68,266. The value to
report should be the actual volume stored in the pond between the designated permanent
pool and temporary pool elevations. Based on the surface areas and accumulated volumes
reported in your calculations, between 7.38 and 8.92, there would be over 102,000 cubic
feet of volume provided. ((62,870 + 70,091)/2) x (8.92 - 7.36) = 102,380 cubic feet.
4. The calculations show area and volume tables which are based on a bottom elevation
of 3.92, but the actual bottom elevation for the pond is 3.38. This appears to affect
the calculation of the permanent pool volume. Based on interpolating the values
reported in the tables, the permanent pool volume is 177,443 cubic feet.:Please provide
verification of how you arrived at 181,851.

I think I may have been wrong in regard to needing a separate offsite
permit & modification to 030720 for this project. In the non-military
world, that would be the case, but because this is the Base, and the
same people are going to own the pond AND the projects that drain to
it, only a modification to 030720 is required.

I have few details I would like to clarify concerning the Camp Lejeune
Permit:
1. The existing permit (DWQ Permit #SW8 030720) was permitted for the
entire build out of the drainage area including the construction of
P-1030.
2. A permit modification (DWQ Permit # SW8 041104) was granted on
January 26, 2005 to build a smaller pond due to monetary constraints
with the idea that future development within the drainage area would
require an expansion of the pond not to exceed the original permit (DWQ
Permit # SW8 030720) specifications.
Question:
Does the current pond expansion require a revision to the DWQ permit;
even if the current expansion is still less than original permit
specifications?
If a permit modification is required, will it be a modification to the
original permit (DWQ Permit #SW8 030720) or the permit modification (DWQ
Permit #SW8 041104)?
Attached is a summary sheet from the permit modification.
