Dear Ms. Mashburn:
The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Lowes Foods Store Morehead Plaza on September 29, 2003. Staff
review of the plans and specifications has determined that the project, as proposed, will
comply with the Stormwater Regulations set forth in Title 15A NCAC 2H .1000. We are
forwarding Permit No. SW8 030501, dated September 29, 2003, for the construction of
the subject project.
This permit shall be effective from the date of issuance until September 29, 2013, and
shall be subject to the conditions and limitations as specified therein. Please pay
special attention to the Operation and Maintenance requirements in this permit. Failure
to establish an adequate system for operation and maintenance of the stormwater
management system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing upon written request within thirty (30)
days following receipt of this permit. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27811-
7447. Unless such demands are made this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
redevelopment and treatment of runoff from existing impervious surfaces in an
alternative infiltration system consisting of a series of sunken landscaped infiltration
islands in compliance with the provisions of 15A NCAC 2H.1000 (hereafter referred to
as the "stormwater rules') and the approved stormwater management plans and
specifications, and other supporting data as attached and on file with and approved by
the Division of Water Quality and considered a part of this permit.
The Permit shall be effective from the date of issuance until September 29, 2013 and
shall be subject to the following specific conditions and limitations:
1. DESIGN STANDARDS
1. The proposed built -upon area is 300,451 square feet, which is less than the
318,660 square feet that previously existed.
2. To the extent practicable, the project has provided stormwater control measures
in accordance with the stormwater rules. Those control measures are:
a. Thirty-one sunken landscaped infiltration islands, which treat approxi-
mately 75% of the existing built -upon area in the parking lot.
b. A reduction in the total amount of built -upon area at the site.
3. Approved plans and specifications for projects covered by this permit are
incorporated by reference and are enforceable parts of the permit.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. Based on a minimum of 31,366 ftz of area, the sunken islands provide a total of
15,683 cubic feet of storage for the runoff. Each island will be 6" deep and will be
covered with landscape stone. Any overflows from the project will ultimately be to
the existing collection system.

If. SCHEDULE OF COMPLIANCE
1. The permittee shall at all times provide adequate erosion control measures in
conformance with the approved Erosion Control Plan.
2. The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request.
3. The permittee shall construct the stormwater control measures as shown'on the
approved plans. Areas and volumes shall be provided as described in the
calculations.
4. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency including, but not limited to:
a. Semi-annual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Debris removal and unclogging of the landscape stone and underlying
infiltration media.
5. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to the approved plans, regardless of size or scope.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision, acquisition, or selling of the project area. The project
area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval was sought.
6. The Director may determine that other revisions to the project should require a
modification to the permit.
7. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
Ill. GENERAL CONDITIONS
Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to an enforcement action by the Division of Water Quality,
in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C.
2. . The permit issued shall continue in force and effect until revoked or terminated.

3. The permit may be modified, revoked and reissued or terminated for cause. The
fling. of a request for a permit modification, revocation and reissuance, or
termination does not stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules, and regulations contained in Title 15A of the North
Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General
Statute 143-215.1 et. al.
5. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations. prior to„construction, for any
additions, deletions or redesign of the previously permitted amount of built -upon
area proposed regardless of the size of the modification.
6. The permit is not transferable except after notice to and approval by the Director.
The Director may require modification or revocation and reissuance of the permit
to change the name and incorporate such other requirements as may be
necessary. A formal permit request must be submitted to the Division of Water
Quality accompanied by the appropriate fee, documentation from both parties
involved, and other supporting materials as may be appropriate. The approval of
this request will be considered on its merits, and may or may not be approved.
The permittee is responsible for compliance with all permit conditions until such
time as the Director approves the transfer request.
7. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations and ordinances, which may be imposed by
other government agencies (local, state and federal) which have jurisdiction.
8. The permittee grants permission to DENR Staff to enter the premises during
normal business hours for purposes of inspecting the facility.
9. The permittee shall notify the Division of any,name, ownership or mailing address
changes within 30 days.
10. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
-Sediment Control Planning and Design Manual.

Designer Certification Requirements:
1. The drainage area to the system contains approximately the permitted
acreage.
2. The drainage area to the system contains no more than the permitted
amount of built -upon area.
3. All the built -upon area associated with the project is graded such that the .
runoff drains to the system.
4. The outlet/bypass structure elevations are per the approved plan.
5. The outlet structure is located per the approved plans.
6. Trash rack is provided on the outlet/bypass structure.
7. All slopes are grassed with permanent vegetation.
8. Vegetated slopes are no steeper than 3:1.
9. The inlets are located per the approved plans and do not cause short-
circuiting of the system.
10. The permitted amounts of surface area and/or volume have been
provided.
11. Required drawdown devices are correctly sized per the approved plans.
12. All required design depths are provided.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS N / A
The following italicized deed restrictions and protective covenants are required to be recorded for all,
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built -upon area for each lot must be provided as an attachment.
The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.

OPERATION & MAINTENANCE PLAN

Planting Soils -
A. Test pH of the soils every six (6) months.
B. Apply alkaline materials such as limestone as indicated in the soils test.
C. Should the plant biological functions become impaired and the plants experience dwarfed
growth or mortality, conduct additional soil tests to determine the extent of accumulation
of toxins and heavy metals. Correction of this condition will require removal of the
contaminated soil.
D. Annual inspections shall be conducted after a storm event to ensure infiltration
performance.
2. Mulch -
A. The crushed landscape stone mulch shall be leveled and replenished as necessary every
six months.
3. Erosion -
A. Check the system for erosion and repair any eroded areas.
4. Plant Materials -
A. Remove and replace all dead and diseased vegetation on a twice yearly basis during the
period March 15 to April 30 and again during the period of October I to November 30.
B. After planting, plants shall be watered at the end of each day for fourteen consecutive
days.
C. Review missing, damaged or undersized support stakes and deficient wires every six
months or whenever needed.
5. General -
A. Plant material upkeep to include addressing problems associated with disease infestation,
replacing dead plant material, and any necessary pruning shall occur on an every 30 day
basis after installation.
B. Inspect system monthly or after every runoff producing rainfall, whichever comes first.
C. Removal, reconstruction and restoration of the infiltration system will be necessary when
the infiltration rate drops to unacceptable levels. Infiltration rate should allow island to
completely drain in less than 12 hours. Reconstruction should the system fail could
include removal and replacement of soils to four (4) eet down.
