Dear Mr. Hatcher:
On October 21, 2004, Wilmington Regional Office personnel performed a Compliance
Inspection of the subject project, located at North Kerr Street in Wilmington, New Hanover
County, North Carolina, The inspection was performed to determine the status of compliance
with Stormwater Pen -nit Number SW8 030108, issued to you on July 23, 2003.
The project has been found in violation of Stormwater Permit Number SW8 030108 issued
pursuant to the requirements of 15A NCAC 2H.1000, The violations found are:
Section I.5- The runoff from all built upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system. A permit
mod f cation must be submitted and approved prior to the construction of additional built -
upon area from outside of the approved drainage area.
(a) The three units located in the southwest corner of the site (behind the stormwater pond) have
gutters that drain directly into the stream. All runoff and stormwater from this site must run into
& through the stormwater pond.
2. Section II.2- During construction, erosion shall be kept to a minimum and any eroded areas
oJ the system shall be repaired immediately.
(a) Erosion from behind the pond and around the on -doing bulkhead construction is entering the
creek. More silt fences and other erosion control devices must be installed to keep this sediment
from entering the stream.
To correct these violations you must:
1. Provide a written "Plan of Action" which outlines the actions you will take to correct the
violation(s) and a time frame for completion of those actions, on or before November 25, 2004.
2. Direct the runoff flow from the gutters into the stormwater pond. The water must enter the
fore -bay so it can benefit from the stormwater pond system.
3. Install more erosion control devices to help contain sediment on -site. If silt fences are used for
this, they may have to be doubled up for added protection.

Failure to provide the "Plan of Action" by November 25, 2004, or to correct the
violations by the date designated in the "Plan of Action", are considered violations of 15A
NCAC 2H.1000, and may result in the initiation of enforcement action which may include
recommendations for the assessment of civil and criminal penalties, pursuant to NCGS
143-215.6A.
By copy of this letter to the New Hanover County Building Inspector, this Office is
requesting that the Building Inspector consider withholding building permits and
Certificates of Occupancy for this project until this matter is satisfactorily resolved.

Dear Mr. Hatcher:
On September 10, 2004, the Wilmington Regional Office received a plan revision for
Stormwater Management Permit Number SW8 030108. The revisions include the
extention of the twin 48'!- pipes. It has been determined that a formal permit modification
is not required for the proposed changes. We are forwarding you an approved copy of
the revised plan sheet C1 for your files. Please replace the old approved plan sheet with
the new one.
Please be aware that all terms and conditions of the permit issued on July 23, 2003,
remain in full force and effect. Please also understand that the approval of this revision
to the approved plans for the subject State Stormwater Permit is done on a case -by -
case basis. An.y other changes to this project must be approved through this Office
prior to construction. The issuance of this plan revision does not preclude the permittee
from complying7..with ail other statutes, rules, regulations or ordinances which may have
jurisdiction over the proposed activity, and which may require a permit or approval prior
to construction,

Location/Description of Violations : The erosion control measures have
failed to retain sediment on site 'at Smith Creek Village. You have not
followed the approved plan, not submitted revised plans and failed -to
properly maintain the erosion control measures.
Dear Mr. Jimmy Hatcher:
This letter constitutes Notice of Violation of Section 23-236, Section 23-243,
Section 23-243.5, Section 23-244, Section 23-245, Section 23-248 (b), Section23-
250 (b), Section 23-251 (a) (1), Section 23-251 (b) and Section 23-252 (a) of the
New Hanover County's Soil Erosion and Sedimentation Control Ordinance.
Section 23-236 Basic Control Objectives states:
(1) Identify critical areas. On -site areas which are subject to severe erosion, and
off -site areas which are especially vulnerable to damage from erosion and /or
sedimentation are to the identified and receive special attention.
(2) Limit time of exposure. All land disturbing activity is to be planned and
conducted to limit exposure to the shortest feasible time.
(3) Limited exposed area. All land disturbing activity is to be planned and
conducted to minimize the size of the area to be exposed at any one time.
(4) Control surface water. Surface water runoff originating upgrade of exposed
areas should be controlled to reduce erosion and sediment loss during the
period of exposure.
(5) Control sedimentation. All land disturbing activity is to be planned and
conducted so as to prevent off -site sedimentation damage.
(b) Manage stormwater runoff. When the increase in the velocity of stormwater
runoff resulting from a land disturbing activity is sufficient to cause
accelerated erosion of the receiving watercourse, plans are to include
measures to control the velocity to the point of discharge so as to minimize
accelerated erosion of the receiving watercourse, plans are to include

accelerated erosion of the site and increased sedimentation of the stream.
Section 23-243 Responsibility for maintenance states:
During the development of a site; the person conducting the land disturbing
activity shall install and/or maintain all temporary and permanent erosion and
sedimentation control measures as required by the approved plan or any provision
of this article, the act, or any order adopted pursuant to these article or the act.
Section 23-243.5 Restoration of areas affected by failure to comply states:
The county may require a person who engaged in, a land disturbing activity and
failed to retain sediment generated by the activity, as required by G.S. 113-57(3),
to restore the waters and land affected by the failure so as to minimize the
detrimental effects of the resulting pollution by sedimentation. This authority is in
addition to any other civil or criminal penalty or injunctive relief authorized under
this article.
Section 23-244 Additional measures states.
Whenever the county determines that significant sedimentation is occurring as a
result of land disturbing activity, despite application and maintenance of
protective practices, the person conducting the land disturbing activity will be
required to and shall take additional protective action.
Section 23-245 Areas not otherwise covered states:
Notwithstanding previous provisions when it is determined that severe off -site
erosion and/or sedimentation occur as a result of any land disturbing activity,
regardless of the size of the site, remedial action shall be taken within a
reasonable time period after notification. Notification of violation shall be
submitted in writing by the county engineering department and receipted by the
owner or agent responsible for the damage.
Section 23-248 Erosion and sedimentation control plans states:
(b) Persons conduction land disturbing activity on a tract which covers one or
more acres shall file three copies of the erosion control plan with the county at
least 30 days prior to beginning such activity and shall keep another copy of the
approved plan and a posted copy of the permit at the job entrance on the job site
before construction begins. After approving the plan, if the county either upon
review of such plan or on inspection of the job site, determines that a significant
risk of accelerated erosion or offsite sedimentation exists, the county will require
a revised plan. Pending the preparation of the revised plan, work shall cease or
shall continue under conditions outlined by the appropriate authority.
Section 23-250 Inspections and investigations states:
(b) If through inspection it is determined that a person engaged in land disturbing
activity has failed to comply with the act, this article, or rules or orders adopted or
issued pursuant to this article, or has failed to comply with and approved plan, a
notice of violation shall be served upon that person by registered or certified mail
or other means reasonably calculated to give actual notice. The Notice shall set
forth the measures necessary to achieve compliance with the plan, specify a
reasonable time period within which such measures must be completed, and warn
that failure to correct the violation within the time period will result in additional
civil and criminal penalties for a continuing violation. However, not time period
for compliance need be given for failure to submit an erosion control plan for
approval or for obstructing, hampering or interfering with an authorized
representative while in the process of carrying out his official duties. If the person
engaged in land disturbing activity fails to comply within the time specified,
enforcement action shall be initiated.
Section 23-251 Penalties states:
(a) Civil penalties.
(1) Any person'who violates any of the provisions of this article, or rules
or orders adopted or issued pursuant to this article, or order adopted or
issued pursuant to this article by the commission, or who initiates or
continues a land disturbing activity for which an erosion control plan
is required except in accordance with the terms, conditions, and
provisions of an approved plan, shall be subject to a civil penalty. The
maximum civil penalty for a violation is $5000.00 per clay. A civil
penalty may be assessed from the date of violation. Each day of a
continuing violation shall constitute a separate violation. The person
alleged to be in violation will be notified of the violation by registered
or certified mail, return receipt requested, or other means reasonably
calculated to give actual notice. The notice shall describe the violation
with reasonable particularity, specify a reasonable time period within
which the violation must be corrected, and warn that failure to correct
the violation within the time period will result in assessment of a civil
penalty or other enforcement action. If, after the allotted time period
has expired, the violator has not completed corrective action, a civil,
penalty may be assessed from the date of the notice of violation.
However, no time period for compliance need be given for failure to
submit an erosion control plan for approval or for obstruction,
hampering or interfering with an authorized representative while in the
process of carrying out his official duties. Each day of continuing
violation shall constitute a separate violation.
(b) Criminal penalties. Any person who knowingly or willfully violates any
provision of this article, or rule or order adopted or issued pursuant to this
article, or who knowingly or willfully initiates or continues a land disturbing
activity for which an erosion control plan is required except in accordance
with terms, conditions, and provisions of an approved plan, shall be guilty of a
Class 2 misdemeanor which may include a fine not to exceed $5000.00 per
calendar day.
Section 23-252 Iniunctive relief states:
(a) Whenever the governing body has reasonable cause to believe that any person
is violating or threatening to violate this article or any rule or order adopted or
issued pursuant to this article, or any term, condition, or provision of an
approved erosion control plan, it may, either before or after the institution of
any other action or proceeding authorized by this article; institute a civil
action in the name of the county, for injunctive relief to restrain the violation
or threatened violation. The action shall be brought in the superior court of the
county.
Corrective measure(s)needed and Time to Comp! : Remove all sediment that
has been deposited in the offsite creek, stabilize or remove the sediment deposited
in the offsite yard, repair the erosion to the adjacent driveway and restore the
driveway, with permission from the adjacent property owner, within 1 working
day of receipt of this notice. Immediately reinstall all erosion control measures as
per the approved plan within 1 calendar day of receipt of the notice of violation.
And resubmit plans to show the changes to the plan for the culvert installation and
how the velocity will be reduced to eliminate offsite erosion within 1 week of
receipt of this notice.

The following checklist outlines design requirements per the Stormwater Best Management Practices Manual
(N.C. Department of Environment, Health and Natural Resources, February 1999) and Administrative Code
Section: 15 A NCAC 2H .1008.

The wet detention basin system is defined as the wet detention basin, pretreatment including forebays and the
vegetated filter if one is provided.

Maintenance activities shall be performed as follows:
After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs
within 2 to 5 days as designed.
2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swale$, riprap, etc.) quarterly to
maintain proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed
of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality
(i.e. stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads 4.875 feet in the main pond, the sediment shall be removed.
When the permanent pool depth reads 2.25 feet in the forebay, the sediment shall be removed.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
6. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment
through the emergency drain shall be minimized to the maximum extent possible.

The Wilmington Regional Office received a Stormwater Management Permit Application
for Smith Creek Village on January 16, 2003. A preliminary review of that information has
determined that the application is not complete. The following information is needed to continue
the storrrlwater review:
Please add the nearest intersection of two major roads to the vicinity map. A major
road is any 1, 2 or 3 digit NC, US or interstate highway.
2. Please turn off the tree layer on the plans in order to see the spot elevations more
clearly.
3. Please provide dimensions for the buildings.
4. Please add a note to the plans that all roof drains must be directed into the detention
pond.
5. Please provide contours and dimensioning for the pond. This should include
labeling the radii of the curves. Also, please label the permanent pool contour.
Please note that this request for additional information is in response to a preliminary
review. The requested information should be received by this Office prior to May 2, 2003, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of
all required items, including the application fee.

If you need additional time to submit the information, please mail or fax your request for a
time extension to the Division at the address and fax number at the bottom of this letter. The
request must indicate the date by which you expect to submit the required information. The
Division is allowed 90 days from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to
enforcement action pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any original
documents that need to be revised have been sent to the engineer or agent. All original documents
must be returned or new originals must be provided. Copies are not acceptable. If you have any

Smith Creek Village is an existing vacant 9.72 acre tract of land. A townhome community
of 55 units with asphalt parking, sidewalks and recreational area is proposed. The built
upon area consists of 56,167 sf of buildings, 107,299 sf of parking and access area, and
20,749 sf of concrete sidewalks totaling 184,215 sf or 43.5% impervious. The site will be
considered high density.
Runoff will be treated by wet detention. The pond is designed to treat both the State's 1"
and the City's 10-year pre -post requirements. Outflow will be to an unknown tributary of
Spring Branch, Classification C-SW.
