project's stormwater controls conducted on February 17, 2009 to determine compliance
with Stormwater Permit Number SW8 030104 issued on November 17, 2003.
Based on a file review and site visit, this office has determined that Stormwater Project
No. SW8 030104 is currently in compliance with the permit. Please be reminded that if

On May 28, 2008, Wilmington Regional Office personnel performed a State Stormwater permit
file review of the subject project, located on SR 1472 in Leland, Brunswick County, North
Carolina. The permit file review was performed to determine the status of compliance with
Stormwater Permit Number SW8 030104, issued to you on November 17; 2003.
The project has been found-iri violation of Stormwater Permit Number SW8 030104 , issued
pursuant to the requirements of 15A NCAC 2H.1000. The violations found are:
Failure to submit a certification from an appropriate designer for the system installed.
Upon completion of construction, prior to issuance of a Certificate of Occupancy,. 9,
and prior to operation of this permitted facility, a certification.must be received from
an appropriate designer for the system installed in accordance with this permit, the
approved plans and specifications and other supporting documentation. Any
deviations from the approved plans and specifications must be noted on the
Certification.
2. Failure to build according to the approved plan. It appears that the forebay was not
installed according to the approved plan, The permitted stormwater system design
requirements, areas, volumes elevations, and orifice size must be provided at all
times in the stormwater system.
To correct these violations you must :
1. Provide a written "Plan of Action" which outlines the actions you will take to
correct the violation(s) and a time frame for completion of those actions, on or
before June 19, 2008.
2. Provide the required Designers Certification for the stormwater management
system. The Designers Certification must be from an appropriate designer.

Failure to provide the "Plan of Action" by June 20, 2008, or to correct the violations by
the date designated in the "Plan of Action", are considered violations of 15A NCAC
2H.1000, and may result in the initiation of enforcement action which may include
recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Brunswick County Building Inspector, this Office is
requesting that the Building Inspector consider withholding building permits and
Certificates o Pccupancy for this project until this matter is satisfactorily resolved.

On December 29, 2003, personnel of this office inspected a project located SR 1472 in Brunswick
County, North Carolina. This inspection was performed to determine compliance with the North Carolina
Sedimentation Pollution Control Act of 1973. The inspection revealed a land -disturbing activity of
approximately 4.9 acres being conducted.
It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The
purpose of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 113A-50
to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If you feel that you are not responsible
for the following violations, please notify this office immediately. '
The violation that was found is
1. Failure to take all reasonable measures to protect all public and private property from damage by such
land -disturbing activities. 15A NCAC 4B.0005. .
Site has been roughly graded without a gravel construction entrance and without the
installation of the stormwater retention pond (primary erosion and sediment control measures.)
To correct this violation, you must:
Install the gravel construction entrance per approved plan. (Reasonable measure)
Install the stormwater retention pond per approved plan. (Reasonable measure)

The initial one day civil penalty could be an assessment of up to $5,000.00. A time period for
compliance is not required for this initial one day civil penalty pursuant to NCGS 113A-61.1 (c) and NCGS
113A-64(a)(1). An initial one day civil penalty is being considered for this project.
If the violations described in this Notice are not corrected within 7 days following your receipt of this
Notice, the Division of Land Resources may take additional appropriate legal action against you pursuant to
NCGS 113A-64. That action could be the assessment of additional civil penalties and may result in the
initiation of other remedies as prescribed by the Act. If additional civil penalties are assessed for the violations,
the amount may be up to $5,000.00 per day for each day of the violation pursuant to NCGS 133A-64(a)(1).
If all violations are corrected within the time period specified for compliance, additional civil penalties or legal
remedies will not be pursued.
Any new land -disturbing activity associated with this project should not begin until the area presently
disturbed is brought into compliance with the Act. When corrective actions are complete, you should notify
this office so that the work can be inspected. You should not assume that the site is in compliance with the
Act until we have so notified you. In addition, once compliance has been achieved, all installed measures must
be satisfactorily maintained until development is complete and the site is fully stabilized to avoid further
violations of the Act.
We solicit your cooperation, and would like to avoid taking further enforcement action. At the same
time, it is your responsibility to understand and comply with the requirements of the Act. Copies of the relevant
statute and administrative rules maybe examined at this office or will be sent to you upon request. Should
you have questions concerning this Notice orthe requirements of the Act, please contact either Kevin Rowland
or me at your earliest convenience.

Dear Mr. Vincent:
The Wilmington Regional Office received a Stormwater Management Permit
Application for Village Road Commons on August 27,.2003. A preliminary review of that
information has determined that the application is not complete. The following
information is needed to continue the stormwater review:
1. Most developers of commerical subdivisions will install the necessary drainage
structures (piping or swales) to direct the runoff to the pond. Because you have
elected to have the lots provide their own drainage piping or swale to convey the
runoff to the pond, it is necessary to tweak restriction Vlll, Section 2d to read as
follows:
All runoff from the built -upon areas on the lot must drain into the fore_bay of the
permitted system. (and delete the rest of that section).
And, to make sure each future lotowner knows he or she will be required to
obtain a separate offsite stormwater permit, please add the following condition:
Each lot whose ownership is not retained by the permittee. shall submit a
separate stormwater permit application to the Division of Water Quality and
receive a permit prior to construction.
2. Please update the pond data box below the cross section detail with the new
areas and volumes.

Please note that this request for additional information is in response to a
preliminary review. The requested information should be received by this Office prior to
September 4, 2003, or the application will be returned as incomplete. The return of a
project will necessitate resubmittal of all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your
request for a time extension to the Division at the address and fax number at the bottom
of this letter. The request must indicate the date by which you expect to submit the
required information. The Division is allowed 90 days from the receipt of a
completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance
under an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-
215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any
original documents that need to be revised have been sent to the engineer or agent. All
original documents must be returned or new originals must be provided. Copies are not
acceptable. If you have any questions concerning this matter please feel free to call me

Thank you for your continuing review of the above referenced project. This resubmittal
includes revisions required as a result of comments from the North Carolina Department of
Transportation. NCDOT requested that the developer reserve more area for the future
widening of Village Road, thus changes had to be made in the allowable impervious area for
each lot and changes had to be made in the pond. The pond became a little smaller than the
previous submittal.

When using the Division SAIDA tables, the correct SAIDA ratio for permanent pool sizing should be computed based
upon the actual impervious % and permanent pool depth. Linear interpolation should be employed to determine the
correct value for nonstandard table entries.
In the 20 coastal counties, the requirement for a vegetative filter may be waived if the wet detention basin is designed to
provide 90% TSS removal. The NCDENR BMP manual provides design tables for both 85% TSS removal and 90%
TSS removal.

II. REQUIRED ITEMS CHECKLIST
The following checklist outlines design requirements per the Stormwater Best Management Practices Manual (N.C.
Department of Environment, Health and Natural Resources, February 1999) and Administrative Code Section: 15 A
NCAC 21-1. 1008.

filter if one is provided.

Maintenance activities shall be performed as follows:
1. After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation, vegetated
cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within 2
to 5 days as designed.
2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative cover
to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain proper
functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is reduced to
75% of the original design depth (see diagram below). Removed sediment shall be disposed of in an appropriate
manner and shall be handled in a manner that will not adversely impact water quality (i.e. stockpiling near a wet
detention basin or stream, etc.).

The measuring device used to determine the sediment elevation shall be such that it will give an accurate depth
reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads 3.38 feet in the main pond, the sediment shall be removed.
When the permanent pool depth reads 3.15 feet in the forebay, the sediment shall be removed.

Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
If the basin must be drained for an- emergency or to perform maintenance, the flushing of sediment
through the emergency drain shall be minimized to the maximum extent practical.
All components of the wet detention basin system shall be maintained in good working order.

Thank you for your initial review of the above referenced project. This resubmittal includes

and subdivision layout required to accommodate future roadway improvements by NCDOT. The
following is in response to your previously mentioned letter. Your original comment has been
noted, followed by our response on bold.
• Please either delineate all wetlands on site, disturbed or undisturbed, or note on the plans
that none exist. No wetlands exist on this site. See attached letter.
• Please locate and record the necessary drainage easements on the lots and the collection
system so that each lot has access to the forebay of the pond. If you are not providing a
main collection pipe for the lots to hook onto, you must stipulate in the deed restrictions
that each lot is required to provide adequately sized and located piping or vegetated
conveyance to drain all of their runoff into the forebay of the pond. Design of a main
collection system is not feasible at this time, since the site layouts of future developments
on the lots are not known. The stipulations mentioned above will be included in the final
deed restrictions and the necessary drainage easements will be provided on the final
recorded subdivision plat.
• Please specify pond side slope vegetation. Vegetation specifications have been provided
for the pond side slopes and the littoral shelf in Note #2.
• Please provide a forebay wall that is lower at the western end in order to force runoff to
traverse the entire length of the pond. The revised pond design includes a depressed rip -
rap section at the western side of the wall to satisfy this request.
• Please provide a copy of the proposed deed restrictions to include all required conditions
and limitations for a high density commercial subdivision. Please use the specific BUA per
lot in square feet, not the 82%. These BUA limits have been provided in an attachment to
the enclosed Permit Application Form as well as the attached standard restrictions for
high density commercial subdivisions from the NCAC.
• Even though the cover letter indicated that calculations were included, I cannot find them
in the file. Please provide a sealed copy of the pond design calculations. We certainly
intended to send the calculations with the original submittal and apologize if we were
responsible for this omission. The revised calculations have been included with this
submittal for your review and approval.

COASTAL ENVIRONMENTAL SERVICES COMPANY (CESCO) has performed a
preliminary study to determine if U.S. Army Corps of Engineers jurisdictional wetlands, as
defined by Section 404 of the Clean Water Act, are present on the subject site_ On August
19, 2002, a site reconnaissance was conducted of all accessible areas of the site as part
of the scope of work for a Phase 1 Environmental Site Assessment (ESA). The following
observations were gleaned from the physical inspection of the property in concert with
selected hand -auger borings:
No vegetation indicative of wetlands was found onsite, only longleaf pine and
other upland flora.
The site soils were found to be Leon fine sand and Baymeade fine
sand (see descriptions in USDA Soil Survey of Brunswick County, NC, map
sheet 6, dated November 1986), not humic in content.
The depth of the water table was measured in each of the boreholes to be
well under one (1) foot below land surface (BLS).
Based on these parameters, the entire subject site appears to be uplands.
Therefore, it has been determined that no jurisdictional wetlands are present onsite.

The Wilmington Regional Office received a Stormwater Management Permit Application
for Village Road Commons on January 13, 2003. A preliminary review of that information has
determined that the application is not complete. The following information is needed to continue
the stormwater review: .
Please either delineate all wetlands on site, disturbed or undisturbed, or note on
the plans that none exist.
Please locate and record the necessary drainage easements on the lots and the
collection system so that each lot has access to the forebay of the pond. If you are
not providing a main collection pipe for the lots to hook onto, you must stipulate
in the deed restrictions that each lot is required to provide adequately sized and
located piping or vegetated conveyance to drain all of their runoff into the forebay
of the pond.
3. Please specify pond side slope vegetation.
4. Please provide a forebay wall that is lower at the western end in order to force
runoff to traverse the entire length of the pond.
5. Please provide a copy of the proposed deed restrictions to include all required
conditions and limitations for a high density commercial subdivision. Please use
the specific BUA per lot in square feet, not the 82%.
6. Even though the cover letter indicated that calculations were included, I cannot
find them in the file. Please provide a sealed copy of the pond design calculations.
7. Please dimension the permanent pool contour of the pond.

Please note that this request for additional information is in response to a preliminary
review. The requested information should be received by this Office prior to April 18, 2003, or
the application will be returned as incomplete. The return of a project will necessitate resubmittal
of all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for
a time extension to the Division at the address and fax number at the bottom of this letter. The
request must indicate the date by which you expect to submit the required information. The
Division is allowed 90 days from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS I43-215.6A.
Please reference the State assigned project number on all correspondence. Any original
documents that ,need to be revised have been sent to the engineer or agent. All original
documents must be returned or new originals must be provided. Copies are not acceptable. If

I need another time extension on responding to your comments. I am working with the
NCDOT consultant designing the changes to Village Road and Old Fayetteville Road on
alternatives to treating the NCDOT runoff and the Village Road Commons runoff. The NCDOT
is proposing to acquire up to 55 ft of property off the frontage of the Village Road property
with their stormwater treatment alternative. We are trying to size a pond to handle the Village
Road Commons stormwater and the NCDOT stormwater.
Can we have another 4 weeks? Walgreens is proposing to go on the corner lot. We will have
to get things worked out the the NCDOT in the next couple of weeks or Walgreens will walk
from the project.

2003. We are waiting on some information from the NCDOT in regard to where the new
proposed R/W will be when the intersection of Village Road and Old Fayetteville Road is

The attached plans and permit applications are for the proposed Village Road Commons
commercial subdivision located in Leland, NC. The plans submitted are for permitting the proposed
detention pond.
The North Carolina Department of Transportation (NCDOT) currently has plans to widen Village
Road and Old Fayetteville Road when the intersection at Village Road and Old Fayetteville Road is
realigned. Therefore, we have not prepared final design plans for the access roads within the
commercial development. The impervious area for the access roads will be included in the
allowable impervious area for the lots that are adjacent to the access roads. Once we confirm with
the NCDOT the road locations, the design of the access roads will be provided with the first lot that
is developed.
Attached are an original and one copy of the permit application along with the following supporting
documents:
• Two (2) Sets of Plans
• Check for $420.00 for application fee
• Two (2) copies of stormwater calculations

On December 29, 2003, personnel of this office inspected a project located SR 1472 in Brunswick
County, North Carolina. This inspection was performed to determine compliance with the North Carolina
Sedimentation Pollution Control Act of 1973. The inspection revealed a land -disturbing activity of
approximately 4.9 acres being conducted.
It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The
purpose of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 113A-50
to 66, and Title 15A, North Carolina Administrative Code, Chapter4. If you feel that you are not responsible
for the following violations, {Tease notify this office immediately.
The violation that was found is
Failure to take all reasonable measures to protect all public and private property from damage by such
land -disturbing activities. 15A NCAC 46.0005. .
Site has been roughly graded without a gravel construction entrance and without the
installation of the stormwater retention pond (primary erosion and sediment control measures.)
To correct this violation, you must:
1. Install the gravel construction entrance per approved plan. (Reasonable measure)
2. Install the stormwater retention pond per approved plan. (Reasonable measure)

The initial one day civil penalty could be an assessment of up to $5,000,00. A time period for
compliance is not required for this initial one day civil penalty pursuant to NCGS 113A-61.1 (c) and NCGS
113A-64(a)(1). An initial one day civil penalty is being considered for this project.
If the violations described in this Notice are not corrected within 7 days following your receipt of this
Notice, the Division of Land Resources may take additional appropriate legal action against you pursuant to
NCGS 113A-64. That action.could be the assessment of additional civil penalties and may result in the
initiation of other remedies as prescribed by the Act. If additional civil penalties are assessed forthe violations,
the amount may be up to $5,000.00 per day for each day of the violation pursuant to NCGS 133A-64(a)(1).
If all violations are corrected within the time period specified for compliance, additional civil penalties or legal
remedies will not be pursued.
Any new land -disturbing activity associated with this project should not begin until the area presently
disturbed is brought into compliance with the Act. When corrective actions are complete, you should notify
this office so that the work can be inspected. You should not assume that the site is in compliance with the
Act until we have so notified you. In addition, once compliance has been achieved, all installed measures must
be satisfactorily maintained until development is complete and the site is fully stabilized to avoid further
violations of the Act.
We solicit your cooperation, and would like to avoid taking further enforcement action. At the same
time, it is your responsibility to understand and comply with the requirements of the Act. Copies of the relevant
statute and administrative rules maybe examined at this office or will be sent to you upon request. Should
you have questions concerning this Notice orthe requirements of the Act, please contact either Kevin Rowland
or me at your earliest convenience.
