Kahn to construct the storm water facilities. The violations were due to the incomplete construction of the facility by our site subcontractor. Atlantic Brokerage takes full responsible for the violations, Atlantic Brokerage has corrected all of the violations in the Notice of Violation by taking the following actions: 1. During the original construction phase all of the slopes of the pond were sodded and a sprinkler system'was installed. 2. Atlantic Brokerage inspected the pond on October 16, 2003. All of the slopes were being properly maintained. 3. Atlantic Brokerage met with the Empire local manager, Mr. Doug Rose, to insure he was aware of the future maintenance requirements of the pond. Mr. Rose had employed Sycamore Land Services to maintain the pond. 4. Atlantic Brokerage measured the invert of the weir and found it to be exactly 12" above the invert of the orifice. 5. A revised set of plans were hand delivered and discussed in a meeting with Laurie Munn on October 17, 2003. 6. Mr. Phil Norris, P.E. was engaged to re -certify the pond on October 28, 2003. Kahn, Manager Makwen Development Company, LLC 5417 Wyoming Drive Charlotte, NC 28273 Subject: NOTICE OF VIOLATION Empire Distributors Site Stormwater Permit No. SW8 021029 New Hanover County Dear Mr. Kahn: On October 10,- 2003, Wilmington Regional Office personnel performed a Compliance Inspection of the subject project, located at off Barbados Drive in Castle Hayne, New Hanover County, North Carolina. The inspection was performed to determine the status of compliance with Stormwater. Permit Number SW8 021029, issued to you on February 5, 2003. The project was certified by the consultant on September 17, 2003, with no deviations noted. The project has been found in violation of Stormwater. Permit Number SW8 021029 , issued pursuant to the requirements of 15A NCAC 21-1.1000. The violations found are: 1. Section 11.3- The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and maintenance plan must be followed in its entirety and maintenance must occur at the scheduled intervals, including, but not limited to: e. Maintenance of all side slopes in accordance with the approved plan. The east slope appears to be steeper than 3:1. 2. Section 11.6- The facilities must be constructed as shown on the approved plans. a. The outlet structure has been modified from the approved plans. Instead of the top of the outlet being at the storage elevation, a rough weir has been cut into the side of the structure. b. The invert of the weir appears to be less than 12" above the invert of the orifice. A minimum of 12" is required to provide the necessary storage volume. c. A trash rack has not been provided. A trash rack is needed for the top and over the weir face. N. C. Provide a written "Plan of Action" which outlines the actions you will take to correct the violations and a time frame for completion of those actions, on or before November 14, 2003. 2. As long as the east slope adjacent the rear parking lot remains stable, the Division will not require regrading to 3:1. If subsequent inspections reveal a problem, you will be required to regrade to 3:1. 3. Provide a revised plan detail for the outlet structure, or construct the approved outlet structure 4. Provide a trash rack over the top and overflow weir of the current outlet structure. Upon completion of the above items, a revised Designer's Certification will be required. Failure to provide the "Plan of Action" by November 14, 2003, or to correct the violations by the date designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of enforcement -action which may include recommendations for the assessment of civil penalties,' pursuant to NCGS 143-215.6A. By copy of this letter to the New Hanover County Building Inspector, this Office is requesting that the Building Inspector consider withholding building permits and Certificates of Occupancy for this project until this matter is satisfactorily resolved. All required parts of the system are provided, such as a vegetated shelf, and a forebay. 14. Land disturbing on the site will exceed one acre, which requires the site to comply with the State Regulations. The stormwater runoff from the 1.24-acre development will be directed to a stormwater detention pond. The stormwater detention pond was designed to accommodate this site at 30% impervious area lot coverage and provide 90% TSS removal without a vegetated filter. CONSTRUCTION SEQUENCE: The Contractor will install the gravel construction entrance and silt fence prior to beginning any clearing and grading operations. Additional silt fence will be installed when and if conditions warrant during construction. The detention pond/silt basin will be constructed immediately after that portion of the site is cleared, and outlet structure with protection will be installed. Disturbed areas will be landscaped or seeded upon completion. The detention pond will be cleaned out to remove any sediment that accumulates during construction.
