Director Division of Water Quality On October 27, 2005, the Division sent you a Notice of Violation via certified mail, #7005 0390 0001 3200 6936, regarding the incomplete recorded deed restrictions for the subject project. The letter was returned as unclaimed on November 18, 2005, because you had moved and failed to notify the Division of your new mailing address. The Notice was remailed on December 6, 2005, via certified mail #7005 0390 0001 3200 7070, to your new address. Your consultant, James Fentress, P.E., of Stroud Engineering,' submitted a letter dated November 29, 2005. This letter indicated that the required deed restrictions had been recorded. We agreed that some deed restrictions were recorded however, there were several statements contained in the permit that were not placed into the recorded deed restrictions. The Division requested that the restrictions be amended to include the missing statements, and that the required Designer's Certification be submitted. Mr. Fentress' November 29, 2005, letter indicated that the Designer's Certification would be forthcoming within the "next few weeks". To date, none of the required documentation for this project has been submitted, and the project remains in violation. Additionally, the statement regarding the borrowing of built -upon area between lots must be amended to indicate that the Division of Water Quality must approve this transaction. The Division has developed language specific to BUA transfers which the parties involved must record, and a copy of the recorded documents must be submitted to the Division in order to keep track of how much BUA each lot has. The Division again requests that you develop and record an amendment to the covenants, which includes the statements, word for word, as listed in Section 11.13 of the July 9, 2002, permit, and which provides for the amended language regarding the borrowing of built -upon area, and submit a copy of the recorded document to the Division. Please also have your consultant prepare and submit the required Designer's Certification. The inspection was performed to determine the status of compliance with Stormwater Permit Number SW8 020212, issued to you on July 9, 2002. The project has been found in violation of Stormwater Permit Number SW8 020212 , issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are: 1. Section 11.13 - Failure to record the deed restrictions as shown in the permit: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 020212, as issued by the Division of Water Quality under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. c. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Water Quality. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division of Water Quality. This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. g. All runoff on the lot must drain into the permitted system. This may be accomplished through any or all of the following: providing roof drain gutters which drain to the street; grading the lot to drain toward the street; or grading perimeter swales and directing them into the pond or street. Lots that naturally drain into the system are not required to provide these additional measures. 2. Section 11.9 - failure to provide the required Designer's Certification, which documents that the permitted facility has been built in accordance with the permit. To correct these violations you must: Provide a written "Plan of Action" which outlines the actions you will take to correct the violation(s) and a time frame for completion of those actions, on or before November 27, 2005. 2. Submit an amendment to revise the language in the deed restrictions to that shown in the permit. All of the required statements were provided in the proposed deed restrictions document that was submitted with the application in February of 2002, but somehow,'those statements did not make it into the final recorded document, which the Division downloaded from the County's 2 real property website. Additionally, the BUA per lot was recorded as 2,800 ft while the permit was issued for 3,500 ft2 per lot. While recording a lower BUA than was permitted is not a violation, I do want to bring the discrepancy to your attention prior to the turnover to the HOA. 3. Submit the required Designer's Certification. Your association manager, Nick Joseph, indicated that he had a copy of the certification dated 2002, but the Division does not have record of receiving it. The Division has been made aware that it is your intent to transfer this permit to the homeowners in the near future. Please contact Linda Lewis at her number listed at the end of this letter to set up a date for an inspection of the facilities to be performed prior to the HOA accepting the permit. Any deficiencies will need to be addressed prior to the Division's approval of the transfer. You are the permittee of record until such time as the Division approves the transfer. Failure to provide the "Plan of Action" by November 27, 2005, or to correct the violations by the date designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of enforcement action which may include recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A. The site is 20.7 acres located in the City of Wilmington, just south of the intersection of North Kerr Avenue and Martin Luther King, Jr. Parkway. Approximately 17.1 acres will be disturbed during the construction period with 0.72 acres of wetlands slated for protection. Stormwater fron the project will be collected in one of (24) catch basins and (7) drop inlets on the property.. Water will be conveyed to a detention pond for treatment and release at a drawdown rate to be between 2 and 5 days. Site Description The site has a sloped topography with 10 feet of relief from north to south. Stormwater from the site will flow overland with sediment control provided by silt fence. The three areas of wetlands will be protected by a line of silt 1-ence along the perimeter. A sediment trap will be placed in the existing ditch to protect against off site transport of sediment. Waters from the site drain to Smith Creek, stream class C-SW. Ad*aeent Properties Land use in the vicinity is zoned R-10. TIic property has been rezoned to R-7(SD). Land to the north and west is undeveloped. Areas to the south and east are single-family residences. Soils The soil, as found in the SCS Soil Survey of New Hanover County, is Lynn Haven, Seagate and Leon. The property is considered to be poorly drained with permeability rates 2.0 to 20 inches/hour.
