This permit expires on May 28, 2012. Per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this is still an active project please complete and submit the enclosed renewal application by November 28, 2011. If this project has not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you have sold the project please provide the name, mailing address and phone number of the person or entity that is now responsible for this permit. Enclosed is a form for change of ownership, which should be completed and submitted if the property has changed hands. Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment system, a certification of completion be submitted to the Division from an appropriate designer for the type of system installed. This is to certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and supporting documentation. If you have not already provided a Designer's Certification to our office, please include a copy with your permit renewal request and processing fee. A copy of the certification form is enclosed for your convenience. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff from 11,728 square feet of impervious area. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 4. A total of 20,752 ft2 of built -upon area is proposed, with 11,728 ft2 (parking lot) being treated by the infiltration system. The tract will be limited to 20,752 square feet as indicated on the application, and per the approved plans. 5. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 6. The runoff from the proposed 11,728 ft2 of parking lot must be directed into the permitted stormwater control system. Any additions to this built -upon area must be approved prior to construction. SCHEDULE OF COMPLIANCE The stormwater managemer! system shall be constructed in it's entirety, vegetated and operational for its' intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Decorative spray fountains will not be allowed in the stormwater treatment system. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. I f the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans , including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. C. Further subdivision, acquisition, or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. If the proposed BUA exceeds the amount permitted under this permit, a modification to the permit must be submitted and approved prior to construction. 4 State Stormwater Management Systems Permit No. SW8 011125 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. The permittee shall notify the Division of any name, ownership or mailing address changes within 30 days. 13. Prior to the sale or lease of any portion of the property, the permittee shall notify DWQ and provide the name, mailing address and phone number of the purchaser or leasee. An access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale or lease of any portion of the property. 14. The permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the built -upon is directed into the permitted system. 15. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 111. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. Responsibility for compliance with all permit conditions remains with the Permittee until such time as the Division approves the formal permit request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated fof cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 28th day of May, 2002. Cantilevered decks and walkways shall meet this standard or shall be designed to breakaway without structural damage to the main structure. Condominium Unit Buildings 2) The buildings shall comply with the North Carolina Building Code, including the Coastal and Flood Plain Construction Standards, Chapter 34, Volume I or Section 39, Volume I-B, and the Local Flood Damage Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the building code or a flood damage prevention ordinance are inconsistent with any of the following AEC standards, the more restrictive provision shall apply. (See attached sheets for Additional Conditions) This permit action may be appealed by the perminee. or other qualified persons within twenty (20) days of die issuing date. An appeal requires resolution priur to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Signature of Perrmittee JU1, -03' 02 (MON) 15: 05 DEHNR COSTAL ME TEL:919 733 1495 P, 003 Pine Knoll Shores Cond=dniums ADDITIONAL CONDITIONS Permit # 40-02 Page 2of3 3) Prior to the initiation of construction within the Ocean Hazard AEC, a representative of the Division of Coastal Management must stake the limits of the appropriate development setbacks for all structures. In accordance with T15A NCAC 07H.0305(e), the setback limits must be measured either from the pre - nourishment vegetation line that was surveyed in as a part of the Bogue Banks Beach renourishment vegetation, project or from the first line of stable natural vegetation, whichever is most landward. Construction of each building must begin within 60 days of these determinations. Failure to initiate construction within 60 days, or erosion of the shoreline by adverse weather conditions, will require these limits to be restaked by the Division. 4) The buildings must be elevated on pilings not less than eight inches in diameter if round or eight inches to a side if square, and the first floor level of the sills and joists must beet the 100-year flood level elevation of feet. 5) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure. NOTE: In order to protect hatchling loggerhead sea turtles, all lights on the building face, including balcony lights on the ocean side of all structures should be eliminated. Where ocean side lighting is required, alternatives include -shading, screening, or replacing fixtures with modern alternative light sources. Parking lots, streets, tennis courts, walkways, dune crossovers, pools and other areas requiring lights should be illuminated with light fixtures located close to the ground to minimize casting direct light on the beach and dunes_ For more information on the proper design of ocean side lighting, contact the N.C. Wildlife Resources Commission at (919) 729-13 59. Beach Access 6) The wooden beach access shall be less than six feet in width, raised on posts or pilings of five feet or .less depth. Due to its location on the primary dune, the pilings must extend to five feet blow mean sea level. 7) The access shall be exclusively for pedestrian use. 8) Dune disturbances will only be allowed tc the extent necessary for development and if the dune's protective value is not weakened or reduced. Any areas of vegetation of the dune that are disturbed shall be revegetated as soon as feasible. Erosion and Sedimentation Control 9) An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Talton Carteret County Project Setting The applicant owns a 2.28 acre parcel of land adjacent to the Atlantic Ocean in Pine Knoll Shores, Carteret County, North Carolina. The property is located on NC Highway 58 at the border between Atlantic Beach and Pine Knoll Shores. The site is undeveloped and is vegetated with a mix of shrubby upland species. Dominant species include red cedar, wax myrtle and Smilax species with scattered live oaks and prickly pear cactus on the property. The 200 foot long shoreline is eroding, creating an erosion escarpment on the seaward side of the primary dune. Elevation of the property is 16 feet, and s zoned VE elevation 12 on the Flood Insurance Rate Map produced by the Federal Emergency Management Agency. The first line of stable natural vegetation is at the top ofthe erosion escarpment and was surveyed prior to the ongoing Bogue Banks Beach Nourishment project. This property is the eastern boundary of that project. The property is bordered on the east by a CAMA Public Access site consisting of a 6 ft wide wooden walkway. The Atlantic Beach and Pine Knoll Shores town limits meet at the CAMA public access. The access is immediately adjacent to a developed commercial property containing Sandcastles, a drinking establishment. Most of the adjacent property is covered by an asphalt parking lot that serves the public access, Sandcastles, and the Sheraton Hotel. The property to the west is owned by DSF Enterprises and is the location of the Windjammer Inn. It has been landscaped and is vegetated with upland grasses and landscape shrubbery. The Atlantic Ocean forms the southern property line. The beach has recently been expanded during the Bogue Banks Beach Nourishment project. Material from an offshore borrow site was deposited on the beach from thetoe of the primary dune to below the mean high water level. NC highway 58, a two-lane asphalt road, forms the northern boundary of the subject property. Jungle Land, an amusement complex is located on the north side of Highway 58. The Atlantic Ocean is classified SB by the Environmental Management Commission. The property is located in the White Oak River Basin. Project Description The applicant proposes to construct two buildings to house eight condominium units and associated parking and a swimming pool. A paved driveway would provide access to the condominium buildings. The proposed condominium buildings are located approximately 125 feet landward of the first line of stable natural vegetation, meeting the long term erosion setback line for large structures. A 40 ft by 60 ft swimming pool with a 6 ft concrete collar is proposed on the landward side of the primary dune. No excavation is proposed in the dune; however, fill material is proposed to create a level area for pool construction. A 6 ft wide wooden walkway is proposed to provide pedestrian access from the condominiums to the beach. During construction of the buildings, the associated septic system, parking lot, driveway, and stormwater collection system, a total of 1.6 acres of the property would be disturbed. Anticipated Impacts The project as proposed would impact 69,696 ftZ. REQUIRED ITEMS CHECKLIST The following checklist outlines design requirements per the Stormwater Best Management Practices manual (N.C. Department of Environment, Health and Natural Resources, November 1995) and Administrative Code Section: 15 A NCAC 2H .1008. Soils have a minimum hydraulic conductivity of 0.52 inches per hour. h. System is not sited on or in fill material or DWQ approval has been obtained. i. Plans ensure that the installed system will meet design specifications (constructed or restored) upon initial operation once the project is complete and the entire drainage area is stabilized. j. System is sized to take into account the runoff at the ultimate built -out potential from all surfaces draining to the system, including any off -site drainage. k. System is located in a recorded drainage easement for the purposes of operation and maintenance and has recorded access casements to the nearest public right-of-way. 1. After further review by staff, we have determined that this project will not meet the requirements of a low density project, due to the proposed project's infiltration piping. . Please resubmit this project to be processed as a high density project. In the re -submittal please include a new stormwater application and accompanying infiltration trench supplement, accompanying calculations, and soils report. Also, please enhance the infiltration detail with design width and height.. It is not necessary to submit an additional application fee. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to March 27, 2002, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. A hand-written note is present on both sets of plans which states that there are no wetlands on the site, but the note is not sealed, nor is it initialed or dated.
