In addition, projects located within the 20 coastal counties, which are excluded by rule from the requirements of 15A NCAC 021 I .1005, will no longer require submittal of State Storrnwater permit applications or submittal of requests for NCDI;NR to provide confirmation that the proposed project is excluded from State Storrnwater permitting requirements under 15A NCAC 021-1 .1000. NCDOT may consult with NCDE-NR on a case-hy-case basis as needed to promote protection of water quality standards. '['iris streamlining initiative is being implemented because NCDOT is regulated under its National Pollutant Discharge Elimination System (Nl'DF'S) permit, NCS000250, Your NPDES permit applies statewide and authorizes NCDOT to discharge general roadway and railway drainage, non -roadway Facility drainage, borrow pit wastewater and stormwater associated with industrial activities. The NPDES permit requires NCDOT to maintain and implement a Post- Construction Stonmvaler Program (PCSP) which regulates stormwater discharges from new NCDOT development and redevelopment for new built upon area. The PCSP requires structural and non-structural best management practices (BMPs) to protect water quality, reduce pollutant loading, and minimiZc post -construction impacts to water quality. The f'CSP outlines the implementation of the approved BM P Toolbox and a training program for NCDOT staff and contractors for implementation of the Toolbox. Mere is the history: 1. 1 had a complaint about a NCDOT infiltration basin a while back, had it inspected, wrote a letter, and they have maintained it. The permit had'expired and so I also asked them to renew. But, there was evidently a 2013 letter from DENR to NCDOT saying that they don't have to renew. (See email attached. That email has a pdf attachment with the letter.) The top of page 2 is inserted below: l:unher. NCDOT will not be required to renew existing State Post -Construction Stormwater permits Mien they expire. Mien existing State Post -Construction Stormwater permits expire, all the operation and maintenance requirements for Stormwater Controls Measures will be covered under the operation and maintenance requirements of the NCDOT pennit. NCS000250. We need to decide three things: a. How do we want to close these permits out?: Options discussed in 2016 were revoke and rescind. Christine had drafted a letter. (the Word file in the attached email), but we don't think it was ever approved/finalized. b. The 2013 letter addresses the O&M, but what about the rest of the permit?: For instance, the permit I was working on has two infiltration basins. If we revoke or rescind these permits what happens to the design data? Or, does it not matter? Was the intention to essentially dissolve the NCDOT permits that had been issued because they no longer had to obtain permits since they have a NPDES Permit? c. If we rescind or revoke them, what do we do with our hard copies?: We typically keep files that are rescinded. (And probably revoked, but there aren't many.) Bradley talked to the transportation group in DWR and they didn't need the files. He recommended that we at WiRO decide if we want to keep them in our filing stacks and if not, archive them in the State Archives. In regards to the Notice of Non -Compliance Inspection, NCDOT mowed this site on September 10th. The mowing of this site was delayed due to above average rainfall that this 12 area received during the month of July which put our mowing contractor behind schedule. The attached photos were taken today to document that the site has been maintained. In regards to the Notice of Permit Extension & Request for Permit Renewal, in a letter dated July 26, 2013 from Mike, Randall, NCDOT was advised that we will not be required to renew existing State Post -Construction permits when they expire. All operation and maintenance requirements for Stormwater Control Measures will be covered. under the operation and maintenance requirements of the NCDOT permit NCS000250. SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Decorative spray fountains will not be allowed in the stormwater treatment system. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. If the proposed BUA exceeds the amount permitted under this permit, a modification to the permit must be submitted and approved prior to construction. 4 l 11 State Stormwater Management Systems Permit No. SW8 011006 Modification 10. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 11. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 12. At least 30 days prior to the sale or lease of any portion of the property, the permittee shall notify DWQ and provide the name, mailing address.and phone number of the purchaser or leasee. An access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale or lease of any portion of the property. 13. The permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the built -upon is directed into the permitted system. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 15. The permittee must maintain the current permitted drainage area. No additional runoff from outside of the permitted drainage area boundary may enter the permitted stormwater facilities without first applying for and receiving a permit modification. III. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of owership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 5 State Stormwater Management Systems Permit No. SW8 011006 Modification 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. An infiltration basin has been designed to handle the runoff from 182,952 square feet of impervious road area. All overflows from the basin must pass through a 50' vegetated filter prior to discharge. ' Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 4. The basin will treat only the amount of built -upon area indicated on page 3 of this permit, and per approved plans. Any changes to the permitted drainage area or built -upon area must be permitted before construction. Minor changes to pipe runs, sizing or pipe location are not required to be repermitted. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be keptto aminimum and any eroded areas of the system will be repaired immediately. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes and vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structure, vegetated filter, basin, catch basins and piping. g. Access to the bypass structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of D WQ. The records will' indicate the date, activity, name of person performing the work and what actions were taken. Decorative spray fountains will not be allowed in the stormwater treatment system. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other_ supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations priorto construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the, stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and'Erosion Control Plan approval was sought. f Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. Ifthe proposed BUA exceeds the amount permitted under this permit, a modification to the permit must be submitted and approved prior to construction. 4 State Storrmwater Management Systems Permit No. SW8 011006 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. The permittee shall notify the Division of any name, ownership or mailing address changes within 30 days. 13. Prior to the sale or lease of any portion of the property, the permittee shall notify DWQ and provide the name, mailing address and phone number of the purchaser or leasee. An access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale or lease of any portion of the property. 14. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. 15. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 111. GENERAL CONDITIONS l . This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. Responsibility for compliance with all permit conditions remains with the Permittee until such time as the Division approves the formal permit request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules; regulations, or ordinance-•~ :which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwatcr management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: Please remove the underdrains. The idea is to infiltrate the runoff, not collect it in underdrains and discharge it. Only the excess design storm events should be going through the filter. If the soils meet the minimum design criteria, there should not be any standing water after 5 days. 2. Perforated pipes through the berm are allowed, but the collection pipe would need to enter the forebay at the top, not the bottom. The runoff would then trickle down over a sand filter. The perforated pipes would lay on the ground at the bottom of the sand filter and help carry the flow from the forebay into the main infiltration area. See the enclosed detail. .3. Please delineate the I5.I acre drainage area for the infiltration basin. A small scale 1 page drawing will be fine. 4. Please sign the operation and maintenance plan and submit the original. Please add a vegetated filter detail which includes a flow spreader mechanism and the finished grade elevations. 6. The system should be off-line, i.e., the excess design storm runoff should bypass the basin before it gets into the basin, not after. Your letter is in opposition to the direct discharge of stormwater into Foy Creek proposed by DOT as part of the US 17 widening project from Porters Neck to Scotts Hill Loop Road. Your letter also mentions that the DOT agreed to divert this runoff northward along US 17. 1 am not aware of any agreement. Please be assured that no direct discharge of stormwater into Foy Creek has been approved. The DOT began the process of permitting an infiltration basin for this stotmwater runoff in May, 2001. The Division of Water Quality required that all other options be exhausted before permitting this project. The Regional Soils Scientist visited the site in June, 2001, and confirmed that it met the minimum requirements for infiltration. The project submitted a State Stormwater Management permit application on October 11, 2001, A permit to construct an infiltration basin to control the runoff from a 15.1 acre drainage area was issued to the DOT on February 2, 2002. Incidentally, the plan you attached to your fax is not the one that we approved. The proposed site meets all infiltration basin criteria set forth in NCAC 2H.1000. The runoff from a 1.5" storm event will be contained and infiltrated. Any excess design storm overflows from the basin will pass through a 50' vegetated filter prior to discharge into Foy Creek. I think you will agree that this is afar better situation than in the past, where it was very likely that this runoff would have been discharged directly into the Creels with no treatment whatsoever. There is a Dept. of Transportation project with a let date of August 2001 that borders on the Pender-New Hanover. County lines. It will drain directly to Futch Creek, SA ORW. A site visit was made by many different agencies for BMPs on November 28, 2000. The two choices put to me that DOT had were either to straight pipe that would let out several hundred yards into a swal.e graded directly into Futch Creek or to pipe it to an impoundment/wetland area which would then let out directly to Futch Creek. I recommended the impoundment area with the addition of a fore bay. I was told onsite that addi.ti.onal area behind the impoundment would be condemned and purchased by DOT if there was not enough area and volume to properly treat the runoff from the 4.2ac of imp. area. I received calculations regarding the proposed fore bay but known for the wetland area. I am currently trying to get this missing information and thought it prudent to inform yourselves as well as inquire as to the extent WQ should enforce it's State SW rules. I've talked with CAMA and it would be very easy to require a Major permit because of the vicinity and impacts to Futch Creek. I need to know exactly how to proceed with permitting. If CAMA does require a Major, what kind of deal was worked out with WO and DOT? In light- of a recent letter to Tommy regarding the protection of SA wagers should infiltration be required or just requested. I'll let you know now that requesting will not get us infiltration. If we were to permit this as a wet pond then it would have to be permitted as a alternative BMP because as you know wet ponds are not allowed to drain to SA waters. (Note, it will have a direct discharge to SA waters.) This project is highly monitored by the public, i.e. conservationists and environmentalists. If we let DOT by with not meeting the least of. minimal. .requirements I truly believe that it will. come back to haunt- us, not to mention the harm to FuLch Creek that will be created and that will last as long as the road remains. By the way, when is our next meeting? If it is the first week in May I think we could talk about this then. .If. it is either the last week in May or the first week in June I need to get back to DOT's engineers before then. The two choices put to me that DOT had were either to straight pipe that would let out several hundred yards into a swale graded directly into Futch Creek or to pipe it to an impoundment/wetland area which'woul.d then let out directly to Futch Creek. I recommended the impoundment area with the addition of a fore bay. I was told onsite that additional area behind the impoundment would be condemned and purchased by DOT if there was not enough area and volume to properly treat the runoff from the 4.2ac of imp. area. I received calculations regarding the proposed fore bay but known for the wetland area. I am currently trying to get this missing information and thought it prudent to inform yourselves as well as inquire as to the extent WQ should enforce it's State SW rules. I've talked with CAMA and it would be very easy to require a Major permit because of the vicinity and impacts to Futch Creek. I need to know exactly how to proceed with permitting. If CAMA does require a Major, what kind of deal was wcr.ked out with WQ and DOT? In light of a recent letter to Tommy regarding the protection of SA waters should infiltration be required or just requested. I'll let you know now that requesting will not get us infiltration. If we were to permit this as a wet pond then it would have to be permitted as a alternative BMP because as you know wet ponds are not allowed to drain to SA waters. (Note, it will have a direct discharge to SA waters.) This project is highly monitored by the public, i.e. conservationists and environmentalists. If we let DOT by with not meeting the .least of minimal requirements I truly believe that it will. come back to haunt us, not to mention the harm to Futch Creek that will. be created and that will last as long as the road remains. By the way, when is our next meeting? if it is the first week in May I think we could talk about this then. If it is either the last week in May or the first week in June I need to get back to DOT's engineers before then. The meeting minutes are provided below. DCM Ed Brooks stated that a mean high water survey would be required to determine whether a CAMA major permit will be required. A permit will be needed if DOT construction occurs within 75 feet of the mean high water line. In order speed things along Ed offered to flag an approximate mean high water line based on field indicators which is typically landward of the actual line. NCDOT's Hydro department mentioned and is checking into leaving the existing pipe leading from the wet area under the road there instead of replacing it. The pipe may not need to be replaced but was agreed to in order to ease the mind of the adjacent landowner about water backing up onto their property. Cathy Brittingham said that since she received the public notice from COE, the CAMA consistency program was triggered. This means that minimum water quality standards must be met in which case the DWQ stormwater division is consulted. DWQ — Stormwater Scott Vinson stated that if a CAMA permit is needed than a stormwater permit would also be required. Either way in order to meet minimum water quality standards the first 1 '/2 inch of run-off gust be collected and treated before release. As the design is now, the forbay arel gmeets the surface area volume requirements for the 1 '/2 inch collection but the wet area does not. Scott made several suggestions. Split the drainage into both areas, Futch Creek and the wet area. 2) Use infiltration (used for SA waters) in the adjacent upland area. The infiltration basin would have to be higher than the water table to ensure that run-off does not discharge immediately. Maintenance and clearing of debris periodically would be involved. Soils would have to be investigated before using upland for infiltration. Must be able to have a little over'/z inch infiltration rate. No forbay, all run-off goes directly to upland. Run-off goes through forbay, 1 '/2 inch goes to upland and rest goes into wet area then is discharged. Expand the wet area into the adjacent upland to increase volume and surface area j \ (COE does not approve of this). Another suggestion was made by DCM that overflow from the inlet to the system could infiltrate through a grass swell. Scott Vinson also stated that the forbay would have to be maintained and cleared ofj a debris periodically. He believes that even with this the wet area will still fill with sediment and have to be maintained as well. It needs to be determined whether` . clearing sediment out of the wet area is a jurisdictional wetland impact by COE standards. The wet area is not a CAMA jurisdictional wetland. The area will continue to be a wetland and vegetation will grow back once sediment is removed during maintenance, although aquatic life might take longer. Everyone present agreed that reaching in with machinery to clear dead debris from the wet area would be acceptable. COE must be consulted. DCM warned that the locals have expressed great concern over any new discharge into Futch Creek which is an AEC. The shell fish beds in Futch Creek were once closed but due to efforts to bring them back are now open again. Hence the reason the locals are protective of this area. According to the USACE public notice issued on 3/10/03, the USACE is reviewing an application from the N.C. Department of Transportation (NCDOT) to authorize a four -lane, median divided facility entirely on new location between 1-40 and US Highway 17, and including the widening of US Highway 17 to four lanes between Porters Neck and Scotts Hill Loop Road in New Hanover and Pender Counties. The purpose of the work is to provide a freeway connection to the Wilmington Bypass to allow through traffic to avoid Market Street and the greater Wilmington urban area. An interchange connects TIP No. R-2405A (I-40 Connector) with TIP No. R-2633C (Wilmington Bypass). Construction of TIP No. R-2633C is authorized by CAMA Major Permit number 130-00. Involved were the state Marine Fisheries office and Shellfish Sanitation; the County Health Department and Planning Office; state and federal Soil and Water officials; the U. S. Corp of Engineers and Pender Watch and Conservancy. We increased salt water flushing which reduced fecal coliform bacteria to acceptable levels Late in 2000 DOT proposed to divert drainage from the proposed 140-US 17 interchange tluough a 60-inch pipe into the Futch Creek branch called Foys Creek. Those concerned mentioned above protested that such a large amount of dirty fresh water could again cause Futch Creek to return to its previous polluted status. DOT agreed to divert the discharge northward along us 17. We have been informed that DOT still plans to channel these waters into the Foy Creek branch of Futch Creek. Only this time along SR 1571 to a holding pond type structure with a spillway into the head waters of the Foys Creek branch of Fetch Creek' Lanny, please do what you can to stop DOT from destroying our successful ei%rt to clean up Futch Creek. Division of Coastal Management (DCM) received the U.S. Army Corps of Engineers (USACE) Public Notice dated 2/8/01 (Action ID No. 199403620) for the above referenced project. DCM circulated the Public Notice to state agencies for review and comment. At an interagency meeting on 5/24/01, the N.C. Division of Water Quality (DWQ) determined that the proposed stormwater management design was not acceptable. In addition, the N.C. Department of Transportation (NCDOT) was in the process of revising the project's mitigation plan. Therefore, on 5/24/01, DCM determined that a final position on the proposal's consistency with the North Carolina Coastal Management Program was not applicable at that time. On 1/23/02, DCM received a letter from NCDOT dated 11/28/01 (DCM 02-20) providing information about changes in impacts to waters of the United States since the 11/3/00 application was submitted. The 11/28/01 NCDOT letter also includes a mitigation plan for the subject project and an update regarding protected species. . DCM has received comments from state agencies regarding the USACE public notice dated 2/26/01, and the NCDOT letter dated 11/28/01. The initial deadline for developing a final position on the project's consistency with the North Carolina Coastal Management Program was 4/23/02. DCM is in the process of developing a final position at this time, however, we are extending the federal and state consistency review for an additional 90 days, pursuant to 15CFR 930.62. An access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale or lease of any portion of the property. 14. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. 15. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within'the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised pians and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. Responsibility for compliance with all permit conditions remains'with the Permittee until such time as the Division approves the formal permit request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. After every runoff producing rainfall event and at least monthly inspect the infiltration system for erosion, trash accumulation, vegetative cover, and general condition. 2. Repair eroded areas immediately, re -seed as necessary to maintain adequate vegetative cover, mow vegetated cover to maintain a maximum height of six inches, and remove trash as needed. 3. After every'runoff producing rainfall event and at least monthly inspect the bypass, inflow and overflow structures for blockage and deterioration. Remove any blockage and repair the structure to approved design specifications. 4. Remove accumulated sediment from the pretreatment system and infiltration basin annually or when depth in the pretreatment unit is reduced to 75% of the original design depth. The system shall be restored to the original design depth without over -excavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality (i.e. stockpiling near a stormwater treatment device or stream, etc.). A benchmark shall be established in the pretreatment unit. The benchmark will document the original design depth so that accurate sediment accumulation readings can be taken. The measuring device used to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the design depth reads I , S feet in the pretreatment unit, the sediment shall be removed from both the pretreatment unit and the infiltration basin. 5 If the Division determines that the system is failing, the system will immediately be repaired to original design specifications. History: The State Environmental Assessment (SEA) describing this project was approved on June 14, 1994 and on December 17, 1998, a State Finding of No Significant Impact was prepared (FONSI). As described in the SEA, the original project extended from 1-40 to NC Highway 17 at Porters Neck and included the widening of US Highway 17 to four lanes to NC Highway 50 in Holly Ridge in Pender County. The widening of US Highway 17 from Porters Neck to Holly Ridge was subsequently addressed in a separate FONSI dated November 1, 1994. With the exception of the section between Porters Neck and Scotts Hill Loop Road, US Highway 17 has been widened to four -lanes including a five -lane section through Hampstead. Impacts to waters and wetlands associated with these projects have been considered under separate permit actions. The project now being considered for authorization is a four -lane, median divided facility entirely on new location between 1-40 and US Highway 17 and includes the widening of US Highway 17 to four -lanes between Porters Neck and Scotts Hill Loop Road in Pender County. 2 The project will connect to the eastern terminus of the Wilmington Bypass interchange at I-40 and will require the construction of a new interchange at US Highway 17 at Porters Neck. The proposed median width will be 46 feet with embankment slopes at 4:1. Flatter slopes on this project are being proposed to preclude the need for additional shoulder widths to accommodate guardrail, Plans also show the installation of 1,200 mm equalizer pipes under the road fill at approximately 60 m inters als. NCDOT also proposes to construct a storm water outfall adjacent to Scotts Hill Loop Road to carry runoff from a portion of the US 17 widening. NCDOT is proposing to discharge this water into a storm water detention facility consisting of a forebay and wet detention pond near the head of Foys Creek on the north side of Scotts Hill Loop Road. The new location portion of the I-40 Connector traverses a broad, relatively flat interstream divide wetland system in the headwaters of Prince Georges Creek, Island Creek, Smith Creek, Pages Creek and Futch Creek. Dominant vegetation includes pond pine (Pines serotina), loblolly pine, (P. taeda), Sweet gum (Liquidambar styraciiva), red maple (Acer rubrum) and a variety of broad leaved, evergreen shrubs including fetterbush (Lxonia lucida) and gallberry (Ilex gtqbD,l. coriacea). Prevalent soil types include Murville mucky sands and Leon fine sands. With the exception of the channelized headwater of Prince Georges Creek at the western end of the project, no streams will be impacted by the proposed project. However, one National Register architectural property is located along the US 17 portion of the project. The Poplar Grove/Foy House is located just east of US 17 near Scotts Hill Loop Road. The National Register Boundaries of this site encompass 14.8 acres. Improvements to US 17 in this area will be constructed west of the existing roadway and, according to the applicant, should not directly impact this site. Potential impacts to this property, or any other registered properties, or properties listed as being eligible for inclusion on the latest published version of the National Register of Historic Places, identified during the review of this project, will be coordinated, as appropriate, with the SHPO. Consultation of the National Register is the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of any other such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work authorized by the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision, whether to issue a permit, will be based on an evaluation of the probable impacts, including cumulative impacts, .of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts that the proposed activity may have on the,public interest requires a careful weighing of all those factors that become relevant in each particular case. The benefits that may be expected to accrue from the proposal must be balanced against its foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore decided by the outcome of the general balancing process. That decision should reflect the national concern for both protection and use of important resources. All factors that may be relevant to the proposal must be considered including the cumulative effects of it. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (according to Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water'quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer decides that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to decide whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general enviromnental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to decide the need for a public hearing and to decide the public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army (DA) permit serves as application to the NCDWQ for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Water Quality (NCDWQ), Salisbury Street, Archdale Building, Raleigh, North Carolina, Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. All persons wanting to make comments regarding the application for Clean Water Act certification should do so in writing delivered to the North Carolina Division of Water Quality (NCDWQ), 1621 Mail Service Center, Raleigh, North Carolina 27699-1621, on or before March 2, 2001, Attention: Mr. John Domey.
