All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for compliance with the permit. On June 4, 2019, the Wilmington Regional Office of DEMLR inspected the subject project, located on each side of Pittman Avenue, off Executive Drive in Morehead City, Carteret County to determine the status of compliance with the State Stormwater Management Permit Number SW8 011003 originally issued to Mitchell Village, LLC on January 7, 2002. The file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Deport" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. The designer certification has not been provided. 2. The permit expired on January 7, 2016 and has not been renewed. 3. The owner LLC was dissolved by the NCSOS in August 2010. DEMLR was not notified of this change, however, Mitchell Village LLC remains on the Carteret County property tax rolls as the owner of the common areas, which includes a wet detention pond. 4. The permittee has not notified the Division of his new mailing address. A mailing address change of the permittee; Please be advised that until you submit the required Permit Transfer Application Form to the Division and receive approval from the Division to transfer the permit, you remain the permittee of record and are required to comply with the terms, conditions and limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including the operation and maintenance of the permitted stormwater system. Failure to provide the requested information, or to respond to this letter with a plan of action, including a timeline to resolve the identified deficiencies, by July 10, 2019, are considered violations of the permit. if the requested information is not submitted to this office by the due date, then DEMLR staff will re -inspect the site and may issue a Notice of Violation. Please also note that any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the stormwater rules is subject to enforcement action as set forth in NCGS 143 Article 21, including the assessment of civil penalties of up to $25,000 per day. City, Carteret County, North Carolina. The inspection was performed to determine the status of compliance with Stormwater Permit Number SW8 011003, issued to you on January 2, 2002. The project has been found in violation of Stormwater Permit Number SW8 011003, issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are: 1. Failure to certify fh_ e stormwater system. A file review revealed that this office has not received a Designers Certificate. Permit condition states that upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved, plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. To correct these violations you must. - Provide a written "Plan of Action" which outlines the actions you will take to correct the violation(s) and a time frame for completion of those actions, on or before November 25, 2010. 2. Submit a copy the required Designers Certificate. PROJECT DESCRIPTION The Landings at Mitchell Village is a residential project that includes stormwater management. The Landings at Mitchell Village is a planned unit development that will contain 67 residential units. The residential units are to be triplexes, quadplexes, and quinplexes as shown on the plans. The project will also consist of the final construction of Pittman Avenue which has been a dedicated right-of-way since the 1970's. A portion of the street was constructed including curb & gutter along the eastern most portion of the right-of-way and access along the western end of the right-of-way is being utilized by an existing resident. Il. STORMWATER MANAGEMENT The project drains to the southeast under Rochelle Drive. The drainage continues to the east until it reaches the headwaters of Pelletier Creek. Pelletier Creek is a class SC water body. One main wet -detention facility is to be constructed. Wet -pond number 2 incorporates the required treatment for the residential P.U.D.. III. EARTH DISTURBING ACTIVITIES A. Soil types- the entire acreage consists of a sandy surface with an underlying hardpan located at various depths. Due to the sandy nature of the site caution must be maintained throughout construction to minimize the disturbed areas. B. Earth disturbing activities will include construction and installation of the wet - detention facilities and associated storm drainage. Construction of water and sewer facilities, roads, parking lots and buildings. It is anticipated that the residential development will be constructed in at least seven phases. As such, limits on land disturbance in the residential area should be limited to the modification of the offsite storm drainage from wet -detention pond no.I , the installation of utilities in Pittman Avenue, street construction of Pittman Avenue and finally each residential sub -section. If it becomes evident that additional erosion and sedimentation control measures are needed, they shall be installed immediately. It is intended that all grading and excavation activities within a certain area will be protected as soon as that activity is complete, i.e., drainage swales, utility easements, etc. A. Sediment Fence - Sediment fence will be utilized as necessary in locations as shown on plans or as deemed necessary by the engineer to insure that off -site sedimentation in controlled. B. Sediment Basins- Stormwater detention pond proposed for the site will serve as a sediment basins during the construction phase of development. C. Riprap outlet protection- Riprap to be installed at locations shown on plans to reduce energy at high velocity areas. D. Seeding - All disturbed areas will be seeded within 14 days following construction in accordance with the seeding schedule shown on plans. E. Stone Construction Entrance - Stone construction entrances will be used to reduce transport of sediment off site. V. CONSTRUCTION SEQUENCE A. Initial Activities: I . Initiate clearing and grubbing operations. 2. Install stone construction entrances. 3. Complete clearing and grubbing operation. 4. Install silt fencing at locations shown. 5. C. Final Activities 1. Construct buildings and install roof gutters as shown on a per building basis. 2. Construct parking lot, drive way, sidewalks, and walkways. 3. Complete installation of remaining underground utility facilities. 4. Remove accumulated sediment from stormwater detention basins and perform final grading of basins. 5: Complete final landscaping and install wet detention basin vegetation as specified. V1. WET DETENTIN BASIN OPERATION AND MAINTENANCE After every significant runoff producing rainfall event and at least monthly: A. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation, grass cover, and general condition. B. Check and clear the orifice and overflow device of any obstructions. 2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash as needed. 3. Inspect and repair the collection system (piping, flumes, swales, riprap) quarterly to maintain proper function. 4. Remove accumulated sediment from the wet detention basin systems semi-annually or when depth is reduced to 75% of the original design depth. COASTAL STORMWATER REGULATIONS The North Carolina Division of Environmental Management implemented coastal stormwater regulations in coastal counties on January 1, 1988. These regulations are detailed in 15 NCAC 2H.1000 Stormwater Runoff Disposal. These rules allow for a development to be considered under various options.
