DEMLR file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. The Designer's Certification for the 2004 modified pond has not been submitted. 2. The stormwater pond is in need of maintenance. 3. The dissolution of the corporate entity in 2013 is an ownership change that requires notification to the Division and permit transfer to the new owner. 4. The permittee subdivided the property in 2004 and sold off the tracts without benefit of a permit modification. Please inform this Office in writing before October 3, 2015, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies, Failure to provide the requested information, or to respond to this letter by the due date, may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not submitted to this office by October 3, 2015 then DEMLR staff will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed. Please be advised that you are required to comply with the terms, conditions and limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including operation and maintenance of the permitted stormwater system. Violations of your Stormwater Management Permit may be subject to the assessment of civil penalties of up to $25,000 per day per violation. Per General Condition 111.1 of the permit, it is your responsibility to submit a formal request to the Division to transfer the permit in the event of a change of ownership. Please submit a completed and signed Name/Ownership change form to DEMLR by the due date above to initiate the transfer of the permit to the Palms at Dunhill Owners Assn. After ownership of the pond was determined via a tax record search, the associated stormwater management permit was also found. The following deficiencies and compliance issues were observed at the inspection and file review: 1. The Designer's Certification for the 2004 permitted condition has not been submitted. 2. The stormwater pond may not have been enlarged as permitted in 2D04. 3. Maintenance of the pond is not being performed, The side slopes are over -grown and the high water level is indicative of a clogged orifice and/or outlet structure piping. 4. The permittee corporation was dissolved by the NCSOS on February 28, 2013. Dissolution is considered an ownership change that requires notification to the Division. 5. The property was subdivided into 2 tracts by the permittee in 2002 with the subsequent conveyance of each tract to a new owner, all without benefit of an approved plan or modified permit. Since the one permitted tract is now subdivided into 2 tracts, each tract must have it's own permit to utilize the permitted stormwater pond as its required treatment. The existing SW8 010903 permit should continue to be the "master" permit for the pond and for the development of the tract The Palms at Dunhill. The permitee corporation, Palm Beach Development Group LLC was dissolved by the NCSOS on February 28, 2013. General Condition 111.9 stipulates that the permitee shall notify the Division of any name, ownership or_mailinq address changes within 30 days. To date, the permittee has provided no such notification to the Division, A Notice of Violation dated June 22 2004 was sent by Certified Mail and was returned bythe Post Office on September 17 2004, marked as Unclaimed. 6. It appears that that the property was subdivided into 2 tracts (1 R and 2R) on June 18, 2002 as depicted in Map Book 42 at Page 249. Nami Hotel Inc. purchased tract 1 R on 9-2-10. Tract 2R was conveyed to H&S Development of Wilmington, LLC on 4- 21-04. H&S Development conveyed Tract 2R to the Palms at Dunhill Owners Association. Ownership of the pond was established, and from that, the applicable permit was located. The following deficiencies were noted in the August 19, 2015 inspection report: 1. The Designer Certification for the 2004 modified permit that enlarged the previously approved pond has not been submitted. 2. The stormwater pond may not have been enlarged as permitted in 2004 to accommodate additional runoff. 3. Maintenance of the pond is not being performed. Side slopes are overgrown and the water level was high, which may indicate at clogged orifice or outlet pipe. 4. The permittee dissolved their corporate entity in 2013. Dissolution of the corporate entity is considered an ownership change and requires notification to the Division to transfer the permit to the new owners. 5. The property was originally all one tract, but was later subdivided into 2 tracts without notification to the Division. Each of the separate tracts must submit for an individual offsite permit to discharge runoff into the permitted wet detention pond. The 2 tract owners need to make arrangements to divide up the available BUA, and for the shared costs to restore the pond to design condition and for the shared costs to provide for the routine maintenance needs of the pond. As of June 22, 2018, another deficiency has been added - the permit has expired and has not been renewed. Required Actions: (Explain each deficiency and what needs to be done to bring the system back into compliance) (a) A trash rack must be fastened to the top of the outlet structure ASAP. (b) A trash/debris screen must be added to the front of the outlet structure. This screen is vital in controlling the amount of trash and debris that enters the outlet structure. (c) The entire pond slope is covered with "love grass". This type of grass is not permitted by the state. Love grass has a very small root system, it does not protect the soil from eroding as well as other grasses do. Grass seed or sod must replace the love grass. (d) The entire pond is full of trash, this needs to be removed ASAP. The trash is not only an eyesore, it can also affect the efficiency of the pond system.
