On November 30 2011 the Division of Water Quality (DWQ) received the Year Two Monitoring
Report dated October 3 2011, for the Carl Lloyd Bank Parcel in Orange County North Carolina On
January 13 2012 Katie Merritt with DWQ requested that the plot size of each monitoring plot be
measured out to four significant figures and be identified in both the text of the report as well as on
Table 2 All calculations in Table 2 need to reflect this change Additionally Ms Merritt requested
more information on the encroachment of the conservation easement Specifically, she requested
information about how the encroachment affected parts of the buffer restoration, what measures were
taken to restore the mowed areas where restoration was affected, and how you plan to prevent the
encroachment in the future Ms Merritt also requested that the height class criteria for counting natural
stems be revised to include no less than l Ocm as required with Level II monitoring on all future
monitoring reports On February 13 2012 DWQ received a satisfactory response to the requests and
appreciates your cooperation On January 13 2012 Ms Merritt requested revisions to both the nutrient
offset credit ledger and the phosphorous credit ledger On January 30 2012 DWQ received the updated
credit ledgers
According to the UBI the following Project Milestones have been met and the corresponding credits
shall be released

By copy of this correspondence DWQ confirms that you have satisfied the above requirements for the
above referenced tract An additional 10% of your nitrogen credits (0 1 x 24,639 32 = 2,463 93 lb -N)
and an additional 10% of your phosphorus credits (01 x 1,586 98 =158 70 lb -P) are now available for
sale Please update your credit ledgers accordingly

A total of 70% of the available nitrogen credits (17,247 52 lb -N) and 70% of the available phosphorous
credits (1,110 89 lb -P) have been released for this site
Please note that nutrient offset credits generated at this site must be used for impacts in the Upper
New Hope Arm of Jordan Lake within the Cape Fear River Basin

number associated with the impacts for which credits are being purchased as compensatory mitigation
