Dear Mr. Mogensen:
This correspondence is in reference to the Tar River Headwaters Mitigation Bank,
located off Bunnie Huff Road, approximately 23 miles northeast of Oxford, in Person
County, North Carolina. The site includes unnamed tributaries that flow into the Tar River
Cataloging Unit (03020101). The purpose of this letter is to confirm the stream restoration
and enhancement credits associated with the Year 2 and Year 3 monitoring activities,
including implementation of the November 2020 adaptive management plan.
Pursuant to the Mitigation Banking Instrument (UMBI) entitled, Tar River Headwaters
Stream Mitigation Bank, approved on January 27, 2017; the site -specific Tar River
Headwaters Stream Mitigation Bank, approved on February 13, 2017; the Year 2
Monitoring Report dated December 2019; the Adaptive Management Plan dated
November 2020; and the Year 3 Monitoring Report dated December 2020, 20 percent of
the mitigation site's total restoration and enhancement credits shall be available for sale
provided the above referenced monitoring reports and adaptive management plan
demonstrates interim performance standards are being met.
By copy of this correspondence, we confirm that you have satisfied the above
requirements for the Year 2 and Year 3 monitoring credit releases, and 393 stream
mitigation units (SMUs) are now available for sale. To date, 1179 SMUs (60 percent of
the total restoration and enhancement credits) have been released for sale.
Please be aware that the Long -Term Maintenance and Monitoring Performance Bond
will expire on December 31, 2022. Failure to submit financial assurance prior to the
expiration date may lead to a suspension in credit sales.
