Good Morning Mr. Dudley,
I have looked through the file for the subject project in order to provide a status update. What is needed is for the items
listed in the October 24, 2019 Notice of Inspection — Not Compliant letter sent by Linda Lewis, which I have scanned and
attached, to be addressed. As noted in my previous email, the permit was renewed on February 20, 2020, so item #1 has
been addressed. In your previous email, you had indicated that the other items are being addressed. Item #2 of the
October 24, 2019 letter required a modification to be submitted in order to address the additional parking on Bulkhead
Bend. To date, an application to modify SW8 050513 to address this parking area has not been submitted. This
modification and all other deficiencies listed in the October 24, 2019 letter will need to be addressed before the transfer
is able to be processed. Please provide a plan of action and timeline for addressing all of the deficiencies listed in the
above referenced letter, with the exception of Item #1.
Hopefully this email helps provide a more clear path for moving forward. Please let me know if you have any additional
questions or concerns.

I just got your message. That is the last correspondence I have with Mr. Fair regarding the subject project as
well.
Given the state of things, I am mostly working remotely. As such, I do not have this file with me currently. I will

provide an accurate status update. I will add this to my list of things to do when I am in the office next, which

Good Morning Mr. Fair,
I am still working on the permit renewal with the additional information provided on January 22, 2019. 1 have a certain
order I have to review projects, but this one is on my list of things to do. I can't give an exact timelne for reviewing this
project, but I am hoping to get to it next week.
In the meantime, I still have not received an update regarding the non-compliance issues noted in Linda Lewis'
compliance inspection letter dated October 24, 2019. On December 12, 2019, Georgette Scott sent you an email
requesting information regarding the non-compliance issues, specifically whose responsibility addressing the non-
compliance issues will be, and what is needed in both situations. No response was received by her prior to me receiving
this renewal application. On January 21, 2020, 1 sent an email requesting an update on the non-compliance issues, but
also never received a response. While this information is rot necessary for the renewal currently being reviewed, it is
necessary for the subsequent transfer of this permit to the HCA as well as complying with the conditions of the permit.
Please let me know if you have any additional questions or concerns.

Mr. Fair,
I am happy to answer those questions for you.
The forebay must remain vegetated, however, large woody vegetation is not allowed to be planted on the forebay berm
or embankment slopes and if this type of vegetation
starts to grow, it should be removed as part of regular maintenance. Rather, the forebay berm should be vegetated with
non -clumping turf grass. Permit condition 11.3 reads,
"The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at the design condition. The approved Operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
c. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times."
Per the signed Operation and Maintenance Agreement, vegetative cover must be maintained at a maximum height of six
inches. Therefore any large woody vegetation that exceeds six inches must be removed and the area reseeded as
necessary to maintain good vegetated cover.
The 3:1 side slopes is a requirement of the stormwater rules (15A NCAC 02H.1000) under which this project was
permitted. Per item a of permit condition 11.3 (quoted above), the side slopes must be maintained in accordance with
the approved plans and specifications. Additionally, permit condition 11.5 indicates that "The facilities shall be
constructed, operated and maintained in accordance with the provisions of this permit, the approved plans and
specifications, and the supporting documents attached to this permit and on file with the Division." The approved plans,
supplements, and designer's certification indicate both ponds were designed and constructed with 3:1 side slopes. If the
side slopes are no longer 3:1, that means it is not in compliance with the permit and that they have not been maintained
over the years. These side slopes must be repaired to a 3:1 slope. Alternatively, if it can be proven with calculations and
technical justification that the steeper side slopes will remain stable, you could submit a Major Modification Application
to modify the permit. This will require updated plans, calculations, and a new engineers' certification (and all other
required documents as listed in 15A NCAC 02H.1042) to be submitted as part of a complete Major Modification package.

Thanks for the response. Can you advise why we need to remove vegetation from the forebay. Also, is there a reason
the slope needs to be 3:1 maximum? The pond has been installed for years and there have been no instances where the
pond has not functioned as intended including multiple hurricanes.

2. It appears the report indicates that the slope on the eastern end of Pond B must be restored to 3:1. The
approved plans and permit indicate that the side slopes must be maintained at a slope of 3:1. Furthermore the
ponds were certified in 2012 by Richard Collier, which included that the side slopes of the ponds were r.o

It is noted that the plans incorrectly show the orifice for Pond B is 1". This error, apparently, was supposed to be
corrected on your plan set several years ago, but that must not have happened. With that said, the calculations
and documented discussion with the design engineer indicate that the 1.5" orifice size stated in the permit is the
correct size.

Hope you are doing well. I have a couple of follow up questions from Linda's inspection report. In regards to comment
#7 in regards to woody stemmed material on pond bank (A), can you advise if the report was referring those in the red
below, or the blue. The blue does not appear to be on a pond bank, but rather on top of the forebay berm.
Also, in reviewing past aerials back to 2011, it appears the slope of the pond bank has not changed since the pond was
completed. Assuming, the iimpervious is within the allowable limits, is this a condition that can remain?

Dear Mr. Dudley:
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any
development approval issued by the former Division of Water Quality under Article 21 of Chapter
143 of the General Statutes, which was current and valid at any point between January 1, 2008, and
December 31, 2010. The law extended the effective period of any stormwater permit that was set to
expire during this time frame to three (3) years from its current expiration date. On August 2,
2010, the Governor signed Session Law 2010-177, which granted an extra year for a total of four
(4) years extension. Accordingly, the Division is herewith notifying you that the expiration date of
the subject permit was extended to June 1, 2019, but has since expired and needs to be renewed.
On October 22, 2019, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected the subject project, located at Pilothouse Lane and US 17 near
Calabash in Brunswick County to determine the status of compliance with the State Stormwater
Management Permit Number SW8 050513 as transferred and reissued to you on June 11, 2012.
DEMLR file review and site inspection revealed that the site is not in compliance with the terms and
conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection
Report" attached to this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The permit has expired and must be renewed.
2. A modified plan and revised design calculations must be submitted to address the
additional parking added on Bulkhead Bend.
3. Install roof drain collection systems on the backs of all buildings except T6, T7, T8 and T9.
4. Modify the outlet structures to reflect the permitted condition for elevations and orifice
size, or modify the permit and provide revised calculations to support the use of the "as -
built" outlet structures and orifices.
5. Extend the trash rack over the face of the weir cuts.
6. Restore the side slopes of Pond B at the eastern end to 3: 1. Parking may need to be removed
to accommodate the minimum slope requirements.
7. Remove the woody stemmed vegetation on the slopes of Pond A. Woody stemmed
vegetation is allowed at the top of the slope, but not on the slope itself. Please keep in mind
the inspection and maintenance access needs when locating large bushes and trees around
a pond.
8. Show the pool deck trench drain and identify its exit location on the plans.
9. If the small pipe under the pool deck behind the retaining wall is anything other than a
perforated pipe to allow groundwater to escape from behind the retaining wall, please
identify the origin of the pipe and address any runoff as per the rules.
10. Provide an updated and corrected certification.

Please be advised that until you receive approval from the Division to transfer the permit, you are
required to comply with the terms, conditions and limitations of the Stormwater Management
Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General
Statute 143-214.7, including the resolution of the deficiencies listed above.
Failure to provide the requested information, or to respond to this letter with a plan of action,
including a timeline to resolve the identified deficiencies, by November 24, 2019, are considered
violations of the permit. If the requested information is not submitted to this office by the due date,
then DEMLR staff will re -inspect the site and may issue a Notice of Violation. Please also note that
any individual or entity found to be in noncompliance with the provisions of a stormwater
management permit or the stormwater rules is subject to enforcement action as set forth in NCGS
143 Article 21, including the assessment of civil penalties of up to $25,000 per day.

The permit must be maintained in an "active" status at all times for as long as the project exists and
the ponds are used to meet NC stormwater requirements. The permit must be renewed regardless of
how long the project has been around.
The 4-year extension has thrown off everybody's timetables. I usually try to research the status of a
project when a transfer is submitted so that if expiration is coming up soon, it can be handled
concurrently with the transfe,. The transfer application was accepted on May 20, 2019 which was only
10 days before it expired, and only made complete on September 27, 2019. Apparently, no one
realized that the permit was going to expire almost right away after accepting the transfer.
We haven't transferred the permit yet, so Pulte Homes is still the permittee of record. Your next step
is to submit the renewal application and $505.00 fee as soon as possible. We'll put the transfer
application aside momentarily while we process the renewal, and then we can pick up the transfer
after the renewal is issued.

Back in June, Robert Tucker, PE, sent me a letter regarding a few alleged compliance issues at the
subject site. He indicated that he represented the Beacon Townes POA in this matter.
The first is about a lack of an orifice in each of the outlet structures and a lack of a "correctly graded"
vegetated shelf. Both of the ponds were certified by a PE (Richard Collier) as having been built in
compliance with the permit and the approved plans. Hopefully, the outlet structure is accessible from
the bank for inspection and hopefully, we will be able to see and verify an orifice. Since the vegetated
shelf is located under the permanent pool, DEMLR will not be able to determine if the shelf is graded
correctly (that's something covered by the certification), but we should be able to see plantings.
The second allegation is a concern that not all of the building roof drain gutters are draining to the
pond, especially those on the outer perimeter of the roads. Four of the 22 buildings within DA 1 were
allowed to discharge through perforated piping into the canal_ The PE certified that all roof drainage
was directed per the plans and noted the 4 buildings that were not collected. DEMLR will walk around
the back of every building at the inspection to try to determine the status of the roof drainage.
The last allegation is about an unknown pipe "in the vicinity of the swimming pool". Is it possible to be
a bit more specific regarding the location and size of this alleged pipe? Usually, a small pipe near a
swimming pool is some type of a pool overflow drain, and not a stormwater runoff pipe. If it is a pool
overflow drain pipe, then that might be an issue for DWR to address, especially if it's backwash water.
If we can identify the size and origin of the pipe, it would be most helpful for the inspection.

Over the past year to eighteen months, the Beacon Townhomes POA has engaged us to evaluate the site storm water
devices and assess compliance of the site with the permit for construction issued by your office. Listed below are
our observations and evaluations.
Based on our site visits, a review of the permit and plans the following items will need to be addressed in some form
or fashion prior to the permit being turned over to the POA.
PONDS
Both ponds are in overall good condition and appear to be generally functioning as intended. Neither pond has the
correct discharge orifice installed to control the release of the design storm and neither pond has a correctly graded
vegetated shelf. Neither pond shows any of the required plantings on the shelf. To make the necessary adjustments
to bring the ponds into compliance will require them to be drained and partially regraded.
ROOF GUTTER DRAINS
All impervious surface from the site is required to be directed to the two ponds. This is not occurring on any of the
buildings except for those on the inside of Freeboard Lane. It is our understanding from the state stormwater staff
that a "hardship variance" was approved for units T6,T7, T8, and T9 that allows the roof drains to discharge into the
adjacent stormwater channel, however this does not impact the required discharge from gutter drains on the
remaining units.
UNKNOWN PIPING
There is a stormwater pipe in the vicinity of the swimming pool that drains into the adjacent stormwater channel.
This pipe is not shown on the plans and the origin of drainage into the pipe should be identified and either redirected
to pond 2 or a permit revision sought to bring it into compliance.
We recognize this site has been developed over some length of time and has had multiple developers so there may
have been some mistakes made during the construction of the site. We hope this information will be helpful to you
as you make an inspection for transferring the permit from the developer to the POA. Should you have any

I do not see a reference to the storm water permit in the Association's Declaration. Pulte Homes provided that the
storm water permit number was SW8 050513.
I am looking for a copy of the storm water permit. I would like to see the name of the original owner or current owner.
Has there been any application for transfers made to transfer the permit to the association? If an application to transfer
the permit has been issued, then has an inspection been performed or scheduled?
Has any correspondence been issued to the developer for non-compliance on any issues regarding the storm water
permit?

You've been in contact with me and with my supervisor, Georgette Scott, several times over the past
two weeks regarding the transfer of the stormwater management permit from Pulte Home Corporation
to the Beacon Townes Condo Association. I'm not sure why you contacted both me and Georgette,
since we both work in the state stormwater program. It was not necessary for you to obtain multiple
inputs as we all convey the same information about transfers. We want to clarify some misinformation
that is apparently floating around out there about the process for transferring this permit and who is
responsible for what.
The Division has NOT received a request to transfer the permit as of this date. Per NCAC
02H.1045(1)(b), the transfer of a permit from the developer to an HOA/POA can occur without the
signature of the HOA/POA on the transfer application. Only the current permittee is required to sign
the transfer application. The current permittee provides the signed transfer form with contact
information for the HOA/POA, the contact information for any management company, the required
documentation and the $505.00 application fee. Upon receipt of a complete transfer application, the
Division will inspect the project for compliance. Any items that are not in compliance must be restored
by the permittee prior to the transfer of the permit, unless the HOA agrees in writing to take on that
responsibility.
One of the items needed for transfer is a Designer's Certification. The original project permitted in
2005, was certified in May 2012. However, the permit was modified in June 2012. The permitted
modifications have not yet been certified. The Division recently contacted Mr. Jamison Fair at The
Pulte Group, to request that he provide this certification along with the transfer application.
did not have access to the file at the time Ms. Lillis and I spoke on the phone, so I was not aware
that this was a condo project. For condominiums, the common areas are conveyed with each unit, so
you won't find a separate "deed of conveyance" for the common area as you would for a single family
subdivision. There is no need to get this information from an attorney.
The inspection will be able to discern if the pond has been maintained, but will not be able to tell if the
accumulated sediment has been removed. As you discussed with Georgette, a portion of the HOA
fees should already be earmarked for maintaining the stormwater system. If we are not able to
determine that the pond has been maintained during the years that Pulte Group held the permit, we
can ask for the maintenance records. These records should provide information about when the
ponds were inspected and what maintenance actions were performed, specifically, when the
accumulated sediment depth was last checked, what the current pond depths are, and if the sedimenl
was removed.
The permit covers 2 wet detention ponds, one of them is 5 feet deep and the other is 4 feet deep. The
approved O&M documents that were used at that time, indicate that the accumulated sediment must
be removed when the pond's depth is reduced to 75% of the original design depth. For the 5-foot
deep pond, the sediment can accumulate up to 1.25' above the design bottom elevation before it has
to be removed. For the 4-foot deep pond, the sediment can accumulate up to 1 foot above the design
bottom elevation before it has to be removed. The O&M agreement requires the use of a measuring
device to measure the water depth below the permanent pool elevation to see how much sediment
h�is,abcumulated. As long as the sediment has not accumulated beyond the limits set forth in the
`O&M agreement, the sediment does not have to be removed.

Mr..Fair — one other point for your consideration.
In reviewing the plans in preparation for the transfer inspection, I note that the pond details that were
approved in 2005 and reapproved in 2012, have an incorrect orifice size noted. The orifice size is
correct in the sealed design calculations, the supplement forms, and in the permit itself, but not on the
pond details.
The pond details currently show a 1" diameter orifice for each pond. I will be crossing out the incorrect
1" orifice shown on both details and correcting it to 3" for Pond 1 and to 1.5" for Pond 2. 1 will initial
and date the changes, since I am only correcting the orifice sizes to what the engineer has already
specified them to be.
It would be good if the HOA had the benefit of that same change on the approved set of plans that
you will or already have given the HOA.

I will pull the file and see what we have and let you know today. If you want to get it transferred quickly I would
recommend checking the site out and make sure everything is in order and BUA is correct. Make sure you send all the
Updated Secretary of State forms and proper original signatures. If the site has common areas that have been deeded to
the HOA make sure we get a copy of the deed. Make sure the Covenants have been correctly recorded and reflect the
correct BUA limits for lots and that we get a copy if you haven't already sent.
When we get the transfer application and all the documents I will review to make sure it is complete before I assign it.
Once assigned it will be inspected because all transfer HAVE to be inspected before they are transferred.
One last thing, if this is a second transfer make sure you send us a check for $40.00.

Georgette back in 2012 we attempted to transfer the stormwater permit for this project to the HOA but seemed to have
only been successful in transferring it from Centex to Pulte. I am in the process of filling out the transfer form to
transfer to the HOA. Can you confirm that you have received the designer's certification? How do I notify DWQ that I
would like an inspection of the stormwater system?

Commencement or continuation of a land -disturbing activity under the jurisdiction of this Act prior to
the approval of an erosion and sediment control plan is a violation of the Act.
