Included in this information was the 2005 Balanced and Indigenous Species Study for the Pigeon River(CWA 316(a) Demonstration). The 2005 study meets submission criteria and Blue Ridge formally requests that this data be reviewed as part of the basinwide water quality plan currently under development and before development of the 2008 303(d) list. The study plan was submitted the Division of Water Quality in February 2005 and is included in Appendix E of the report. The State Health Director lifted the fish consumption advisory on Waterville Lake on January 9, 2007. Blue Ridge requests that any reference to this body of water in the next basinwide plan include this information. Data relevant to this decision was submitted in the 2005 Dioxin Monitoring in Fish Tissue Report and the 2006 Dioxin Monitoring in Fish Tissue Report. The lake was originally listed in 1998 as impaired due to the fish advisory. Due to the recent removal of this advisory the lake should be removed from the list of impaired waters in 2008. The 2005 B&I Study and the fish tissue reports constitute the Company's data submission of water quality information relevant to the current basinwide water quality plan under development (i.e. the 2008 303(d) list year). Fish collection for 2005 took place in August and September. The University of Tennessee at Knoxville completed fish collection and the report. Fish collection followed the December 2001 monitoring plan approved by DENR. Project details were modified in 2006 to be responsive to the North Carolina Division of Water Quality. The principal changes to the program in 2006 were the elimination of sampling of the main stem of the Pigeon River beginning in 2006 and the collection of at least one whole body bottom feeder sample from Waterville Lake (Stations 4A or 4B). Canton, North Carolina CDear Mr. Haynes— Enclosed is the subject plan required under Part I, Condition A.13 of the NPDES permit for the Blue Ridge Paper Products mill in Canton, North Carolina. Blue Ridge Paper is required to submit a thermal variance report under Section 316a of the Clean Water Act as part of the May 2006 application to renew the NPDES permit for the Canton Mill. We have selected a team lead by Dr.Larry Wilson of the University of Tennessee;Department of Forestry, Wildlife and Fisheries to complete fieldwork and prepare the 316a Thermal Variance Report. Dr. Wilson and the University of Tennessee are key members of the Pigeon River Restoration Project. The focus of this project is re-introduction of non-game species to the Pigeon River following the substantial improvements in water quality associated with the Canton Mill modernization in the 1990s. Re-introductions in the Tennessee portion of the Pigeon River began in 2001 and were expanded to North Carolina portions of the river in 2004. The restoration project is cooperative effort between state and Federal water quality and wildlife agencies in Tennessee and North Carolina. The project receives funding support from both public and private sources including Blue Ridge Paper. General information on the Pigeon River Restoration Project is also enclosed. The purpose of this meeting was to discuss the scope of the 2005 study and proposed changes from previous studies in 1995 and 2000. (Blue Ridge Paper)provided comments on the public review draft of the North Carolina Water Quality Assessment and Impaired Waters List(2006 Integrated 305(b) and 303(d)Report). In those comments, Blue Ridge Paper requested that the Division review data collected by the University of Tennessee(UT) during their biological assessment of the Pigeon River in 2005 and meet with us before finalizing the status of the Pigeon River in the 2006 Integrated Report. These data are included as attachments to this letter. The UT assessment was led by Dr. J. Larry Wilson—Professor and Interim Head of the Department of Forestry, Wildlife and Fisheries and the benthic identification was led by Dr.David Emier—Emeritus Professor,Ecology and Evolutionary Biology. In our discussions with the Division, we understand that the proposed use support ratings of the Pigeon River are heavily based on the biological monitoring that the Division performed in 2002. It should be noted that 2002 was the fmal year of a prolonged drought in the region that started in 1998 and is an "unrepresentative"result for the Pigeon River,particularly the Division's monitoring site at Clyde. When compared to the Division's past monitoring results,the 2002 results are a clear departure from the improved quality trends seen in the river beginning in the early 1990s. The attached 2005 data by the University of Tennessee when correlated to the Division's biological rating criteria indicate that the benthic health of the river from Canton to Waterville is Good-Fair or better. Therefore, we believe the Pigeon River should not be on the 303(d)list for "Impaired Biological Integrity". Blue Ridge Paper submits that the results of the 2005 biological assessment are relevant to the 2006 Integrated Report in that it brings to light the most recent data on the river. As indicated above, the data collected from 2002 should not be used in the 2006 Integrated Report to describe conditions in the Pigeon River as it is unrepresentative of conditions in the River in more recent years. In the March comment letter, Blue Ridge Paper requested a meeting with Division staff to discuss these issues and also offered the participation of the principle scientists that did the 2005 monitoring and analysis work for this meeting. Blue Ridge Paper continues to have interest in meeting with the Division. The 2006 Integrated Report is very important since it is a key part of the Division's view of water quality improvements in the Pigeon River and is submitted both to EPA and available to the public. Blue Ridge Paper certainly respects the efforts that the Division must make to update this Integrated Report every two years and would like to aid in this effort by providing the attached information for consideration. Blue Ridge Paper will submit a river study, which will include a complete biological review of the Pigeon River, to the Division by May 31, 2006 as part of its NPDES permit renewal package. Comments provided below include and reflect the conversation between Blue Ridge and Michelle Woolfolk(Division of Water Quality) and other Division staff. Blue Ridge and its Canton Mill operation have undertaken an aggressive and very successful effort to improve the quality of the Mill's effluent and the water quality of the Pigeon River. Over the last fifteen years,the Mill has undertaken tremendous efforts and invested great resources in accomplishing these goals. We certainly respect the efforts that the Division must make to update this Integrated Report every two years. Blue Ridge also knows that the Division is well aware of these efforts and has been a huge part of the water quality improvements that have been realized. This Integrated Report is very important since it is a key part of the Division's view of these water quality improvements and is submitted both to EPA and available to the public. In our discussions with the Division, we understand that the current ratings of the Pigeon River are heavily based on the biological monitoring that the Division performed in 2002. We would point out that 2002 was the final year of a prolonged drought in the region that started in 1998 and likely represents an"unrepresentative"result for the River,particularly your monitoring site at Clyde. When compared to the monitoring results from 1997, the 2002 results are a clear departure from the improved quality trends seen in the river beginning in the early 1990s. The Mill's effluent quality has progressively improved over this entire period and Blue Ridge continues to undertake more steps to further these efforts. Blue Ridge believes that the Division should consider the most recent available data on the River to finalize these ratings. The report that presents those results is scheduled to be finalized in May of this year. Blue Ridge respectfully requests that the Division consider this more recent data under more "normal"hydrologic conditions. Blue Ridge would be glad to meet with Division staff to discuss these issues. In addition we would offer to solicit the participation of the principle scientists that did the 2005 monitoring and analysis work for this meeting. Another concern is the"assessment unit" listings used by the Division. While we realize that the Division's stream classification listing identifies only one index number for the Pigeon from Canton to the State line, using this index number alone to describe this complex segment makes it difficult for the reader to understand this segment and to link this report with past DWQ reporting. The previous listings/reports from DWQ's web site for 1998, 2000,2002 and 2004 all "break"the River into several assessments units. The Division should continue to use the assessment units employed in the past for continuity and understanding. Specific issue points on this report follow: 1. The report lists the"Pigeon River(Waterville Lake below elevation 2258)" on page 43 of the 303(d) list. The reason for the listing is "Impaired biological integrity"due to the current dioxin posting for the lake. Blue Ridge believes this designation is inappropriate for the following reasons: • The 1998, 2000, 2002, and 2004 reports all list Waterville Lake for"fish advisory-dioxin". The reports do not list this issue as "impaired biological integrity." • Dioxin in carp has never been established as a biological impact to the carp, only as a potential issue to humans who consume the carp. • The 2005 French Broad River Basinwide Water Quality Plan (Chapter 5,page 67) states that"Waterville Lake is on the state's 303(d) list of Impaired waters due to the fish consumption advisory." The report does not mention "impaired biological integrity" as an issue. Based on the information available, Blue Ridge believes the only portion of the Pigeon River that should be included on the 303(d) list is Waterville Lake. In addition, the impairment to the lake should be consistent with previous 303(d) listings in which the lake is listed due to the fish consumption advisory. Updated data on dioxin concentrations in carp are enclosed for review. 2. If it is the intent of the Division to list only Waterville Lake on the 303(d) list, the description of the impaired water should be changed. Currently the description reads "From 0.15 miles downstream of W. Park St to State Route 1642 (Main Street)". The current description should be changed to exclude any portion of the main stem of the Pigeon River. UTK field personnel followed the December 2001 Fish Tissue Sampling Plan prepared by EA Engineering, Science and Technology, Inc., (EA Engineering 2001a) of Chicago, Illinois. UTIC prepared this 2005 fish tissue sampling report using the template developed by EA Engineering for prior reporting years. Bottom feeding species were collected in 2005 from six locations in the Pigeon River and analyzed for 2,3,7,8-tetrachlorodibenzo-p-dioxin (TCDD), 2,3,7,8-tetrachlorodibenzofuran (TCDF), and other CDD and CDF isomers. TCDD and TCDF concentrations in fillet composites from bottom feeders were very low(range=non-detect to 2.8 parts per trillion(ppt)) at all locations sampled. Fillets used for analyses were obtained from black redhorse, common carp, and channel catfish. Chemical analyses were also conducted on a composite sample of three common carp (whole body samples) collected from Station 4A and total TCDD and TCDF concentrations were 2.1 and 1.3 ppt respectively. Percent lipid content of the tissues (fillets and whole body) used for analysis ranged from a mean of 5.6% (fillets)to 13%(common carp whole body). Tissue concentrations of 2,3,7,8-TCDD were consistent with values reported in 2004,and the same conclusion drawn in 2004 can be applied to the 2005 results, i.e., that the concentration of 2,3,7,8-TCDD in carp fillets from Waterville Lake has declined by 94-99 percent during the period from 1990 through 2004(Figure ES-1). Dioxin concentrations in fish tissue samples from all sites sampled in 2005 were below the FDA dioxin health advisory limit and the toxicity equivalent limit of the North Carolina Department of Health and Human Services. iv Figure 6-1 (Cont.). The University of Tennessee Knoxville folks did a fine job in presenting the results for 16 dibenzodioxin/furan congeners and wouldn't expect anything less especially since this is my alma mater. However, the results of one of the dibenzofuran congeners is missing for all of the fish samples. Specifically, the dibenzofuran congener 1,2,3,4,7,8,9-HpCDF results were not reported.
