Dear Mr Chambers
On January 19 2012 the North Carolina Division of Water Quality (Division) received a copy of your permit
modification application for a 401 General Water Quality Certification install a fill in one additional stream at the JT
Russell Ethanol Transfer Facility expansion site in Healing Springs NC in Davidson County Additional information is
required in order that we may determine your project s compliance with 15A NCAC 2H 0500 The Division will require
this information in order to process your application to impact protected wetlands and/or streams on the subject property
Therefore we will place this project on hold as incomplete until we receive this additional information and if we do not
receive the additional information requested below we will have to move toward denial of your application as required by
15A NCAC 2H 0506 Please provide the following information so that we may continue to review your project
1 During a site visit on February 8 2012 fill within a,junsdictional wetland and intermittent stream beyond the
limits of the impacts approved in 401 Water Quality Certification authorization DWQ #11 0582 issued October
13 2011 was noted Resolution of this violation is necessary before the Division can authorize additional impacts
at this site A site visit has been scheduled for March 7 2012 to discuss the violation and further information may
be required upon conclusion of the site visit
You will be further notified if additional information is required for this application If you will not be able to provide the
requested information within the requested timeframe we will assume that you no longer want to pursue this project and
we will consider the project as returned
