A copy of this PCN has been provided directly to Mr. Chad Coburn in the NC -DWQ Wilmington Field Office. Please note that this PCN was previously provided to the Corps of Engineers and the permit is anticipated to be issued by March 9, 2012. The project area is ±12.0 acres in size and is located adjacent to North Kerr Avenue, in Wilmington, New Hanover County (Latitude: 34.277639 °N; Longitude: - 77.889361 °W). The project is located in the Cape Fear River basin and onsite waters drain to Smith Creek. The Water Quality Classification for Smith Creek is C; SW and the Stream Index Number is: 18- 74 -63. The cataloging unit for the site is 03030007. Proposed Project The proposed project consists of the construction of a security fence adjacent to North Kerr Avenue across a UT to Smith Creek in order to meet FAA security requirements. The existing security fence has repeatedly failed at the stream crossing due to high stream flow and accumulation of debris which tears the fence down. As a result of recent utility easement clearing by CFPUA, the fence failure is visible from Kerr Avenue and presents a security breach. In order to meet FAA requirements for the Runway 6 -24 Runway Object Free Area (ROFA), as well as TSA security requirements, the fencing must cross the stream. In order to construct a durable stream crossing for the security fence, the Wilmington Airport Authority proposes to construct a culverted stream crossing for the security fence. The proposed crossing will be constructed by installing three 72" culverts, which will connect to three existing culverts beneath the perimeter road. In order to comply with the FAA runway safety requirements while providing a secure perimeter, the existing culverts will be extended past the ROFA to support the new fence. It is also anticipated that FAA may require the existing airport perimeter road to be relocated outside of the ROFA sometime in the future. Therefore, the proposed culvert extension is designed to accommodate both the new security fence and the future relocation of the perimeter road. (The purpose of the perimeter road is to allow for Airport Rescue and Fire Fighting (ARFF) personnel to respond to aircraft accidents, and to allow TSA personnel to perform daily perimeter security checks. The latter requirement results in the need for the perimeter fencing to be visible from and preferably adjacent to the perimeter road. Please see the attached Project Purpose discussion by Talbert & Bright, which has been provided as an Appendix. This project scope also consists of the clearing of uplands within the project area to remove mature trees in order to provide line of sight to aircraft on approach to Runway 24 and to the approach lighting system. The existing trees currently prevent line of sight. The clearing and grading will occur only in uplands, and no wetlands will be disturbed. Silt fencing will be installed around all disturbed areas to prevent accidental disturbance or sedimentation of existing wetlands. Please see attached Sediment and Erosion Control Plan for location and extent of the proposed clearing. The proposed clearing of the vegetation within the adjacent uplands does not require authorization by the Corps, but we wanted to notify you to avoid any future questions. Project History Ms. Emily Hughes with the Corps of Engineers issued a Jurisdictional Determination (AID #SAW- 2010 - 00280) for the subject property on January 12, 2011. Previous permits have been issued for prior projects within the Wilmington International Airport. The "Wilmington International Airport Permit Actions Summary Table" has been provided as a Appendix, and identifies the previous permits issued, along with the authorized impact areas, to document that the cumulative impacts of previous projects and the proposed project do not exceed 0.50 acres. Proposed Impacts The proposed impacts consist of 214 if of permanent stream impacts for installation of culverts within the stream to accommodate the proposed security fence and future perimeter road. The culverted crossing will consist of the installation of triple 72" aluminum culverts, each approximately 143 if long within the existing stream channel. Stream impacts were minimized through the installation of 72" culverts, which will act to slow down the velocity through the existing 60" culverts, which allows for a shorter rip -rap apron below the outfall of the culverts. Mitigation The applicant proposes to mitigate for the proposed 214 if of permanent stream impacts by purchasing stream mitigation from EEP at a 2:1 ratio, resulting in the purchase of 418 If of stream mitigation. A copy of the EEP Letter of Acceptance has been provided as an Appendix. The current request is for 214 if of permanent stream impacts (see the attached maps and PCN for details). These include: 1. Due to high stream flows, the existing security fence has repeatedly failed where it crosses a stream that runs through the Airport property and under Kerr Avenue. Due to recent utility easement clearing by CFPUA, this security breach is visible to motorists on Kerr Avenue (photo below). 2. The FAA Air Traffic Control Tower (ATCT) does not currently have 'line of sight' to aircraft on approach to Runway 24 or to the approach lighting system due to the presence of trees on Airport property. 3. There is a large wooded area comprised of uplands and wetlands that is currently inside the airport perimeter fence and is directly adjacent to Runway 6 -24. According to the Airport's Wildlife Hazard Management Plan prepared by USDA Wildlife Services, the area habit for wildlife that is potentially hazardous to aircraft operations. 1 �, The Airport proposes to mitigate these safety and security issues by performing the following work: 1. In order to meet FAA requirements for Runway 6 -24 Runway Object Free Area, the fencing must cross the existing stream. The Airport proposes to construct a durable stream crossing for the fencing to provide a secure airport perimeter in compliance with TSA requirements. Construction of the stream crossing will impact the existing stream. 2. The Airport proposes to relocate the security fencing closer to the runway to "fence out" the wetland area from the airfield. This will provide some mitigation for the potential wildlife hazard associated with the wetlands habitat. With the exception of the stream crossing described in #1 above, the fence relocation will not impact streams or wetlands. 3. The Airport proposes to clear trees from approximately 11 acres of upland area to provide the ATCT line of sight requirements to the Runway 24 approach lighting system and to mitigate roosting habitat and associated wildlife attractants in accordance with recommendations in the Airport's Wildlife Hazard Management Plan. This work will not impact streams or wetlands. Description of Stream Impact There are triple 60 -inch HDPE pipes (inside 72" RCP host pipes) and a single 48 -inch RCP located at the upstream end of the stream. The triple pipes convey an existing stream through the Airport property under Taxiway B and Runway 6 -24. The existing pipe ends are located within (but do not violate) the Runway Object Free Area (ROFA) and the fence must be located outside of the ROFA per FAA Airport Design requirements. In order to comply with FAA runway safety requirements while providing a secure perimeter, the existing culverts will be extended past the ROFA to support the new fence. It is also anticipated that FAA may require the existing airport perimeter road to be relocated outside the ROFA sometime in the future. Therefore, the proposed culvert extension is designed to accommodate both the new fence and the future relocation of the airport perimeter road. (The purpose of the airport perimeter road is to allow Airport Rescue and Fire Fighting (ARFF) personnel to respond to aircraft accidents, and to allow TSA personnel to perform daily perimeter security checks. The latter requirement results in the need for the perimeter fencing to be visible from and preferably adjacent to the perimeter road.) The proposed project consists of installing triple 72" aluminum culverts, each approximately 143 If long installed within the existing stream channel, and approximately 138 If of 48" aluminum pipe to connect the existing 48" RCP to one of the new 72" culverts. The 72" culverts will act to slow down the velocity through the 60" HDPE pipes and therefore require a shorter length of riprap apron. Class 2 Riprap is proposed for a length of 71 feet downstream from the triple pipe outfalls to protect the channel and prevent scour. Please note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including SL 2009 -337: An Act to Promote the Use of Compensatory Mitigation Banks as amended by S.L. 2011 -343. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net. Based on the information supplied by you in your request to.use the NCEEP, the impacts that may require compensatory mitigation are summarized in the following table. The amount of mitigation required for this impact is determined by permitting agencies. Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation. The mitigation will be performed in accordance with the N.C. Department of Environment and Natural Resources' Ecosystem Enhancement Program In -Lieu Fee Instrument dated July 28, 2010.
