The Division of Water Quality (Division) is in receipt of your Violation Response and plan of action dated February 27 2012 The
Division has reviewed your letter and requires the following action to be taken
You have requested 30 days to submit a stream mitigation restoration/repair design in accordance with your 401 Water Quality
Certification The Division hereby accepts this proposed schedule of completion Please subrmt these plans by March 31 2012 You
have also indicated that you will ensure that construction of the stream mitigation repair /restoration will be commenced immediately
upon approval of the design and the Division appreciates your commitment to restore the mitigation site within this tree plantmg
season if at all possible
Thank you for your attention to this matter This Office is still considering sending a Recommendation for Enforcement to the
Director of the Division of Water Quality regarding these issues and any future /continued violations that may be encountered Your
above mentioned response to this correspondence will be considered in this process This office requires that the violations as
detailed above be abated immediately These violations and any future violations are subject to civil penalty assessment of up to
