REQUEST FOR MORE INFORMATION
Dear Mr. & Mrs. Sears:
On January 10, 2012, the Division of Water Quality (DWQ) received your application
dated December 19 2011 to impact 80 square feet of Zone 1 and 48 square feet of Zone 2 to
construct a new deck to access the front of the house on the subject property. The DWQ has
determined that your application was incomplete and/or provided inaccurate information
as discussed below. The DWQ will require additional information in order to process
your application to impact protected isolated wetlands and /or streams on the subject
property. Therefore, unless we receive the additional information requested below, we
will have to move toward denial of your application as required by 15A NCAC 213.
0.259. This project will be placed "on hold" as incomplete until we receive this
additional information. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
1. Impact Justification (Avoidance and Minimization)
This office believes you may be able to avoid or minimize impacts to the riparian
buffers. Please evaluate whether you could move the home 5 feet farther away from

the water to avoid Zone 1 impacts or elevate the house 3 additional feet so that the
open wood slatted deck is no longer considered an impact. Please see Buffer
Clarification Memo 2007 -002 for details regarding open wood slatted decks in the
buffer.
2. Any Zone 1 impacts require a Major Variance Application to be presented to the
Environmental Management Commission (EMC) for approval. The Regional Offices are
not authorized to approve impacts in Zone 1. If the impacts can not be avoided, you
must apply for a Major Variance (application enclosed). Please contact Ms. Amy
Chapman, State Buffer Coordinator, at 919 - 807 -6400 for information on
procedures.
Please respond within 30 days of the date of this letter by sending this information to me
in writing at the DWQ Washington Regional Office. If we do not hear from you within
30 days, we will assume that you no longer want to pursue this project and we will
consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to
wetlands, waters or protected buffers. Please be aware that any impacts requested within
your application are not authorized (at this time) by the DWQ. Please call Amy Adams of

Office at 919- 807 -6400 if you have any questions regarding or would like to set up a
meeting to discuss this matter.
