This Office has never placed deadlines for completion of stormwater controls in the Certifications that are issued simply because what is being certified is the control system itself, not the building. It is assumed that the control system will be constructed as part of the project, not an after -thought. As a result of this, a stipulation has been added to all future Certifications of Compliance for projects: the control system must be completed in it's entirety, permanently vegetated, and operational prior to construction of impervious surfaces other than roadways. If you read the Inspection Report carefully it says that "Action to correct this violation must be initiated prior to December 7, 1993. " This does not mean the action must be completed by December 7. i am fully aware of how long it lakes to construct a poi -ad. i am inagreement with your reasoning as to why the pond expansion was delayed. It certainly does not make sense to issue a change order at that late date and delay occupancy of the store, not to mention the exhorbitant costs associated with change orders of that nature. All I wanted from Mr. Henry was a letter explaining how the pond would come to be built as approved, the expected date the contract would be awarded, and the expected completion date. Please take whatever time is necessary within reason to award and execute the project, just keep me informed and updated on progress. The expansion of the project was complete, however, the pond had not been enlarged, as required. In order to alleviate this situation, this Office will begin adding the following statement to all Certification of Compliance with Stormwater Regulations letters: "All proposed stormwater ponds, swales, and ditches shown as a part of the approved stormwater plans, must be constructed in their entirety, permanently vegetated or anchored, and operational for their intended purpose prior to construction of the impervious surfaces associated with the project, except roads, and prior to issuance of the Certificate of Occupancy. Please accept my apology if due diligence has not been accomplished by failure to inform you of the projected construction dates for this work. I assure you there has been no intent to delay the pond construction, and neither Wal-Mart Stores, Inc. nor Adams Consulting Engineers, Inc. wishes to jeopardize the permit through non-compliance. As stated in your letter to Mr. Henry, the Wal-Mart store expansion is fully complete and the additional surface runoff is being directed to the existing undersized pond. Based on an initial understanding that the existing pond was properly permitted and adequately sized for the Wal-Mart expansion, construction on this facility was begun in February, 1993. It was not until further investigations by your office required the subsequent preparation of plans and specifications on our part, and on August 23, 1993, Stormwater Project No. 921003 was permitted to enlarge the pond. The general contractor for Wal-Mart Stores, Inc. was near 90 percent complete with the store expansion by this date; by the time we had completed the entire package of construction drawings and sitework specifications, the owner was within a few weeks of obtaining a Certificate of Occupancy from the City of Jacksonville. Wal-Mart felt it would not be in their best interests to issue a change order to the general contractor on -site this close to project completion and fulfillment of contractual obligations; therefore, the project engineer for Wal-Mart turned over the plans and specs for the pond expansion to Wal-Marts Property Management department to negotiate a contract for the pond expansion project. 6320 Copeland Road o P.D. The review has not been completed because the required Operation and Maintenance Plan has not been submitted, therefore the Stormwater Certification has not been issued for this project. On August 5, 1993, Regional Office Staff conducted a compliance inspection of the project's stormwater facilities and found construction underway. Operation of the stormwater system prior to receipt of the required Certification of Compliance is a violation of 15A NCAC 2H.1003 and is subject to enforcement action pursuant to NCGS 143-215.6A including the assessment of civil and criminal penalties.
