Page 2 9 Narrative Description The NC Division of Coastal Management staff has reviewed this proposal under the NC State Environmental Policy Act and issued a Finding of No Significant Impact on August 31 2009 The property is located in Vandemere at the end of Captains Drive Drive off of Griggs Road in Pamlico County The subdivision known as Vandemere Cove is approximately a 40 acre tract adjacent to Vandemere Creek This site is developed with gravel access roads The subdivision s community common area lot is 5 7 acres The adjacent tract to the north is a similar residential development known as Port Vandemere under construction and the adjacent tract to the south is a proposed subdivision known as Vandemere Creek subdivision The elevation of the high ground of the parcel is about +3 above the normal water level Vegetation on the common lot mainly consists of Coastal Wetlands mixed trees and shrubs and Section 404 Wetlands This lot has approximately 1 300 of continuous shoreline along Vandemere Creek Immediate offshore water depths adjacent to the lot range from about -2 to -6 9 nwl The subaqueous substrate is firm without shell This waterbody is about 700 feet across at this location These waters are not classified as a Primary Nursery Area and there is not any submerged aquatic vegetation present This area is closed to shellfish harvest and is classified as SC Sw Nutrient Sensitive Waters There is not a defined Federal Channel in this area This project area is subject to the Neuse River Riparian Buffer Rules 10 Proposed Development The applicant wishes to construct a new 66 lot subdivision (a k a Vandemere Cove) with infrastructure paved roads gazebo golf cart parking lot 65 slip community marina nature trail and an overlook deck adjacent to Vandemere Creek in Vandemere The proposed development will take place near the end of Captains Drive off of NC 306 The upland development consists of the construction of a 66 lot subdivision with infrastructure golf cart parking lot gazebo nature trail overlook deck and asphalt roads The utilities will be sited within the roadway network right of ways The access roads will connect to Vandemere Creek Drive The first access road will be called Seagom Way" that heads south and forms a T called "Baybreeze Lane "Port Road" will be another small cul de sac off of Vandemere Creek Drive At the end of Vandemere Creek Drive the road will fork north and south The road that forks to the north will not be a part of this protect The road heading south will serve this proposed subdivision and will connect to Captains Drive " At the end and on the south side of Captains Drive there will be a proposed pond with a fountain The remainder of the main road to the south will be off site and will not be a part of this protect This subdivision will have 65 interior lots and the 66' lot will abut Vandemere Creek This Lot #66 will be the subdivision s common area lot and will host the subdivision s community marina Brad Connell February 21, 2012 Morehead City Field Investigation Report Vandernere Cove Page 3 At the end of Captains Drive there will be 375 long by 12 wide asphalt golf cart path heading east towards the subdivision s common area (Lot #66) The cart path has a parking area able to support 35 spaces This parking lot will be 75 long and 40 wide There will be two paths that connect to this parking lot One path on the northwest side of the parking lot will be a winding nature trail that connects to a proposed gazebo and then ends at the marina s Dock C adjacent to the proposed overlook deck This nature trail will be 6 wide and approximately 870 long The nature trail will be constructed of asphalt over the uplands and will be elevated decking as it traverses through the wetland areas The gazebo will be located approximately 285 north of the golf cart parking lot This roofed gazebo will be 25 by 25 with a 40 walkway connection to the nature trail This gazebo will be more than 50 from the landward edge of the Coastal Wetlands The second path on the southeast end of the golf cart parking lot will lead to Dock C " which is the main spine of the community marina This pier will be 725 long and 6 wide It will head in a northeasterly direction Dock A and Dock B will be ,jointly connected to Dock C approximately 180 east of the golf cart parking lot Dock A will be 385 long and 6 wide It will support a total of eighteen boat slips "Dock A will have rune finger piers and sixteen independent tie pilings Each finger pier will be 3 wide and 25 long At the waterward terminus of Dock A there will be an 8 wide and 60 long "T" platform "Dock B" will be 315 long and 6 wide It will support a total of twenty boat slips This dock will have ten finger piers and twenty tie pilings Each finger pier will be 3 wide and 25 long At the waterward terminus of "Dock B there will be an 8 wide and 60 long T platform This platform will support the pump out station The pump out will connect to a force main beneath the dock and connect to a waste water tank located immediately southeast of the golf cart parking lot Dock C will have a 25 by 25 overlook deck This overlook deck will be approximately 165 north of 'Dock B " As Dock C continues to the shoreline it then breaks up into two sections These two sections will support the remaining twenty seven boat slips These two sections are connected by a 6 wide and 120 long platform The northern section will have a 6 wide and 106 long pier walkway This northern section of "Dock C" will support four finger piers and twelve tie pilings Each finger pier will be 3 wide and 25 long There will be an 8 wide and 60 long T platform at the waterward terminus The southern section of Dock C will have a 6 wide and 165 long pier walkway This southern section of dock will support eight finger piers and nineteen independent tie pilings Five of the finger piers will be 3 wide and 25 long and the other three finger piers will be 3 wide and 32 long There will be an 8 wide and 60 long T platform at the waterward terminus of this dock also Brad Connell February 21, 2012 Morehead City Field Investigation Report Vandemere Cove Page 4 Fifty nine of the boat slips at this marina will be able to support vessels up to 28 long The remaining six boat slips will be able to dock vessels up to 35 long Water depths within the proposed boat slips range from 4 8 to 7 6 nwl deep Fueling and /or boat maintenance facilities are not proposed at this time 10 Anticipated Impacts The marina will not pose a hazard to navigation because it will be less than '/a of the width of the waterbody The marina docks will be greater than 50 from both of the adjacent riparian property lines This proposed community marina will usurp 105 600 ftZof Public Trust Waters The marina and nature trail s decking will shade approximately 4 895 ft' of Coastal Wetlands The remaining proposed development (i a the gazebo asphalt roads and golf cart parking lot) will fill 779 724 ftZ of high ground This project area is subject to the Neuse River Riparian Buffer Rules The proposed gazebo and parking lot are sited outside of the EMC s 50 riparian buffer but significant portions of the nature trail and the overlook deck are proposed within the 50 riparian buffer Water depths within the proposed boat slips are deep enough to prevent scouring of the shallow bottom habitat The waters of Vandemere Creek are not classified as a Primary Nursery Area and there is not any submerged aquatic vegetation present This area is closed to
