Program Project setting Doug Dorman with Atlantic Environmental Consultants LLC on behalf of Marshy Ridge Retreat LLC (Billy C Beasley — owner) has requested the attached application be processed under the Express Permit Review Program for construction of a commercial travel trailer park The project site is located at 100 Marshy Ridge Road off SR 1217 (Colmgton Road) near the Town of Kill Devil Hills on a manmade canal off Colmgton Creek which opens into the Albemarle Sound The coastal waters of Colmgton Creek and the adjacent manmade canal are classified as Estuarine Waters with the corresponding designated Coastal Shoreline (75' Estuarine Shoreline) Areas of Environmental Concern (AECs) The proposed project site is 50 95 acres (2 219 382 W) and site preparation is currently underway on the 9 08 acres of uplands with land disturbing stormwater pond and road construction All active work is outside of the Coastal Shoreline AEC The site work currently underway is authorized via Stormwater Permit No SW7111003 issued by the Division of Water Quality on 13 January 2012 as well as an Erosion and Sedimentation Control Plan (Project No DARE - 2012 -005) issued by the NC Division of Land Resources on 26 January 2012 The site has 2 884' of total shoreline with ±900' adjacent the highground associated with the manmade canal and the remaining ±1 984' adjacent Coastal Wetlands along Colmgton Creek The highground portion of the property averages 5 feet above the normal water level (NWL) and the undisturbed areas are vegetated with pines hardwoods upland grasses and herbaceous shrubs and vines The wetland portion of the site has been delineated as 404 wetlands by Tom Steffens of the U S Army Corps on 9 November 2009 and the majority of this wetland is Coastal Wetlands dominated by Juncus romerianus as well as some S artina cvnosuroides and Distichlis sl2icata Existing manmade features on the site include 275 of riprap along a section of the manmade canal and a cemetery sitting on a hill in the center of the upland portion of the property The property is bordered to the south and west by residential properties with single family homes and similar vegetation Colmgton Creek and the associated manmade canal have been classified as SC by the Environmental Management Commission The area is closed to the harvesting of shell fish Dare County has zoned the area R -2B and a conditional use permit dated 3 October 2011 is attached in the application Project description The applicant proposes to construct a 48 site travel trailer park with an access loop road and parking area at each site An office trailer bath house and sewage dump station are also proposed Each trailer site will consist of a 10' by 35 gravel trailer pad with an Marshy ft2 (382%) A49 long retaining wall is proposed along a section of the loop road adjacent an area of delineated 404 wetlands to prevent any fill from entering the wetland Nine of the proposed trailer sites are proposed within the 75' Coastal Shoreline AEC The total impervious coverage proposed within the AEC is 2 448 ft2 (1 15 %) No work is proposed closer than 30 to the NWL of the manmade canal The total amount of disturbance for the project site is 409 464 ft2 (9 40 acres) which includes all the uplands on the site The applicant proposes to construct a wastewater system utilizing standard septic tanks and drain fields Anticipated impacts The project as proposed will result in the disturbance of ±409 464 ft2 of uplands associated with the construction activities Approximately 84 777 ft2 (3 82 %) of impervious surface is proposed for this project The project as proposed will result in the placement of 2 448 ft2 (1 15 %) of impervious surface in the Coastal Shoreline AEC associated Travel Trailer Park CAMA Mayor Permit — Marshy Ridge Retreat LLC Collmgton Dare County North Carolina The proposed improvements are requested by Marshy Ridge Retreat LLC for improvements to a 50 95 acre site located on a manmade canal that connects to Collmgton Creek in Collmgton Dare County North Carolina The proposed improvements include the construction of a 48 site travel trader park and associated infrastructure to support the park such as waterlines stormwater infiltration basins septic systems bath house office and gravel road with parking The proposed impacts within the 75 Area of Environmental Concem(AEC) include site pads 1 9 with associated parking and septic forcemam In addition a portion of stormwater infiltration basin B will be constructed within the 75 AEC The proposed elevation for the top of basin B is 2 9 feet with a bottom elevation of 2 5 feet All the stromwater infiltration basins (A F) will not be excavated more than 6 inches and are interconnected with depths were taken by AEC staff on August 16th 2011 Submerged Aquatic Vegetation (SAV) study was also conducted by AEC staff on August 16th 2011 which determined there were no SAV's within the project area AEC staff delineated Section 404 wetlands in October 2009 AEC staff met with Tom Steffans of the US Army Corp of Engineers to approve wetland alignment and a Notice of Jurisdictional Conditional Use Permit No 7 -2011 Dare County Sections 22 -22 -2 and 22 68 Application of Beasley Land Company LLC fvr Marshy Ridge Retreat Campground On October 3, 2011 the Dare County Board of Commissioners considered the apphcation of the Petitioner above named which application is on file with the Dare County Planning Department, and the Board finds as follows 1 That the written application of Petitioner with attachments has been duly submitted to the Dare County Planning Board as regwred by Section 22 of the Dare County Code (hereinafter referred to as "Code "), 2 That the apphcatiwn substantially complies with the requirements of the Code in that it requests uses permitted by conditional use pernut under the Code, including campgrounds 3 That the Petitioner owns 16 62 acres in Colmgton, NC which is identified on the Dare County Tax Records as Parcel 029956000 The property is zoned R -213 4 That the Dare County Planning Board recommended for approval the granting of this Conditional Use Permit as requested The Planning Board made thus recommendation on September 12, 2011 6 That the Dare County Board of Commissioners is empowered under sections ofthe Code set out above to grant uses such as allowed herein and insofar as the conditional use is hereinafter allowed it will not adversely affect the public interest, 7 That the hereinafter described conditional use is deemed to be reasonable and is not in degradation of the intent of the ordinance NOW, THEREFORE under the provisions of the Code, the following conditional use is granted to Beasley Land Company LLC for a campground, subject to such conditions as are hereinafter set out i CONDMONAL USE A campground consisting of 48 travel trailer sites A site plan depicting the proposed improvements identified as Appendix B is included as part of this Permit CONDMONS 1 A total of 48 camp sites, a 579 square feet bath house, one mobile home to be used as park Jr— office Each campsite shall consist of 30' x 50' campsite with a 10' x 35' gravel parking area for the individual travel trailer and additional gravel parking improvements for motor vehicles within the campsite 2 Travel trailers may be allowed to remam in the park on a year -round basis however such units shall not be used as permanent dwellings Any travel trailer that remains in the park on a year round basis shall be fully licensed and ready for highway use Highway use 2s defined as remaining on its wheels or jacking system and is attached to the site only by quick disconnect type utilities and has no permanently attached additions 3 No additions, decks, porches, or other appurtenances other than 100 square foot entrance landing shall be allowed for each travel trailer It shall be the responsibility of the park owner to ensure that all travel trailer owners are aware of this requirement Any campsite found to be in violation shall be required to remove all improvements found to be mconsnstent with the travel trailer park ordinance 4 A 20' wide gravel road shall be constructed to access the campsites as depicted on the site plan. The gravel road shall consist of a minimum 8" depth of gravel consistent with NCDOT sub -base standards for subdivision roads 5 The campground shall be served by central water from the Dare County water system and will utilize on site wastewater systems subject to approval by the Dare County Health Department 6 Access to the existing cemetery located on the site shall be as depicted on the site plan The easement for the access shall be recorded in the Dare County Register of Deeds prior to the campground is granted final approval 7 A mobile home may be located in the campground to serve as the park office and or the residence for the campground manager This is the only mobile home that may be located in the park. 8 A bathhouse facility will be constructed on the site as required by the Dare County Travel Trailer Park Ordinance The number of fixtures provided shall be as established in the Travel Trailer Park Ordinance. 9 All supplemental state permits shall be secured prior to the inst illation of any of the improvements for the campground Copies of these permits shall be provided to the Dare County Planning Department 2 10 All proposed nnprovements shall be installed within 12 months of the date of Board of Commmswner approval A final plat depicting the location of all site mprove rents shall be submitted to the Plammng Board for final review to ensure compliance with the approved site plan. 11 Any signage for the campground shall be subject to a separate review and approval proems accordmg to the Dare County Sign Ordmance 12 It n understood that all other terms and proviswns of the Code shall remain m full force and effect except as herem lawfully permitted, This � h day of 2011 I.A.
