docking facility Charles and Carolyn Wilson Page Two 9 PROJECT DESCRIPTION The project site is located at 393 Howard s Lane adjacent to the AIWW in Hampstead Pender County To get to the site from Wilmington take US Hwy 17 N to Forest Sound Road (approximately 12 5 miles from the Wilmington Regional Office) Turn right onto Forest Sound Road which after approximately 0 6 miles becomes Corcus Ferry Road Continue approximately 13 miles down Corcus Ferry Road to Howard's Lane Take a right onto Howard s Lane and travel to the terminal end of the road The Wilson s property is the last residence on the eastern side of Howard s Lane house number 393 The lot is approximately 127 acres and existing man made features on the property include a single family residence pier and floating dock The high ground portion is elevated approximately 4 6 feet above Normal High Water (NHW) Vegetation on the tract consists of lawn grasses ornamental trees and shrubs The highground transitions to an area of high marsh consisting of Spikegrass (Distichlis Wicata) Salt Meadow Hay (Spartina patens) and Black Needlerush (Juncus roemerianus) which extends approximately 25 feet in width toward Normal High Water (NHW) The high marsh transitions waterward to an area of low marsh where Glasswort (Sahcornia spp ) Sea lavender (Limonium spp) and Smooth Marsh Cordgrass (Spartina Alterniflora) exist The area of low marsh is approximately 30 35 feet in width as measured waterward of the NHW boundary The existing pier located along the eastern property line was authorized by CAMA General Permit #51368 on 8/28/08 The existing pier extends toward the east and terminates at the edge of a narrow creek that ties into the Hampstead Marina boat basin The surrounding tidal flat (located north of the property) ranges from dry to 1 foot at Normal Low Water (NLW) with the exception of the narrow navigable channel that transects the existing pier The channel is approximately 500 feet long and approximately 25 feet wide Water depths in the existing channel are approximately 0 5 1 foot at NLW According to information obtained during a site visit in September 2011 Submerged Aquatic Vegetation (SAV) does not appear to exist in the area surrounding the existing docking facility however SAVs have been reported less than 0 5 miles north of this location The waters of the AIWW adjacent to the project site are classified as SA ORW by the North Carolina Division of Water Quality They are NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries and they are OPEN to the harvest of shellfish PROPOSED PROJECT The applicant is proposing to excavate an entrance channel to and around his existing docking facility As proposed the entrance channel would originate from a point immediately adjacent to the Hampstead Marma boat basin Currently Hampstead Marina has an active CAMA major permit which authorizes maintenance dredging activities in the vicinity of the docking facility and boat ramp The applicant s request would tie into the dredging footprint of the marina and span north along a 25 30 foot channel a distance of approximately 240 feet As proposed, the dredge limits would measure approximately 240 feet in length by 8 feet in width by 4 feet in depth relative to NLW As calculated the volume of dredged material would be approximately 285 cubic yards According to the application package the dredging activities would occur a distance of 5 foot or greater from the edge of the marsh and would extend approximately 15 feet north of the applicant s existing dock The applicant indicates that all spoil material generated from the project would be disposed of on a sovereign island owned by the State of North Carolina and located at the confluence of Howards Channel and the AIWW A phone call to the State Property office confirmed ownership of the island however Mr John Charles and Carolyn Wilson Page Three Barbour requested additional time to research the property to ascertain whether or not spoil material could be placed there It should be noted however that in years past the island has been used for spoil disposal and permission agreements to use the island have been generated by the Corps of Engineers Although the spoil disposal area is located on a Corps designated disposal island (DA 205) this particular project does not require prior authorization from their agency because the proposal does not involve or impact any areas within the Corps 100 foot easement The proposed spoil disposal area is triangular in shape and measures approximately 340 feet by 375 feet by 100 The area is accessible by barge and no impacts to Coastal Wetlands are anticipated as a result of the project (neither from dredging nor from spoil deposition) Spoil material would be contained on site by existing dike walls and silt fencing 10 ANTICIPATED IMPACTS The proposed entrance channel and boat basin excavation would result in the disturbance of approximately 1920 square feet of shallow bottom habitat As proposed the excavation would result in the removal of approximately 285 cubic yards of sandy shallow bottom Additionally, the proposed spoil deposition would impact approximately 127 500 square feet of highground As described in the application package the project does not appear to impede
