Subject: Compliance Evaluation Inspection
OMNOVA Solutions
General Wastewater Discharge
NPDES Permit No. NCG500245
Union County, North Carolina
Enclosed please find a copy of the Compliance Evaluation Inspection Report for the inspection conducted
at the subject facility on June 8, 2012 by Ms. Donna Hood of this Office. Several operational/monitoring
corrections were made at the time of the inspection. They are as follows:
1. Sample only when the system discharges. If the system discharges once a year, sampling is only
required once a year. If the system discharges two or more times a year, semi-annual monitoring is
applicable.
.2. Sample effluent (discharge) from the system for temperature, total residual chlorine, oil and grease (if
applicable), and pH. Stream (creek) monitoring is currently required for temperature only and not
any other parameters.
3. Total residual chlorine (TRC) analyses were performed to 100 microgram levels. TRC should be
performed to detection levels less than 50 micrograms, which is the level of compliance set by the
current Division of Water Quality policy.
4. Oil and grease monitoring is not required if the discharge does not include air compressor condensate.
Facility personnel expressed the difficulty of having lab personnel onsite at the time of the cooling tower
discharge. Every effort should be made to have lab personnel onsite to collect the sample during a discharge
event. However, should this not be possible, lab personnel may collect samples immediately prior to the
discharge event from the cooling tower.

Section D: Summary of Finding/Comments (Attach additional sheets of narrative and checklists as necessary)
Effluent Sampling:
In the past, the facility has sampled twice a year, as listed in the permit monitoring requirements. During the
inspection, it was discovered that cooling tower only discharges once a year. Please be advised that only
discharging effluent should be sampled for permit monitoring requirements. If the cooling tower is hot
discharging, no sample should be taken and/or analyzed. It was also discovered that 'creek' samples were
being collected as effluent samples. No other water/waterbody should be collected, and analyzed for permit
compliance, only discharging effluent at the cooling tower unit. Lastly, is was observed that the laboratory
was sampling chlorine with a detection level at 100 micrograms. Please be advised that North Carolina has
a chlorine stream standard of 17 micrograms with a permit'compliance level of less than 50 micrograms.
Detection level for the residual chlorine test should be less than 50 micrograms.

Reference is made to the May 10, 2004 letter submitted on your behalf by Delta Environmental
Consultants, Inc. requesting rescission of the subject NPDES General Permit. The letter states the
discharging system is no longer operational and therefore the site no longer requires coverage under the
general permit. In accordance with your request, NPDES General Permit NCG510093 is rescinded,
effective immediately.
Please be advised that this permit rescission is based wholly upon your statement that the activities which
would require general permit coverage at the site have ceased or been eliminated. Division staff has not
visited the site to obtain independent verification. Operating a treatment facility, discharging wastewater
or discharging specific types of sormwater to waters of the State without a valid NPDES permit will
subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be
certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify
this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface
waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.
If you have questions about this matter, please contact Bob Sledge at (919) 733-5083, extension 547 or

On behalf of Laney Oil Company, Inc., Delta Environmental Consultants, Inc. (Delta) herein
requests cancellation of the above -referenced General NPDES permit. The associated
groundwater pump, and treat system has not operated for several years, and therefore, no longer

please advise accordingly.

Dear Mr. Janson.
oftSECTIONReference is made to your April 25, 2001 request for rescission of the subject NPD
Permit. In your letter you state that the remediation system was deactivated in 1996. In accordance with
your request, NPDES General Permit NCG510073 is rescinded, effective immediately.
Please be advised that this permit rescission is based wholly upon your statement that the
activities which would require general permit coverage at the site have ceased or been eliminated.
Division staff has not visited the site to obtain independent verification. Operating a treatment facility,
discharging wastewater or discharging stormwater to waters of the State without a valid NPDES permit
will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be
certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
Rescission of this discharge permit does not absolve you of any other responsibilities you may
have with regard to any groundwater contamination that may still exist at the subject site.
If you have questions about this matter, please contact Bob Sledge at (919) 733-5083, extension
547 or the Water Quality staff in our Mooresville Regional Office at (704) 663-1699.
