Our firm has been retained by Colorado Coastal Development to pursue a Nation Wide Permit to
impact approximately 0.29 acres of jurisdictional wetlands, and 1671inear feet of a perennial
stream. The proposed construction is needed to develop a residential subdivision in the Federal
Point Township, in New Hanover County, North Carolina.
Impacts to wetlands associated with the project consist of approximately 0.29 acres of fill to
non-tidal waters of the United States. Construction activity will impact 257 linear feet of
perennial stream. However, 90 linear feet of impact for installation of utilities lines will be
temporary impacts that will be restored to the original grade and contour once the utilities have
been installed.
The compensatory mitigation proposal, to offset permanent losses of waters of the United States,
has been proposed to be handled through the North Carolina Ecosystem Enhancement Program.
Due to design restraints, there is not sufficient upland remaining on the tract to replace the
proposed impacted wetlands and still meet the project's purpose. NC EEP can better mitigate the
proposed wetland impacts in a single, adjacent wetland mitigation project. We are working with
the NC EEP and will notify the State and Corp when approval for the project has been received.
