State of North Carolina Department of Environment, Health and Natural Resources Division of Environmental Management 0\ James B. Hunt, Jr., Governor Jonathan B. Howes, Secretary A. Preston Howard, Jr., P.E., Director Mr. Carson Cato Comm/Scope, Inc. P..O. Box 199 Catawba, NC 28609 Dear Mr. Cato: July 15, 1993 COMM TIN YrV ;•:+•. •,,,, T JUL 1 6 1993 DIVISI!..a JBT MOORES'VILLE RESIutIAL OFFICE Subject: Response To Comments Comm/Scope Permit: NC0034754 Catawba County This letter is in reference to your correspondence submitted to us on April 5, 1993. In accordance with your request dated July 28, 1992, we are forwarding herewith the subject permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency dated December 6, 1983. We would like to address the concerns you have regarding the subject permit. 1. In review of the North Carolina Administrative Code 15A NCAC 2B.0308, "Classifications and Water Quality Standards Assigned to the Waters of the Catawba River Basin," we have confirmed that the receiving waters for Comm/Scope's discharge is WS IV. 2. The fecal coliform limits of 200/100m1 reflects the revised fecal coliform standard as stated in the North Carolina Administrative Code 15A NCAC 2B.0211(b)(3)(E). This limit does not vary numerically based on the receiving stream's flow; rather, it is applied to dischargers with domestic wastewater. 3. According to information on outfall 002, we understand that this discharge is 100% Contact Cooling Water with biocides added. Contact cooling water is not exempt from whole effluent toxicity testing requirements. Based on the Division's current whole effluent toxicity permitting policy, the appropriate action is to assign a Ceriodaphnia chronic toxicity testing with a 19% limit to this outfall. This limit is in the draft -permit. We hope these comments address your concerns adequately. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. P.O. Part II Page 1 of 14 PART II STANDARD CONDITIONS FOR NPDES PERMITS aECTTON A. DEFINITIONS 1. Permit Issuing Authority The Director of the Division of Environmental Management. 2. DEM or Division Means the Division of Environmental Management, Department of Environment, Health and Natural Resources. 3. Used herein means the North Carolina Environmental Management Commission. 4. Act or "the Act" The Federal Water Pollution Control Act, also known as the Clean Water Act, as amended, 33 USC 1251, et. seq. 5 Mass/Dav Measurements a. The "monthly average discharge" is defined as the total mass of all daily discharges sampled and/or measured during a calendar month on which daily discharges are sampled and measured, divided by the number of daily discharges sampled and/or measured during such month. It is therefore, an arithmetic mean found by adding the weights of the pollutant found. each .day of the month and then dividing this sum by the number of days the tests were reported. The limitation is identified as "Monthly Average" in Part I of the. permit. b. The "weekly average discharge" is defined as the total mass of all daily discharges sampled and/or measured during the calendar week (Sunday - Saturday);on which daily discharges are sampled and measured, divided by the number of daily discharges sampled and/or measured during such week. It is, therefore, an arithmetic mean found by adding the weights of pollutantsfound each day of the week and then dividing this sum by the number of days the tests were reported. This limitation is identified as "Weekly Average" in Part I ofthe permit. c. The "maximum daily discharge" is the total mass (weight) of a pollutant discharged during a calendar day. If only one sample is taken during any calendar day the weight of pollutant calculated from it is the "maximum daily discharge." This limitation is identified as "Daily Maximum," in Part I of the permit. d. The "average annual discharge" is defined as the total mass of all daily discharges sampled and/or measured during the calendar year on which daily discharges are sampled and measured, divided by the number of daily discharges sampled and/or measured during such year. It is, therefore, an arithmetic mean found by adding the weights of pollutants found each day of .the year and then dividing this sum by the number of days the tests were reported. This limitation is defined as "Annual Average" in Part I of the permit. Part ll Page 2 of 14 6. Concentration Measurement a. The "average monthly concentration," other than for fecal coliform bacteria, isthe sum of the concentrations of all daily dischargessampled and/or measured during a calendar month on which daily discharges are sampled and measured, divided by the number of daily discharges sampled and/or measured during such month (arithmetic mean of the daily concentration values). The daily concentration value is equal to the concentration of a composite sample or in the case of grab samples is the arithmetic mean (weighted by flow value) of all thesamples collected during that calendar day. The average monthly count for fecal coliform bacteria is the geometric mean of the counts for samples collected during a calendar month. This limitation is identified as "Monthly Average" under "Other Limits" in Part I of the permit. b. The "average weekly concentration," other than for fecal coliform bacteria, is the sum of the concentrations of all daily discharges sampled and/or measured during a calendar week (Sunday/Saturday) on which daily discharges are sampled and measured divided by the number of daily discharges sampled and/or measured during such week (arithmetic mean of the daily concentration values). The daily concentration value is equal to the concentration of a composite sample or in the case of grab samples is the arithmetic mean (weighted by flow value) of all the samples collected during that calendar day. The average weekly count for fecal coliform bacteria is the geometric mean of the counts for samples collected during a calendar week. This limitation is identified as "Weekly Average" under "Other Limits" in Part I of the permit. c. The "maximum daily concentration" isthe concentration of a pollutant discharge 'during a calendar day. If only one sample is taken during any calendar day the concentration of pollutant calculated from it is the "Maximum Daily Concentration". It is identified as "Daily Maximum" under "Other Limits" in Part I of the permit. d. The "average annual concentration," other than for fecal coliform bacteria, is the sum of the concentrations of all daily discharges sampled and/or measured during a calendar year on which daily discharges are sampled and measured divided by the number of daily discharges sampled and/or measured during such year (arithmetic mean of the daily concentration values). The daily concentration value is equal to the concentration of a composite sample or in the case of grab samples is the arithmetic mean (weighted by flow value) of all the samples collected during that calendar day . The average yearly count for fecal coliform bacteria is the geometric mean of the counts for samples collected during a calendar year. This limitation is identified as "Annual Average" under "Other Limits" in Part I of the permit. . e. The "daily average concentration" (for dissolved oxygen) is the minimum allowable amount of dissolved oxygen required to be available in the effluent prior to discharge averaged over a calendar day. If only one dissolved oxygen sample is taken over a calendar day, the sample is considered to be the "daily average concentration" for the discharge. It is identified as "daily average" in the text of Part I. f. The "quarterly average concentration" is the average of all samples taken over a calendar quarter. It is identified as "Quarterly Average Limitation" in the text of Part.I of the permit. g. A calendar quarter is defined as one of the following distinct periods: January through March, April through June, July through September, and October through December. Partl Page 3 of 14 7. Other Measurements a. Flow, (MGD): The flow limit expressed in this permit is the 24 hours average .flow, averaged monthly. It is determined as the arithmetic mean of the total daily flows recorded during the calendar month. b. An "instantaneous flow measurement" is a measure of flow taken at the time of sampling, when both the sample and flow will be representative of the total discharge. c. A "continuous flow measurement" is a measure of discharge flow from the facility which occurs continually without interruption throughout the operating hours of the facility. Flow shall be monitored continually except for the infrequent times when there may be no flow or for infrequent maintenance activities on the flow device. 8. Types of Samples a. Composite Sample: A composite sample shall consist of: (1) a series of grab samples collected at equal time intervals over a 24 hour period of discharge and combined proportional to the rate of flow measured at the time of individual sample collection, or (2) a series of grab samples of equal volume collected over a 24 hour period with the time intervals between samples determined by a preset .number of gallons passing the sampling point. Flow measurement between sample intervals shall be determined by use of a flow recorder and totalizer, and the present gallon interval between sample collection fixed at no greater than 1/24 of the expected total daily flow at the treatment system, or (3) a single, continuous sample collected over a 24 hour period proportional to the rate of flow. In accordance with (1) above, the time interval between influent grab samples shall be no greater than once per hour, and the time interval between effluent grab samples shall be no greater than once per hour except at wastewater treatment systems having a detention time of greater than 24 hours. In such cases, effluent grab samples may be collected at time intervals evenly spaced over the 24 hour period which are .equal in number of hours to the detention time of the system in number of days. However, in no case may the time interval between effluent grab samples be greater than six (6) hours nor the number of samples less than four (4) during a 24 hour sampling period. b. Grab Sample: Grab samples are individual samples collected over a period of time not exceeding 15 minutes; the grab sample can be taken manually. Grab samples must be representative of the discharge or the receiving waters. 9. Calculation of Means a Arithmetic Mean: The arithmetic mean of any set of values is the summation of the individual values divided by the number of individual values. b. Geometric Mean: The geometric mean of any set of values is the Nth root of the product of the individual values where N is equal to the number of individual values. The geometric mean is equivalent to the antilog of the arithmetic mean of the logarithms of the individual values. For purposesof calculating the geometric mean, values of zero (0) shall be considered to be one (1). Part is Page 4 of 14 c. .Weighted by Flow Value: Weighted by flow value means the summation of each concentration times its respective flow divided by the summation of the respective flows. 10. Calendar Day A calendar day is defined as the period from midnight of one day until midnight of the next day. However, for purposes of this permit, any consecutive 24-hour period that reasonably represents the calendar day may be used for sampling. 11. Hazardous Substance A hazardous substance means any substance designated under 40 CFR Part 116 pursuant to Section 311 of the Clean Water Act. 12. Toxic Pollutant A toxic pollutant is any pollutant listed as toxic under Section 307(a)(1) of the Clean Water Act. SECTION B. GENERAL CONDITIONS 1. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of Title 15A, Chapter 8A .0202. Once the facility is classified, the permittee shall submit a letter to the Certification Commission which designates the operator in responsible charge within thirty days after the wastewater treatment facilities are 50% complete: Part II Page 8 of 14 2. Proper Operation and Maintenance The permittee shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the permittee to achieve compliance with the conditions of this permit. Proper operation and maintenance also includes adequate laboratory controls and appropriate quality assurance procedures. This provision requires the operation of back-up or auxiliary facilities or similar systems which are installed by a permittee only when the operation is necessary to achieve compliance with the conditions of the permit. 3. Need to Halt or Reduce not a Defense It shall not be a defense for a permittee in an enforcement action that it would have been necessary to halt or reduce the permitted activity in order to maintain compliance with the condition of this permit. 4. Bypassing of Treatment Facilities a. Definitions (1) "Bypass" means the known diversion of waste streams from any portion of a treatment facility including the collection system, which is not a designed or established or operating mode for the facility. (2) "Severe property damage'.' means substantial physical damage to property, damage to the treatment facilities which causes them to become inoperable, or substantial and permanent loss of natural resources which can reasonably be expected to occur in the absence of a bypass. Severe property damage does not mean economic loss caused by delays in production. b. Bypass not exceeding limitations. The permittee may allow any bypass to occur which does not cause effluent limitations to be exceeded, but only if it also is for essential maintenance to assure efficient operation. These bypasses are not subject to the provisions of Paragraphs c. and d. of this section. c. Notice (1) Anticipated. bypass. If the permittee knows in advance of the need for a bypass, it shall submit prior notice, if possible at least ten days before the date of the bypass; including an evaluation of the anticipated quality and affect of the bypass. (2) Unanticipated bypass. The permittee shall submit notice of an unanticipated bypass as required in Part II, E. 6. of this permit. (24 hour notice). d. Prohibition of Bypass (1) Bypass is prohibited and the Permit Issuing Authority may take enforcement action against a permittee for bypass, unless: (A) Bypass was .unavoidable to prevent loss of life, personal injury or severe property damage; " (B) There were no feasible alternatives to the bypass, such as the .use of auxiliary treatment facilities, retention of untreated wastes or maintenance during normal Part II Page 9 of 14 periods of equipment downtime. This condition is not satisfied if adequate backup equipment should have been installed in the exercise of reasonable engineering judgment to prevent a bypass which occurred during normal periods of equipment downtime or preventive maintenance; and (C) The permittee submitted notices as required under Paragraph c. of this section. (2) The Permit Issuing Authority may approve an anticipated bypass, after considering its adverse affects, if the Permit Issuing Authority determines that it will meet the three conditions listed above in Paragraph d. (1) of this section. 5. Upsets a. Definition. • "Upset " means an exceptional incident in which there is unintentional and temporary noncompliance with technology based permit effluent limitations because of factors beyond the reasonable control of the permittee. An upset does not include noncompliance. to the extent caused by operational error, improperly designed treatment facilities, inadequate treatment facilities, lack of preventive maintenance, or careless or improper operation. b. Effect of an upset. An upset constitutes an affirmativedefense to an action brought for noncompliance with such technology based permit effluent limitations if the requirements of paragraph c. of this condition are met. No determination made during administrative review of claims that noncompliance was caused by upset, and before an action for, noncompliance, is final administrative action subject to judicial review. c. Conditions necessary for a demonstration of upset. A permittee who wishes to establish the affirmative defense of upset shall demonstrate, through properly signed, contemporaneous operating logs, or other relevant evidence that: (1) An upset occurred and that the permittee can identify the cause(s) of the upset; (2) The permittee facility was at the time being properly operated; and (3) The permittee submitted notice of the upset as required in Part II, E. 6. (b) (B) of this permit. (4) The permittee complied with any remedial measures required under Part II, B. 2: of this permit. d. Burden of proof. In any enforcement proceeding the permittee seeking to establish the occurrence of an upset has the burden of proof. 6. Removed Substances Solids, sludges, filter backwash, or other pollutants removed in the course of treatment or control of wastewaters shall be utilized/disposed of in accordance with NCGS 143-215.1 and in a manner such as to prevent any pollutant from such materials from entering waters of the State or navigable waters of the United States. The permittee shall comply with all existing federal Part II Page 10 of 14 regulations governing the disposal of sewage sludge. Upon promulgation of 40 CFR Part 503, any permit issued by the Permit Issuing Authority for the utilization/disposal of sludge may be reopened and modified, or revoked and reissued, to incorporate applicable requirements at 40 CFR Part 503. The permittee shall comply with applicable 40 CFR Part 503 Standards for the Use and Disposal of Sewage Sludge (when promulgated) within the time provided in the regulation, even if the permit is not modified to incorporate the requirement. The permittee shall notify the Permit Issuing Authority of any significant change in its sludge use or disposal practices. 7. Power Failures The permittee is responsible for maintaining adequate safeguards as required by DEM Regulation, Title 15A, North Carolina Administrative Code, Subchapter 2H, .0124 Reliability, to prevent the discharge of untreated or inadequately treated wastes during electrical power failure's either by means of alternate power sources, standby generators or retention of inadequately treated effluent. SECTION D. MONITORING AND RECORDS 1. Representative Sampling Samples collected and measurements taken, as required herein, shall be characteristic of the volume and nature of the permitted discharge. Samples collected at a frequency less than daily shall be taken on a day and time that is characteristic of the discharge over the entire period which the sample represents. OP NATO RESOURCES AND Oply w ;' '. -DEVELOPMENT JUN 0 9 9993 pNIStati 5F Etill iui ait1 A'4 Ufa unatslat Comments on Draft Permit for Comm/Scope, Inc. NPDES Permit No. NC0034754 Catawba County The Instream Assessment Unit has reviewed the comments from the subject facility and has the following recommendations. 1) Fecal Coliform Limit The previous limit of 1000/100m1 for Comm/Scope was based on the old N.C. water quality standard for Class C waters. The new limit of 200/100m1 reflects the revised: fecal coliform standard as stated in North Carolina Administrative Code 15A NCAC 2B .0211 (b)(3)(E). This limit does not vary numerically based on the receiving stream's flow but is applied to dischargers with domestic wastewater. Comm/Scope's receiving stream, an unnamed tributary to Terrapin Creek, has a Class C classification therefore the fecal limit is applicable. 2) We will defer to the Environmental Sciences Branch on recommendations regarding the Chronic Toxicity Limit assigned to outfall 002. However, there needs to be clarification on the discharge point for outfall 002. The location of outfall 002 on the map submitted in Comm/Scope's letter is not the same location of the discharge point in the 1991 wasteload allocation or the Mooresville Regional Office's staff report (4/29/91). The. location of the 002 outfall was to a stream or dry ditch with a 7Q10=0 cfs. If the correct discharge point is into the Comm/Scope pond then a 7Q10 of 0.05 cfs should be used. The instream waste concentration (IWC) would be 5% with a wasteflow of 0.00175 MGD. If the proposed wasteflow of 0.0075 MGD is used then the IWC = 19%. If there are any questions concerning these comments, please contact me. cc: Larry. Valid electronic signature refers to an electronic signature on an electronic document that has been created with an electronic signature credential. This Electronic Signature Agreement, when fmalized and approved, will allow the individuals with electronic signature credentials to sign electronically a variety of required permit documents in lieu of the submittal of signed paper copies. The submittal of Electronic Discharge Monitoring Reports (eDMR) will be available once your electronic signature credentials are in place. Some agreements for document submittals or acceptance, as noted in the Agreement Conditions (Section B.), are not currently available electronically but are included here to have the agreements in place and to avoid the need to complete future submittal of agreement forms when these systems are initiated. SUITE 301 MOORESVILLE, NC 28115 Subject Notice of Violation Tracking # NOV-2017-LV-0809 NPDES.Permit .No. N00034754. CommScope: WWTP Catawba County. Dear Mr. Basinger: 6519. CommScope Road P. O. Box:199 Catawba; NC 28609 DEC 2 2 2017 Gnr, r MOO^ESV!! F.. F rr i I am .responding to the Notice dated December 14th, .2017, that we received on December 18th, 2017,with regards to the "Notice of Violation" for Tracking # NOV- 2075-LV-0809: With regards to remedial action steps completed to correct such noted problems, we are submitting this written request to provide explanation of the noted violations. 1 The noted violations cited from the review of the August 2017 Discharge Monitoring Report (DMR) for the facility revealed the following violations: Date Parameter Reported Value Permit Limit 8/7/17 Nitrogen, Ammonia Total (as N).— Concentration (CO610) 11.54 mg/L 10 mg/L (Daily maximum exceeded) 8/31/17 Nitrogen, Ammonia Total (as N) — Concentration (CO610) 2.88 mg/L 2 mg/L(Monthly average exceeded) As for the noted violations cited by NCDEQ during their review of the August 2017 Discharge Monitoring Report and as provided above, the following information is provided to explain what happened during the time of these violations along with noting the corrective action that was implemented to correct for these parameter exceedances: 1) The noted violation was reported on 8/7/17 as the Total Ammonia Nitrogen parameter value of 11.54 mg/L (reported by Statesville Analytical Inc.) exceeded the allowed daily maximum of 10 mg/L as provided by the NPDES Permit. Please note that this value was not reported to CommScope staff until August 24th.. Once reported, staff asked for the laboratory to run a secondary analysis on the sample. However, this could not be completed as such that the excess sample was poured out (even though it was still within the 28-day hold time for ammonia nitrogen). 2) Please also note that the result reported for 8/7/17 also accounted for the monthly average of 2 mg/L to be exceeded for the same parameter as well. In other words, the one day of sampling caused the daily maximum and monthly average to be exceeded for Ammonia. [Please note that samples reported for 8/14/17, 8/21/17, and 8/28/17 were all below the detection limit of 0.5 mg/L.] 3) Please note that I have attached the daily bench sheet for the facility for 8/7/17 for your review as well. For the day in question, the ammonia was ran in-house utilizing the HACH TNT plus Vial Test Kits, which revealed an ammonia value of 0.316 mg/L. If this value had been high, it would have eluded staff to an issue with the WWTP. 4) As for these HACH TNT plus Vial Test Kits, staff is now completing a low and mid -range analysis test on the process control on a daily basis to verify that the NPDES limit has not been surpassed. 5) Furthermore, staff is also keeping a split sample onsite in the refrigerator in case future analysis may reveal an issue, and this will allow a second sample to be completed for further verification. 6) It is also noteworthy to provide that the facility has maintained compliance for the ammonia nitrogen parameter since this occurrence. There has not been any other issues with this parameter. In other words, there has not been any violations of a continuing nature for this parameter and, for more specifics, there has not been any violations for all other parameters. 7) Please note that once the ORC and Backup ORC were aware of the ammonia exceedance, the certified laboratory completing the analysis 8) Also, please note that the CommScope staff would like to stress that these noted violations were definitely inadvertent (or involuntary), especially noting the remaining of the month for ammonia nitrogen was below detection levels (<0.5 mg/L) as well as providing that for the past three (3) months, the plant has maintained compliance for the ammonia nitrogen parameter. Also, please note that the CommScope staff is very aware that the violations noted above are a serious infraction of NPDES Permit No. NC0034754. However, please be aware that the CommScope has completed multiple corrective actions steps to prevent such problems in the future. Now, based on this above information, I feel that CommScope, Inc. completed remedial and corrective action to correct for the noted violations. Furthermore, please note that CommScope will still continue to be very diligent about remediating such concerns and violations in a timely manner. Please note that it is the intent of the CommScope staff to continue in a multifaceted manner to make significant improvements as needed to the WWTP as well as reduce the number of noted violations in the future. We would also like to mention that the CommScope staff is working attentively to address any and all corrective actions to prevent future violations for the WWTP. Please feel free to call Ms. Nicole Johnston (Environmental Consultant for CommScope, Inc.) at 336-366-0870 if you need further information. 3 Thank you for your assistance with this `Notice of Violation' for the noted cited above. We look forward to hearing your response soon. Sincerely, Nicole Johnston .: Environmental Consultant CommScope Inc. Additional Comments About the Event: Press Release provided: Notification of Discharge of Partially Treated Wastewater HICKORY, N.C., May 2, 2016—General Statute 143-215.1C requires that the owner or operator of any wastewater collection or treatment works issue a press release when untreated or, in this case, partially treated wastewater discharge of 1,000 gallons or more reaches surface waters. In accordance with that 'requirement, the following statement has been prepared and issued to media in the affected county of Catawba: Due to a failed circuit breaker, on May 1, 2016 approximately 1,700 gallons of domestic wastewater discharged from CommScope's Catawba plant without receiving the final required treatment from an ultraviolet treatment system that was in the process of being installed. That installation is due to be completed by the end of May. A heavy rainfall, in connection with the failed breaker, allowed partially treated wastewater to be discharged into Terrapin Creek within the Upper Catawba River Basin in Catawba County. CommScope is investigating the installation of backup alternate systems so that a similar incident will not be repeated. Per guidelines, North Carolina Emergency Management was notified of the event on Sunday, May 1, 2016 and Division of Water Resources received notice on May 2. JAY ZIMMERMAN Director RECEIVED!NCDENRIDWR APR 4 2016 WQROS MOORESVILLE REGIONAL OFFICE Subject: NP.DES Electronic Reporting Requirements and Sixty Day Notice of Minor Modification of the NPDES Permit Commscope WWTP NPDES Permit Number:. NC0034754 Dear NPDES Permittee: The U.S. Environmental Protection Agency (EPA) recently published the National Pollutant Discharge Elimination System (NPDES) Electronic Reporting Rul. The rule requires'NPDES regulated facilities to report information electronically, instead of filing written paper reports. The rule does not change what information is required from facilities. It only changes the method by which information is provided (Le., electronic rather than paper -based). EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their key milestones, are: • Phase 1—Starting on December 21, 2016, regulated entities that are required to submit Discharge Monitoring Reports (DMRs) will begin submitting these reports electronically, instead of on paper. If you are currently reporting your DMR data electronically using eDMR, then you simply need to continue reporting in the same way as you are now. The key change is that, starting on December 21, 2016, electronic reporting of DMRs will be required, instead of voluntary. • Phase 2 —Starting on December 21, 2020, regulated entities that are required to submit certain other NPDES reports will begin submitting these reports electronically, instead of on paper. Reports covered in the second phase include Notices of Intent to discharge in compliance with an NPDES general permit, Sewer Overflow/Bypass Event Reports, and a number of other NPDES program reports. For more information on EPA's NPDES Electronic Reporting Rule, visit http://www2.epa.gov/compliance/final-national-pollutant-discharge-elimination-system-npdes- electronic-reporting-rule. Under the new rule, the electronic reporting process supersedes the paper reporting process outlined in your existing permit. To bring your permit up-to-date with the new reporting requirements, this letter serves to notify you that in sixty days your NPDES permit will be modified to incorporate the new electronic reporting requirements. The modification will require electronic reporting in place of paper -based reporting. Electronic reporting will be required beginning as indicated above for Phases 1 and 2 reporting. Please attach the enclosed NPDES Permit Standard Conditions Part 111—Addendum to your permit. This permit modification becomes effective on July 1, 2016. All other terms and conditions in the original permit remain unchanged and in full effect. This modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007. If any parts contained in this modification are unacceptable to you, then you have the right to file a petition for a contested case with the Office of Administrative Hearings within thirty (30) days following receipt of this letter. This assessment is based upon the following facts: A review has been conducted of the self - monitoring data reported for June 2015. This review has shown the subject facility to be in violation of the discharge limitations found in NPDES Permit No NC0034754. The violations are summarized in Attachment A to this letter. Based upon the above facts, I conclude as a matter of law that CommScope, Inc. violated the terms, conditions, or requirements of NPDES Permit No. NC0034754 and North Carolina General Statute (G.S.) 143-215.1(a)(6) in the manner and extent shown in Attachment A. A civil penalty may be assessed in accordance with the maximums established by G.S. 143-215..6A(a)(2). Because a remission request forecloses the option of an administrative hearing, such.a request must be accompanied by a waiver of your right to an administrative hearing and a stipulation that no factual or legal issues are in dispute. Please prepare a detailed statement that establishes why you believe the civil penalty should be remitted, and submit it to the Division of Water Resources at the address listed below. In determining whether a remission request will be approved, the following factors shall be considered: (1) whether one or more of the civil penalty assessmentfactor'sin G.S. 143B-282.1(b) were wrongfully applied to the detriment of the petitioner; (2) whether the violator promptly abated continuing environmental damage resulting from the violation; (3) whether the violation was inadvertent or a result of an accident; (4) . whether the violator had been assessed civil penalties for any previous violations; or (5) whether payment of the civil penalty will prevent payment for the remaining necessary remedial actions. Please note that all information presented in support of your request for remission must be submitted in writing. The Director of the Division of Water Resources will review your evidence and inform you of his decision in the matter of your remission request. The response will provide details regarding case status, directions for payment; and provision for further appeal of the penalty to the Environmental Management Commission's Committee on Civil Penalty Remissions (Committee). Please be advised that the Committee cannot consider information that was not part of the original remission request considered by the Director. Therefore, it is very important that you prepare a complete and thorough statement in support of your request for remission. With regards to the ten (10) business days' response that is required upon receipt of this notice, we are submitting this written request to provide explanation of the noted violations. The noted violations cited from the review of the June 2015 self -monitoring report for the facility revealed the following parameters at Outfall 001: Date Parameter Reported Value Permit Limit 6/9/2015 Fecal Coliform 2,419 CFU/100 mL 400 CFU/100 mL (Daily maximum) 10 mg/L(Weekly average) 6/13/2015* Nitrogen Ammonia (*Sample collected 6/9/2015) 10.5 mg/L 6/30/2015 Nitrogen Ammonia 7.16 mg/L 2 mg/L(Monthly average) r As for the noted violations cited by NCDENR during their review of the June 2015 self - monitoring report and as provided above, the following information is provided to explain what happened during the time of these violations along with noting the corrective action steps that were implemented to correct for these parameter exceedances: 1) *Please note that the violation reported for 6/13/2015 for Nitrogen Ammonia in excess of the weekly average was collected on 6/9/2015 along with the other parameters for BOD, Total Suspended Residue (TSR), Fecal Coliform, Dissolved Oxygen, pH, and Oil & Grease. 2) Please note that the plant was put back online (after being off for the previous months of April and May as well as partially offline for March) on 6/1/2015. (P/ease see the attached spreadsheet documenting the 'actual'days that the WWTP was online during the 2015 year — 91 days — as provided in the Pump & Haul Loads tab.) Compliance samples were collected on 6/2/2015 as per the NPDES permit requirements. The ORC placed the WWTP back online on June 1st as per several conditions that were ongoing at the time: a. The plant had been offline for the previous 68 days. Staff was having 'pump and haul' completed during this time by Bumgarner Septic Tank & Grading out of Granite Falls, NC. Please note that during 'pump and haul,' there is no discharge from the facility. (Please see the enclosed copies of the DMRs for the 2015 year providing several months with 'NO FLOW' reported. Also, please note the attached invoice for Bumgarner Septic Tank & Grading providing costs through August 2015 for $300,206.39 and also as provided below. (Please note that staff was trying to `offset' these costs from further increase by putting the plant back online.) b. Furthermore, the ozone disinfection system was showing promise of working properly as provided by the technicians, Water Tech Solutions, Inc. out of Mooresville, NC. Also, please note that the discharge from the system was crystal clear (as provided in email documentation enclosed) and showed promise of working efficiently and effectively. c. Initial in-house testing on 6/1/2015 provided that the treatment plant was in compliance as per the following testing: i. pH for the basins along with the `process control' effluent was within acceptable range. Please note that staff provided this as `process control' effluent as this was not discharged from the plant but was hauled offsite to the Clark Creek WWTP in Newton, NC. [Please note that CommScope has a field certification for this analysis.] 2 ii. Dissolved Oxygen and Settlometer readings for the basins were acceptable and provided sufficient Dissolved Oxygen for the biomass. The sludge judge for the clarifiers was sufficient as well. iii. Initial ammonia checks for process control completed in-house were compliant. [Please note that the staff only completes operational process tests for this, since they are not certified to run any analyses except for those identified with their field certification license. 3) The initial results for these analyses collected on 6/2/2015 provided a good fecal count with the ozone disinfection with a fecal value of 4.1 CFU/100 mL (as reported via email on 6/3/2015). The effluent pH was excellent with a value of 7.2 pH units along with the Dissolved Oxygen reading of 10.8 mg/L (which are both monitored in-house as part of the field certification). However, the results for the other parameters — BOD, Total Suspended Residue, Ammonia Nitrogen, and Oil & Grease were not received until 6/10/2015 (as provided via email on that date and also is the date the plant was taken back offline). Please note that the results did highlight some concerns and issues with higher than expected values for BOD (3.5 mg/L) and Ammonia Nitrogen (3.81 mg/L). The result reported for Total Suspended Residue (<2.77 mg/L) seemed to be OK and within compliance limits as per the monthly limit. Anyway, the results for BOD and Ammonia Nitrogen should have been a hint that the plant was not fully back up and running properly with a healthy biomass to provide sufficient treatment to lower these expected parameter values. [Please also note that the ammonia reported was higher than the summer limit for Ammonia Nitrogen of 2.0 mg/L (which contributed to the monthly average violation for the month).] 4) Now, since the initial fecal result for the sample collected on 6/2/2015 was OK per the email received on 6/3/2015, samples were again collected on 6/9/2015 as per the NPDES permit requirements. Although the pH and Dissolved Oxygen readings were again acceptable (7.6 pH units and 17.4 mg/L, respectfully), the results reported for BOD (12.3 mg/L), Ammonia Nitrogen (10.5 mg/L), and Total Suspended Residue (9 mg/L) were even further higher than the results reported for these analyses for 6/2/2015. Please note that this Ammonia Nitrogen result of 10.5 mg/L accounted for the exceedance of the weekly average of 10 mg/L along with contributing to the monthly average violation of 2.0 mg/L as well. Please also note that these results were not received until 6/17/2015. 5) An also critical note is that the lab had mailed the fecal result collected for 6/9/2015 with a value of 2,419 CFU/100 mL on the morning of 6/10/2015. It was at this time that the Backup ORC notified the EHS Manager and ORC that the plant was going back offline (please see attached email correspondence). This result accounted for the Fecal Coliform violation noted above for an exceedance of the daily maximum of 400 CFU/100 mL. As a result of this value, technicians from Water Tech Solutions, Inc. were called back in-house to perform corrective action on the ozone disinfection system and determine why there was not a sufficient kill' for the fecal coliform as previously expected from 2(b) above. 6) Further corrective action steps were also initiated by staff that included the following: a. Staff ordered equipment needed to perform biomass monitoring of MLSS and MLVSS. Staff was concerned that the biomass numbers were not high enough to properly lower the BOD and Ammonia Nitrogen as provided with the first set of data collected on 6/10/2015 for the samples collected on 6/2/2015. Staff started running these analyses after receiving training on performing these tests from their environmental consultant, Nicole Johnston [as also mentioned below in 6(e)]. [Please note that staff spent approximately $7,000.00 (as provided below) for obtaining the oven, furnace, and other laboratory equipment needed to run these process control tests.] b. Staff completed further analyses of fecal coliform and ammonia nitrogen (along with other process control testing) after the results from 6/10/2015 (as also provided via enclosed documentation in the section for Additional Process Control Laboratory Data). Please note that these analyses provided some further questions as to the effectiveness of, the ozone system along with effectiveness of the reduction in BOD, Ammonia Nitrogen, and Total Suspended Residue with the biomass present at the time. Results as highlighted showed good values collected for the process monitoring for Ammonia Nitrogen; however, there was some questionable data as to the effectiveness of the ozone system. (Please note that CommScope has spent $6.810.00 with Statesville Analytical as provided below.) c. Staff has also approved a Capital Appropriation Project for building a new Trojan UV system to provide the needed disinfection to adequately meet the required daily maximum permit limit of 400 CFU/100 mL. Please note costs provided below along with the attached PO documentation for the unit for completing this capital appropriation project. d. Staff also brought Kemp, Inc. to provide further updates to the WWTP including new rails for the aeration basins and clarifiers as well as assist with any upgrades that may be needed to further provide enhanced plant efficiency and with the upcoming UV 4 system installation. The cost spent thus far for this year is provided below in the amount of $14,378.00. e. Staff diligently worked with Environmental Consultant Nicole Johnston (Now DBA Burch Environmental, LLC) over the past few months to offer further guidance and environmental support for the WWTP staff. Ms. Johnston has completed several specific items that have provided further corrective action for these violations as well. These include the following: i. Training has been performed to provide accurate analytical process control data to assess the biomass of the WWTP such as the MLSS/MLVSS along with improved techniques for pH, Dissolved Oxygen, and other process control testing. ii. New equipment (recommended by Ms. Johnston) was obtained for pH, Volatile Analysis (MLSS/MLVSS), and Dissolved Oxygen. iii. A new bench sheet for daily process control testing has been completed to allow for further documentation of the WWTP performance for compliance with the NPDES permit. iv. Ms. Johnston has been working on updating the Operation & Maintenance Manual for the WWTP along with all supporting standard operating procedures to allow for better process control of the WWTP. This will eventually contain the documentation needed for proper operation of the upcoming Trojan UV system. v. Ms. Johnston has introduced the WWTP staff to the eDMR process, for which they are `in training' to learn how to completed. This will extremely helpful in the future to further offer assistance denoting when the WWTP is having some concerns and/or is out of compliance. f. One other note is that staff completed additional research and 'studying' of the Ozone System (see attached documentation from EPA — "Wastewater Technology Fact Sheet — Ozone Disinfection"). Staff identified that there may be issues with the ozone system as defined with the disadvantages provided within the documentation. 7) Also, please note that the CommScope staff would like to stress that these noted violations were definitely inadvertent (or involuntary), especially noting the enclosed documentation of 'pump and haul' from the site during the entire year for.2015 thus far (and still ongoing as of present) as well as the other corrective action steps completed as noted above. 5 8) Also enclosed for your convenience are pictures of the WWTP from 6/7/2015 and 6/8/2015 providing that the plant looked OK from an operator standpoint for sample collection on 6/9/2015. However, since the results were not obtained in a timely fashion for the completed analyses for the samples collected on 6/2/2015 and 6/9/2015, there was little else to do at the time except to return the plant to 'pump and haul' procedures. Now, here is a brief summary of the expenses provided during this corrective action response including items completed during this upset at the WWTP as well as for the ozone capital improvements project and noted modifications (and as noted above): COMPLETED BY: TOTAL EXPENSE ACTION COMPLETED AND/OR. However, please be aware that the CommScope spent over $413,000 (as noted above***) to provide completed (and ongoing) corrective actions steps along with previous improvements and modifications to the WWTP during the previous weeks and/or year. Now, based on this above information, I feel that CommScope, Inc. completed remedial and corrective action to correct for the noted violations. Furthermore, please note that CommScope will still continue to be very diligent about remediating such concerns and violations in a timely manner. Furthermore, it is the intent of the CommScope staff to continue in a multifaceted manner to make significant improvements as needed to the WWTP as well as aim to eliminate any noted violations in the future. We would also like to mention that the CommScope staff is working attentively to address any and all corrective actions to prevent future violations for the WWTP. Please feel free to call Ms. Nicole Johnston (Environmental Consultant for CommScope, Inc.) at 336-366-0870 if you need further information. Box 199 Catawba, NC 28609 RECEIVED/NCDENR/DWR MAR 2 3 2015 WQROS MOORESVILLE:REGIONAL OFFICE for Enforcement I am responding to the Notice dated March 9th, 2015, that we received on March 11th, 2015, with regardsto. the "Notice of Violation and Notice of Recommendation for Enforcement" for Tracking. #. N.OV 2015-LV-01.05. With regards to .the ten (10) b.usiness days' response that is required upon receipt of this notice, we are submitting this written requestto provide explanation of the noted violations. The noted violations cited from the review: of the November 2014 self -monitoring: report for the facility revealed the following parameters at Outfall 001: Date Parameter . Reported Value . .Permit Limit 11/20/14 BOD 199.0 mg/L 40.7: mg/L (Daily maximum) 30.0 mg/L(Monthly average) 11/30/14 BOD 54.0 mg/L 11/20/14 Fecal Conform 921 CFU/100 mL 400 CFU/100 mL (Daily maximum) 21.5 mg/L (Daily 11/20/14 . . TSS 212.0 mg/L 39.2 mg/L :(Daily maximum) 11/30/14 TSS 55.3 mg/L 30.0.mg/L (Monthly average) As for the noted violations cited by NCDENR during their review of the November 2014 self -monitoring report and as provided above, the following information is provided to explain what happened during the time of these violations along with noting the corrective action that was implemented to correct for these parameter e- xceedances: 1) The noted violations were present on 11/20/14 as the following parameters exceeded the allowed daily maximum as provided by the NPDES Permit BOD, Fecal Coliform, Ammonia, and. TSS: Furthermore, the results reported for 11/20/14 also accounted for the monthly average to be exceeded for the following parameters as well: BOD, Ammonia, and TSS. In: other words, the one day of sampling caused the daily maximums and monthly averages to be exceeded. 2) Now, in order to explain the reported analysis, the following occurred earlier in the week: a. On Monday, 11/17/14, the Backup ORC (Mark Carpenter) arrived at the WWTP and found the following had occurred creating several issues at the plant: i. The ozone pump had failed; therefore, the Backup ORC had Kemp, Inc. out of Sherrills.Ford, NC, to come out and change: the pump with oneof the two (2) spare pumps. Please also note that just the week prior (as provided with the attached invoice from Kemp) that the ozone had completely underwent several modifications including pump rebuilds, changing out the discharge piping and fittings, etc. that totaled $14,378.00(I have also enclosed the original approximate capital appropriation request from 2013 for building the ozone system at an estimated $60,000.00, which was clearly underquoted due to the other repairs and/or startup failures during the 2013/2014 year.) ii. The caustic pump was found to not be operable; thus, the Backup ORC had to repair the pump and get it back into working order. iii. The floats on the tertiary sand filters were found to be out of service, for which Kemp, Inc. was also asked to check about repairing these. Now, the sand filters were found to be completely clogged and causing excessive backwash of solids to enter into the 2 ozone chamber. Kemp, Inc. tried to clean out the solids; however, they were not able to get the filters functional at the time. They had to return on Tuesday, 11/18/14, and Wednesday, =11/19/14, to. work on the clogged sand filters:** iv. The; heaters for the two (2) aeration tanks had also went out, for which Kemp,Inc. changed out these heaters with spares kept :onsite. v. A copy. of the daily operatorlog citing these issues is also enclosed forthis date. vi. Due to this upset; the Backup ORC had called in Bumgarner Septic Tank and Grading out. of Granite Falls, NC, to 'pump and: haul'any discharge from the facility: Two (2) loads (as -provided with the attached pumpers certification forms:) were hauled out from the site for that day with the PT-4 truck which has 3,500 gallons. capacity (as noted with the enclosed contract). The actual volume of 6,918 gallons.iis:noted with: the. enclosed invoice (which totaled $1,090.16 which'i includes the price of $0.12 per gallon plus charges for the truck/driver stand :by. hour rate and:: labor charges). Please note that although the totalizer ran for the day, the plant discharge was plugged, and the flow was hauled off by .Bumgarner Septic.. to the City of Newton Clark Creek WWTP.' (Also, please note that the pump utilized for bypass pumping was downstream of the totalizer.) vii. Furthermore, the Backup ORC notified the ORC, Shannon Lowrance, of the problems and what corrective action steps were : completed and/or initiated. 3) The ORC was back onsite on Tuesday, 11/18/14. He checked the WWTP for --any further issues and decided todelay the normal sample collection untillater in the week. The normal day for sampling for the WWTP for the required weekly analysis is normally collected on Tuesday; - This delay was necessary because Kemp, Inc. was making adjustments to the ozone system as well as continuing the repair of the sand filters. [**Please note that the ORC was onsite when Kemp, Inc. returned on Tuesday, 11/18/14, and Wednesday, 11/19/14, to complete the repairs started on 11/17/1:4.] 4) The ORC completed the grabsample collectionas required by the NPDES permit. on Thursday, 11/20/14. However, Mr. Lowrance continued to notice that the sand filters were still causing an upset for the plant.: Therefore, he plugged the line and called in Bumgarner Septic to 'pump and haul.' On that day, there were six (6) loads hauled out with utilization of both the PT-3 (which also has a 3,500 gallons capacity) and PT-4 trucks. Furthermore, there were four (4) additional loads hauled on Friday, 11/21/14. Please see the attached . pumpers certifications forms along with invoice for this two-day hauling total of $4,066.40. 5). Also, please note that the. CommScope staff would like to stress that thesenoted violations were definitely inadvertent (or involuntary), especially noting the enclosed documentation of 'pump and haul' from the site during the week from 11/17/14 through 11/21/14. 6) Now, please note that by the sampling event on the next business workday on Monday, 11/24/14, that the WWTP was back into compliance. 7) Also enclosed for your convenience are some .pictures showing our totalizer, the 'pump and haul' hose, and the plug used when CommScope completed 'pump and haul.' Now, here is a briefsummary of the expenses provided during this corrective action response including items completed during this upset at the WWTP as well as for the ozone capital improvements project and noted modifications (and as noted above)::. Ozone is a powerful oxidizer andan effective germicidal. Ozone can begenerated by passing oxygen, or air containingoxygen, through an area having an electrical discharge or spark (electrodes). As the air or oxygen flows through theair gap, and the electrical discharge, a portion of the oxygen is converted to ozone: 02 molecules are reduced to monatomic form (just0, one oxygen atom): The single oxygen. -atomis very reactive. and binds with, a 02_ molecule forming 03, or ozone. It has been found that pH increases very slightly because of oxidation. This is probably the effectof carbon dioxide being driven out of the solution by the ozone • Color and turbidity arereduced by addition of ozone., This is brought about by chemical oxidation of the substancecausing the color or turbidity .. As with chlorination, the effectiveness.of idiSinfection 'is depended on_the concentration • of the disinfectant, thorough mixing:and contact time. Ozone 'brings about. disinfection 3100.times faster than. chlorine. In summary: both treatment methods are effective. for treating drinking water that has been through a physical treatment such as sedimentation or filtering. http://water.me.vccs.edu/courses/ENV149/ozonationHYPERLINK "http://water.me.vccs.edu/courses/ENV149/ozonation.htm" ::him.: Gayer Textbook www.water-research.net www.ozonesolutions.com Scope of work for Ozone Gas . We have checked and rechecked our BOD testing and results and have found nothing wrong with the way we grab samples, or with our outside testing laboratory. In checking back through several years of testing this is the first BOD NOV that CommScope Catawba has experienced.
