Please let this letter serve as my clients' request far a vested rights determination. with eespect t~ thou
property located at 1160] Appaloosa Run W, Raleigh, Wake Gounty, North Carolina.
My cti.ents purchased the property in September 1980. At the time my cliel~i`c pu.rchase~ . the
ro arty, it was always their intention. to build their retirement home upon that property. IViy c~ien. is

paid $ I I,dOG for the property in 1980.
Shortly after purchasing the property, rn.y clients had William Poofe prepare house plans for the
property at the cost of $2,500. I have a copy of these plans for you to view if you. would like ~o see
them. They are so large thst it would be difficult to copy them., but if I need to copy them, I 'wjill do
so. My clients decided against building #be house at the time that the plans were drawn up.

At 'the time my clients purchased the property., there were no other haus.es nr build;ngs in tl,e~ era.
Over the course of time, houses were built on either side of and behind my clients' property and a
subdivision was built around my clients' property. As such, my client slartci3 paying yualrterty
property owners assessments for the subdivision, along ~vith annual property taxes, etc. My clients'
calculation as to the total charges they have incurred with respect to this prope-~cy i'raal the ti~'e of
]heir purchase nearly twenty-seven years ago is close to 540,000. I have asked my clients tc~ pul'
together a list of their expenses incurred in purchasing and maintaining the Appaloosa Run. property.
That list is attached to this submission as Exhibit "A" and incorporated herein by .reference.
I
I believe under our law in making iY vested rights determination that the amount o£ money spent by
my clients is not the only deterruinati~ve factor. There is na question that my cli.en.ts have spent a.
significant amount an this property, and these expenditures were in large part incurred prior ~a the
buffer requirements that went into effect in the area in the Iota `90's. However, I believe the ease law

also requires the party making a vested rights determination to consider any equitable consideratia!ns
as well. I ask your client to consider that even though my clients were the first to .purchase property
in the area, they have been the last to build. The stream which is at issue in this case appears to have
been created by actions taken by the property owners association in routing flow tram other adjacent
properties that have residences on them. More importantly, these residences were constructed prior
to the time ofthe buffer raquiretnents. Thus, even though some of these residences are closer to the
stream than my clients' own residence if constructed would lse, these adjacent properties are
obviously not affected by the buffer requirements because the property owners were fortuitous
enough to build those structures prior to the impositiop of the requirements.
Suffice it to say that there art residences on each side of my clients' property, residences behind my
clients' property, and residences down the street from my clients' property. Mr. Jones and 'I recently
shot video of the property, the surrounding properties, and Cho source of the stream. This video is
"traditional" (i.e. non-digitalj, an$ it is not easiky dupiicated. C~owever, T am happy to make a copy
of this video available Cn the Division of Water Quality far purposes of the vested rights
determination.
I will refrain from making any extended legal argument at this time with respect to the vested rights
doctrine. Suffice it to say that I believe given my clients' expenditures in this matter, their
expectation of being able to build their residence years before any buffer requirements were ia~ place,
the passage of time, and the equities concerning the surrounding properties, that it is peri'eetly
appropriate and required for the Division of 'Water Quality to make a vested rights deterrninat~on in
this matter and grant my clients the relief they seek without having to go forward with the OAI-I
proceedmg-
My clients are happy to moet with ]~WQ and you between now and the scheduled hearing time on
March 28 at a mutually convenient Circa to discuss this matter further Ind. to present any further
evidence and/or argument 17'WQ desires.
