Regarding your letter dated January 10, 2012
I will demonstrate my proposed project is the least environmentally damaging practicable
alternative to install a driveway culvert to access Lot 8.
Lot 4: On July 29ti' 2009 I was notified by Carteret County Planning and Development of a road -
closing request for an undeveloped portion of Holly Lane. See attached map showing the portion
of the road. On January 11, 2010 An Order was adopted by the Board of Carteret County
Commissioners of the closing of the road and a certified copy of the order was filed in the office
of the Register of Deeds of Carteret County. See attachment (A). This road closing granted me
a permanent driveway to access Lot 4. I gained a 30' x 125' (.08 acres) tract of land. This also
substantiated the minimum "Flag" lot requirements based on the Carteret County guidelines to
serve only one. singe family home. See attachment (B). No other access is allowed to service
other single - family dwellings. Please see septic as requested. See attachment (C).
Lot 5: I purchase this constructed established home in 2003. No other access is allowed to
service other single - family dwellings. Please see septic as requested. See attachment (D).
Lot 6: No other access is allowed to service other single - family dwellings. (Backside of lot runs
into Lot 7 septic area). Please see septic as requested. See attachment (E).
Lot 7: No other access is allowed to service other single - family dwellings. (Wetland finger on
West side only allows driveway access on the East side of lot). Please see septic as requested.
See attachment (F).
Lot 8: No other access is allowed to service other single - family dwellings. North side does not
meet minimum width requirements for road. East side has wetland finger, house and septic
adjacent to lot. South side has DOT & Carteret County approved road access. West side has
wetlands on the entire side. Please see septic as requested. See attachment (G and G -1 Map
showing placement of all septic repair areas).

On August 10, 2009 I closed on the 3 lots at Dogwood for the purpose of settling and building
my home on Lot 8. at the end of Dogwood Lane. I have applied and received septic permits for
the 3 lots purchased.
With my investigation to access my home, on December 7, 2009 I contacted DOT to inquire
about paving the recorded road. See attachment (H) letter and 1956 sub- division plat.
Over the years the overall plan was to perform a re- combination of the land to allow enough
uplands to construct my home on Lot 8. On August 18, 2011 successfully moved the lot lines for
lot 8 onto lot 7 and moved the back of lot 7 line over into lot 4 thereby satisfying the county
ordinance of R -20 per lot. See attached map.
I am formally requesting that you reconsider my position on the lot 8- driveway permit and
allowing me to cross with a 12' culvert pipe, which is the least environmentally damaging
practicable alternative to access, this lot.

'COMMISSIONERS TO ABANDON THE 240 FEET OF HOLLY
LANE THAT LIE WEST OF WATER OAK DRIVE
WHEREAS, Darlene Lewis has requested the abandonment the 240 feet of Holly Lane
that lie west of Water Oak Drive; and
WHEREAS, as required by the General Statutes, the Board of Commissioners did first
adopt a resolution declaring its intent to close the public road or easement and called a public
hearing on the question; and
WHEREAS, the Board did cause a notice of the public hearing reasonably calculated to
give full and fair disclosure of the proposed closing to be published once a. week for three
successive weeks before the hearing; and
WHEREAS, a copy of the resolution was sent by registered -or certified mail to each
owner as shown on the county tax records of property adjoining the public road or easement who
did not join in the request to have the road or easement closed; and
WHEREAS, a notice of the closing and public hearing was prominently posted in at
least two places along the road or easement; and
WHEREAS, at the hearing, the Board did hear all interested persons who appeared with
respect to whether the closing would be detrimental to the public interest or to any individual
property rights; and
WHEREAS, after the hearing, the Board of Commissioners was satisfied that closing the
public road or easement is not contrary to the public interest and that no individual owning
property in the vicinity of the road or in the subdivision in which it is located would thereby be
deprived of reasonable means of ingress and egress to his property.
THEREFORE, BE IT RESOLVED, the Board does hereby adopt this order closing the
road or easement and a certified copy of the order shall be filed in the office of the Register of
Deeds of Carteret County.

Flag lot. A lot that is composed of a narrow "flagpole" strip extending from the street
and much wider "flag" section lying immediately behind a lot or lots having the required
street frontage for a conventional lot. In the case of a flag lot, the lot line at the end of the
flag pole lying generally parallel to the street to which the flagpole connects shall be
considered to be the front lot line for setback purposes. Flag lots must meet the conditions
and design standards delineated in section 4- 3.4.1(B).
4 -3.4. Access requirements.
4- 3.4.1.
(B) Flag lots may be approved by the administrator for all
minor subdivisions or by the planning commission for all
major subdivisions as an alternative means of access,
provided that the following requirements are met:
(1) A flag lot shall serve only one single - family
dwelling and its uninhabited accessory structures
except as otherwise allowed by the Carteret County
Manufactured Housing Ordinance for manufactured
homes on individual areas in unzoned areas;
(2) Generally, the maximum flagpole length shall
not exceed 300 feet. However, the planning
commission may authorize a length in excess of
300 feet if, in the opinion of the planning
commission, extenuating site conditions warrant a
greater flagpole length;
(3) The minimum flagpole width on an approved
public or private street shall be 25 feet;
(4) The maximum lot size in areas with public
sewer shall be one acre. The maximum lot size
without public sewer shall be three acres. (Note:
The "flagpole" portion of the lot is not used to
calculate area, width, depth, and setbacks of the lot
or to provide off - street parking.);
(5) The minimum separation between the flagpole
portion of the lot and that of another flag lot shall be
150 feet;
(6) Where public water is available, any building
on the flag lot must be within 1,000 feet of a
hydrant. This distance shall be measured along the
street, then along the flagpole, then in a straight
line to the building location;
(7) Where public sewer is available, occupied
buildings on the flag lot shall have a gravity service

line, or the sewer pump requirements shall be
noted on the plat;
(8) Use of a single driveway to serve a flag lot and
an adjoining lot is permitted and encouraged; the
preferred location for the driveway is on the
flagpole portion of the flag lot, with the conventional
lot granted an access easement over the flagpole;
(9) No resubdivision of a flag lot shall be permitted
unless access to the proposed new lot(s) can be
provided from an approved public or private street;
and
(10) Flag lots shall be approved by the planning
commission only where the configuration of the
parcel or site features warrant such a lot design.
Authorizing a flag lot design is intended to
accommodate a particular extenuating
circumstance which makes traditional lot design
infeasible. Therefore, flag lots should be judiciously
approved.

c. The entire filled area shall be seeded with perennial grass seed.

The site evaluation for the above - mentioned lot has been completed and has been found to be
provisionally suitable with a Type Va wastewater system to serve a four (4) bedroom single
family house. The wastewater plans must be drawn by a licensed engineer with the State of
North Carolina and submitted to this office for approval.
Please note that prior to installing the septic system and /or obtaining any building permit

A pre- construction conference shall be required on the site prior to beginning any site modification or installation

1. All documents, including but not limited to design review plans and specification, Tri -party agreements,

procedures and other pertinent documents relating to system operation and maintenance, All legal documents must
be recorded with the Carteret County Register of Deeds.
2. This permit is effective only with respect to the specific design flow facilities, and the nature and volume of
waste described in the Permit Application, and other supporting data. Changes in the proposed use, waste flow,
nature or volume of waste render this permit void.

3. Prior to any changes in system layout, approval must be obtained from Health Department,
4. The designated repair area is to have no parking, driveways or other impervious materials located on it.
5. The issuance of this permit does not preclude the permittee from complying with any and all statutes,
regulations, or ordinances which may be imposed by other government agencies which have jurisdiction, or any
other permits issued by this department.
6. This permit shall become invalid if the information submitted in the application was falsified or changed, if the
permit was based on inaccurate or incomplete information, or if the designated site is altered.
7. This improvement permit shall not be affected by a change in ownership of the site provided both the site for the
wastewater system and the facility the system serves are unchanged and remain under the ownership or control of
the person owning the facility.
NOTICE OF EXPIRATION: This permit expires 5 years (60) months from date issued. If expiration occurs the
client shall comply with all changes in applicable regulation, laws, technical aspects, etc, that may be effective at
that time. This may require additional preparation, more complex wastewater systems, operation and maintenance
requirements, pre - treatment, etc. This could result in less area for the home, parking, lower water usage and further
development limitations.

Plans for the wastewater system shall be prepared by a person having a demonstrated knowledge
of wastewater, such as an engineer licensed with the State of North Carolina. The system shall
be designed according to Section .1900 of the State Sewage Rules. Wastewater plans shall be
submitted to and approved by the Carteret County Environmental Health Division. A contract
between the owner and a certified operator shall be required for the purpose of operation and
maintenance of the septic system for as long as the system is required.

Criteria for Engineered Plans
for Wastewater Systems with Designs Flows of 3000 gpd or less
(as required by Carteret County Health Department)
Site specific plans and specifications shall be prepared by a resistered professional engineer or an individual
with a demonstrated knowledge of the proposed wastewater system and who has been authorized in writing
by the manufacturer (where applicable).
Prior to the issuance of an Authorization to Construct, the site specific plans and specifications shall be
submitted for review and approval by Carteret County Health Department. In addition, if fill or any other site
modification or easements are required prior to the system installation, they shall be completed as indicated
on the Improvement Permit and approved by Carteret County Health Department.
The design must incorporate and be consistent with the approved site plan and layout as indicated on the
Imporvement Permit. Plans and specifications shall include requirements for any site modifications as
indicated on the Improvement Permit.
The plans and specifications shall include but shall not be limited to the following requirements:
1. All conditions as required in Laws and Rules for Sewage Treatment and Disposal Systems (I SA
NCAC 18A. 1900) and all conditions as required in the Innovative, Experimental or Controlled
Demonstration Wastewater System Approvals (where applicable) shall be met. The most current
Approvals issued by DENR shall be used when designing these systems. All design submittals shall be
accompanied by a letter from the manufacturer's North Carolina authorized representative.
2. The plans shall include the owner's name, the facility description, the design flow and calculations, the
facility location, the proposed system, the engineer's seal and signature or designer's certification and
the date. Revision dates shall be included on all revised plans and specifications.
3. A site plan based on a surveyed plat showing location of system, repair area, water supply lines on the
site and /or wells located on the site and within 100 feet of the property lines, water bodies, ditches,
storm sewers and storm water control devices, and existing and proposed building foundations and
appurtenaces. Dimensions and / or metes and bounds shall be used to locate the system and compnents
on the site plan.
4. Spefications describing all materials and components to be used and methods of construction. Include
tank manufacturers cut sheets, pump specification sheets, effluent filter specifications, etc. that are
pertinent to the system.
S. Plan and profile drawings showing depth of fill (if required), depth of rock bed or trenches, placement
of system components and appurtenances, supply lines, pipe diameters and lengths, depth of cover,
valves and other appurtenances, and elevations required for all relevant system components relative to
an established benchmark.
6. Plans and profile drawings for all tanks, showing capacity, access manholes, effluent filters and risers
(when required), pump tank with riser, pump and float details (including float elevations), discharge
piping, anti- siphon hole or dump valve, check valve, union disconnect, gate valve, electrical
connection detail and control panel. A Halliday (or equivalent) hatch cover (locking), A2424 or larger
where required, or equivalent cover is required over the pump access on the pump tank.
7. Carteret County requires the following items at the recommendation of
OSWS /DEH/NCDENR:
A. Geotextile fabric or untreated paper over the trench, at the gravel - backfill interface.
B. Use reducing tees instead of bushing -down.
C. Use one nominal size smaller pressure - adjustment gate valve than the effluent supply line or
manifold (whichever is smaller) at the drainfleld. The designer shall make sure the reduction
in valve size does not cause the total dynamic head of the system to exceed the pump
capability.
D. Provide an elapsed time meter and cycle counter for each pump in the control panel for
systems with designs flows over 600 gallons per day.
E. Incorporate a drainback mechanism such as an anti- siphon hole or a dump valve return
effluent to the pump tank.

Provide a float tree (show detail) with sufficient wire inside tank to allow float tree to be
removed from tank for float maintenance.
8. A properly sized and approved effluent filter shall be required at the outlet of the septic tank. Risers
are required over both ends of the septic tank when the finished grade is greater than six (6) inches
below the finished grade. The riser over the effluent filter shall extend at least to the finished grade to
allow for maintenance access. A Halliday (or equivalent) hatch (locking) or equivalent is
recommended over the effluent filter to facilitate maintenance.
9. Calculations for pump and pump curve (provide pump curve for pump specified in plans),
calculations for determination of head pressure, calculations for dosing volumes and drawdown for
the pump tank and drainfield (where applicable).
10. Where required, a written, signed and sealed report from a Licensed Soil Scientist, (detailed site
assessment) shall be made part of required plans.
11. Operation and maintenance requirements, including requirements for certified operator, testing and
start -up procedures and inspection procedures.

Dear Mr. Boulia,
Your letter dated December 7, 2009 was forwarded to this office for response. Your
request for paving included the desire to have the section of subject road west of its
intersection with Water Oak Drive (SR 1228) state maintained.
The attached plat copy you furnished indicated this section of Florida Park Subdivision was
recorded in 1956. In developments that are recorded prior to 1975 the addition of roads
can occur after the road is placed in an acceptable state of maintenance (as an unpaved
road). The paving of the road would not occur until. it was placed in our paving priority
system.
The addition of roads is dependent on a number of other issues as well. A primary issue is
the number of homes served. The minimum number of homes required is four full -time
homes. During our review it was observed there were 3 developed lots. The corner lot
(Lot 3) on the south side of road will not count as it is served by the unimproved section of
Water Oak Drive. The other 2 lots (Lot 1 & 2) appear to be occupied by full -time
residents, according to Carteret County tax information.
We will need to be contacted again when the proper number of homes exists. If I can
provide further assistance, please advise.

I atri interested in having the west side Dogwood Drive paved. I own lots 6, 7 and 8 and
plan to develop them soon.. There are also three adjoining neighbors that have an interest
in a state maintained road as well. This road services 6 residential properties. I am

clearly shows a 60' access on the west side of Dogwood. -
