Reference the Department of the Army permit issued on September 15, 2010 for the
proposed roadway improvements to US 17(Western Parkway) from SR 1403 (Country Club
Road) to Western Boulevard in Onslow County, North Carolina Reference is also made to your
permit modification dated September 12, 2011 additional information dated October 18, 2011,
and cross section drawings received November 7, 2011 According to the current request the
modification is necessary to construct a service road for Ramp IB near station 18 +94 25 within
the U -4007 B project Specifically, the request is to impact an additional 0 22 acres of non
riparian wetlands originally not depicted in the permit drawings Upon discovery of these
additional resources the Department adjusted the design to minimize impacts to the maximum
extent practicable
We have determined that the proposed change is minor, and that a supplemental public
notice is not necessary Your permit is hereby modified to include the aforementioned changes
as described in the September 12 2011 and October 18, 2011 modification requests It is
understood that all other conditions of the original permit and previous modifications remain
applicable, including the permit expiration date of December 31 2015 The Department is
bound by the submitted mitigation plan to offset the unavoidable impacts In this case, the
Department should request NCEEP to provide 0 44 acre non riparian credit for the 0 22 acre non
riparian impact necessary for project construction
