On April 26 2011 we issued a public notice describing the North Carolina Department of
Transportation's ( NCDOT) proposal to add the Clayhill Farms Mitigation Site to the NCDOT
Umbrella Mitigation Bank The site is located approximately 8 9 miles southeast of Maysville
on NC Highway 58 near the community of Kuhns in Jones County, North Carolina
On June 20 2011 we submitted a letter to you containing our comments as well as comments
made by the North Carolina Department of Cultural Resources and the National Marine Fisheries
Service on this project It is Department of the Army (DA) policy to provide a project proponent
the opportunity to furnish a proposed resolution or rebuttal to all comments and/or objections
from the public and government agencies before a final decision is made At this time no
resolutions or rebuttals have been received in tlus office
On August 23 2011 a NC Interagency Review Team (NC IRT) closeout review of the
Clayhill Farms site was held and it was determined that significant issues remain in determining
the location condition extent of wetlands and overall condition of the stream project It was
agreed that the close out review be delayed until the spring of 2012
The Corps, in consultation with the NC IRT, has determined that the Claylull Farms
Mitigation Site cannot meet the requirements for inclusion into the NCDOT Umbrella Mitigation
Bank until such time that the site meets its success criteria, the final credit structure of the Site is
determined, and is accurately reflected in a new Addendum package This action concludes the
Modification of Instruments as outlined in 33CFR 332 8(g)(1) and Standard Review Process in
33CFR 332 8(d)(1)
Please be advised that by copy of this correspondence and our letter dated October 1 2010 we
are informing both the NC DOT and the NC EEP that the Clayhill Farms Site may not be debited
for any mitigation credits whatsoever until these issues are resolved
