credits for the Privateer Farms Mitigation Site which is an addendum under the North Carolina Department of Transportation Umbrella Mitigation Banking Instrument (NCDOT UMBI) executed on September 4, 2009 In that letter, our office failed to include the release of the final 20% (or 53 5 riverme wetland credits) of the bank which were withheld in 2010 By copy of this letter we are acknowledging that these and all remaining credits are released for DOT use Please be reminded that credits are prohibited from being sold for non DOT projects If you have any questions please do not hesitate to conservation easement recordation for the Privateer Farms Mitigation Site, which is an addendum under the North Carolina Department of Transportation Umbrella Mitigation Banking Instrument ( NCDOT UMBI) executed on September 4, 2009 The Privateer Farms site is within Harrison Creek watershed and is located west of NC Hwy 53 north of Elizabethtown at the Bladen/Cumberland County line North Carolina Additionally please reference our July 12 2011 letter concerning the release of NC DOT mitigation credits to the private sector as it relates to the NCDOT UMBI and our July 21, 2011 receipt of the Privateer Farms Permanent Conservation Easement Upon reviewing the conservation easement which was recorded in December 24 2003 and corrected on July 7 2005 our office concurs that you have fulfilled the preservation mechanism requirements pursuant to Section III(D)(1)(c) of the NCDOT UMBI and the May 2009 Privateer Farm Addendum Consequently all remaining credits totaling 8 066 linear feet of stream credits and 213 credits of riverine wetlands are released for compensatory use for NCDOT projects only At this time credits are prohibited from being sold for non NCDOT projects Private sector use of the bank will not be available until specific concerns outlined in our July 12, 2011 letter have been adequately addressed 4 Please be reminded that your agency must continue to fulfill
