This Office has reviewed your PCN application dated November 29 2011 for the driveway
crossing The Division of Water Quality (DWQ) has determined that your application was
incomplete as discussed below The DWQ will require additional information in order to
process your application to impact protected wetlands /waters and/or streams on the subject
property The DWQ received a letter from the US Army Corps of Engineers ( USACE) from
Christy Wicker dated January 10 2012 concerning your project The USACE considers your
project as incomplete and is requiring additional documentation from you The DWQ cannot
adequately review an application that is incomplete Therefore, unless we receive the
additional information requested in the USACE January 10"' letter (attached), we will have
to move toward denial of your application as required by 15A NCAC 2H 0506 and will place
this project on hold as incomplete until we receive this additional information Please provide all
of the requested information so that we may continue to review your project
Please respond within three weeks of the date of this letter by sending this information to me in
writing and two copies to Ian McMillan c/o 401 Wetlands and Stormwater Branch 1650 Mail
Service Center Raleigh NC 27699 1650 Please reference the DWQ Project # of 2011 1083 in
all future correspondence If we do not hear from you within three weeks we will assume that
you no longer want to pursue this project and we will consider the project as withdrawn

On December 28 2011 this Office received a request from you for verification to utilize
Nationwide Permit 18 for the discharge of fill material into 0 01 acre of jurisdictional wetlands
adjacent to Bogue Sound to construct a road crossing to access a proposed single family home
The proposed project area is located on the north side of the terminus of Dogwood Lane on Lot
8 in Newport Carteret County North Carolina
Upon review of your application this Office has determined that your application is
incomplete and cannot be processed until the following information is received
You must demonstrate that your proposed project is the least environmentally
damaging practicable alternative Please provide additional documentation that
you have avoided and minimized your project s impact to the maximum extent
practicable Since you currently own all of the Lots (Lots 4 5 6 and 7)
surrounding Lot 8 it appears that you have high ground alternatives available for
a driveway Please provide the following documentation to determine if you can
avoid impacts to the wetland
a It appears you can access Lot 8 by constructing a driveway on the west
side of the septic area on Lot 4 from the abandoned portion of Holly Lane
Your application does not adequately substantiate your position that this is
not a viable alternative
b Provide an explanation on why a shared driveway cannot be constructed
off Water Oak Drive and utilized by Lots 6 7 and 8
c Provide maps and documentation showing the placement of all
septic /repair areas on Lots 4 5 6 7 and 8 along with their sizes setbacks
and what lot/structure each septic /repair area will service

d Provide information why you cannot construct your single family home
on Lots 4 6 or 7 Since all of these lots are owned by one entity (you) it
is determined that you have high ground alternatives for placement of your
house and driveway
2 The drawings you submitted do not show where the proposed wetland crossing is
to be constructed We will need drawings showing the dimensions of the road
top slopes and length and width in relation to the wetland In addition 20 feet
for a road crossing seems relatively large for the current purpose Please provide
an explanation on whether or not the footprint can be reduced in size in order to
minimize impacts to wetlands
3 Please provide information on the size and length of the culvert to be installed
Please submit the above information within 30 days of receipt of this Notification or we will
consider your application withdrawn and close the file Be aware that if upon review of any
additional information we determine that a less environmentally damaging practicable
alternative exists we would have no choice but to deny your NWP verification request and
consider your proposal in accordance with the standard permit (Individual Permit) processing
procedures
