It is our intentions that you would consider this application for a No Practical Alternative to the
proposed stream crossing as shown on the attached plans for Midas Lane Subdivision This
application shows that the proposed roadway will cross the existing stream in two locations The
first 5trevn crossing has the purpose to traverse the stream to access the rear of the property The
second roadway crossing traverses the same stream for the purpose of access to the adjacent parcel
per the Durham Unified Development Ordinance (UDO) There are two driveway crossings for the
purpose of access to the residential home sites
The entrance of the subdivision also has a partial encroachment of the stream buffer This design
cannot be altered since the proposed roadway is an extension of an existing roadway with private
owners on either side
