finger pier create slips for six boats with tie pilings and install 16 seasonal moorings Project Setting The site of the proposed development is located within the Town of Duck at the Sunset Grill and Bar located at 1264 Duck Rd adjacent to NC 12 and the Currituck Sound Dare County The property is ±38 333 sf in size and has ± 425 of shoreline that has been hardened by ±330 of bulkhead and ±95 of riprap The Sunset Grill and Raw Bar restaurant is located within the highground area along with raised decking and an asphalt parking lot A 230 x6 pier extends from the restaurant area that has a 30 x30 octagonal gazebo ( ±750 sf per drip line measurements) at the end On the north side of the gazebo is a ±480 sf platform that has a swiveling het ski lift/hoist and on the west side of the gazebo are two finger piers measuring ±26 x3 (78 sf) and ±21 x4 (84 sf) Several areas of highground decking extend waterward of normal water level (NWL) along the bulkhead These areas include a ±407 sf triangular shaped platform along the northern property line a ±28x6 (168 sf) platform connected to the north side of the pier a ±50 sf triangular shaped area connected to the south side of the pier and a ±16 x14 (240 sf) platform 90 to the south of the pier Based on available information there appears to be no archaeological sites on this property The adjacent riparian property to the north is the community water access for the Ships Watch Subdivision It has a pier and platform of similar length a bulkheaded shoreline and a boatramp The adjacent property to the south is an undeveloped thin strip of land adjacent to NC 12 that has had the shoreline stabilized with riprap The waters of the Curntuck Sound are classified as SC by the Environmental Management Commission and are not open to shellfish taking Water depths within the Currtuck Sound at the project location range from 2 feet to 3 feet below NWL There is approximately 3 5 to 4 miles of open water to the west of the site The bottom substrate within the project area is made up of fine sands Due to the time of year submerged aquatic vegetation was not observed growing within the project area however it is known to grow within the shallow waters of this area This property sustained severe damage from Hurricane Irene resulting in two emergency General Permits issued through 7H 2500 GP #58209A was issued for the replacement of the bulkhead on the property and GP #58295A was issued for the replacement of elevated platforms along the shoreline replacement of all platforms within the Public Trust Area and repairing damage to the pier and gazebo Work is currently in progress to rebuild these structures Development Proposal The applicant has operated a seasonal het ski rental business at this site for a number of years and is proposing to expand the operation by constructing a 52 x4 finger pier on the west side of the gazebo that will connect to the existing finger pier 11 tie pilings will be installed to create 6 boat slips The applicant has indicated that live aboard dockage will not be permitted and sewage discharge or pumpouts are not proposed as boaters will have access to restroom between the months of April 1 to November 1 Three boat moorings will be located on the north side of the pier a distance of ±70 to ±130 waterward of NWL Thirteen moorings will be located on the south side of the pier four kayak moorings will be placed a distance of ±150 to ±180 waterward of NWL six het ski moorings will be placed a distance of ±230 to ±270 waterward of NWL and three additional boat moorings will be located ±215 to ±275 waterward of NWL The buoys will be 12 in diameter and will be anchored with danforth or mushroom style anchors Anticipated Impacts • The proposed finger pier will result in the additional shading of 208 sf of PTA and EW AECs • The proposed finger pier in addition to the existing pier and platforms will result in total cumulative shading of ±3 845 sf of PTA and EW AECs within the project site • The seasonal anchored buoys and tie pilings will result in the disturbance of 27 sf of shallow bottom PTA and EW AECs • The boatslips and seasonal moorings will RECEIVED JAN 2 7 2012 The subject property is located on Duck Road (NC 12) in the Town of Duck located at approximate latitude 36 010 12 00 N and longitude 75 °45 25 00 W adjacent to the Curntuck Sound in Dare County North Carolina PURPOSE and PROPOSED CONSTRUCTION A Project Description The proposed project is located within a mixture of developed commercial and residentially developed properties The 0 88 acre subject site is zoned commercial and the parcel is currently developed with a restaurant Sunset Grill a boat ramp pier with a gazebo and platform The subject parcel is 88 acres with 425 feet of shoreline There are currently no U S Army Corp jurisdictional wetlands or CAMA wetlands on site or adjacent to the shoreline This CAMA mayor permit application is being prepared for manna development with 16 seasonal mooring buoys and 6 boat slips which will allow water access for recreational purposes and mooring within this 0 88 acre parcel on the Currituck Sound during summer months The Currrtuck Sound comprises of Public Trust Waters and Estuarine Waters and is directly connected to the Albemarle Sound According to the Wildlife Resource Commission and Marine Fisheries Commission the Albemarle Sound and Curntuck Sound is classified as Coastal fishing waters The Currntuck Sound is classified as point waters as depicted on the Descriptive Boundaries for Coastal Joint Inland Waters plat provide by the NCDMF Fisheries Rules 2007 Title 15A NCDENR Chapter 3 Subchapter 3 0202 The site of the proposed mooring buoy s are located within the Curntuck Sound above the Albemarle Sound therefore it is classified as in Joint Waters The Curntuck Sound is within the Pasquotank River Basin the stream classification for the Curntuck Sound is SC Water depths were taken by AEC staff on June 20th 2011 Submerged Aquatic Vegetation (SAV) study was also conducted by AEC staff on June 20th 2011 which determined SAV s were outside the project area The SAV study conducted by AEC staff determined SAV s are not present within the proposed mooring area within the Curntuck Sound however SAV s are present adjacent to the proposed mooring area within shallow water depths along the shoreline Techniques used to conduct the SAV study included taking samples in transects wading since the water was less than four feet in depth Equipment used for the SAV study included measuring devices and Project narrative (Sunset Grill & Water Sports — pg 2) 1 —o�loetmg sanjes by hand since there was no wind and the water was clear all patches of SAV s were visible Existing water depths range from 2 0 feet to 4 0 feet within the proposed 16 mooring buoy s and a maximum water depth of 4 0 feet at the end of the pier The attached drawing shows in detail the existing water depths in both locations The adjacent shoreline of the Currituck Sound is a minimum of three miles of open water from the adjacent shoreline and the proposed 16 mooring buoy s and 6 slips Water depths in the center of the Currituck Sound adjacent to the project are consistent at 7 0 feet Current water depths were surveyed on June 20 2011 which confirmed depths within the area of proposed mooring buoys are suitable for jet skis and small boats (6 to 20 in length) accommodated for this project The existing mooring area includes dockside power potable water lighting and restrooms located at the Sunset Grill A concrete boat ramp currently exists within the project site at the southern end of the shoreline The following permits were obtained for this project site A CAMA Minor Permit (Permit #82 0025) issued to Shaver/Lancaster on 7/82 to construct a restaurant A CAMA Major Permit (Permit #74 84) issued to Barrier Island Station/Paul Shaver to construct a pier gazebo and decking A modification to this permit (Permit #74 84) was issued on 11/19/84 A CAMA Exemption was issued to John Kotch on 10/20/11 for repairs to the platform after a storm event PROPOSED OPEN WATER IMPACTS Open water impacts include the re construction of an existing finger pier at the end of the existing pier and setting of 11 permanent moorings tie pilings and 16 anchors with 12 buoy s to mark the locations for the seasonal moorings CONSTRUCTION Construction of the boating facility (finger pier and moorings) will take place using hydraulic pumps and hand tools The seasonal
