On October 18 2011 I received a request for modification to the DA
authorization for the construction of the Sanford Bypass /R -2417

The stream at site 5 has been channelized and graded to the dimensions of a
ditch Please provide a compensatory mitigation proposal for the 50 feet of
permanent stream impacts located at Site 5 I would be fine with a 1 1
mitigation ratio given the character of the stream and the nature of the
impacts
I plan to attend the November 15 onsite meeting

Rachelle and Art I have reviewed the permit mod request for R- 2417AA The
following corrections and additional information is required for DWQ to
complete your request
Site 5 - The impacts for this site in the original 401 were permitted as
impacts to a perennial stream which required mitigation I need a mitigation
proposal for the additional permanent impacts that occurred at this site
The additional impacts to Site 6 are considered permanent because the
original dimensions and profile of the stream were permanently altered by the
actions of the contractor Furthermore I will need a revised impact

summary sheet that reflect the 50 ft of additional permanent impacts that
occurred at this site
FYI during my last visit the culvert was perched about 0 9 ft which
appeared to be more than it was at my last visit I have arranged for Galen
Call to come to the next review on Nov 15 to make recommendations on how to
correct this issue
Site 6 - Was permitted as intermittent system and DWQ will reserve the right
to determine if the impacts for the crossing are indeed temporary after the
temporary crossing is removed At the time of permitting DWQ was not
requiring mitigation for impacts to intermittent systems therefore if the
impacts for this crossing are deemed permanent additional mitigation will not
be required In the meantime to process the permit mod as currently
proposed I will need a revised impact summary sheet reflecting the
additional 30 ft of impacts for the crossing at this site
Site 9 - Sta 177 +29(LT /RT) - was permitted as impacts to a perennial system
and DWQ will reserve the right to determine if the impacts for the crossing
are indeed temporary after the crossing is removed If DWQ deems that the
stream has been altered from its original dimension and profile after the
crossing is removed DOT will be required to mitigate for the entire reach
that was permentantly impacted by the crossing In the meantime to process
the permit mod as currently proposed I will need a revised impact summary
sheet reflecting the 10 ft of additional impacts for the crossing
The above clarifications and additional information needs to be submitted as
soon as possible If we do not receive it within 15 days of this e -mail we
will be forced to issue an official hold letter on your modification request
Ronnie did I cover everything? Is there any additional information you need
to process this?
Marty & Art it would be great if the crossings are removed and the stream
restored to its natural state prior to our next visit so we can close this
issue out Please see if this can be done
